Appendix 1 2 About this submission This submission is provided to the Redistribution Committee for the Northern Territory by the Australian Labor Party NT. The submission supports retaining both names of the electoral divisions in the Northern Territory. The submission provides comments on the proposal to alter the boundaries of both the electoral divisions in the Northern Territory for consideration by the augmented Electoral Commission to modify or adjust the boundaries through the objection and comments on objections process (and inquiry process, if required). This submission has been prepared mindful of the statutory requirement priorities to be considered and recommends no change or minimal change to the current boundaries of both electorates. The minimal change be, the inclusion of the entire local government area of the Litchfield Council in the electorate of Lingiari as proposed in the draft changes to the boundaries with the areas of Palmerston North and Palmerston South to remain in the electorate of Solomon. -

Submission to the Joint Standing Committee on Electoral Matters Inquiry Into the Conduct of the 2013 Federal Election
11 April 2014 Joint Standing Committee on Electoral Matters Parliament House Canberra ACT Please find attached my submission to the Committee's inquiry into the conduct of the 2013 federal election. In my submission I make suggestions for changes to political party registration under the Commonwealth Electoral Act. I also suggest major changes to Senate's electoral system given the evident problems at lasty year's election as well as this year's re-run of the Western Australian Senate election. I also make modest suggestions for changes to formality rules for House of Representatives elections. I have attached a substantial appendix outlining past research on NSW Legislative Council Elections. This includes ballot paper surveys from 1999 and research on exhaustion rates under the new above the line optional preferential voting system used since 2003. I can provide the committee with further research on the NSW Legislative Council system, as well as some ballot paper research I have been carrying out on the 2013 Senate election. I am happy to discuss my submission with the Committee at a hearing. Jesuit Social Services is a social change organisation. In the Northern Territory, we work with some of the most disadvantaged people and communities, through partnerships with local Aboriginal community- controlled organisations and communities and the delivery of youth justice programs in the Top End and Central Australia. This includes work in the metropolitan areas of Darwin and Palmerston, the urban centre of Alice Springs, the regional centres of Katherine and Tennant Creek, and the remote communities of Santa Teresa, Atitjere and Engawala in Central Australia, and Wadeye in the Top End. Our work in the Territory reinforces every day the size, diversity and unique demographics of this jurisdiction. It is extremely difficult to imagine how the Territory would be appropriately or fairly represented by a single MP. The young people and communities we work with are extremely diverse in terms of culture and language, reflecting the fact that almost one third of the population is Aboriginal, and with more than 100 Aboriginal languages spoken, it is one of the most linguistically diverse areas in the world. Moreover, the size of the Territory – Australia’s third largest jurisdiction, six times the size of Victoria and almost double the size of New South Wales, with 40 per cent of population living in remote and very remote areas (and 80 per cent of Aboriginal people living in remote and very remote areas), means that covering these distances to appropriately serve and represent communities would be extremely challenging, if not impossible, for a single MP. -

The Electoral Act requires this report to be tabled in the Legislative Assembly within three sittings days after its receipt. Additional copies have been provided for this purpose. Bill Shepheard Electoral Commissioner 24 April 2014 ELECTORAL COMMISSIONER’S FOREWORD The 2012 Legislative Assembly General Elections (LAGE) were the third general elections to be conducted under the NT Electoral Act 2004 (NTEA). The 2012 LAGE was also conducted under the substantially revised NTEA which had a significant impact on operational processes and planning arrangements. Set term elections were provided for in 2009, along with a one-day extension to the election timeframe. Further amendments with operational implications received assent in December 2011 and were in place for the August 2012 elections. A number of these changes were prescribed for both the local government and parliamentary electoral framework and, to some extent, brought the legislation into a more contemporary operating context and also aligned its features with those of other jurisdictions. The NTEC workload before the 2012 LAGE was particularly challenging. It was the second major electoral event conducted by the NTEC within the space of a few months. Local government general elections for five municipalities and ten shire councils were conducted on 24 March 2012, the first time their elections had all been held on the same day. -

RESEARCH PAPER SERIES, 2017–18 5 MARCH 2018 House of Representatives by-elections: 1901–2017 Stephen Barber Statistics and Mapping Section Executive summary This paper provides details of House of Representatives by-elections, from that held for Darling Downs on 14 September 1901 to the most recent held on 16 December 2017 for Bennelong. The following observations can be made about those by-elections: • there have been 151 by-elections, an average of 3.4 per parliament • the average number of nominations has grown over the years from 2.2 per by-election to 12.0 per by- election • in only four cases was a by-election contested by just a single candidate • an increasing tendency has been for governments to avoid contesting by-elections in their opponents’ safe seats • in only ten cases have the opposition party failed to contest a by-election • seventy-six of the by-elections followed the resignation of the member, 68 members died in office, there have been six voided elections, and one MP was expelled from the House • since 1949 resignations account for almost two-thirds of by-elections and over half the resignations have occurred in safe seats • on 35 occasions the party complexion of a seat has altered at a by-election • five of the losses have been by the opposition of the day • the average two-party preferred swing against the government of the day has been 3.8 per cent • since 1949 the largest two-party swing against a government occurred against Labor in Canberra in 1995. The largest swing to a government occurred to the Coalition in McPherson in 1981. -

