THAT Council for the Township of Central Frontenac supports the proposed Elizabeth Street Reconstruction as a priority project that will improve pedestrian safety, traffic flow, parking congestion and help promote economic growth in the down town and surrounding area. Council authorizes staff to submit the Expression of Interest for the Ontario Community Infrastructure Fund to support the reconstruction of Elizabeth Street and supporting storm sewer system for the total amount of $2,299,107.60.

22 b) PUBLIC WORKS 106-2015 Speed Limit Reduction – Long Lake Road

That Council for the Township of Central Frontenac approve the recommendation of the Public Works Supervisor to reduce the speed limit on the Long Lake Road from the Public Beach Road southerly 1000 metres to the north end of the causeway from 80 km/h to 60 km/h.

AND FURTHER that Schedule "A" to by-law 2009-299 A be amended to include the Long Lake Road as per recommended by the Public Works Supervisor.

5. Mayor’s Remarks Mayor Frances Smith has attended 3 AGM’s (Sharbot Lake, Horseshoe/Crotch Lake and Kennebec Lake). The Central Frontenac Hazadous Waste Day was a success once again and Mayor Smith thanked everyone who helped out.

The Mayor and key staff members met with Detachment Commander Sharron Brown and Sargeant Paul Legault, the purpose of the meeting was to get clarification on numbers and costs for 2015 billing, and Staff Sargent Brown strongly recommended that we consider having a police services committee to assist with communications.

Mayor Smith attended the overpass construction project near the corner of Elizabeth Street and Road 38. Minister Leal was also in attendance.

We have just received an update from the County pertaining to the trail project development from Fish Creek to Sharbot Lake. Funding is from the 150th anniversary grant which was approved in the amount of $250,000.00.

As Deputy Warden of the County Mayor Smith attended along with Warden Doyle met with Sophie Kiwala as well as Brian Patterson to discuss joint issues.

A couple of meetings were held with Kelly Pender County of Frontenac CAO, who is completing the “state of the organization” for the township and most of the interviews will be completed this week.

The following are reminder of upcoming events: August 15 – Proctor Sisters doing a marathon swim from Sharbot Lake park to the Beach raising money for the Canadian Cancer Society, estimated time to arrive at the beach is 11-11:30AM. August 16-19 - AMO Conference Niagara Falls August 20 – Frontenac Community Services Summer BBQ, 5PM August 21-23 – Parham Fair August 28-30 – County of Frontenac 150th Anniversary celebrations are taking place at Harrowsmith.

Deputy Mayor Jamie Riddell Deputy Mayor Jamie Riddell, mentioned that a meeting is being planned regarding wireless internet for the Mountain Grove and North Frontenac areas.

The Central Frontenac Minor Softball Association has wrapped up for the year, and Councillors Victor Heese, Brent Cameron and Jamie Riddell went to the Leggatt Lake Cottage Association Golf Tournament.

a) BUILDING – Boat Ramp

Fire Chief Young explained that the budgeted amount for the ¾ ton truck is $75,000 which has been budgeted for the past two years and that the truck is coming in under budget. Signage, lights and foam unit still needs to be installed and with all of this it should be still under budget.

WHEREAS the Operation of All Terrain Vehicles on Municipal Highways By-law # 2006-221 was adopted on October 10, 2006.

WHEREAS of July 1, 2015 the Province implemented new changes increasing On Road Access for Off-Road Vehicles (ORV) and All-Terrain (ATV), allowing more types of ORV’s and ATV’s. Two-up ATV’s Side-by-side ORV’s and utility terrain vehicles (UTV’s) on the shoulder of public roads where permitted. Furthermore, on-road access has been extended to allow provincially permitted ORV’s to operate on Crown Land Roads within municipalities

AND THEREFORE THAT Council for the Township of Central Frontenac approve By-law 2015-30 for All-Terrain, Multi-Purpose Off Highway Utility and Recreational Off-Highway Vehicles (Off-Road Vehicles).

WHEREAS Mike Richardson (previous Public Works Manager) has written Central Frontenac Township a proposal to complete the 2nd intake of OCIF (Ontario Community Infrastructure Fund) applications.

AND WHEREAS the expressions of interest deadline for submission is September 11, 2015;

AND WHEREAS in order to increase our chances of success, it is recommended that we don’t stretch our already limited resources in the Public Works Department, that we hire Mike Richardson to complete the application on our behalf.

AND THEREFORE council approve the hiring of Mike Richardson to complete the 2nd intake of OCIF (Ontario Community Infrastructure Fund) application on behalf of the municipality. CARRIED

Re: Ontario Community Infrastructure Fund (OCIF) for the Reconstruction of Elizabeth Street

A. RECOMMENDATION

That Council for the Township of Central Frontenac supports the proposed Elizabeth Street Reconstruction as a priority project that will improve pedestrian safety, traffic flow, parking congestion and help promote economic growth in the down town and surrounding area. Council authorizes staff to submit the Expression of Interest for the Ontario Community Infrastructure Fund to support the reconstruction of Elizabeth Street and supporting storm sewer system for the total amount of $2,299,107.60.

B. BACKGROUND/ INFORMATION

Central Frontenac Township started the process for the reconstruction of Elizabeth Street in 2010. A comprehensive study was completed on the parking in Sharbot Lake in 2011. Although the new design for Elizabeth Street does not accommodate all of the recommendations in the report, it does not preclude those recommendations from being implemented at a later date. The main recommendations that will be addressed are the widening of the street, the improved delineation of parking spaces and the improvement of the sidewalks.

In 2011, J.D. Jewell Engineering Inc. was retained, through an open tender process, to redesign Elizabeth Street to accommodate improved parking layout, improved sidewalks and upgraded storm sewer system.

