The site consists of 10.3 acres. Parcels I, 11 , and III are zoned for industrial and manufacturing uses, and Parcels I and n are also designated in the New York City Zoning Resolution as "Public Place", a classification that these parcels are to be used for a public purpose. The site uses are noted above. The site is in Kings County, and the latitude is 40.6764"N, and the longitude is 73.9956° W. The site location is illustrated in Figure 1, taken fi:om a portion of H United States Geological Survey Topographic Map. A general site plan is presented on Figure 2, with source documentation as noted on the figure. Figure 3 provides infonnation regarding adjacent property information. The tax map for the site is provided in Figure 4.

There are two existing easements recorded for the siTe. The City of New York has an casement for a sewer and KeySpanfNationai Grid has two easements for natural gas improvements. A description of each existing easement is provided below.

Easement Holder City of New York

Description - sewer easement acquired by the City of New York as successor to the City of Brooklyn pursuant to L. 1879, C. 207. A survey of Lots I, 100 and 200 by Bart1ett, Ludlam & DiU, Order No. 91039, dated and revised in 1969, shows a 72-inch sewertraversing all dU'ce lots (Block 47 1, Lots 1,100 and 200), and :mother sewer extending southerly into Lo! 100 from the southerly end of 5tb Street and joining the 72-inch sewer, which is not shown on the accompanying tax map.

Easement Holder National Glid

Description - utility easement burdening two contiguous areas within Lot 100 benefiting National Grid as successor to the Brooklyn Union Gas Company, set fonh in a grant from Peter Galasso, lnc. to the Brooklyn Union Gas Company dated 6/9170 and recorded on 3/9171 in Rec1469, p. 1040. Easement 1 is a right­ of~way roughly IS-feet wide extending southerly into un 100 from tbe southerly end of Boy! Street. The easemem is for ingress and egress aDd the installation, maintenance and operation of gas mains, service pipes, telephone and electric lines. Easement 2 provides similar rights and additional rights for buildings and fencing and for machinery and a Tulmel Shaft.

Section V. Property Eligibility Information

The Brooklyn Union Gas Company (BUG) [aka KeySpan Corporation (KeySpan)/ National Grid USA], the City of New York, Vichar, Inc. and Harvie International, Ltd. certify that the Carroll Gardens! Public Place MGP site meets the definition of a Brownfield site (real property, the redevelopment or reuse of which rnay be complicated by the presence or potential presence of a hazardous waste, petroleum, pollutant, or contaminant). The site is not:

Further, the applicants state that the Carroll Gardens! Public Place site is currently vacant or underutilized. Parcel I has been vacant since the City acquired the parcel in 1975. The City leases Parcel II to a concrete batch plant operator and the warehouse on Parcel III is leased to a supplier of school uniforms.

In the past several years, KeySpan has documented a major source of manufactured gas plant material at the Carroll Gardens! Public Place MGP site (see reports listed in Site's Enviromnental History below). This MGP source material has penetrated deep underground at the site. MGP-related material has also been found on properties to the east, across the , at depths below the bottom of the canal. However, linkage with the site has not been confIrmed and other source areas are present east and north of the canal. A major remediation, which will include construction of a barrier wall to halt the potential flow of MGP contaminants into the Gowanus Canal, has been approved by the NYSDEC. The redevelopment of the Carroll Gardens! Public Place Site is clearly complicated by the extensive MGP contamination at the site.

The Carroll Gardens! Public Place site is clearly distinguishable from two former manufactured gas plant sites in Manhattan that had applied to the Brownfield Cleanup Program and were recently rejected by the Department of Enviromnental Conservation.

First, as to neighborhood character and development pressure, the West Chelsea community where the two Manhattan MGP sites are located, was rezoned in 2005 and has consequently attracted intense development pressure and sharply rising property values. In contrast, the Gowanus Canal comdor consists of known assemblages of vacant and llllderutilized property (between 3rd Street and Douglass Streets) and traditional industrial and commercial uses (south of3rd Street), according to a recent NYC Department of City Planning CDCP) analysis. Although some developers have plans for several Gowanus sites, the Gowanus has not been rezoned and lacks the intense development pressure of West Chelsea in Manhattan. In the past 5 years, DCP has received applications for nine new buildings in the 60-block Gowanus study area. Since 2003, only three new buildings have been built and issued certificates of occupancy in the area. The completed buildings include two new hotels on Butler and Union Streets and the City's EMS station on Carroll and Bond Streets. The other permitted buildings are mostly storage facilities or offices, the Whole Foods on 3rd Street and 3rd Avenue, and a hotel on 3rd Avenue and Douglass Street.

