THE CITY AND COUNTY OF CARDIFF (CARDIFF SOUTH) (PARKING CONTROL) ORDER 2010
Made on: 24th June 2010 Coming into force on: 5 th July 2010
The County Council of the City and County of Cardiff in exercise of its powers under Sections 1, 2, 4, 45, 46, 47, 49 and 53 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (hereinafter referred to as “the Act of
1984”) and Part 6 of the Traffic Management Act 2004 (hereinafter referred to as “the Act of 2004”) and the Civil Enforcement of Parking Contraventions
(City and County of Cardiff) Designation Order 2010, and of all other enabling powers and after consultation with the Chief Officer of South Wales Police in accordance with Part III of Schedule 9 to the Act of 1984 hereby makes the following Order (hereinafter referred to as “this Order”).
PART I – PRELIMINARY.
1. Definitions.
In this Order the following expressions shall have the meaning hereby respectively assigned to them:
“the 2000 Regulations” means the Disabled Persons (Badges for Motor Vehicles) (Wales) Regulations 2000; “the 2002 Regulations” means the Traffic Signs Regulations and General Directions 2002; “Ambulance” has the same meaning as Schedule 2 Art. 6 (2) to the Vehicle Excise and Registration Act 1994; “Applicant” means an applicant for a Permit; “Applicant’s Residence” means the address at which the Applicant resides;
1 “Carriageway” has the same meaning as in section 329(1) of the Highways Act 1980; “Civil Enforcement Officer” has the same meaning as in section 76 of the Act of 2004 and means a person authorised by or on behalf of the Council to supervise and enforce the restrictions and prohibitions imposed by this Order; “Clearway” means an area of Carriageway indicated by the relevant diagram to the 2002 Regulations and also defined as “Clearway during prescribed hours” by the Legend to Schedule 1 and also defined as a “Clearway” by Schedule 4 to this Order; “the Council” means the County Council of the City and County of Cardiff, or its successor authority; “Disabled Person” means a disabled person of a description prescribed by Regulation 4 of the 2000 Regulations as amended; “Disabled Person’s Badge” has the same meaning section 142 (1) of The Act of 1984; “Disabled Person’s Parking Place” means an area of Carriageway defined in the Legend to Schedule 1 as “Disabled” and also defined as a “Disabled Person’s Parking Place” in Schedule 11 to this Order; “Doctor” all references to this term shall have the same meaning as the term “Legally Qualified Medical Practitioner” which is defined in Schedule 6 Para. 11 (1) to the Medical Act 1983; “Doctors Parking Permit” means a Permit issued in accordance with the provisions of Article 53 C of this Order; “Doctors Vehicle” means a Vehicle habitually used by a Doctor for his professional practice; “Driver” in relation to a Vehicle waiting in a Parking Place means the person driving the Vehicle at the time it was left in the Parking Place; "Duly Authorised Person" for the purposes of the supervision and enforcement of the provisions of this Order means a police officer in uniform or a Civil Enforcement Officer or any other person expressly authorised to act on behalf of the Council; “Electronic Communications Apparatus” has the same meaning as in the Schedule 2 Para. 1 (1) to the Telecommunications Act 1984; “Enactment” means any Enactment whether public, general or local and includes any order, byelaw, rule, regulation, scheme or other instrument having effect by virtue of an Enactment; "Goods" means any article not easily carried by hand and includes Postal Packets of any description; “Goods Vehicle” means a Vehicle which is constructed or adapted for use for the carriage of goods or burden of any description and is not drawing a Trailer; "Hackney Carriage" has the same meaning as in section 38 of the Town Police Clauses Act 1847;
2 “Invalid Carriage” has the same meaning as in section 136 (5) of the Act of 1984; “Label” means the textual information associated with a restriction in Schedule 1 that is joined to that restriction by a dashed line; “Legend” means the area in Schedule 1 that details the shading types used to represent the restrictions of this Order; “Limited Waiting Parking Place” means an area of Carriageway defined by the Legend in Schedule 1 to this Order as “Limited waiting” and also defined as a “Limited Waiting Parking Place” in Schedule 7 to this Order; “Loading Bay” means an area of Carriageway indicated by the relevant diagram to the 2002 Regulations and also defined as “Loading” by the Legend in Schedule 1 to this Order and defined as a “Loading Bay” in Schedule 6 to this Order; “Loading Restriction” means an area of Carriageway indicated by the relevant diagram to the 2002 Regulations and also defined as a “Loading and Unloading Restriction” by Schedule 3 to this Order and as either: “No loading at any time” or “No loading during prescribed hours”, “No waiting at any time and no loading at any time”, “No waiting at any time and no loading during prescribed hours”, or “No waiting or loading during prescribed hours” by the Legend in Schedule 1 to this Order; “Maximum duration of stay” means the period specified in the Label for that particular restriction in Schedule 1 and also so specified in Column 6 of Schedules 6, 7, 9, and 10; “Minimum period before returning” means the period specified in the Label for that particular restriction in Schedule 1 and also so specified in Column 7 of Schedules 6, 7, 9 and 10. “Motorcycle” has the same meaning as in section 136 (4) of the Act of 1984; “Owner” in relation to a Vehicle, has the same meaning as in section 92 of the Act of 2004; “Parking Charge” means the charge for parking in a Pay and Display Parking Place; “Parking Disc” has the same meaning as Art. 8 (5) to the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (Wales) Regulations 2000; “Parking Place” means the part of the carriageway designated by this Order to be used as a parking place of a type as defined in the Legend to Schedule 1 as either: “Limited waiting”, “Resident”, “Shared use”, “Pay and display”, “Disabled”, “Ambulance”, “Doctor”, “Police”, or “Taxi rank”, and also respectively defined in Schedules 7, 8, 9, 10, 11, 12 and 13 to this Order as a “Limited Waiting Parking Place” a “Residents Parking Place”; a “Shared Use Parking Place”; a “Pay and Display Parking Place”; a “Disabled Person’s Parking Place”; a “Special Parking Place (Ambulance)”; a “Special parking Place (Doctors)”; a “Special Parking Place (Police)”; or a “Taxi Rank”. “Passenger Vehicle” means a Vehicle (other than a motorcycle or an invalid carriage) constructed or adapted solely for the carriage of not more than eight