The consultant has completed the draft design and tender documents for Elizabeth Street with the upgraded storm system. A public meeting was held at Soldiers Memorial Hall where the design for Elizabeth Street was available for the public to view and make comments. The concept design drawings and the public’s comments were presented to council on November the 22, 2011. Council approved the concept design so that the detailed design and engineering could be completed.

In 2012, Jewell Engineering completed the storm sewer review. The report recommended the replacement of the whole system to correct the deficiencies.

C. FINANCIAL IMPLICATIONS

The Township is eligible to apply for the Ontario Community Infrastructure Fund (OCIF) grant by submitting the Expression of Interest (EOI) by September 11, 2015. If the Township is successful with their project submission the Township will be notified in October to complete the second phase of the OCIF grant submission. The OCIF grant will cover up to 90% of the construction cost.

The updated project estimate as of September 2, 2015 has allowed for the replacement of the sewer line, the reconstruction of Elizabeth Street and the engineering costs to complete the project.

Cost Breakdown: Reconstruction of Elizabeth Street $1,503,691.00

Replacement of Outlet storm sewer from Garrett Street to the outlet at the end of Matthew St. $321,975.00

Contingency $182,566.60

Engineering – to update drawings and include storm water outlet. $2,025

Engineering – Contract Management - 15% of construction cost $273,850

Additional engineering reports that may be required such as Geotechnical, Archaeological Assessment and Biological. $15,000

Total Project costs $2,299,107.60

Re: Speed Limit Reduction – Long Lake Road

A. RECOMMENDATION

That Council for the Township of Central Frontenac approve the recommendation of the Public Works Supervisor to reduce the speed limit on the Long Lake Road from the Public Beach Road southerly 1000 metres to the north end of the causeway from 80 km/h to 60 km/h.

AND FURTHER that by-law 2009-299 A Schedule A be amended to include the Long Lake Road as per Public Works Supervisor recommendation.

B. BACKGROUND/ INFORMATION

At the January 27, 2015 Council meeting, Council requested staff to review the speed limit on the section of the Long Lake Road near the public beach and to bring back a report.

Staff, have completed the review and have determined that with the amount of curves and intersections through this area including the beach, that decreasing the speed limit will increase the public’s safety and therefore, are recommending that the speed limit be reduced from 80km/h to 60 km/h from public beach road southerly 1000 meters to the north end of the causeway.

Road Maintenance and Operations:

- Crews are grading and patching trying to keep up with wash outs and pot holes throughout the Township due to the weekly heavy down pours we have been receiving lately. - Brushing is ongoing on Babcock Road and Bell Line east and will continue to Bell Line west when completed in the present areas. - The new School Speed zone signs have been installed in Sharbot Lake on August 31st so that traffic will have a week to see them and adjust prior to the school year commencing.

Construction:

- Paving is complete on Fifth Lake Road and crews are shouldering and tying driveways in to the new road surface. Estimated completion is the 3rd week of September. - Raymo Road culverts have been installed and the road was reopened to the public on August 25th. This job is complete with the exception of some minor guiderail installation. - Culverts, ditching and excavations are complete on Mill and Frontenac Road. The contractor is now placing gravel to prepare for new surface treatment that will take place in the next couple of weeks. - The reinstatement of the new asphalt on Road 38 and Elizabeth St. where the over pass has been removed is completed and open to two lanes of traffic with some short lane closures during the day to complete the remaining work. Detours have been removed from Elizabeth St and there still remains the paving of the approaches of the trail up to Road 38, light standards and the remaining guiderail installation. Estimated completion is 2nd week of September. - The paving of the Medical Centre parking lot and Medical Centre Road between Matthew Street and the Medical Centre is completed.

A. RECOMMENDATION(S)

That Council for the Township of Central Frontenac support Jeremy Neven, Chief Building Official to go forth an apply for a 4 year term position on the Building Materials Evaluation Commission and further that all costs associated with this appointment such as travel costs, hotel and per diem will be covered by the Commission.

B. BACKGROUND

The Building Materials Evaluation Commission (BMEC) is a regulatory agency authorized under the Building Code Act, 1992 (BCA). It has a mandate to conduct or authorize the examination of materials, systems and building designs for construction. When approving a material, system or building design, the BMEC may attach certain conditions for its use. The BMEC may also make recommendations to the Minister regarding changes to the BCA or Building Code.

C. DISCUSSION

There are currently 14 members of the BMEC from across Ontario from such disciplines as building officials, engineers, researchers and independent industry members. Over the course of the next 6 months, many will have fulfilled their term and will be stepping down. I have been asked to apply to the commission by a current member who would support my application.

The time commitment over the 4 year term includes one day per month travel to Toronto for meetings and evaluations of proposed products, etc. The travel, hotels and per diems are all paid by the commission.

As these 12 meetings would require a day away from the office, many commission members offset the hours lost in the municipal office by providing equivalent hours worked outside of the office.

D. FINANCIAL IMPLICATIONS

All travel costs, hotel and per diem is paid by the BMEC. The cost to the Township is $0

B. BACKGROUND/ INFORMATION

Pursuant to the Municipal Act, 2001 a Sale of Land by Public Tender was conducted on August 27, 2015. The attached list shows the results of the sale. Section 354(2)(a) provides that the treasurer shall remove unpaid taxes from the tax roll if the council of the municipality, on the recommendation of the treasurer, writes off the taxes as uncollectible. Section 354(3) provides that the municipality may only write off the taxes after an unsuccessful tax sale but may do so whether or not the property is vested. Section 379(5)(b) provides that the treasurer, if there is no successful purchaser, may prepare and register in the name of the municipality, a notice of vesting. Section 380.1 provides that if there is no successful purchaser, the treasurer may, within two years after the date of the public sale, offer the land for public sale, a second time. Section 386.1 to 386.5 sets out the conditions under which the municipality may enter on and inspect the land.