5 Election Day and the Scrutiny 5.1 Election day is the culmination of an intense period of activity by political parties, candidates and the AEC. On election day 2001, over 11.25 million voters attended 7,703 booths, presided over by over 65,000 AEC officials. The largest polling booth was at Wodonga (in the Division of Indi, Victoria), which issued 7,746 votes on election day, including ordinary, absent and provisional votes.1 The largest ‘super booth’2 was in Sydney, where a total of 8,338 ordinary and declaration votes were issued. The smallest polling booth was at Perisher Valley (in the Division of Eden Monaro, New South Wales), which issued a total of 30 votes, including ordinary and declaration votes. The Sydney pre-poll voting centre (in the Division of Sydney, New South Wales) issued the largest number of pre-poll votes, while the Division of Maranoa in Queensland handled the largest number of postal votes.3 Counting of votes on election night concluded when the last vote was entered into the AEC’s counting system at approximately 1:30am on Sunday, 11 November 2001.4 1 AEC, Behind the Scenes: the 2001 Election Report, Commonwealth of Australia, 2002, at: http://www.aec.gov.au/_content/when/past/2001/bts/index.htm, accessed 21 May 2003. 2 The term ‘super booth’ refers to the situation where a number of normal polling booths for different Divisions are located in the one polling place. The Hon Mr Tony Smith MP Chair, Joint Standing Committee on Electoral Matters PO Box 6021 PARLIAMENT HOUSE ACT 2600 7 April 2014 Dear Mr Smith Inquiry into and report on all aspects of the conduct of the 2013 Federal Election and matters related thereto A healthy political philosophy reflects a balanced view across many social issues. There once was a time whereby parliaments using the Westminster system consisted of progressive local representatives with a broad gamut of individual special interests. Today this type of representative is labelled as ‘single issue’ or ‘independent’ and big parties have become dominate for convenience of getting laws passed. I was a senate candidate for a micro party in the federal election on 7 September 2013. The party I represented was not a front party, not aligned with any existing political party or Member of Parliament. We were a member of the Minor Party Alliance and lodged a Group Voting Ticket. Political parties are responsible for social and national development. Misinformed and misguided choices at the ballot box can produce hazardous consequences for our society and we all then have to live with those consequences, at least for a period of time. Many millions of Australians have never been a member of any political party. The membership numbers for the major parties is said to be around 80,000 Liberal and 35,000 Labor. Yet in elections around 10 million people vote for these two parties. This situation needs to be challenged. Voters over generations have been trained to vote for one of two camps. -

3 Election Preparation 3.1 The period between the calling of an election and polling day is a period of intense activity on the part of the AEC, political parties and candidates. This activity includes the formal requirements for calling the election and nominating candidates, as well as publicity and advertising. Notification of an election and election writs 3.2 The AEC raised concerns about a number of formalities, namely: how it is notified of a forthcoming election; its role in preparing election writs; and the method of certifying the names of the successful candidates on the writs.1 3.3 The following outlines the context in which these concerns arise, followed by consideration of the submissions on these points. The role of election writs in an election 3.4 An election writ is a legal document that ‘commands’ an electoral officer to hold an election, and specifies the dates for the close of rolls, the close of nominations, polling day and the return of that writ. 1 Submission (AEC, no. 147), pp. 9-11, Transcript of Evidence, 16 August 2002 (Mr A Becker), pp. EM68-70. 98 3.5 The provisions governing election writs are detailed in sections 12 and 32 of the Constitution, and Part XIII of the Electoral Act. The function of election writs and how they fit in to the stages of an election is described below.2 Determination of an election date 3.6 Under the Constitution, the Governor-General has the power to prorogue the Parliament and dissolve the House of Representatives.3 However, as a matter of convention, the Prime Minister determines when he or she wishes an election to be held, subject to the constitutional requirement that the term of the House of Representatives shall be a maximum of three years.4 It is the convention that the Prime Minister visit the Governor-General to request that an election be held on the date chosen by the Prime Minister.5 In 2001, the Prime Minister visited the Governor-General on Friday, 5 October, and announced the election date the same day.