3 passengers (exclusive of the driver) and their effects and not drawing a Trailer; “Penalty Charge” has the same meaning as in section 92 of The Act of 2004; “Penalty Charge Notice” means a notice issued or served by a Civil Enforcement Officer pursuant to the provisions of section 78 and 92 of The Act of 2004; “Permit” without more means a parking permit issued under the provisions of Article 53; “Permit Holder” without more means a person to whom a Permit has been issued under the provisions of Article 53; “Permitted Hours” in relation to a Parking Place means the period specified in the Label in Schedule 1 and as also specified in Column 5 of Schedules 6, 7, 8 9, 10, 11, 12, 13 and Column 4 of Schedule 14; “Police Vehicle” means any Vehicle habitually used by police constables in connection with the execution of their duties; “Postal Packet” has the same meaning as ‘relevant postal packet’ in section 4 (7) of the Postal Services Act 2000; “Prescribed Hours” in relation to a Waiting Restriction, Loading Restriction, Clearway, or School Keep Clear Marking means the period specified in the Label in Schedule 1 and also specified in Column 4 of Schedules 2, 3, 4 and 5. “Professional Health Carer” shall be construed to cover members of those professions which are mentioned in section 60 (2) of the Health Act 1999, and as such shall include those persons to whom the designation “Doctor” applies for the purposes of this Order; “Public Holiday ” means Christmas Day, Good Friday or any day which is designated a bank holiday in Wales under Schedule 1 para. 1 The Banking and Financial Dealings Act 1971, subject to the process provided for in section 1 of the same act; “Public Service Vehicle” means a Vehicle as defined in section 1 (1) (a) or (b) of the Public Passenger Vehicles Act 1981; “Relevant Position” in relation to Permit to be displayed on a Vehicle means the Permit or badge is exhibited in a conspicuous position so that all the particulars are clearly visible in the front or near side of the Vehicle; “Resident” means in relation to a Parking Place any person who is able to satisfy the Council that he does not possess the facility of off street parking and that his usual residence is at premises fronting a length of Road specified in Schedule 8 to this Order subject to the additional permissions in Schedule 17 of this Order, save that a person residing in a property excluded by Schedule 17 shall not for these purposes be a Resident. The expression “off street parking” includes any area situated within the curtilage of a dwelling house or otherwise which does not form part of the adopted highway and is used for the purpose of parking a Vehicle;
4 “Residents Parking Permit” means a Permit issued in accordance with the provisions of Article 53 (A) of this Order; “Residents Parking Place” means an area defined in the Legend to Schedule 1 as “Resident” and also defined as a “Residents Parking Place” in Schedule 8 to this Order; “Road” has the same meaning as in section 142 (1) of The Act of 1984; "Schedule" followed by a number without more means a schedule to this Order; “Schedule 1” means the map schedules to this Order; “School Keep Clear Marking” means the part of the Carriageway indicated by the relevant diagram to the 2002 Regulations and also defined as “School keep clear during prescribed hours” in the Legend in Schedule 1 to this Order and defined as “School Keep Clear” in Schedule 5 to this Order; “Shared Use Parking Place” means an area defined in the Legend to Schedule 1 to this Order as “Shared use” and also defined as a “Shared Use Parking Place” in Column 2 of Schedule 9 of this Order. “Special Parking Place (Doctors)” means an area defined in the Legend to Schedule 1 to this Order as “Doctor”, and also so defined in Column 6 of Schedule 12 of this Order ; “Special Parking Place (Police)” means an area defined in the Legend to Schedule 1 to this Order as “Police”, and also so defined in Column 6 of Schedule 12 of this Order; “Special Parking Place (Ambulance)” means an area defined in the Legend to Schedule 1 to this Order as “Ambulance”, and also so defined in Column 6 of Schedule 12 of this Order; “Special Parking Place (Public Service Vehicles)” means an area specified in the Label to Schedule 1 to this Order as “Coach Parking”; “Surrender” means sending the relevant document within a stamped addressed envelope complete with the correct value of postage to: Highways and Waste Management Cardiff County Council County Hall Atlantic Wharf Cardiff CF10 4UW; “Suspended” in relation to a Parking Place means Suspended in accordance with Article 66 of this Order or in the case of a Loading Bay, Article 19 of this Order. “Tariff”, means the applicable Tariff for the Tariff Code “A” or “B” in Column 8 of Schedule 10 as specified by Column 2 of Schedule 16.
5 “Tariff Code” means the code “A” or “B” in Column 8 of Schedule 10 and Column 3 of Schedule 16; “Taxi Rank” means an area defined in the Legend to Schedule 1 to this Order as “Taxi Rank”, and also so defined in Schedule 13; “Ticket” means a ticket purchased from a Ticket Issuing Machine; “Ticket Issuing Machine” means an apparatus or device of a type approved in accordance with section 35 (3) of the Act of 1984; “Traffic Sign” means a sign of any size colour and type prescribed or authorised under or having effect as though prescribed or authorised under section 64 of The Act of 1984; “Trailer” means a wheeled carriage drawn by a Vehicle so constructed or adapted that the overall height of which does not exceed 2.44 metres and the overall length of which does not exceed 5.49 metres and has a current Vehicle Excise License and is insured for use on the highway; “Vehicle” means a mechanically propelled Vehicle intended or adapted for use on the Roads; “Visitors Parking Permit” means a Permit issued in accordance with the provisions of Article 53 (B) of this Order; “Waiting Restriction” means an area of Carriageway indicated by the relevant diagram to The 2002 Regulations and also defined as a “Waiting Restriction” in Schedule 2 to this Order and defined in the Legend to Schedule 1 as either: “No waiting at any time and no loading at any time”; “No waiting at any time and no loading during prescribed hours”; “No waiting during prescribed hours”; “No waiting or loading during prescribed hours” or “No waiting at any time”. “Written Notice” shall be deemed to occur on the second day after posted by first class post to the Permit Holder at the address shown by that person on the application for the Permit or at any address believed to be that person’s abode provided that day is a business day or if not, the next business day after that day. “Zone” means collectively the lengths of Road designated as Parking Places by Schedule 14 to this Order; (B) The restrictions imposed by this Order are as defined in Schedules 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13 and 14. In the event that the details of Schedules 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 , 13 and 14 contradict or render ambiguous those defined in Schedule 1, then the restrictions as defined in Schedule 1 shall be deemed to be the correct and definitive restrictions.
PART II – GENERAL.
2. General.
(A) Except as provided by this Order the restrictions imposed by this Order shall be in addition to and not in derogation of any restrictions or requirements
6 imposed by any Regulations made or having effect as if made under the Act of 1984, the Act of 2004 or by or under any other Enactment.
(B) Where an Act of Parliament referred to in this Order or any Regulation Direction or Order made under it is repealed and new provisions enacted (with or without modifications) then the new provisions shall be substituted in this Order where relevant.
(C) The Interpretation Act 1978 shall apply to this Order as it applies to an Act of Parliament.