Re: Failed Tax Sale Policy

A. RECOMMENDATION

That Council for the Township of Central Frontenac receive the attached draft Failed Tax Sale Policy including attachments as presented by the Treasurer for information purposes and further; that council provide comments on the proposed draft policy.

B. BACKGROUND/ INFORMATION

Current practice when a tax sale fails is determining with department heads if we vest or write off part of the taxes and relist the property. We have had some success and some failures in writing off the taxes and re- listing. Determining a correct value can be difficult without outside assistance and writing off taxes below the tax sale position gives the ability to the current owner to pay the remaining taxes and keep the property.

This new RFP process will enable us to put the property out to the public to determine an accurate value and to put the property back into an active status through the process described in Appendix A. Also the taxes would not be written off until we had a successful buyer.

C. FINANCIAL IMPLICATIONS

Legal costs would be incurred for drawing up the agreements to transfer ownership but would be similar to re-listing.

TAX SALE POLICY - Draft

1. Purpose:

The purpose of the policy is to establish guidelines on the Township’s process within the legislated Tax sale process of the Municipal Act.

2. Policy:

The Township’s goal is to return properties to a state where taxes are collected on a regular basis. All properties in tax arrears are subject to this policy.

Cancellation price: an amount equal to all the tax arrears owing at any time in respect of land together with all current real property taxes owing, interest and penalties thereon and all reasonable costs incurred by the municipality after the treasurer becomes entitled to register a tax arrears certificate under section 373 in proceeding under this Part or in contemplation of proceeding under this Part and may include, (a) legal fees and disbursements, (b) the costs of preparing an extension agreement under section 378, (c) the costs of preparing any survey required to register a document under this Part, and (d) a reasonable allowance for costs that may be incurred subsequent to advertising under section 379 4. Guidelines:

Under section 373(1) where any part of tax arrears are owing with respect to land on January 1 in the third year following that in which the real property taxes become owing, the treasurer of the municipality may prepare and register a tax arrears certificate against the title to that land.

1. On a yearly basis, by February 28th, a listing of qualifying accounts will be generated by the Treasury Department, excluding any properties that already have tax arrears certificates issued or payment plans in place. 2. The Township will send each taxpayer an overdue notice stamped with a note “TAX SALE PENDING $______REQUIRED By April 30th to stop the process”. Owners will be given until April 30th to pay any arrears that are in the 3 years or beyond along with all penalties, or an acceptable payment arrangement has been made with the Treasurer. 3. A reasonable payment arrangement will be accepted by the Treasurer if it enables the property to be removed from tax sale position within a reasonable amount of time. Once an acceptable arrangement has been made, the property would not be placed in the tax sale process but should the arrangement not be followed the tax sale process would immediately begin. 4. The listing of qualifying remaining tax sale properties will be distributed internally to other departments to ensure that there are no outstanding issues on the properties that may involve the Township or other organizations such as the Municipal Property Assessment Corporation (MPAC). Should there be any properties that do fall under this category; they will be excluded from the tax sale registration to provide for further investigation. 5. Once the list has been streamlined and the April 30th date has passed, tax arrears certificates will be issued to the remaining properties. Currently this process is outsourced but consists of the following steps being undertaken in coordination with the Township. a) Farm Debt Notice: It is legislated that every property listed receives a farm debt notice. The legal intent of the farm debt notice is to inform farmers of their right under Section 5 of the Farm Debt Mediation Act that they are entitled to make application for a review of their financial affairs. However, this is the first official non-Township communication which notifies the

taxpayer that the tax sale registration will take place after a 15 business day period should the arrears not be paid. b) Title Search: Every property prior to a tax arrears certificate being issued must have a title search to ensure that the proper information is on file including registered owners, interested parties and proper land details. Should any issues be encountered such as ownership and MPAC related data, the process on that property will be put on hold until it has been resolved. c) Registration of Tax Arrears Certificate: The tax arrears certificate is registered on title for the property. d) Extension Agreement: At any time prior to the end of the 1 year from the date of registration of the tax arrears certificate, the Township may approve by by- law an extension agreement with the taxpayer. To be eligible for consideration, the extension agreement must include that all current taxes will be paid within the required due dates and that the existing arrears on the account will be paid off within a one to two year period. Acceptance of this agreement by the Treasurer and the Mayor through by-law # 2013-07, or council if the amount owing is greater than $20,000 or payment terms of longer than 12 months will put the tax sale process on hold for the property. Should there be any breach of the agreement, the tax sale process will resume from the date of the breach. e) First Notice to Interested Parties: A first notice is sent out to all interested parties within 60 days of the registration of the tax arrears certificate. This notice advises them that a tax arrears certificate has been issued on the property and that should the cancellation price not be paid within a year of the date of registration of the tax arrears certificate, the property will go up for public tender. Interested parties include, but are not limited to: registered owners, mortgage companies, and registered lien holders f) Statutory declaration: For each property, the Township receives a listing of the interested parties to whom notices were sent out g) Registration of Cancellation Certificate: At any time when the cancellation price is paid during the one year from the date of registration of the tax arrears certificate, a cancellation certificate will be issued on the property. h) Final Notice to Interested Parties: Within 30 days after 280 days have passed since the registration of the tax arrears certificate, a final notice is sent to all interested parties. i) Tax Sale Advertising: After a one year period from the date of registration of the tax sale certificate, if the cancellation price has not been paid, the treasurer will make a statutory declaration that the remaining properties will be part of a public tender. It is legislated that the land be advertised for sale once in the Ontario Gazette as well as once a week for a period of 4 weeks in the local municipality’s newspaper. The Treasurer will also circulate the advertisement to council and department heads to see if there is any interest in the municipality putting in a sealed bid. A copy of the advertisement will also be mailed to the neighbouring properties surrounding the tax sale property. j) Successful Purchaser: Various criteria must be met for a bid to be successful but one main item is that the bid must be at a minimum the cancellation price listed within the public advertising. If there is a successful purchaser, the Township will prepare and register a tax deed in the name of the successful purchaser once all legislated requirements have been met. Any excess funds from the cancellation price must be paid into court and a notice is sent to all interested parties. After a period of 1 year, any excess funds will be collected by the Township if the funds exceed the legal costs involved to receive the funds. These funds will be assigned to the tax sale expenses recovery revenue account. k) No successful Purchaser: Under the Municipal Act, the Township has the option to vest or re-advertise the properties that were not successfully sold within 2 years of the tax sale date. After the two year period, the process is