Second, as to seriousness of contamination, the Carroll Gardens! Public Place site is a source ofMGP related contaminant material that may impact a surface water body. The MGP contamination beneath the two West Chelsea sites is more limited and has not reached a surface water source.

Finally, the two West Chelsea sites can be distinguished from the Carroll Gardens! Public Place site in terms of existing remediation authority. Con Edison executed a Vollllltary Agreement with DEC to remediate the two West Chelsea sites several years before those sites were applied to the BCP. In contrast, DEC's Vollllltary Agreement with KeySpan for the Carroll Gardens! Public Place site was for investigation only, not remediation.

Section VI. Project Description

The objective of me project is to mitigate the environmental issues identified on the ~ite and facilitate potential redevelopment of the property. The NYSDEC has approved a Remedial Altematives Analysis defming a selected remedy, and a Remedial Design Work Plan presenting the details of the development of design and construction documents. These documents are attached to this BCP application. This includes additional environmental and geotecJrnical site investigations and on site pilot srudies to fimllizc the design documents.

The remedy in general, includes sh,lllow excavation of contaminated soil (nominally 8 feel helow street grade) throughout the site (Parcels 1, II and III). It is expected that an excavation suppon system will be required for the work on Parcell along SID Street and about balfthe parcel~length along Smith Street. Existing foundations and below grade remnant MGP structures will be removed., some to a d'-'Plh of about 30 feet below grade on Parcel 1. A visual excavation batTier will be i.nstalled at the base of the excavations, denoti.ng the limit of clean fill and warning ofpotentiaJly impacted soil below. Excavated soil will be disposed of off site. The excavations will be backfilled with clean excavated matcl;al (as available) and clean soil from off site to about street grade and the site will be rough graded. A DNAPL containment ban·ter will be installed along the Gowanus Canal coupled with a DNAPL recovery system. Engineering and institutional controls will be implemented to identify remaining impacted soil and groundwater and deal with the monitoring and maintenance of remedial systems in place.

The additional environmental and geotechnical investigations and pilot studies are estimated for completion in the third quarter of 2008 followed by the completion of the remedial design in the flrst qUClrter of 2009. The remediaJ design bid and contracting is projected for the second qua11er of 2009 followed by remedial implementation through the second quarter of 20 II. However, the estimated scbedule for these activities are tentative and could be affected by a number factors including: site access, New York City debris removal (scheduled to begin on March 17,2008 and be completed within three months), active concrete plant relocation, fom1er facilities demolition, subcontractor availability, supplemental remedial investigation on Parcel m, coordination with Ihe New York City Mayor's Office of Environmental Coordination (NYC MOEC), and review, input and approvals [Tom the NYSDEC and the New York State Department of Health. "

The proposed use after the remedy will be a mixed~use development consistillg of several buildings up to 12 stories in height which will provide 500 to 600 units of mixed income housing, retail space, ancillary padcing and community facilities. This site development is projected to occur in 2011 through 2013.

Additional analytical data have bet-"l1 collected as part of the NYSDEC-approved supplemental remedial investigation scope of work. This investigmion included soil vapor and indoor air sample coUection at Parcel flI and a further evaluation of off-site MOP-related impacts in soil and groundwater that is on-going. Once the investigations are complete, the findings will be summarized in a supplemental remedial investigation report.

No other existing environmental infonl1alion, studies, reports, or other such data have been found for this site.

Previous investigations have included the completion of numerous test pit excavations; installation of soil borings, soil vapor points and monitoring wells; and the collection and analysis of soil vapor, soil, and groundwater samples. Previous investigations have identified soil vapor, soil, and groundwater at the site are impacted with MGP~rel ated petroleum products, volatile organic compounds (not including chlorinated solvents), semi-volatile organic compounds, metals, PCBs, and cyanide.

Tables that summarize the chemical concentrations within soil , soil vapor and groundwater reported ill the comprehensive Final Remedial Investigation Rep011 are appended to the end of this attachment. A summaty of investigations completed to date, the selected remedy, and the design approach are provided within the Final Remedial Design Work Plan, Carroll Gardens! Public 1>lacc. A copy of this document will be submitted under a separate cover.