(D)If any provision of this Order is held invalid or unenforceable for any reason by a court of competent jurisdiction such provision shall be severed and the remainder of the provisions of the Order shall continue in full force and effect as if the Order had been executed with the invalid illegal or unenforceable provision eliminated.
(E) The Orders in Schedule 18 are revoked and consolidated within the Order without any change of substance pursuant to Regulation 21 of the Local Authorities’ (Traffic Orders) (England and Wales) Regulations 1996 in so far as they relate to parking contraventions within the meaning of section 73 (2) (a) of and Part 1 of Schedule 7 to the 2004 Act.
PART III – WAITING RESTRICTIONS.
3. The Designation of Waiting Restrictions.
Any length of Road defined in Schedule 1 by the Legend as “No waiting at any time and no loading at any time”, “No waiting at any time and no loading during prescribed hours”, “No waiting during prescribed hours”, “No waiting or loading during prescribed hours” or “No waiting at any time” and also as defined in Schedule 2 as a “Waiting Restriction” is hereby designated as a Waiting Restriction.
4. Prescribed Hours of Operation of Waiting Restrictions.
The Prescribed Hours of operation of Waiting Restrictions shall be as specified in the Label for that particular restriction and also as specified in Column 4 of Schedule 2.
5. Waiting.
Save as provided in Articles 6, 60 and 62 of this Order no person shall, except upon the direction of or with the permission of a police officer in uniform or a
7 Civil Enforcement Officer, cause or permit any Vehicle to wait on any length of Road designated as a Waiting Restriction: (A) the Prescribed Hours of which are specified in the Label as no waiting “at any time”; and also so specified in Schedule 2; (B) during the Prescribed Hours, the extent of which are specified in the Label and also so specified in Schedule 2.
6. Waiting Exemptions. Nothing in Article 5 of this Order shall prohibit any person from causing or permitting any Vehicle to wait: (A) to enable a person to board or alight from a Vehicle; or (B) to enable a Vehicle to wait provided the Vehicle is being used to load or unload in connection with the removal from or delivery to adjacent premises of Goods and/or furniture.
PART IV – LOADING RESTRICTIONS.
7. The Designation of Loading Restrictions.
Any length of Road defined in by the Legend as “No waiting at any time and no loading at any time”, “No waiting at any time and no loading during prescribed hours”, “No loading during prescribed hours”, “No waiting or loading during prescribed hours” or “No loading at any time” and also as defined in Schedule 3 as a “Loading and Unloading Restriction” is hereby designated as a Loading Restriction.
8. Prescribed Hours of Operation of Loading Restrictions.
The Prescribed Hours of operation of Loading Restrictions shall be as specified in the Label for that particular restriction and also as specified in Column 4 of Schedule 3.
9. Loading and Unloading.
Save as provided in Article 60 of this Order no person shall, except upon the direction of or with the permission of a police officer in uniform or a Civil Enforcement Officer, cause or permit any Vehicle to wait: (A) on any length of Road the Prescribed Hours of which are specified in the Label as no loading “at any time” and also so specified in Column 4 of Schedule 3;
8 (B) on any length of Road during its Prescribed Hours, the extent of which are specified in the Label and also so specified in Column 4 of Schedule 3.
PART V – CLEARWAYS.
10. The Designation of Clearways. Any length of Road defined by the Legend as a “Clearway during prescribed hours” and also defined as “Clearway” in Schedule 4 is hereby designated as a Clearway.
11. Prescribed Hours of Clearways. The Prescribed Hours of Clearways shall be as specified in the Label for that particular restriction and also as specified in Column 4 of Schedule 4.
12. Clearways. Save as provided in Article 60 of this Order no person shall, except upon the direction of or with the permission of a police officer in uniform or a Civil Enforcement Officer, cause or permit any Vehicle to stop: (A) on any length of Road the Prescribed Hours of which are specified in the Label as a Clearway “at any time” and also so specified in Column 4 of Schedule 4; (B) on any length of Road during its Prescribed Hours the extent of which are specified by the Label and also so specified in Column 4 of Schedule 4.
PART VI – SCHOOL KEEP CLEAR MARKINGS.
13. The Designation of School Keep Clear Markings.
Any length of Road defined by the Legend as a “School keep clear marking during prescribed hours” and as defined in Schedule 5 as a “School Keep Clear Marking” is hereby designated as a School Keep Clear Marking.
14. Prescribed Hours of School Keep Clear Markings. (A) The Prescribed Hours of operation of School Keep Clear Markings shall be as specified in the Label for that particular restriction and also as specified in Column 4 of Schedule 5.
9 15. School Keep Clear Markings. Save as provided in Article 60 of this Order, no person shall, except upon the direction of or with the permission of a police officer in uniform or a Civil Enforcement Officer, cause or permit any Vehicle to stop during the Prescribed Hours on any length of Road designated as a School Keep Clear Marking.
PART VII – LOADING BAYS.
16. The Designation of Loading Bays.
Any length of Road defined by the Legend as “Loading” and also defined in Schedule 6 as a “Loading Bay” is hereby designated as a Loading Bay.
17. Permitted Hours of Operation of Loading Bays.
(A) The Permitted Hours of operation of Loading Bays shall be as specified in the Label for that particular restriction and also as specified in Column 5 of Schedule 6.
(B)Save as provided in Article 60 of this Order, no person shall, except upon the direction of or with the permission of a police officer in uniform or a Civil Enforcement Officer, cause or permit any Vehicle to wait during the Permitted Hours on any length of Road designated as a Loading Bay, except in the case of a Goods Vehicle from which Goods are being continuously loaded and/or unloaded or are being delivered to and/or collected from adjacent premises.
Use of a Loading Bay.
18. Manner of standing in a Loading Bay.
The Driver of a Vehicle waiting in a Loading Bay in accordance with the foregoing provisions of this Order shall ensure that every part of the Vehicle stands within the limits of the same Loading Bay.
19. Power to suspend the use of a Loading Bay.
(A)Any Duly Authorised Person may suspend the use of a Loading Bay or any part thereof whenever it is considered such suspension is reasonably necessary: (i) for the purpose of facilitating the movement of traffic or promoting its safety; (ii) for the convenience of the occupiers of premises adjacent to the Loading Bay on any occasion of the removal from or delivery to such premises of furniture;
10 (iii) for the convenience of occupiers of premises adjacent to the Loading Bay at times of weddings or funerals or on other such occasions; (iv) for the convenience of occupiers of adjacent premises for parking the official Vehicles (provided that there are no more than three) being at that time in use in connection with a wedding taking place that day comprising only the Vehicles to transport the bride and/or the bridegroom and/or the bridesmaids to the place of the marriage ceremony on the wedding day; (v) for the purpose of facilitating any building operation demolition or excavation adjacent to the Loading Bay; (vi) for the maintenance or reconstruction of the Loading Bay; (vii) for the laying, erection, alteration or repair in or adjacent to the Loading Bay of any sewer or of any main pipe or apparatus for the supply of gas water or electricity or of any Electronic Communications Apparatus; (viii) for the purpose of facilitating a Council supported event; (ix) on any occasion on which it is likely by reason of some special attraction that any Road will be thronged or obstructed.