deemed to be cancelled and would need to start over. Appendix A provides the flow of the steps to be taken.

Within 30 days of tender opening, the Treasury department will distribute to all departments and council the listing of unsold properties and will provide for a 2 month period where these properties can be vested. A request to vest will need to be supported by a detailed rationale of purpose, benefits, risks, and costs before it can be presented to Council for consideration.

For the properties where there is no interest and/or once the two month period has expired, the Township will issue an RFP to the market for each property.

l) RFP to Market: Prospective buyers will submit a bid on the property regardless of the cancellation price along with a proposal of the intended use for the property. They will be requested to provide a deposit equivalent to 10% of their bid. The Township is under no obligation to accept any of the bids received.

The assessment of received bids will be conducted by the Treasurer and CAO or Clerk, which will provide a recommendation to Council. If a bid is accepted, a conditional agreement of purchase and sale will be entered with the purchaser and the Township.

The original agreement of purchase and sale will be drafted by the Township’s legal counsel and will be reviewed at each instance to ensure no additional clause should be incorporated within the agreement. A further 40% deposit will be required from the purchaser. The agreement will specify that all deposits received will be non-refundable once the agreement is signed unless the Township is unable to transfer ownership of the property due to uncontrollable circumstances.

The Township will vest the property and write off all taxes on the property. The property will be declared surplus by the Township. The remaining 50% of the bid price will be collected from the purchaser. Once payment is received, the Township will prepare and register a tax deed in the name of the purchaser.

The County of Frontenac on July 17, 2013 approved funding a Propagation Study for radio communications on behalf of the four lower tier Townships and allocated $25,000 in 2014 County Budget for this Study;

Concerns have been raised with the existing radio communication equipment and its reliability which has been identified by the Townships Fire and Public Works Departments.

The Frontenac CAOs, Fire Chiefs and Public Works Managers have been collaborating to identify the types of infrastructure and equipment requirements that could establish an effective and efficient communications system to safeguard the health and safety of County residents; and have agreed there is a need for an Infield Communications Gap Analysis Study. A chronology of the work done is outlined in the attached administrative report from North Frontenac.

Each of the lower tier municipalities are seeking the support of their respective Council’s over the next couple of weeks to have this issue placed on the County’s September agenda in time for the County’s budget deliberations.

BACKGROUND For a number of years the Fire Chiefs (FCs) within the Frontenacs had been discussing the problems and issues with Radio Communications (i.e. outdated tower sites, base radios and portable radios; and inadequate cover and limited capabilities for inoperability, even within our own municipalities). Communications is the critical component during emergencies and currently there is no reliability in the system.

In July 2013 the FCs within the County of Frontenac requested the County of Frontenac, on behalf of the four lower tier municipalities, fund a Propagation Study for Radio Communications across the Frontenacs and this was supported by all the Frontenac Township Councils. On July 17, 2013 County Council approved funding a Propagation Study for radio communications on behalf of the four lower tier Townships and allocated $25,000 in the 2014 County Budget for this Study. South Frontenac Fire Chief Rick Chesebrough, in consultation with the other FCs, issued a Request for Proposal (RFP) in August 2013.

Marian VanBruinessen, Treasurer, County of Frontenac reviewed the Building Canada Fund criteria for possible future funding, if Frontenac Councils desired to move forward on an actual project.

Glentel Inc. Ottawa provided a Radio Communications Study Report dated February 16, 2014 and Fire Chief Chesebrough presented this Vendor Report to County Council on February 19, 2014 and County Council referred the Radio Communications Report to staff for review and report back to the Committee of the Whole at a later date. The FCs made the same presentations to their respective Councils in March 2014. The FCs continued to work collectively to investigate all communication options for all Frontenac Councils consideration and the Public Works Managers (PWMs) became involved to ensure the needs of all the Departments were being considered.

It was determined at the Frontenacs CAO’s meeting in June 2014 that all Managers (FCs, PWMs, Treasurers, etc.) wishing to attend and/or provide joint recommendations to Council (Lower Tier and/or Upper Tier) shall first present the draft recommendations to the Frontenac CAOs to look at the options, prior to presenting anything to Council. The CAOs are not trying to tell the Managers what to recommend; however, to assist the Managers with their recommendations and to ensure they meet the goals/objectives of the municipalities. The CAOs requested that the FCs and PWMs provide the CAOs with a signed off collaborative fact based report, not based on assumptions, that explains the following:  What is the current situation? (type of equipment being used, the age of it, the number of towers/locations, etc.)  What is the current status? (operable/specific limitations, dead zones, etc.)  What is the anticipated problem? (changes by Fed Gov’t / Kingston Fire/L&A changes / limitations of Ambulance system, etc.)  What are the risks with the problem? (lack of communication between trucks, individuals, departments, etc.)  What is the timeline for changes? (date that frequencies are being dropped, changes by L&A/Kingston, etc.)  What is the immediate impact? (within in each fire department, between the Frontenac’s/ mutual aid group, etc.)  What are the interim measures being put in place? (patch by KAC, relayed communication/ groups what is happening within L&A, what about other neighbours, etc.)  Other relevant background facts.

