INTRODUCTION

The Private Educational Institutions Regulatory Commission was established by the Govt. of Himachal Pradesh under Section 3 of the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Act, 2010 (Act No. 15 of 2011) for the purpose of providing a regulatory mechanism in the State and for working as an interface between the State Government and Central Regulatory Bodies for the purpose of ensuring appropriate standards of admission, teaching examination, research, extension programmes and protection of interest of students of the private higher educational institutions. The Himachal Pradesh Private Educational Institutions (Regulatory Commission) Rules, 2011 covers various operational aspects for implementation of the Act such as terms and condition of services, directive powers, operation of funds, penalties, etc. The provisions of this Act or Rules or Orders made thereunder, shall have overriding effect, notwithstanding anything inconsistent therewith contained in any other law for the time being in force.

The following legislations, rules and regulations are significant and worth mentioning here in context to the role and functions of the Regulatory Commission.

• Himachal Pradesh Private Educational Institutions (Regulatory Commission) Act, 2010: The Legislative Assembly of Himachal Pradesh in the sixty-first year of the Republic of India promulgated this legislation which provides for establishment of the Regulatory Commission and Regulatory mechanism in the State for the purpose of ensuring appropriate standards of admission, teaching, examination, research and protection of interest of students in the private higher educational institutions and for matters connected therewith or incidental thereto; • University Grants Commission Act, 1956 and Rules & Regulations made there under. • UGC (Establishment of and Maintenance of Standards in Private Universities) Regulations, 2003. • UGC (Minimum Standards and Procedure for award of M.Phil/Ph.D Degrees) Regulation, 2009. • All India Council for Technical Education Act, 1987 and Rules & Regulations made there under.

ORGANIZATION OF THE COMMISSION

Constitution of the Commission: The Government of Himachal Pradesh vide Notification No. EDN-A-Ka(3)-12/2009 dated 27.07.2011 appointed Ms. Sarojini Ganju Thakur, IAS (Retd.) as founder Chairperson of the Himachal Pradesh Private Educational Institutions Regulatory Commission for a period of three years or until she attain the age of 65 years, whichever is earlier. Prof. Jagat Bhushan Nadda, was appointed Member of the Commission by the Govt. of Himachal Pradesh vide notification No. EDN-A-Ka (3)-12/2009 dated 02.07.2012 and he worked as such up to 15.05.2013.

Staff of the Commission : The Government of Himachal Pradesh has initially sanctioned 27 different categories of post(s) in the Commission vide Notification(s) No. EDN-A-Ka(3)- 12/2009 dated 20.07.2011 and 13.01.2012 respectively. The staff in-position against the sanctioned strength as on 31.03.2014 was as under:

ROLE AND RESPONSIBILITIES OF THE COMMISSION Powers and functions of the Commission: The H.P. Private Educational Institutions Regulatory Commission has been mandated to discharge the following functions under the Act.

(1) It shall be the duty of the Commission to ensure that standards of admission, teaching, examination, research, extension programme, qualified teachers and infrastructure, are being maintained by the Private Educational Institutions in accordance with the guidelines issued by the Regulatory Bodies of the Central Government or the State Government or by the Central Government or the State Government from time to time. In case of failure of the Educational Institutions to meet the standards laid down, the Commission shall have the power to penalize the Educational Institutions under section 11 of the Act and in case of successive failure of an Institution to meet the standards, the Commission may recommend to the State Government/ Regulatory Body for the winding up of the Institution.

(2) The Commission shall ensure that the admissions in the Private Educational Institutions are based on merit achieved in National Common Entrance Test or the State Common Entrance test or any other test as notified by the State Government and where there is no National Level Common Entrance Test, or State Level Common Entrance Test or any other test, the merit shall be determined strictly on the basis of the marks obtained in the qualifying examination.

(3) The Commission shall develop an appropriate mechanism for receipt and redressal of grievances of students and parents, and direct the private institution to set-up a proper Grievances Redressal mechanism for redressal of complaints reported to the Commission. Such complaints shall be addressed within the time fixed by the Commission with details of the steps taken by the institution to redress such complaint.