(B) A Duly Authorised Person suspending the use of a Loading Bay or any parts thereof in accordance with the provisions of paragraph (A) of this Article shall thereupon place or cause to be placed in or adjacent to that place the use of which is Suspended a Traffic Sign indicating that waiting by Vehicles is prohibited in accordance with section 64 of the Act of 1984.
(C) No person shall cause or permit a Vehicle to be left in the Loading Bay or part thereof as the case may be during such period as there is in or adjacent to that place a Traffic Sign sited in pursuance of paragraph (B) of this Article.
PART VIII - PARKING PLACES.
Section 1 – Designation of Types of Parking Places and Provisions Relating to Parking Places.
20. Designation of a Limited Waiting Parking Place.
Any length of Road defined by the Legend as “Limited waiting” and also defined in Schedule 7 to this Order as a “Limited Waiting Parking Place” is hereby designated as a Limited Waiting Parking Place.
21. Permitted Hours of Operation of a Limited Waiting Parking Place.
11 The Permitted Hours of operation of a Limited Waiting Parking Place shall be as specified in the Label for that particular restriction and also as specified in Column 5 of Schedule 7.
22. Vehicles for which Limited Waiting Parking Places are designated.
(A) A Limited Waiting Parking Place may only be used, subject to the provisions of this Order, for the leaving during the Permitted Hours of such Vehicles as are Passenger Vehicles, Goods Vehicles, Motorcycles or Invalid Carriages; (B) Provided that the use of that Parking Place or part of the Parking Place in which the Vehicle is left has not been Suspended.
23. Limited Waiting Parking Places.
Save as provided in Articles 58, 60 and 61 of this Order no person shall, except upon the direction of or with the permission of a police officer in uniform or a Civil Enforcement Officer, cause or permit any Vehicle to:
(A) wait on any length of Road outside of the period of Permitted Hours specified in the Label and also so specified in Column 5 of Schedule 7;
(B) wait on any length of Road for a period in excess of the Maximum duration of stay, the extent of which is specified in the Label for that particular restriction and also so specified in Column 6 of Schedule 7;
(C) return to wait at any length of Road before the elapse of the Minimum period before returning, the extent of which is specified in the Label for that particular restriction and also so specified in Column 7 of Schedule 7.
24. Designation of a Residents Parking Place.
Any length of Road defined by the Legend as “Resident” and also defined in Schedule 8 to this Order as a “Residents Parking Place” is hereby designated as a Residents Parking Place.
25. Permitted Hours of Operation of a Residents Parking Place.
The Permitted Hours of operation of a Residents Parking Place shall be as specified in the Label for that particular restriction and also as specified in Column 5 of Schedule 8 to this Order.
26. Vehicles for which Residents Parking Places are designated.
12 (A) Residents Parking Places may only be used, subject to the provisions of this Order, for the leaving during the Permitted Hours of such Vehicles as are Passenger Vehicles, Goods Vehicles or Trailers. (B) Provided that the use of that Parking Place or part of the Parking Place in which the Vehicle is left has not been Suspended.
27. Permits to be displayed on Vehicles left in Residents Parking Places. At all times during which a Vehicle is left in a Residents Parking Place during the Permitted Hours there shall be displayed in the Relevant Position on the said Vehicle either: a valid Residents Parking Permit or a valid Visitors Parking Permit.
28. Residents Parking Place Exemptions.
In the case of a Residents Parking Place nothing in Articles 26 or 27 of this Order shall prevent waiting by: (A) the official Vehicles (provided that there are no more than three) being at that time in use in connection with a wedding taking place that day comprising only the Vehicles to transport the bride and/or the bridegroom and/or the bridesmaids to the place of the marriage ceremony on the wedding day; (B) Vehicles being used for or in connection with building and/or maintenance works being performed in or upon any property adjacent to the Parking Place; or (C) a Motorcycle.
29. Designation of a Shared Use Parking Place.
Any length of Road defined by the Legend as “Shared use” and also as defined in Schedule 9 to this Order as a “Shared Use Parking Place” is hereby designated as a Shared Use Parking Place.
30. Permitted Hours Operation of a Shared Use Parking Place.
(A) The Permitted Hours of operation of a Shared Use Parking Place shall be as specified in the Label for that particular restriction and also as specified in Column 5 of Schedule 9. (B) The Maximum duration of stay for a Shared Use Parking Place shall be as specified in the Label for that particular restriction and also specified in Column 6 of Schedule 9. (C) The Minimum period before returning for a Shared Use Parking Place shall be as specified in the Label for that particular restriction and also specified in Column 7 of Schedule 9.
13 31. Use of Shared Use Parking Places. (A) No Vehicle shall wait in a Shared Use Parking Place during the Permitted Hours: (i) for a period of time in excess of the Maximum duration of stay and; (ii) having waited for a period of time up to or including the Maximum duration of stay and thereafter left the Shared Use Parking Place in question, return to wait in that Shared Use Parking Place before the expiry of the Minimum period before returning. (B) Nothing in paragraph (A) of this Article shall prevent waiting during the Permitted Hours by Vehicles displaying a valid Residents Parking Permit.
32. Designation of a Pay and Display Parking Place.
Any length of Road defined by the Legend as “Pay and display” and also defined in Schedule 10 as a “Pay and Display Parking Place” is hereby designated as a Pay and Display Parking Place.
33. Permitted Hours of Operation of a Pay and Display Parking Place.
The Permitted Hours of operation of a Pay and Display Parking Place shall be as specified in the Label for that particular restriction and also as specified in Column 5 of Schedule 10.
34. Vehicles for which Pay and Display Parking Places are designated.
(A) A Pay and Display Parking Place may only be used, subject to the provisions of this Order, for the leaving during the Permitted Hours of such Vehicles as are Passenger Vehicles, Goods Vehicles, Motorcycles or Invalid Carriages; (B) Provided that the use of that Parking Place or part of the Parking Place in which the Vehicle is left has not been Suspended.
35. Tickets to be displayed on Vehicles left in Pay and Display Parking Places. At all times during which a Vehicle is left in a Pay and Display Parking Place during the Permitted Hours a valid Ticket shall be displayed in the Relevant Position on the said Vehicle.
Pay and Display Operation.