The FCs and PWMs met in August 2014 and drafted a Radio Communications Report that was presented to the Frontenac CAOs on September 5, 2014; however, not all Frontenac FCs and/or PWMs had an opportunity to provide their input and the CAOs need all the facts to ensure there is a clear picture of the situation to effectively move forward. Due to the timing of the Municipal Election, it was felt that the FCs and/or PWMs would have time to clearly define the facts and provide a more detailed Report to the CAOs for consideration, before presenting it to each lower tier Frontenac Council for their consideration, prior to asking the County of Frontenac to finance a Gap Analysis Study.

In October 2014 the Frontenac CAOs had GlobeConsult Corporation, complete an independent assessment of the Glentel Radio Communications Study Report details, in particular, Radio Coverage Evaluation, information on Long-Term Evolution (LTE) with respect to public safety communications, Network Operations (Interoperability) and Licensing & Frequencies. David du Feu, GlobeConsult Corporation recommended a Request for Information (RFI) should be issued to several vendors soliciting information, including costs, for various technical solutions at different serviceability standards for a proposal to upgrade Frontenac’s public safety communications. He also advised that any RFI or subsequent Request for Proposal (RFP) should be managed by an independent telecommunications professional that is capable of evaluating submissions based upon technical performance.

On January 29, 2015 the Frontenac FCs and PWMs attended a Frontenac CAOs meeting and provided an updated Report answering the questions from the CAOs, explaining our present radio communication systems are outdated, results in delays, lack of parts available for present systems, need to be able to communicate with Mutual Aid partners, present analog equipment will not be available in the future as the industry is moving to digital communications and our present systems will not work (narrow vs wide band), etc. which makes this a criteria issue and explained why a Gap Analysis Report is required to better define the costs, needs and an implementation plan. Frontenac Islands and Central Frontenac had to make some immediate short-term solutions/changes to their systems, pending a solution for the Frontenacs common issues. It was noted at this meeting that perhaps our infrastructure (towers) could be rented out, creating potential revenue for the municipalities. It was also noted that the Vendor completing the Gap Analysis Reports cannot be a future supplier and the County’s Procurement By-law would have to be complied with, if Councils approve the Gap Analysis Study. The FCs and PWMs are to meet again to prepare a final Report for the CAOs’ review, prior to it being presented to each lower tier Council requesting their support of the County funding the Gap Analysis Study.

Due to changes in staffing throughout the Frontenacs, all FCs and PWMs did not have an opportunity to meet; however, some of them provided the CAOs with a draft Report. In March 2015 in Jim Phillips, P. Eng., PWM’s opinion, this Report still does not provide enough information about the communications issues in the Townships (i.e. the findings in the previous Communication Report; including a concise list of the issues with the present situation in all the Townships, such as, the communication challenges, outdated equipment, future requirement to switch from analogue to digital frequencies, dead zones, lack of interoperability between Townships and adjacent municipalities, dispatch providers, etc.). The report should then list the decision points to move forward and recommend the need for a “Gap Analysis” which would drill down into the specific needs of the region and

each Township followed by a Business Case for funding and if successful, the issuing of an RFP to service providers. It was generally thought that the Gap Analysis could cost as much as $30,000 and if all the Townships were agreeable to move forward, the Townships would jointly request that the County fund this next phase. It was also discussed that the company chosen to complete the Gap Analysis would not be eligible for bidding on providing the service in the future. Therefore, in his opinion, the FCs and PWMs should meet again to review these comments and work to revise this Report before presenting it to the CAOs.

In April 2015 North Frontenac Township’s FC was asked by his colleagues to coordinate another meeting with the Frontenac FCs and PWMs.

A final summary report prepared by Fire Chief Chesebrough, in consultations with some of the FCs and PWMs, was provided for the CAOs meeting on May 15, 2015; however, this was deferred to provide time for Central Frontenac Township’s input, as the CF CAO and/or CF FC were not present when the County FCs and PWMs met to discuss and revise the attached Report to the CAOs. Due to ongoing staff changes the FCs and PWMs have not been able to meet again.

On June 23, 2015 Frontenac Islands Township Joint Fire Committee met to discuss the need for a Gap Analysis Study. The Committee strongly supported the further exploration and discussion of the challenges of the Emergency Services and Public Works communications throughout the County by requesting that a Study be conducted to identity the types of infrastructure and equipment requirements that could establish an effective and efficient communications system to safeguard the health and safety of County residents. On July 13th Frontenac Islands Council passed a Resolution supporting the County of Frontenac undertake a “Gap Analysis Study” to identify infrastructure and equipment requirements necessary to establish a County Wide Communications System and that such Study be funded by the County of Frontenac.

COMMENTS The Frontenac CAOs support the FCs and PWMs in recommending the next step being a “Gap Analysis Study” report.

It is proposed that the draft Terms of Reference (TOR) for the Request for Proposal (RFP) will include - Reporting to the Frontenac County Chief Administrative Officers, the Consultant will: - Review Glentel and GlobeConsult Reports and provide comment; - Meet with Fire Chiefs and PW Public Works Managers (PMWs), as a group, to assess issues and concerns; - Meet with Fire Chiefs and PWMs individually to review local gaps; - Meet with current Service Provider(s) to assess current state of operations; - Meet with OPP Communications to determine interoperability options; - Meet with Kingston Communications Centre to determine interoperability options; - Meet with Regional Network (EORN) to determine how/if EORN efforts can assist; - Conduct "field" evaluations as required; - Prepare a business case. Identify options, risks and costs, including "do nothing" option; - Investigate grant options; - Provide recommendation(s), including timing and project management options; - Provide draft to CAOs/Fire Chiefs/PWMs for review and comment; - Present final report to a combined Council meeting (all four municipal councils).

