CLOSURE ORDER WITH DISCONNECTION OF ELECTRICITY

WHEREAS, the West Bengal Pollution Control Board (hereinafter referred to as the Board), is entrusted to execute different Acts and Rules within the territorial jurisdiction of West Bengal, for the purpose of prevention and control of pollution.

AND WHEREAS, the Board in consultation with the State Plastic Management Committee, Govt. of West Bengal, imposed restriction on use of plastic carry bags below 40 microns in thickness and less than 12”X16” in size.

AND WHEREAS, the Board monitors the compliance of the above mentioned restrictions by conducting inspections / raids in different places within West Bengal.

AND WHEREAS, such inspections / raids were carried out by the Board on 06/09/2011 & 29/09/2011.

AND WHEREAS, during such inspections / raids, the following units were found to violate either the provisions of Plastic Waste (Management & Handling) Rules, 2011 and its subsequent amendments and/or found to operate without obtaining Consent to Operate from the Board :-

AND WHEREAS, hearings in this regard were conducted by the Board on 13/09/2011 & 13/10/2011.

NOW THEREFORE, in due consideration of the violations observed during inspections / raids, the aforementioned units are hereby closed by the Board with immediate effect.

The electricity connection of the units is ordered to be disconnected forthwith.

The General Manager – Operations (C&M), CESC Ltd., is requested to take necessary steps for disconnection of electricity of the units immediately.

The closure order will take immediate effect and the Officers-in-Charge, Cossipore,Tiljala,Karaya and Taratala Police Station, under West Bengal Police are directed to execute the Closure order against the aforementioned units and submit the compliance reports to the State Board within seven days from the receipt of this Memo.

This direction has been issued to the Officers-in-Charge, Cossipore, Tiljala, Karaya and Taratala Police Stations and M/s. CESC Ltd. in conformity with the order of the Hon’ble High Court, Calcutta dated 21/08/1998 and 28/04/1999 respectively.

The Environmental Engineers, Salt Lake R.O. & Camac Street R.O. of the Board are requested to take necessary steps for proper execution of the closure order and also visit the units involving the local police station and Nodal Police Officer of the concerned district.

This direction is issued in exercise of the powers conferred under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 especially Plastic Waste (Management & Handling) Rules, 2011 and its subsequent amendments.

This has the approval of the Competent Authority.