(4) The Commission may conduct inspections of Private Educational Institutions as and when required and may form expert committees, for inspections of Private Educational Institutions.

(5) The Commission shall have the power to monitor and regulate fees in Private Educational Institutions.

[AR 2013-14] Page 5 Procedure and Powers of the Commission: (1) The Commission shall, for the purposes of any inquiry or proceedings under this Act, have the same powers as are vested in a civil court under the Code of Civil Procedure, 1908 (5 of 1908) in respect of the following matters, namely :- (a) summoning and enforcing the attendance of any person and examining him on oath; (b) discovery and production of any document or other material object producible as evidence; (c) receiving evidence on affidavits; (d) requisitioning of any public record; (e) issuing commission for the examination of witnesses; (f) reviewing its decisions, directions and orders; (g) any other matter which may be prescribed. (2) The Commission shall have the powers to pass such interim order in any proceeding, hearing or matter as the Commission may consider appropriate. (3) The Commission may authorize any person, as it deems fit, to represent the interest of the students and parents in the proceedings before it. (4) All disputes under this Act shall be decided summarily in accordance with the provisions of Order XXXVII of the Code of Civil Procedure, 1908. Penalties: (1) The Commission may, for the contravention of any of the provision of this Act or the rules or regulations made there under, or directions issued by the Commission, impose penalty, in such manner as may be prescribed, but not exceeding one crore rupees: Provided that the maximum penalty for a second or subsequent contravention shall be five crore rupees; Provided further that no penalty shall be imposed unless the institution concerned is given an opportunity of being heard. (2) The penalty imposed under sub-section (1) shall be recoverable from the endowment fund or any other Fund or as arrear of land revenue from the Educational Institution concerned. While exercising power and discharging its duties, the Regulatory Commission ensures utmost transparency and accountability in its functioning.

IMPLEMENTATION OF THE ACT AND ORDERS ISSUED

The Regulatory Commission with the aim to achieve the objectives and in the pursuit of discharge of its functions under Section 9 of the H.P. Private Educational Institutions (Regulatory Commission) Act, 2010 has taken several initiatives not only to establish the institution but also to develop regulations/systems for implementations of various regulatory provisions within the shortest possible time in view of the complex scenario of education in the private higher educational institutions of the State. The Regulatory Commission covers all the private educational institutions in the State viz., Degree Colleges, Professional Colleges of Education, Institutes of Technical Education, Management, Law, Engineering, Medical, Pharmacy, Paramedical Institutions and Universities, Centre of Excellence or any other educational institutions of higher learning, except schools affiliated to any recognised Board of School Education. There are approximately 252 institutions of higher education under the jurisdiction of Regulatory Commission in the State including 16 state private universities and 17 private engineering colleges. Geographical distribution of private higher educational institutions in the State is as under.

[AR 2013-14] Page 7 To improve education standards and implementation of regulatory norms in the institutions of higher education, wherein, more emphasis was given to the Universities. The H. P. Private Educational Institutions Regulatory Commission has taken following initiatives during the year 2013-14.

1. Stakeholder’s Consultation: The Regulatory Commission has been working as a facilitator with Private Universities in order to improve quality of education and initiated stakeholders consultation process so as to establish future ways of working and to provide enabling regulatory environment with the State Government Agencies involved in the process of establishment of institutions, approval of courses/fees, monitoring of norms and with the Stakeholders Consultation Meeting State Private Universities regarding streamlining the process and ‘Building a Vision for

Private University Education in the State.

2. Course Approvals and Academic Review: The Govt. of Himachal Pradesh in May, 2012 introduced an amendment in the State Private University Acts to make the HP-PERC responsible for course approvals. It also prescribes a time schedule for such approval making it mandatory by 31 December of the concerned year. To ascertain the status of courses offered by the state private universities vis-à-vis approvals, detailed academic review were undertaken by the Commission and initiated action against the institutions having any shortfall in faculty, infrastructure etc. Besides, in pursuit to bring transparency and accountability in the functioning of the Universities, after constant persuasion and reviews, the Regulatory Commission has brought all information on approved courses/ fees, students enrolled, faculty, infrastructure, academic regulations, course curriculum, degree awarded etc. on the public domain through their websites.