FINANCIAL IMPLICATIONS Estimated cost for an Infield Communications – Gap Analysis Study is unknown at this time; however, it is estimated to be between $25,000 to $35,000 and it is proposed that the Report be included in the County of Frontenac budget for completion in 2016.

A. RECOMMENDATION

THAT Council of the Township of Central Frontenac authorize the Mayor and Clerk to sign a Shared Services Agreement with the County of Frontenac and the other Frontenac lower tier municipalities for the provisions of joint IT and GIS services.

B. BACKGROUND/ INFORMATION

In April 2015, the Frontenac CAO’s prepared and presented a report to each of their respective councils on a shared services model. Information Technology and GIS Services was one area to be examined.

Central Frontenac is unique in that we already have a qualified combined IT Manager / GIS Technician and 911 coordinator in house which has met our needs for a number of years, while, the other lower tier municipalities have either contracted out this service or in North Frontenac’s case they did provide it in house but that individual has moved on.

Frontenac CAO’s have been evaluating options that will address similar needs throughout the County.

The CAO’s are proposing that the County become the service provider for the four local municipalities. In making such a proposal the four lower tier municipalities recognize that the County should not bear any incremental cost to provide for this service.

A shared service model has been developed that sees the cost of incremental staff being shared between the four townships based on the equipment that has to be maintained and the number of land parcels.

These incremental staff (1 GIS and 2 IT positions) would be housed in the local Township offices and provide services to the Townships with the benefit of back up services from across the entire shared service model. This system will see the benefits of a comprehensive management approach to IT and GIS services.

Cost savings yet to be determined but it is anticipated that efficiencies and costs savings will be achieved by harmonizing policies and hardware/software platform where practicable and feasible.

C. FINANCIAL IMPLICATIONS

During the remainder of 2015 we will continue to have our own in house IT Manager /GIS Technician /911 coordinator while this model is being developed. Beginning in 2016, if approved, the new model would be in place and would be fully funded with the current allocation.

I am writing Council to ask for permission to film inside the Soldiers Memorial Hall in Sharbot Lake for a Remembrance Day project.

For a second year in a row we are marking Remembrance Day with a special video project that follows the story of one solider of the First World War. This year, we have selected to tell the story of Private E. Badour, 20th Battalion, who was from Sharbot Lake. He was killed during the Battle of Passchendaele in 1917 and has no known grave. His name is listed in your Memorial Hall.

We are still making plans about how and when to film in Sharbot Lake but we would ask for permission to film in the Hall and for you to waive any rental fees involved.

We would be happy to make the final version available to the Township after it is completed. You can find last year’s project online at www.RememberKFLA.ca.

Proposal Applications have been submitted for a site-specific Official Plan Amendment and Zoning By-law amendment to facilitate the creation of two new lots at 1091 Gold Russ Lane from an existing 9.7 hectare (24 acre) property.

Background The subject land is located on west side of Hungry Lake, east of Henderson. The surrounding area generally consists of seasonal waterfront development and public lands. The subject property is approximately 9.7 hectares (24 acres) and contains an existing cottage and accessory structures. The lands are wooded with a high rocky areas at the southern portion of the lot. The retained lot and one of the severed lots has frontage on Hungry Lake and Dead Creek. A large portion of the frontage is wetland area, similar to other lots on the south side of Hungry Lake. The property has frontage on Gold Russ Land and Grey Rock Lane goes through the property. Map 1 illustrates the location of the property.

The purpose and effect of the Official Plan and Zoning By-law amendments is to:  redesignate the parcel from Rural District to Waterfront District and;  rezone a portion of the parcel from Environmental Protection to Waterfront Residential

The proposed consents would create the following lots:  Severed Lot 1: 3.5 hectares (8.6 acres), non-waterfront lot with 130 metres road frontage on Gold Russ Lane and 260 metres frontage on Grey Rock Lane;  Severed Lot 2: 2.6 hectares (6.4 acres), vacant waterfront lot with 120 metres water frontage and a right-of-way over Grey Rock Lane in favour of Lot 1 and;  Retained Lot: 3.6 hectares (8.9 acres), with existing waterfront dwelling and 280 metres water frontage.

Provincial Policy Statement (2014) The 2014 Provincial Policy Statement (PPS) provides direction on matters of Provincial interest related to land use planning and development. It promotes efficient land use and development patterns that support strong, liveable and healthy communities, protect the environment and public health and safety, and facilitate economic growth.

Section 1.1.5.2 b) and c) of the PPS permits resource-based recreational uses (including recreational dwellings) and limited residential development in rural lands in Ontario municipalities and in 1.1.5.4 promotes development that is compatible with the rural landscape and can be sustained by rural service levels. The applications represent a resource-based recreational use and would be in an appropriate Official Plan designation for this purpose.

The proposed development is within the Hungry Lake Barrens Provincially Significant Area of Natural and Scientific Interest (Life Science), which is noted for exposed rock barrens, bedrock ridges, and narrow wetland areas. Section 2.1.5 of the PPS states that development (including the creation of a lot) and site alteration shall not be permitted in significant areas of natural and scientific interest, unless it has been demonstrated that there will be no negative impacts on the natural features or their ecological functions. An EIS has been submitted and was reviewed by Quinte Conservation, who had no objection to the proposed applications.

An archaeological assessment has also been prepared to support the proposed development. No evidence of archaeological sites was identified.

The development proposal to create two new waterfront lots is consistent with the Provincial Policy Statement (2014).

Official Plan The subject property is designated as Rural District and Provincially Significant ANSI in the Official Plan. The Official Plan amendment application would redesignate the lands to Waterfront District.

