He’s also on his fourth offensive coordinator, and that number feels noteworthy, too. Before he arrived in Tempe, he lived in Minnesota, Las Vegas, Colorado, Texas and a bunch of places in California. Stability is relative. Actually, everything is relative. Among the eight college counselors working the Elite 11 Finals this month in Southern California, two were seniors being touted as future NFL first-round picks — Auburn’s Jarrett Stidham and Missouri’s Drew Lock. Five others are the front men of teams with top 10 promise — Alabama's Jalen Hurts and Tua Tagovailoa, Penn State’s Trace McSorley, West Virginia’s Will Grier and UCF’s McKenzie Milton. The other was a guy who’s battled through a bunch of injuries and been on teams the past three seasons that are a combined two games under .500. American football as a whole is the most popular sport in the United States. In the United States, professional football and college football are the most popular forms of the game, with the other major levels being high school and youth football. As of 2012, nearly 1.1 million high school athletes and 70,000 college athletes play the sport in the United States annually. The National Football League, the most popular American football league, has the highest average attendance of any sports league in the world; its championship game, the Super Bowl, ranks among the most- watched club sporting events in the world, and the league has an annual revenue of around $10 billion. Besides the Super Bowl and other high profile games, one of the most watched events of the sport is the National Football League (NFL) Draft. The draft is an event where professional football teams select some of the top college prospects to be a part of their team for the next season. However, the draft has a greater impact than only on the professional teams and the college prospects. In 2014, the NFL Draft was covered by the NFL Network, ESPN, and ESPN2 over the course of 3 days where 45.7 million people watched. With an event getting so much press and coverage, many fans look to predict the outcomes of the Draft, interested in who their team will draft and which select athletes will be the coveted first round draft picks.

The twelve-minute test, which measures “cognitive ability,” has been shown to have a disparate impact on minorities in various employment situations. This Note contends that the NFL’s use of the Wonderlic also has a disparate impact because of its effect on a player’s draft status and ultimately his salary. The test cannot be justified by business necessity because there is no correlation between a player’s Wonderlic score and their on-field performance. As such, this Note calls for the creation of a football-specific intelligence test that would be less likely to have a disparate impact than the Wonderlic, while also being sufficiently job-related and more reliable in predicting a player’s success.