36. Amount of Parking Charge, Maximum Stay Period and Return Time.
14 (A) The Parking Charge for a Vehicle in a Pay and Display Parking Place during its Permitted Hours shall, subject to provisions made hereafter, be as specified for that particular Pay and Display Parking Place by the Tariff. (B) The maximum length of time it is permissible to park in a Pay and Display Parking Place for the purposes of paragraph (A) of this Article shall be the Maximum duration of stay for the Pay and Display Parking Place as specified in the Label for that particular Pay and Display Parking Place and also specified in Column 6 of Schedule 10. (C) No Vehicle which, having displayed a Ticket, has been taken away from a specific Pay and Display Parking Place during the Permitted Hours shall be allowed to return to that Pay and Display Parking Place during the Permitted Hours, until the expiry of the Minimum period before returning as set out in the Label for that particular Pay and Display Parking Place and also as set out in Column 7 of Schedule 10.
37. Payment of the Parking Charge.
(A) The Parking Charge payable in a Pay and Display Parking Place where a Ticket Issuing Machine is installed shall be payable on the leaving of a Vehicle in the Pay and Display Parking Place by the insertion into the Ticket Issuing Machine of payment to the value of the relevant Parking Charge for the parking period for which payment is being made.
(B) Upon payment of the Parking Charge, the Driver shall display or cause to be displayed the Ticket issued by the Ticket Issuing Machine in the Relevant Position on the Vehicle for which the Ticket was issued.
(C) If there is cause for a Civil Enforcement Officer to display within any Pay and Display Parking Place a notice to indicate that the Ticket Issuing Machine relating to that Pay and Display Parking Place is out of order then that notice shall state the Maximum duration of stay permitted for that Pay and Display Parking Place. The extent of the Maximum duration of stay shall be, under these circumstances only, the longest Period in which a Vehicle may be left in the Pay and Display Parking Place without payment of any Parking Charge.
(D) If a Ticket Issuing Machine which was out of order is repaired during the Charging Hours then any Vehicle parked before the successful completion of the repair shall be exempt from charge provided that it is not parked for longer than the Maximum Duration of Stay permitted for that Pay and Display Parking Place.
(E) If a Ticket Issuing Machine is out of order then a Civil Enforcement Officer may, instead of placing a notice in accordance with paragraph (C) of this Article, place a notice nominating another Ticket Issuing Machine or machines
15 in the locality at which a Ticket may be obtained and that Ticket shall be valid for the purposes of this Article. If a Civil Enforcement Officer chooses to adopt this course of action then the provisions of paragraph (C) of this Article shall not apply.
38. Indications by Ticket Issuing Machines and Tickets.
(A) Subject to Article 59, payment of the Parking Charge specified in Article 37 (A) shall be demonstrated by the issue, by a Ticket Issuing Machine relating to that Pay and Display Parking Place, of a Ticket indicating: payment of the Parking Charge; the day and time at which the period for which payment was made will expire; and by the display of that Ticket on the Vehicle in the Relevant Position.
(B) Subject to Article 59, the expiry of the period for which the Parking Charge has been paid in respect of a Vehicle left in a Pay and Display Parking Place shall be indicated when there is displayed in the Relevant Position on the Vehicle a Ticket, and the precise time of day and date of expiry as shown on that Ticket has elapsed.
(C) The precise time of day and date shall be determined by reference to the clock of the Ticket Issuing Machine from which the Ticket in question was bought which shall be evidence of the same in any enforcement proceedings or any subsequent appeal.
(D) Subject to the provisions of Article 37, if at any time while a Vehicle is left in a Parking Place without a valid Ticket displayed in the Relevant Position on that Vehicle then it shall be presumed, unless the contrary is proved, that the relevant Parking Charge has not been paid.
(E) If it appears, unless the contrary is proved, in accordance with the provisions of this Article that the Parking Charge has not been duly paid, or that the period for which payment was made by the Parking Charge has already expired, then these indications shall be evidence that a contravention has occurred for the purposes of Article 67.
(F) Any Ticket issued by a Ticket Issuing Machine relating to a Pay and Display Parking Place referred to in Schedule 1 or Schedule 10 shall be presumed, unless the contrary is proved, to have been issued on the day and time shown thereon.
39. Restriction on the removal of Tickets.
16 Where a Ticket has been displayed on a Vehicle in accordance with the provisions of Article 35, no person except the Driver of the Vehicle shall remove the Ticket from the Vehicle unless authorised to do so by the Driver of the said Vehicle.
40. Designation of a Disabled Person’s Parking Place.
Any length of Road defined by the Legend as “Disabled” and also defined in Schedule 11 as a “Disabled Person’s Parking Place” is hereby designated as a Disabled Person’s Parking Place.
41. Permitted Hours of Operation of a Disabled Person’s Parking Place.
The Permitted Hours of operation of a Disabled Person’s Parking Place shall be as specified in the Label for that particular restriction and also as specified in Column 5 of Schedule 11.
42. Vehicles for which Disabled Person’s Parking Places are designated.
(A) A Disabled Person’s Parking Place may only be used, subject to the provisions of this Order, for the leaving during the Permitted Hours of such Vehicles as are Passenger Vehicles, Goods Vehicles, Motorcycles or Invalid Carriages;
(B) Provided that the use of that Parking Place or part of the Parking Place in which the Vehicle is left has not been Suspended.
43. Badges and Discs to be displayed on Vehicles left in Disabled Person’s Parking Places. At all times during which a Vehicle is left in a Disabled Person’s Parking Place, there shall be displayed in the Relevant Position on the said Vehicle a valid Disabled Person’s Badge and, if the Disabled Person’s Parking Place is time-limited, a Parking Disc.
44. Designation of a Special Parking Place.
(A) Any length of Road defined by the Legend as “Doctor”, “Police” or “Ambulance” and also defined in Schedule 12 as either: a Special Parking Place (Doctors); a Special Parking Place (Police); or a Special Parking Place (Ambulance) is hereby designated as a Special Parking Place; (B) Any restriction specified as ‘Coach Parking’ in the Label is hereby designated as a Special Parking Place (Public Service Vehicles).
17 45. Permitted Hours of Operation of a Special Parking Place.
The Permitted Hours of operation of a Special Parking Place shall be as specified in the Label for that particular restriction and also as specified in Column 5 of Schedule 12.