. The Carroll Gardens! Public Place lvIGP Site is cUlTently used for commercial and manufactUling! industrial purposes, or is vacant. The Carroll Gardens! Public Place MGP was operating by the late 1860's and continued operatillg through the 1960' s. The Carroll Gardens! Public Place MGP initiaJly occupied Parcels I and II. The Carroll Gardens! Public Place MGP ex.panded operations to include Parcel f1l sometime between 1904 and 1914 and Block 468, Lot 25 by 1939. Gas holders, tar handling, fuel oil tanks, andlor other MGP production and distribution bu ildings were present on each of the lots. It should be noted that Block 468, Lot 25, is not part of this Brownfield Clean-up Program application, but will be remediated by Keyspan.

Parcell! was developed as a concrete plant in 1975. In 1971, a warehouse was developed on ParccllH. According to the 1996 Sanborn map, Block 468 Lot 25 remained undeveloped through 1996.

Current Usc/lnt-ended Usc:

The current land use on Parcel J is Open Space (vacant lot); Parcel II is indusnial/rnanufacturing (Fen-ara Brothers Concrete Plant); and Parcel III is a warehouse (commercial). The proposed usc of the site is for mixed-use development consisting of several buildings up to 12 stories in height which will provide 500 to 600 units of mixed income housing, retail space, ancillary parking and community facilities.

Item 2: Is the proposed used consistent with applicable loning laws! maps'!

The proposed development is not consistent with current zoning classification. The property will have to be re·zoned for the proposed development.

Item 4: Are there Blly Environmental Justice Concerns?

It is unknown if there are any Envirorunental Justice Concerns relating to Carroll Gardens! Public Place MGP Site.

Item 8: Are there important cultural resources, including federal or state historic or heritage sites or Natiye American religious sites within YZ mile?

The Carron Gardens Historic District is on the National Register of Hjstoric Places and located approximately y.; mile northeast of the site, There are no other important cultural resources, including federal or state historic or heritage sites proximate to the site.

Item 9: Arc thCl'C important federal, state, or local natural resources, including waterways, wildlife refuges, wetlands, or critical habitats of endangered or threatened species within ~ mile?

Federal \\'etlands (the Gowanus Canal) are located adjacent Lo the eastern property boundary of the site. There are no important federal, state, or local wildlife refuges or critical habitats or endangered or threatened species proximaTe to the site. The lndi311a Bat and the Seabeach Amaranth are listed as endangered species within Kings County

Item 10: Are there floodplains within Yl mile?

Floodplains are located on the eastern pOltion of the site on Parcel n and Parcel III.

Tbe site is currently fenced thereby restricting public access. Engineering (lnd instimtional controls are proposed as pm1 oftbe remedial design to address the remaining impacTed soil mId groundwater after the completion of remedial activities.

Item 12: Describe on attachment the proximity to r eal property currently used for residential use, and to urban, commercial, industrial, agricultural, and recreat.ional areas.

Adjoining land uses are described above and include induSll;al, manufacturin g, commerc ial, and residential use. Recreational facilities (St. Mary's Playgrounds) are located adjacent to the site. The adj oining land uses arc shown on Figure 3 of this application. h em 13: Describe the potential vulnerability of groundwater to contamination that might migrate from the site, including pl'oximity to well head pl'otection and groundwater recharge areas, and oilier areas identified by the Department and the Shlte's Comprehensive Groundwater Remediation and Protection Program.

There are no public water supply wells wilbin 1 mile of the site. According to the NYS DOH, there are not any wellhead protcction areas or recharge areas in the vicinity of the site . The Freedom of Infonnation Act request letter nnd tbel\rySDOH response are attached.

Remedial investigations have determined that the grOlUldwater at the Carroll Gardens! Public Place site is impacted. These impacts have been encountered outside the footprint oftbc property of the Carroll Gardens! ?ublic Place Site. KeySpan is curren{\ y completing supplemental remedial investigations to evalu atc Ihe extcnt of the potential impacts.

The CalTOiI Gardens! Pllblic Place MOP site is located along the Gowanus Canal in Brooklyn, New York. The surficial site geology beneath the site consists of fill; alluvial (1Dd marsh deposits (peat, silt, clay, and sand]; glacial outwash sands inter bedded with glacial till; Gardner'S Clay; and Jarneco Gravel. Site investigations were completed to approximarely Elevation -1 60 Feel. Bedrock underlying th e site is the Fordham Gneiss.