[AR 2013-14] Page 8 During the academic session 2013-14, sixteen state private universities have offered Diploma/Under Graduate/Graduate/Post Graduate/Research programmes in about 33 engineering discipline(s) and 59 other courses of management(s), science(s), social science(s), law, pharmacy, etc. as per the following details.

Approvals for running of existing as well as new courses were subject to the following terms and conditions, that;

a. The universities shall observe the eligibility criteria, minimum standard of instructions and prescribed norms for the running of a course/programme/grant of degree which shall be imparted by a duly qualified teaching staff and appropriate academic physical infrastructure facilities as prescribed by the relevant regulatory bodies e.g. UGC/AICTE/PCI/BCI etc. b. The academic infrastructure and other facilities like labs, equipments and computers should be available as per norms of the relevant regulatory bodies by the time the prospectus is ready for issuance to the students. c. The availability of essential academic infrastructure like lab etc. for each course/programme must also find mention in the prospectus. The number of seats approved for each course along with seats reserved, approved fee structure, schedule of admission and admission criteria must interalia find mention in the prospectus. d. The nomenclature and duration of the course/degree/programme should conform to UGC/other regulatory bodies. e. The universities shall ensure submission of requisite information to the UGC as required under Sections 3.7 & 3.8 of U.G.C. (Establishment and Maintenance of Standards in Private Universities) Regulations, 2003 which interalia requires

[AR 2013-14] Page 9 sending of intimation to the U. G.C six months prior to starting of a new course. Where the U.G.C. inspection is overdue, the university shall ensure submission of requisite information to the U.G.C. in the prescribed format at the earliest so that inspection could take place. f. The basis for admission to B.Tech and MBA courses shall be through JEE (Main) and CMAT respectively or as prescribed by the State Govt. from time to time. g. Where applicable, the universities shall take appropriate steps for seeking course accreditation which will add to its credibility besides enhancing employability of the students-both nationally and internationally. The commission may be kept informed of the progress made in this regard from time to time. h. The universities website shall be updated as per directions given from time to time by the Commission for information of students/general public. The information sought for by the Regulatory Commission regarding the functioning of the university including aspects like admission, student admitted, examinations; faculty and academic infrastructure etc must be furnished from time to time in the manner as required by the Regulatory Commission. i. Where the student’s intake in any course is less than 20% of the sanctioned intake, the academic regulations of the University must provide option to student for migration, if not already existing. j. The universities shall strictly comply with the UGC (Establishment and Maintenance of Standards in Private Universities Regulations, 2003. k. Proposal for fee approval for the existing/ new courses for academic session 2013- 14 to be submitted to the State Government within the prescribed time frame in the manner as prescribed. l. If any information provided is found incorrect at any stage or the assurances provided regarding meeting the norms of faculty and infrastructure in respect of all courses or in the event of violation of standards of admission, charging of excess fees than approved or indulging in practices which are not in conformity with the prescribed regulations, the Commission reserves its right to withdraw the approval and take such action, as it may deem fit.

From the above tables, it is clear that the focus of institutions in mainly to offer courses/programme of studies in Engineering/Technical discipline and that other courses which include management, pharmacy, hotel management, science and art subjects are comparatively less.

During the year, the Commission has also constituted a Committee to review all research programmes being run by the private universities in the State as per the following terms of reference and directed the universities to remove deficiencies as noticed during review to bring their programmes in line with the UGC (Minimum Standards and Procedure for award of M.Phil/Ph.D Degrees) Regulation, 2009, which were mostly complied with. The Terms of Reference/Parameters for review of research programmes were as under:

1. Compliance regarding fulfilment of minimum criteria in terms of procedure followed for admission, eligibility/allocation criteria for supervisor’s availability of in-house

[AR 2013-14] Page 11 faculties, compliance of condition of course work and assessment methods as prescribed under the UGC (Minimum Standards and procedure for Award of M.Phil/Ph.D degree) Regulation 2009. 2. To ascertain whether the Academic regulations framed by the universities are in conformity with the UGC (Minimum Standards and procedure for Award of M.Phil/Ph.D degree) Regulation 2009 or not? 3. To check whether the fee charged for M.Phil/Ph.D programmes are duly approved by the competent authority or not and number of in-house faculty available for Ph.D/M.Phil programmes by the University? 4. To check whether Research Development Committee constituted or not? 5. Any other point/Suggestion incidental to the running Ph.D/M.Phil Programmes by the State Universities?