46. Vehicles for which Special Parking Places are designated.
(A) A Special Parking Place may only be used, subject to the provisions of this Order, for the leaving during the Permitted Hours of: (i) in the case of a Special Parking Place (Doctors) such Vehicles as are Doctors Vehicles; (ii) in the case of a Special Parking Place (Police) such Vehicles as are Police Vehicles; (iii) in the case of a Special Parking Place (Ambulance) such Vehicles as are Ambulances; (iv) in the case of a Special Parking Place (Public Service Vehicles) such Vehicles as are Public Service Vehicles. (B) Provided that the use of that Parking Place or part of the Parking Place in which the Vehicle is left has not been Suspended. (C)Except as provided by this Order no person shall except upon direction or with the permission of a police constable in uniform or a Civil Enforcement Officer cause or permit any Vehicle to wait at any time in a Special parking Place designated by this Order unless that Vehicle is of the relevant class designated in paragraph (A) of this Article for use of that type of Special Parking Place.
47. Permits to be displayed on Vehicles left in a Special Parking Place (Doctors). At all times during which a Vehicle is left in a Special Parking Place (Doctors) there shall be displayed in the Relevant Position on the said Vehicle a valid Doctors Parking Permit.
48. Designation of a Taxi Rank.
Any length of Road defined by the Legend and also as defined in Schedule 13 as a Taxi Rank is designated as a Taxi Rank.
49. Permitted Hours of Operation of a Taxi Rank.
18 The Permitted Hours of operation of a Taxi Rank shall be as specified in the Label for that particular restriction and also as specified in Column 5 of Schedule 13.
50.Vehicles for which Taxi Ranks are designated.
(A) A Taxi Rank may only be used, subject to the provisions of this Order, for the leaving during the Permitted Hours of such Vehicles as are Hackney Carriages. (B) Provided that the use of that Parking Place or part of the Parking Place in which the Vehicle is left has not been Suspended.
Section 2 – Use of a Parking Place.
51. Manner of waiting in a Parking Place.
The Driver of a Vehicle standing and/or waiting in a Parking Place in accordance with the foregoing provisions of this Order shall ensure that every part of the Vehicle stands within the limits of the same Parking Place.
52. Restriction on the use of a Parking Place.
No person shall use any Parking Place (or parts thereof), or any Vehicle whilst it stands either partially or wholly in a Parking Place in connection with the sale or offering for sale of any article to any persons in or near the parking place or in connection with the selling or offering for hire of his skill in handicraft or the giving of his services for material gain in any other capacity whatsoever.
Section 3 – Permits for certain Parking Places.
53 Application for, and issue of Permit.
(A) Residents Parking Permits (i) Any Resident who is the owner of a Vehicle of the class specified in Article 26 (A) which is an eligible Vehicle for the purposes of Article 53 (D) (i) may apply to the Council for the issue of a Residents Parking Permit. (ii) An Applicant for a Residents Parking Permit must satisfy the Council that he has a legal connection with the Vehicle which he has nominated on his application.
19 (iii) The holder of a Residents Parking Permit may not use it to park in any Parking Place other than in the Road or Roads specified on the Permit. No Resident shall be entitled to hold a Residents Parking Permit for more than one Vehicle at any one time. (iv) A Residents Parking Permit shall only be valid in respect of the Vehicle for which it is issued and no Permit Holder shall cause or allow any such Permit issued to him to him to be displayed on any other Vehicle. (v) Notwithstanding any other provisions of this Article, if a Resident can satisfy the Council that he is a bona fide motor trader then he may apply to the Council for the issue of a special Residents Parking Permit marked “Motor Trader,” which may be displayed on any Vehicle of the class specified in Article 26 (A).
(B) Visitors Parking Permits. Any Resident who is the owner of a Vehicle of the class specified in Article 26 (A) which is an eligible Vehicle for the purposes of Article 53 (D) (i), except in cases where restrictions to issue subsist, may apply to the Council for the issue of a Visitors Parking Permit. The issue of a Visitors Parking Permit will be limited to one Permit per property. The user of a Visitors Parking Permit may not use it to park in any place other than the Road named on the Permit. The user’s Vehicle must be of the class specified in Article 26 (A).
(C) Doctors Parking Permits. (i) Any Doctor who is the owner of a Vehicle of the class specified in Article 46 (A) (i) which is an “eligible Vehicle” for the purposes of Article 53 (D) (i) may apply to the Council for the issue of a Doctors Parking Permit for the leaving of that Vehicle in a Special Parking Place (Doctors). (ii) A Doctors Parking Permit shall only be valid in respect of the Vehicle for which it is issued and no Permit Holder shall cause or allow any such Permit issued to him to him to be displayed on any other Vehicle. (iii) The Permit shall state the number of the Special Parking Place (Doctors) to which it relates, and the hours during which the designated Vehicle may be left in said Special Parking Place (Doctors). (iv) Doctors Parking Permits shall only be granted to Doctors whom the Council is satisfied are liable to be called as of necessity to emergencies away from the surgery or consulting room shown on such application to the extent that the need for special parking arrangements is justified and to whom no suitable alternative parking facility is available within a reasonable distance.
20 (D) Permits - General Provisions.
(i)For the purposes of Article 53 (A) (i), (B) and (C) (i) an “eligible Vehicle” is a Vehicle as described in Articles 26 (A), 42 (A) or 46 (A) (i) which has a current Vehicle Excise Licence and is insured for use on the highway. (i) All applications made in accordance with the provisions of this Article shall be made on the form, relevant to the particular application, to be issued by and obtainable from the Council and shall include all the particulars, information and evidence required by the relevant form. (ii) On receipt of an application made under the foregoing provisions of this Article, and upon the conclusion of the making of any other enquiries of the Applicant or a third party that it considers reasonable and being satisfied that the application is valid, the Council may issue to the Applicant a Permit of the requisite type. (iii)The annual charge for a Permit is: (a) for a Residents Parking Permit or a Visitors Parking Permit is the sum or sums calculated by reference to Schedule 3 of the County Council of the City and County of Cardiff (On Street Parking Places) (Charges) Order 1999; (b) for a Doctors Parking Permit is nil; (iv) No Permit will be issued unless sufficient payment has been received. (v)The use of any Permit is only effective provided it complies with all relevant stipulations in this Order. (vi) The issue of Permits is at the absolute discretion of the Council and the Council reserves the right to deny the issue of a Permit to students of universities in the City and County of Cardiff who are prohibited by the terms of a contract or tenancy agreement with any such university from bringing a Vehicle to university with them.
54. Surrender, withdrawal and validity of Permits.
(A) General Provisions (i) A Permit Holder may Surrender a Permit to the Council at any time. (ii) A Permit Holder shall Surrender a Permit to the Council if the Vehicle in respect of which such a Permit was issued is adapted or used in such a manner that it is determined that it is no longer a Vehicle of the class specified in Articles 26 (A), 42 (A), or 46 (A) (i). (iii) The Council may at any time withdraw a Permit entirely at its own discretion if in all the circumstances it considers it reasonable to do so. If the Council chooses to take such action then the Permit Holder shall Surrender the Permit to the Council within 48 hours of receipt of Written Notice.