Section 3.6.3 of the plan contains the policies on development in the Waterfront District, which are focused on shoreline protection and lake management. The requirements of the zoning by- law and Quinte Conservation Authority will ensure shoreline protection is maintained on the proposed vacant lot. The proposed lot has a sufficient building area for a dwelling and septic outside of the 30 metre setback and ribbon of life as required in the Official Plan.

Section 10.11.13 B includes special policies Council should have regard for when evaluating consent applications, including the need for impact studies for development in or adjacent to natural heritage features. Section 7.5.2.4 of the Plan states that it is the policy of Council to protect Hungry Lake Barrens, and development is only permitted if it has been demonstrated through the preparation of an Impact Assessment that there will be no negative impacts on the natural features or on the ecological functions for which the area is identified.

The proposed consent was supported by an environmental impact study that was reviewed by Quinte Conservation Authority. The proposed conditions of development in the EIS should be incorporated into a development agreement as a condition of the proposed consent.

The proposed development conforms to the Township of Central Frontenac Official Plan.

Zoning The subject property is currently zoned as Environmental Protection in the Township’s Zoning By-law, which permits limited Conservation and Forestry Uses. The area with the existing dwelling is also zoned Waterfront Residential. The proposed retained and severed lots are able to meet the performance standards in the Zoning By-law for the proposed Residential Waterfront rezoning.

The following recommendations from the EIS would be recommended to be implemented through a development agreement registered on title as a condition of consent.

 No development shall be permitted until a site plan agreement has been entered into and registered against title to the lands.  No timber cutting shall be permitted except to accommodate the footprint of the building.  No building envelope shall be built or situated on exposed rock ridges.  No building envelope shall be constructed on a slope of greater than 10%.  All development must be set back a minimum distance of 30 m from the edge of the wetland associated with Dead Creek and Hungry Lake, and no cutting or removal of trees and/or disturbance of the soil mantle shall be permitted within that setback area.  All development must be set back a minimum distance of 30 m from the high water level of Hungry Lake.  No docks shall be permitted within the wetland associated with Dead Creek.

Comments As of September 2, 2015 no public comments had been received as part of the circulation of these development applications. The applications have been circulated to the Ministry of Municipal Affairs and Housing, which is the approval authority for the Official Plan Amendment. The Ministry responded to the notice by requesting additional time to provide comments after the public meeting. Quinte Conservation reviewed the applications and EIS and had no objection to the proposed development.

Pre-consultation The applicant pre-consulted with Township and County staff prior to submitting the applications.

Conclusion As of the writing of this report, no issues had been identified as part of the circulation process. Subject to review by MMAH, and any issues raised at the public meeting, the proposed development is consistent with the Provincial Policy Statement, conforms to the intent of the Official Plan for the Waterfront District, and would facilitate the proposed consents.

It is recommended that Township Council: 1. Receive public comments at the public meeting 2. Defer any decision on the proposed Official Plan Amendment and Zoning By-law until comments are received from the Ministry of Municipal Affairs and Housing

Proposal An application has been submitted proposing to rezone lands at 1694 Brewer Road as a condition of consent application B-03-15-OL, which was approved by the Committee of Adjustment on July 16, 2015.

Background The applicant has received provision consent to sever approximately 1.0 hectare (2.5 acres) portion of an existing lot legally described as Lot 11-12, Concession 9, in the geographic township of Olden. The existing lot is occupied by a small cottage fronting on the west basin of Sharbot Lake while the retained lot is vacant. The western portion of the property slopes to the southeast away from Sharbot Lake, while the eastern portion, slopes towards a wetland area, the lake and an adjacent road allowance. The existing dwelling is on higher ground on the northern part of the property, part of a cluster of cottage development along the shoreline. A condition of the provisionally approved consent application B-03-15-OL was to rezone the retained lands to recognize a reduced distance for the septic system from Sharbot Lake.

Provincial Policy Statement (2014) The 2014 Provincial Policy Statement (PPS) provides direction on matters of Provincial interest related to land use planning and development. It promotes efficient land use and development patterns that support strong, liveable and healthy communities, protect the environment and public health and safety, and facilitate economic growth.

Section 1.1.5.2 b) and c) of the PPS permits resource-based recreational uses (including recreational dwellings) and limited residential development in rural lands in Ontario municipalities and in 1.1.5.4 promotes development that is compatible with the rural landscape and can be

sustained by rural service levels. This rural severance represents a limited residential development located near a major rural road which not would require an increase in rural service levels.

Furthermore, Section 2.1.8 states that development and site alteration shall not be permitted adjacent to fish habitat unless the ecological function of the adjacent lands has been evaluated and it has been demonstrated that there will be no negative impacts on the natural features or on their ecological functions. The application is adjacent to a sensitive lake trout lake, but the impacts have been reviewed by the Ministry of the Environment and Climate Change (MOECC), which did not object as the proposed severance met their policies for allowing new lots adjacent to these lakes.

The proposed rezoning is consistent with the Provincial Policy Statement (2014).

Official Plan The subject property is designated as Rural Area and Waterfront District in the Official Plan. Section 3.6.1 of the plan states that the plan provides for a supply of land for rural residential use and makes provision for other rural uses typically found in an area.