Besides, the Committee has also suggested and recommended certain safeguard for improvements in research activities of the universities;

a) That new Ph.D programme should only be started in those disciplines where there is a strong faculty base. Generally, a new Ph.D programme should only be started after at least three years of the running of the Masters Programmes in that discipline. In all disciplines whether social sciences, humanities or management or basic sciences the position of the faculty, library and connectivity with internet facilities from INFLIBNET, etc., should be checked and in the case of basic sciences minimum number of functioning laboratories, equipment and faculty should be verified on the spot. Evaluation of these recommendations should be the starting point for any programme to be approved. For existing and approved programme the inspection of the minimum infrastructure should be made again to evaluate whether the programme are really workable or working at present. b) The whole Ph.D programme and the processes leading to these have to be made academic and student-centric. Students should enjoy adequate safeguards. That will ensure the quality of research and also check the sole revenue enhancing exercise of the University. This should be uniformly applied to all the Universities. c) There is no retention policy and faculty improvement programmes for the faculty. Though it is an universal fact that a professional will look to move to better avenues but a frequent movement of faculties from one to another institution in the case of private University will harm the interest of the students as the new institution will not

[AR 2013-14] Page 12 allow continuation of Ph.D guidance of student registered with the earlier University of the Faculty due to the conflict of interest. d) Linkages with other institutions and Universities should be established. e) The faculty has appreciably good track of the extra-mural financial support in the form of projects. That should be translated to augment research facilities and support the deserving students in the form of fellowships. Such measures will boost the research output of the University. f) Students’ presentations for six monthly progress monitoring and pre-thesis submission should be held. g) Soft copies of the RDC meetings, approved synopsis, abstracts and thesis should be posted on the website and the last two should be submitted to the HPPERC and UGC.

3 Admission Norm: The H.P Private Educational Institutions (Regulatory Commission) Act, 2010 provided that the admissions in the Private Educational Institutions are based on merit achieved in National Common Entrance Test or the State Common Entrance test or any other test as notified by the State Government and where there is no National Level Common Entrance Test, or State Level Common Entrance Test or any other test, the merit shall be determined strictly on the basis of the marks obtained in the qualifying examination. Therefore, in order to regulate admission norms especially in technical and professional courses and with a view to adopt transparent uniform cross comparable admission processes in the State, duration and entry level qualification for all technical and professional courses not to be less than the AICTE norms was prescribed and each university was directed to notify this requirement in advance on their website and prospectus for the next academic session. The Commission has streamlined the admission criteria and ensured merit based admissions in all the State Private Universities and made admission disclosure mandatory not only to the Commission but also to the public at large through their web portals.

The above admission criteria were further relaxed by the State Govt. vide Notification No. EDN (TE)A(9)1/2012 dated 07.10.2013 which is as under; “It has come to the notice of the Government that a large no. of students have been admitted by various Private Universities, Colleges & Polytechnics in violations of the norms for admission fixed by the State Government. It has been accordingly decided to allow these institutions to retain such students admitted before 15.08.2013 to various courses of B.Tech. (Including Bio-Tech, Food Tech and Bio- info.) M.Tech., B.Pharma., M.Pharma, MBA and Diploma Courses subject to the minimum qualification prescribed by the AICTE and other regulatory bodies for the session 2013-14 as a onetime measure in the larger interest of the students/parents. However, such institutions shall be proceeded against for imposition of penalty for the violation committed by them by respective regulatory/affiliated bodies as per relevant provisions of law simultaneously. While doing this, such regulatory/affiliated bodies shall keep in view any order passed by the Hon’ble High Court or any other Court/ authorities including those in CWP No. 6170/2013 titled Un-aided Polytechnic Welfare Association Vs. State of HP and CWP No. 7688/2013 titled Himachal Private Universities Management Association Vs. State.”