21 (iv) A Permit shall cease to be valid on the occurrence of any one or more of the events set out above in this Article.
(B) Residents Parking Permits Without prejudice to the generality of Article 54 (A) a Residents Parking Permit ceases to be valid and a Permit Holder must Surrender it to the Council on the occurrence of any of the following events: (i) the Permit Holder ceases to qualify as a Resident for the purposes of this Order; (ii) the Permit Holder ceases to be the Owner of the Vehicle in respect of which the Permit was marked; (iii) a change in the registration number of the Vehicle in respect of which the Permit was marked; (iv) the expiration of the date stated on the Permit; or (v) (if relevant) the Permit Holder ceases to be a motor trader.
(C) Visitors Parking Permits. Without prejudice to Article 54 (A) a Visitors Parking Permit ceases to be valid and a Permit Holder must Surrender it to the Council on the occurrence of any of the following events: (i) the Permit Holder ceases to qualify as a Resident for the purposes of this Order; or (ii) the expiration of the date stated on the Permit.
(D) Doctors Parking Permits. Without prejudice to Article 54 (A) a Doctors Parking Permit ceases to be valid and a Permit Holder of a type to which this paragraph of this Article applies must Surrender it to the Council on the occurrence of any of the following events: (i) the Permit Holder ceases to qualify as a Doctor for the purposes of this Order; (ii) the Permit Holder ceases to be the owner of the Vehicle in respect of which the Permit was issued; (iii) the revocation of the designation of the Special Parking Place (Doctor’s) in respect of which the Permit was issued; (iv) the expiration of the date stated on the Permit.
55. Application for, and issue of duplicate Permits.
22 (A) If a Permit is: mutilated or accidentally defaced; or the figures or particulars thereon have become illegible; or the colour of the Permit has become altered by fading; or the Permit is otherwise damaged in such a way to prevent its easy use then the Permit Holder shall Surrender it to the Council and the Council upon receipt of the Permit shall issue a duplicate Permit so marked, and upon such issue the Permit which it duplicates shall cease to be valid. (B) If a Permit is lost or destroyed then the Permit Holder may apply to the Council for the issue to him of a duplicate Permit and the Council, upon being satisfied as to the veracity of the claim of such loss or destruction, shall issue a duplicate Permit so marked, and upon such issue the Permit which it duplicates shall cease to be valid. (C) All provisions of this Order which apply to a Permit and an application for that Permit shall also apply in the same manner to a duplicate Permit and an application for that duplicate Permit.
56. Restriction on the removal of Permits.
Where a Permit has been displayed on a Vehicle in accordance with the provisions of Article 27, 31, or 47 of this Order no person except the Driver of the Vehicle shall remove the Permit from the Vehicle unless authorised to do so by the Driver of the Vehicle.
57. Form of Permits. (A) Form of Residents Parking Permits and Visitors Parking Permits On these there shall be found: (i) the registration number of the Vehicle to which it was issued; or (ii) in the case of a Residents Parking Permit issued to a motor trader, in place of the registration number the words “MOTOR TRADER”; or (iii) in the case of a Visitors Parking Permit, the registration number shall be replaced with the word “VISITOR”; together in all cases with the name of the street in which the Applicant to whom the Permit has been issued resides.
(B) Form of Doctors Parking Permits On a Doctors Parking Permit”; there shall be found: (i) the number of the Parking Place to which the Permit relates; (ii) the hours during which the designated Vehicle may be left in the Parking Place.
23 (C) All Permits shall be in writing, indicate that they were issued by the Council and bear an expiry date and shall otherwise be in such a form as determined by the Council.
PART IX –EXEMPTIONS, EXCEPTIONS, MOVEMENT OF VEHICLES AND SUSPENSIONS.
Section 1 – Exceptions and Exemptions.
58. Parking Exemptions. Nothing in Articles 22, 23, 26, 34, 42, 46, 50, 27, 31, 35, 43 or 47 of this Order shall prevent: (A) a person from boarding or alighting from a Vehicle; or (B) the leaving of a Vehicle in a Parking Place if the Vehicle is being used by a Doctor, district nurse, midwife, registered veterinary surgeon or person of a similar profession when visiting premises adjacent to the Parking Place, provided that the Vehicle is displaying an appropriately worded notice to the effect that it is being used “on call”; (C) a Vehicle from waiting provided the Vehicle is being used to load or unload in connection with the removal from or delivery to adjacent premises of Goods and/or furniture.
59. Pay and Display Parking Charge Exemptions. No Parking Charge shall be payable and nothing in Article 38 of this Order shall apply: (A) if the Vehicle is being used by a Doctor, district nurse, midwife, registered veterinary surgeon or similar person when visiting premises adjacent to the Parking Place; provided that the Vehicle is displaying an appropriately worded notice to the effect that it is being used “on call”; (B) in respect of any Vehicle left in a Pay and Display Parking Place during the Permitted Hours if that Vehicle is a Motorcycle; or (C) in respect of any Vehicle left in a Pay and Display Parking Place during the Permitted Hours if that Vehicle displays in the Relevant Position a Disabled Person’s Badge.
60. General Exceptions.
Nothing in Articles 5, 9, 12, 15, 17, 18, 23, 26, 27, 31, 34, 35, 42, 43, 46, and 50 of this Order shall prohibit any person from causing or permitting any Vehicle to stop or wait for so long as may be necessary:
24 (A) to enable a Vehicle if it cannot conveniently be used for such purpose in any other Road, or other place to be used in connection with (i) any building operation, demolition or excavation, (ii) the removal of any obstruction to traffic, (iii) the maintenance, improvement, or reconstruction of a Parking Place or length of Road or any part thereof, or (iv) the laying, erection, alteration or repair in or near a Parking Place or length of Road of any sewer or of any main pipe or apparatus for the supply of gas, water or electricity or of any Electronic Communications Apparatus;
(B) to enable any Vehicle owned by a funeral director or owner of funeral Vehicles to be used as part of a funeral cortege or otherwise in connection with a funeral;
(C) to enable a Vehicle, not being a Passenger Vehicle, to wait in a Parking Place: (i) while Postal Packets addressed to premises adjacent to the Parking Place in which the Vehicle is waiting are being unloaded and delivered or; (ii) while Postal Packets are being collected for loading from premises or post boxes adjacent to the Parking Place in which the same Vehicle is waiting;
(D) if a Vehicle is waiting owing to the Driver being prevented from proceeding by circumstances beyond his control (e.g. such waiting as is necessary to prevent an accident);
(E) to enable a Vehicle to wait in the Road for so long as may be necessary in the taking in of petrol, oil, water or air, provided such taking in cannot be effectively accomplished elsewhere;
(F) where a Driver is required by law to stop;
(G) where a Vehicle is being used for either fire brigade, or Ambulance purposes, or in the service of a police force being used in pursuance of lawful powers or duties;
(H) for preventing obstruction of the Road by Order under section 21 of the Town Police Clauses Act 1847 made on the occasion of any public procession, rejoicing or illumination or where the Road is thronged or liable to be obstructed as to close or partially close the Parking Place;
25 (I) if the Vehicle is waiting for only so long as may be necessary to enable it to be used in conjunction with the removal of any obstruction to traffic; or
(J) if an Owner has been given the express permission of the Council, the terms of such permission to be defined by the Council according to what the Council considers appropriate to a given circumstance, and he complies precisely with those terms.
