Cornwall THE Examinations of Frances Dunstan, Widow, Wearne Dunstan, Samuel Hill Moyle, and John Kerby taken upon Oath before Christopher Wallis Popham Esquire TO WIT and The Reverend Clerk two of Her Majesty's Justices of the Peace, acting in and for the said County, this twenty third day of December one thousand eight hundred and forty three touching the place of the last legal settlement of the said Frances Dunstan and Elizabeth Jane Dunstan her infant legitimate Child by Wearne Dunstan her late deceased husband

Frances Dunstan for herself saith, I am twenty three years of age, I was lawfully married according to the rites and ceremonies of the Church of at the parish Church of the parish of Aberystruth in the County of Monmouth in the month of May one thousand eight hundred and forty, to Wearne Dunstan the younger my late deceased Husband – he was killed on the first day of March last, my said deceased Husband did no act to gain a Settlement after our marriage. I have gained no Settlement since his death, since our said Marriage I have had by my said Husband one Child called Elizabeth Jane Dunstan now aged fifteen months. I now reside with my said Child in the parish of Sithney in the County of and am with my said Child now actually chargeable to that parish

Wearne Dunstan for himself saith, I was lawfully married to my first wife Jane Whear in the parish Church of Sithney in this County sometime in the month of February one thousand eight hundred and fifteen, after which marriage my said wife had by me two children Thomas and Wearne, my said son Wearne Dunstan was the Husband of the Pauper Frances Dunstan and never did any act whereby to gain a Settlement in his own right previous to his marriage – he was Born in the parish of Sithney on the twenty ninth day of December one thousand eight hundred and sixteen and never lived out of the parish of Sithney until after he was twenty one years of age – his Mother died when he was about six months old – and on her death he was put out to Nurse with his Grandmother in the said parish of Sithney at my expense – At Michaelmas in the year one thousand eight hundred and twenty I took to rent of one William Penpraze a tenement consisting of House and Land situate at Bolitho in the parish of Crowan in this County for a term of twenty one years at the yearly rent of Twenty four pounds, the Indenture of Lease now produced by me bearing date the twenty ninth day of September one thousand eight hundred and twenty and duly executed by the said William Penpraze and attested by William Varker Blewett only – is the Indenture of Lease under which I took and held the said tenement – I entered on the said tenement under and by virtue of such Lease on the twenty ninth day of September one thousand eight hundred and twenty and lived on, held, and had the sole occupation thereof from that day up to and until the twenty ninth day of September one thousand eight hundred and twenty four, I paid the full sum of Twenty four pounds for each year’s tenancy to the said William Penpraze and had and received from him the stamped Receipts now produced by me in discharge of such rent and during the whole of such tenancy I resided and Slept on the said tenement in the said parish of Crowan and during which time my said Son Wearne was unemancipated and lived with his Grandmother in the said parish of Sithney – I then left the said parish of Crowan and lived in the parishes of Gwinear and Kenwyn for about four or five years and in America for about seven years and half but did no act to gain a Settlement until I took to rent on the twenty ninth day of September one thousand eight hundred and thirty eight a tenement in the parish of my said Son Wearne did not live with me or within the same parish or maintained by me at any time after I left the said tenement at Crowan and was at the time of my taking the said tenement in Wendron aforesaid namely on the twenty ninth day of September one thousand eight hundred and thirty eight living apart from me in the parish of Sithney and was then of the age of twenty one years and upwards

Samuel Hill Moyle for himself saith, I am a Relieving Officer of the Union – the parish of Sithney is within and forms part of the Helston Union – the abovenamed Pauper Frances Dunstan resides with her Child in the parish of Sithney and is with her said Child now actually chargeable to and receiving relief from the said parish of Sithney Taken and Sworn the day and year first aforesaid Before us Saml. John Kerby for himself saith, I live in Helston in the County of Cornwall. I well know the person and handwriting of William Varker Blewett formerly a Clerk in the employ of Mr Roberts of this place Solicitor, the name “W.V. Blewett” as the only attesting Witness to the due execution of the Indenture of Lease of the 29th day of September 1820 now produced by Wearne Dunstan is the hand writing of the said William Varker Blewett – the said William Varker Blewett has been dead several years – about ten years, or upwards, as I have been informed and believe

23rd December 1843 Removal Order Sithney to Crowan (Frances Dunstan & child)

Cornwall To the Churchwardens and Overseers of the Poor of the Parish of Sithney in to Wit the County of Cornwall, and to the Churchwardens and Overseers of the Poor of the Parish of Crowan in the County of Cornwall, and to each and every of them

UPON the Complaint of the Churchwardens and Overseers of the Poor of the said Parish of Sithney in the County of Cornwall, unto us whose Names are hereunto set, and Seals affixed, being Two of Her Majesty’s Justices of the Peace, in and for the said County of Cornwall, (and one of us of the Quorum) that Frances Dunstan the widow of Wearne Dunstan deceased and Elizabeth Jane Dunstan her child by her said deceased Husband now aged about fifteen months have come to inhabit in the said Parish of Sithney not having gained a legal settlement there, nor produced any Certificate owning them to be settled elsewhere; and that the said Frances Dunstan and her said Child are now actually chargeable to the said Parish of Sithney WE, the said Justices, upon due proof made thereof, as well upon the examination of the said Frances Dunstan upon Oath, as otherwise; and likewise upon due consideration had of the premises, do adjudge the same to be true; and we do adjudge that the lawful Settlement of her the said Frances Dunstan and her said Child is in the said parish of Crowan in the said County of Cornwall WE do therefore require you the said Churchwardens and Overseers of the said Parish of Sithney or some or one of you to convey the said Frances Dunstan and her said Child from and out of your said Parish of Sithney to the said Parish of Crowan and them to deliver to the Churchwardens and Overseers of the Poor there, or to some or one of them together with this our Order, or a true copy thereof, at the same time shewing them the original; and We do hereby require you the said Churchwardens and Overseers of the Poor of the said Parish of Crowan to receive and provide for them as Inhabitants of your Parish.

GIVEN under our Hands and Seals the twenty third day of December in the seventh year of the Reign of Her Majesty Queen Victoria, and in the Year of our Lord One Thousand Eight Hundred and Forty three

23rd December 1843 Notice of Removal Order Sithney to Crowan (Frances Dunstan & child)

NOTICE

In the matter of Frances Dunstan a Pauper

To the Overseers of the Poor of the Parish of Crowan in the County of Cornwall

WE the Overseers of the Poor of the Parish of Sithney in the County of Cornwall, do hereby give you notice that the above‐named Frances Dunstan and Elizabeth Jane Dunstan her Child now aged about Fifteen months have become and now are chargeable to our said Parish of Sithney and that an Order has been duly obtained for their removal to your said Parish of Crowan as the place of their last legal settlement (a Copy of which Order, and also a Copy of the Examinations on which the same order was founded and made, are herewith sent.) – And we do also hereby further give you notice, that unless you appeal against the said Order, and, within twenty‐one days from the date hereof duly serve notice of such appeal, the said Paupers will be removed to your said Parish of Crowan in pursuance of the said Order.