Uniform Academic Calendar: The Regulatory Commission has ensured that institutions follows a uniform academic calendar as per UGC norms (90 teaching days per semester) with the semester duration (July to December) and (January to June), which was adopted after a due consultative process and collection of fees in two equal instalments at the beginning of each semester for all the private universities in the State and streamlined the process and prescribed timeline for advance approval of course/fees before commencement of academic session. 5. Grievance Redressal: The Grievance Redressal of students and parents is one of the vital functions of the Regulatory Commission. In this regard, the Commission has established/put in place the Grievance Redressal mechanism and also issues public notices through print media from time to time for general awareness. Besides, notice board(s) have also been placed in every institution for information and awareness of students, parents. In addition, the Regulatory Commission has Snapshot of web enabled Grievances also developed an application Redressal Mechanism for online redressal of grievances, where the grievances can be registered / submitted on line and the same will be processed online and applicant without visiting the office will know the status of the grievance and action taken thereon. The overall status of grievance(s) received against the different private higher educational institutions in the State and action taken thereof during the year 2013-14 is as under.

6. Financing of Commission: Though the Regulatory Commission has been envisioned as a self financing mechanism. Therefore, in exercise of the powers conferred by Section 8(a) of the H.P. Private Educational Institutions (Regulatory Commission) Act, 2010, the Commission has notified regulation for levy of 1% of the total fees (except refundable securities) received by the private higher educational institutions in the State every year to be credited into the fund established by the Regulatory Commission for meeting expenses required in connection with the discharge of its functions under Section 9 of the H.P. Private Educational Institutions (Regulatory Commission) Act, 2010 and also for meeting objects and the purposes authorised by the Act. Presently, there is a stay on the operation and implementation of Section 8(a) of the HP Private Educational Institutions (Regulatory Commission) Act, 2010 dealing with the funds of the Regulatory Commission. Therefore, 1% of the fee collected by Universities could not be credited into the fund established by the Regulatory Commission.

7. Inspections : To ascertain the standards of admission, teaching, examination, research, faculty and infrastructure being maintained by the institution in accordance with the Central/State Regulatory bodies norms and/or guidelines issued by the Central/State Government and compliance of statutory provisions as per Act/Statutes of the University from time to time, the Regulatory Commission under Section 9(4) of the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Act, 2010, has notified the ‘Inspection Schedule’ for Private Higher Educational Institutions in the State to be conducted by the Commission itself or through ‘Expert Committees’ to be constituted for the purpose from

The purpose of these inspections were to ensure that norms of the Central Regulatory bodies are being observed in order to ensure that the standards for admission, examination, faculty etc. are being observed to maintain quality of education. For technical/professional subjects, the norms of AICTE or the concerned regulatory body are applicable, while the U.G.C. norms govern the norms for other departments, general regulations for award of degrees and minimum requirement for faculty etc. The broad terms of reference of the Inspections carried out by the Commission were as under: a) To examine the admission process for courses approved and run, the number of students enrolled and the nature/schedule of fee charged.

b) To examine the adequacy of the faculty in terms of prescribed strength (number)/ qualification and experience as per Regulatory norms.

c) To review the level of infrastructure available for different courses and examine the adequacy for the conducting all technical courses.

e) Issues of governance and statutory compliances under the University’s Act/Statutes, Finance and Accounts.

f) Operation of Fund (Verification of latest Bank account with the accounts maintained by the university).

g) Research Programme: 1. Whether the programme is duly approved by the State Govt./Regulatory Commission Competent authority or not? 2. Students enrolled under different disciplines (only in those universities whose Research Programme has not been reviewed). 3. Whether the number of seats in each Department advertised in advance. 4. Whether the Post graduate Department in such disciplines in which the students have been enrolled for M.Phil/Ph.D exists or not? 5. Availability of infrastructure of research.