61. Disabled Person’s Badge exemptions.
Notwithstanding any other provision in this Order, nothing shall render it unlawful to cause or permit any Vehicle being used for the conveyance of a disabled person to wait in a:
(A) Limited Waiting Parking Place, or;
(B) Pay and Display Parking Place for the entirety of the Permitted Hours provided that Vehicle displays in the Relevant Position a valid Disabled Person's Badge.
62. Disabled Person’s Badge exemptions also requiring a Parking Disc.
Nothing in Articles 5 (a) and 27 of this Order shall render it unlawful to cause or permit any Vehicle being used for the conveyance of a disabled person, which displays in the Relevant Position both: (A) a Disabled Person's Badge; and (B) a Parking Disc provided the Driver or other person in charge of the Vehicle has marked on the Parking Disc the time at which the period of waiting began; to wait for a period not exceeding three hours in a Residents Parking Place or in any length of Road designated as a Waiting Restriction in Schedule 2 (not being a period separated by an interval of less than one hour from a previous period of waiting by the same Vehicle in the same part of a Road, or in the same Residents Parking Place on the same day) and provided that the Waiting Restriction is not also subject to a Loading Restriction.
Section 2 – Alteration of Vehicle Positions.
63. Alteration of position of a Vehicle in a Parking Place.
26 When a Vehicle is waiting in a Parking Place in contravention of the provisions of Article 51 of this Order a Duly Authorised Person may alter or cause to be altered the position of the Vehicle in order that it comply with those provisions.
64. Movement of a Vehicle in a Parking Place.
In accordance with the Removal and Disposal of Vehicles Regulations 1986 (as amended): (A) A Duly Authorised Person may in case of an emergency move or cause to be moved to any place he thinks fit any Vehicle left in a Parking Place; and (B) where a Duly Authorised Person is of the opinion that a contravention has taken place as contained in Article 67 he may remove or cause to be removed the contravening Vehicle from the Parking Place.
65. Duty to move on.
Notwithstanding any exception or exemption contained in this Order, the Driver of a Vehicle waiting during the Prescribed Hours or Permitted Hours in any Road shall move the Vehicle on the instructions of a police officer in uniform or a Civil Enforcement Officer whenever such an instruction may be necessary to give for the purpose of preventing or removing an obstruction.
Section 3 – Suspension.
66. Power to suspend the use of a Parking Place.
(A)Any Duly Authorised Person may suspend the use of a Parking Place or any part thereof whenever it is considered such suspension is reasonably necessary: (i) for the purpose of facilitating the movement of traffic or promoting its safety; (ii) for the convenience of the occupiers of premises adjacent to the Parking Place on any occasion of the removal from or delivery to such premises of furniture; (iii) for the convenience of occupiers of premises adjacent to the Parking Place at times of weddings or funerals or on other such occasions; (iv) for the convenience of occupiers of adjacent premises for parking the official Vehicles (provided that there are no more than three) being at that time in use in connection with a wedding taking place that day comprising only the
27 Vehicles to transport the bride and/or the bridegroom and/or the bridesmaids to the place of the marriage ceremony on the wedding day; (v) for the purpose of any building operation demolition or excavation adjacent to the Parking Place; (vi) for the maintenance or reconstruction of the Parking Place; (vii) for the laying, erection, alteration or repair in or adjacent to the Parking Place of any sewer or of any main pipe or apparatus for the supply of gas water or electricity or of any Electronic Communications Apparatus; (viii) for the purpose of facilitating a Council supported event; (ix) on any occasion on which it is likely by reason of some special attraction that any Road will be thronged or obstructed.
(B) A Duly Authorised Person suspending the use of a Parking Place or any parts thereof in accordance with the provisions of paragraph (A) of this Article shall thereupon place or cause to be placed in or adjacent to that place the use of which is Suspended a Traffic Sign indicating that waiting by Vehicles is prohibited in accordance with section 64 of the Act of 1984.
(C) Save as provided in Article 58 of this Order or a person expressly permitted by the Council to wait in the Parking Place while it is Suspended, no person shall cause or permit a Vehicle to be left in the Parking Place or part thereof as the case may be during such period as there is in or adjacent to that place a Traffic Sign sited in pursuance of paragraph (B) of this Article.
PART X – CONTRAVENTIONS.
67. Contravention of restrictions and Parking Places.
Save as provided in Articles 6, 28, 58, 59, 60, 61, and 62 of this Order, if a Vehicle is left in a length of Road defined in the Schedules during the Permitted Hours or Prescribed Hours without complying with the provisions of this Order, a contravention shall be deemed to have occurred and a Penalty Charge shall be payable. A Penalty Charge Notice may then be issued by a Civil Enforcement Officer.
PART XI – OPERATIONS.
68. Installation of Ticket Issuing Machines, placing of Traffic Signs, etc.
The Council shall: (A) place and maintain Traffic Signs indicating the limits of each restriction and Parking Place referred to in the Schedules;
28 (B) install and maintain in proper working order at least one Ticket Issuing Machine in such position as they think fit in the vicinity of each Pay and Dsiplay Parking Place referred to in Schedule 1 and also referred to in Schedule 10;
(C) place and maintain in or in the vicinity of each Parking Place referred to in Schedule 1 and also referred to in Schedules 6, 7, 8, 9, 10, 11, 12 and 13 Traffic Signs indicating that such Parking Places may be used during the Permitted Hours for the leaving only of the Vehicles appropriate to the particular type of Parking Place as specified in this Order;
(D) carry out such other work as is reasonably required for the purposes of the satisfactory operation of a Parking Place.
PART XII – COMMENCEMENT AND CITATION. 69. Commencement and citation.
This Order is made on the 24th day of June 2010 and shall come into force on the 5th day of July 2010 and may be cited as The City and County of Cardiff (Cardiff South ) (Parking Control) Order 2010.