Section 3.6.3 recognizes that it is imperative for the Township to protect Lake Trout Lakes due to its sensitive nature and high value to our fishery industry. Section 3.6.3.3. B identifies that Silver Lake, Crow Lake, Eagle Lake and the West Basin of Sharbot Lake are considered to be At- Capacity. For this reason, the creation of new lots, either by severance or by plan of subdivision, that are within 300 m (984 ft) the highwater mark of these lakes, or their tributaries, shall be prohibited, except where one or more of the following conditions occur:

 There’s a setback of at least 300 metres from the shoreline of the lake or such that drainage from the tile fields would flow at least 300 metres to the lake.  The tile fields on each new lot are located such that they would drain into the drainage basin of another waterbody, which is not at capacity.  To separate existing, habitable dwellings which were included in the original capacity calculation, each having a separate sewage disposal system, provided that the land use would not change.  The proposed new use, has a scale and density that is less than currently exists on site, and shall demonstrate a net reduction of the phosphorous loading on the lake. Prior to any redevelopment being approved, the Environmental Impact Study (EIS) shall be completed to the satisfaction of the municipality, the Ministry of Natural Resources and the Ministry of the Environment. The Environmental Impact Study (EIS) shall, among other things, provide recommendations on implementation tools related to hydro-geology, soils and vegetation matters on site.

Overall, the proposal meets the first two conditions as the tile fields drain away from the west basin of Sharbot Lake into another drainage basin, and the distance of the flow would be over 300 metres to the west basin of Sharbot Lake via this other drainage basin. In order to secure the septic system location, a rezoning is required.

The proposed rezoning conforms to the Township of Central Frontenac Official Plan.

Zoning By-law The subject property is zoned as Rural (R) and Waterfront Residential (RW) in the Township’s Zoning By-law, which permit a variety of dwelling types and other uses in the Rural Zone. The location of the existing cottage was approved through a previous minor variance. The proposed lot dimensions meet the other performance standards in the Zoning By-law. Since the retained lot would not be a lot of record under Section 4.36 of the by-law, a rezoning is required to

reduce the minimum setback of the sewage system in accordance with the proposed location endorsed by the MOECC. The proposed by-law would rezone the portion of the severed lot zoned Rural to Waterfront Residential, along with a Waterfront Residential Exception Zone for the retained lands to allow a septic system within 300 metres of the west basin of Sharbot Lake in accordance with the development agreement to be registered on title.

Comments The Ministry of the Environment and Climate Change (MOECC) provided an analysis of the proposal based on the criteria for allowing severance on at-capacity lake trout lakes. MOECC has no objection to the original severance application if the subsurface sewage system is installed at the envelope proposed because: 1) the envelope designated for the septic tile field drains away from the west basin of Sharbot Lake to another drainage basin 2) The distance of the flow would be over 300 m to the west basin of Sharbot Lake via another drainage basin

KFLA Public Health and Mississippi Valley Conservation Authority had no objection to the severance and did not provide additional comments for the rezoning.

Several public comments were originally received with objections to the proposed severance, relating to an access strip to the water. The access strip was later removed by the applicant. Other objections included that the lands would be used for camp sites. The lot currently permits a campground under the standard Rural Zone, among other uses, however any commercial use would be subject to site plan control and would be limited given the site-specific limitations on septic systems within 300 metres of the lake, and wetland areas on the property. Rezoning the lands from Rural to Waterfront Residential would potentially remove some of these currently permitted commercial uses, and recognize that part of the lot slopes towards Sharbot Lake. No additional public comments were received as of September 1, 2015.

Pre-consultation The applicant pre-consulted with Township and County staff prior to submitting the application. Site visits were undertaken on May 4 and June 5, 2015.

Conclusion The proposed rezoning is consistent with the Provincial Policy Statement (2014), and conforms to the Township of Central Frontenac Official Plan.

It is recommended that the Committee approve rezoning application ZB-03-15, subject to addressing any additional comments received at the public meeting.

THE CORPORATION OF THE TOWNSHIP OF CENTRAL FRONTENAC By-law No. 2015-XX

BEING A BY-LAW TO AMEND BY-LAW NO. 2011-52 AS AMENDED

WHEREAS pursuant to the provisions of the Section 34 of the Planning Act, RSO 1990, the Council of a Municipality may enact by-laws regulating the use of lands and the erection of buildings and structures thereon,

AND WHEREAS By-law No. 2011-52 regulates the use of land and the location, use and erection of buildings and structures within the Township of Central Frontenac;

NOW THEREFORE, the Council of the Corporation of the Township of Central Frontenac enacts as follows:

1. That Schedule ‘A3’ to By-law No. 2011-52 is amended by changing the zoning of certain lands legally described as Part Lot 11 and 12, Concession 9, former Olden Township, Township of Central Frontenac shown on Schedule ‘A’ to this by-law, from the Rural (R) Zone to the Waterfront Residential Exception XX Zone and the Waterfront Residential Zone

2. THAT the text of By-law No. 2011-52, as amended, is hereby amended by adding the following: Section 5.6.4 XX) RW-X___, Part Lot 11 and 12, Concession 9, Olden

On those lands identified as Waterfront Residential Exception XX Zone (RW-X__) the following provisions shall apply: a) Despite Section 4.36 of the by-law, a sewage disposal tile field or filter bed may be permitted within 300 m [984.4 ft.] of the high water mark of Sharbot Lake in accordance with the location identified in the development agreement registered on title on the subject lands. b) A maximum of one sewage disposal system and one dwelling unit is permitted

3. That all other provisions of By-law 2011-52 shall continue to apply.

BEING A BY-LAW TO CONFIRM THE SPECIAL COUNCIL MEETING AUGUST 25, 2015, AND THE REGULAR COUNCIL MEETING SEPTEMBER 8, 2015

The Council of the Corporation of the Township of Central Frontenac enacts as follows:

1. The action of the Council at its meeting held on the 25th of August, and the 8th of September, 2015 in respect of each report, motion, resolution or other action passed and taken by the Council at its meeting, is hereby adopted, ratified and confirmed.

2. The Mayor and the proper officers of the Corporation are hereby authorized and directed to do all things necessary to give effect to the said action, to obtain approvals where required, and, except where otherwise provided, to execute all documents necessary in that behalf in accordance with the by-laws of Council relating thereto.