The follow-up directions were issued to the institution, not-complying with prescribed academic parameters and in case the institutions failed to comply with the directions issued by the Regulatory Commission penal action under section 11 of the H.P. Private Educational Institutions Regulatory Commission Act and Rules made thereunder were initiated against the institutions.

PENALTIES IMPOSED ON VARIOUS DEFAULTING INSTITUTIONS AND STATUS OF LEGAL CASES IN THE HON’BLE COURTS

During the year 2013-14, the Regulatory Commission could not institute proceedings for major violations under Section 11 of the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Act, 2010 which provides for imposition of penalties for contravention of the provisions of the Act, Rules and regulations made there under initially due to partial stay on the operation and implementation of Section 11 of the above Act and final order in CWP No. 10140/2012 vide which the act incorporating Regulatory Commission was declared ultra-vires the Constitution of India. [AR 2013-14] Page 19 CHAPTER-6 OTHER OBSERVATIONS AND RECOMMENDATIONS Himachal Pradesh is the first State to set up a regulatory body for all private institutions imparting higher education above Senior Secondary (10+2) levels with a mandate to provide a regulatory mechanism in the State for Private Higher Educational Institutions and to work as an interface between the State Government and the Central Regulatory Bodies. During the year one important development in private higher education regulatory mechanism was the judgment rendered by the Hon’ble High Court of Himachal Pradesh in CWP No. 10140/2012 whereby, the Himachal Pradesh Private University Management Association (H-PUMA) had challenged the constitutionality of the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Act, 2010 as well as the Rules made thereunder by way of a writ petition before the High Court. The Hon’ble Higher Court of Himachal Pradesh in its judgement, dated 19.10.2013 had struck down the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Act, 2010 as ultra-vires the Constitution of India. However, pending further orders the Hon’ble Supreme Court of India in SLP (Civil) 36903/2013 has granted partial stay on the judgment dated 19.10.2013 in favour of the State/Commission and restored the status quo ante. The Regulatory Commission has been working as a facilitator with private institutions in order to improve quality of education and constantly interacting with the stakeholder’s regarding streamlining the process and building a vision for private higher education in the State. On the initiative of the Regulatory Commission, Mock AIEEE now JEE-main Test scheme for all Govt. Schools was evolved and administered through Department of Higher Education and implemented by all the State Private Universities with an objective to enhance the awareness level of students aspiring for engineering programs. In this endeavour, the State Private Universities have conducted off-line/on-line Mock tests in 600 Govt. Senior Secondary Schools teaching science at 10+2 level throughout the State benefitting majority of the students. As a result of enhanced awareness more than 65% of passed out students from HP Board had appeared in JEE Main 2014 examination. With constant persuasion the universities have improved transparency and brought information on approved courses / fees, student’s enrolment, faculty, infrastructure, academic regulations, course curriculum, etc. on the public domain through its websites. Besides, the Regulatory Commission has also developed an application for online redressal of grievances, where the grievances can be registered / submitted on line and the same will be processed online and applicant without visiting the office will know the status of the grievance and action taken thereon. *****

The Regulatory Commission has been envisioned as a self financing mechanism. The Govt. of Himachal Pradesh has provided Rs. 70.00 lakhs as loan for its initial establishment during the year 2011-12. The Section 8(a) of the Himachal Pradesh Private Educational Institutions (Regulatory Commission) Act, 2010 provides for levy of maximum of 1% of the total fees collected by the private educational institutions for carrying out its various functions. This is apart from penalties. No further allocation of funds is made by the Commission as it has no subordinate offices. All the receipts and payments of the Commission were regulated through Commission’s own Fund as established under the aforesaid Act. The Annual Accounts of the Commission for the year 2013-14 were prepared on the prescribed formats as contained in the Fund Rules. The accounts of the Commission are being prepared in the shape of Receipt and Payment Account, Income & Expenditure Account and Balance Sheet. The Annual Accounts would be laid before the State Legislative Assembly after completion of audit in terms of requirement of Section 13(2) of the Act ibid.
