APPLICANT’S BRIEF IN RESPONSE TO OPPOSER’S MOTION FOR SUMMARY JUDGMENT Applicant, The National Association of Professional Baseball Leagues, Inc. (“Applicant”)

hereby opposes the Motion for Summary Judgment of Portland Mavericks Baseball Club, Inc.

(“Opposer”) as to Count III (Lack of Bona Fide Intent to Use) in both Notices Oppositions (14

TTABVUE). As shown below, the record contains substantial evidence of Applicant’s bona fide

intent to use the subject marks as of the filing dates of the applications. Such evidence includes

the specimens and other submissions in the application prosecution files which are automatically

of record in these proceedings 37 C.F.R. 2.122(b); TMEP §528.05(a)(1), evidence provided to

Opposer in the course of discovery further supplemented by the Declaration of Robert Fountain,

dated April 13, 2020 (“Fountain Decl.”) submitted herewith.

Although Applicant believes such evidence conclusively demonstrates its bona fide intent

to use the marks, at the very least, such evidence raises genuine disputes of material fact as to

Applicant’s bona fide intent to use. Moreover, Opposer’s contention that Applicant’s discovery

responses suggest otherwise is simply incorrect. Therefore, Opposer’s Motion should be denied.

1 PROCEDURAL BACKGROUND

The subject applications were filed on April 14, 2017 and were initially filed under

Section 1(a) showing actual use in interstate commerce. Rather than further contesting the

unwarranted objections of the Examining Attorney, Applicant amended its applications bases to

Section 1(b) intent-to-use applications in the course of prosecution.

The subject applications were published for opposition on September 11, 2018. Opposer

obtained extensions of time to oppose the applications extending the deadline to oppose until

January 9, 2019. On January 9, 2019, Opposer filed Notices of Opposition which Applicant

answered on February 8, 2019. 1 TTABVUE and 4 TTABVUE (in both proceedings). Applicant

moved to consolidate the proceedings. 5 TTABVUE. Opposer did not oppose the motion to

consolidate but with the consent of Applicant filed a motion to extend all deadlines in the

interim. 7 TTABVUE. By Order dated March 6, 2019, the Board granted the motion to

consolidate and the consented motion to extend all deadlines which set discovery to close on

October 16, 2019 and the Pretrial Disclosures to November 23, 2019. 8 TTABVUE.

On December 2, 2019, Opposer filed a further request for extension of time and requested

that the lapsed Pretrial Disclosure deadline of November 23, 2019 be set for December 23, 2019.

9 TTABVUE. By Order dated January 7, 2020, the Board granted the motion as conceded

though it did not reopen the period for serving Pretrial Disclosures, it set the Opposer’s trial

period to end on February 10, 2020. 11 TTABVUE

On February 12, 2020, two days after what was supposed to be the end of the Opposer’s

trial period, the parties filed a stipulation which effectively sought to reopen the period for

serving Opposer’s Pretrial Disclosures and Opposer’s testimony period. 12 TTABVUE. By

2 Order dated February 28, 2020, the Board granted the consented motion to re-open and extend

trial dates. 13 TTABVUE. It reset Opposer’s deadline to serve its Pretrial Disclosures to March

13, 2020. Finally, on March 12, 2020, the day before its thrice extended/reopened deadline to serve Pretrial Disclosures and the last permitted date under 37 C.F.R. §2.127(e)(1), Opposer served the present motion. 14 TTABVUE- 24 TTABVUE. The tactics of Opposer are clearly designed to delay the registration of Applicant’s trademarks and cause harm to Applicant’s business.

FACTS

Applicant is an association of minor league baseball teams and trades under the name

Minor League Baseball. Fountain Decl. at ¶ 2, Exhibit A (Applicant’s website).

It is common practice for sports leagues such as Applicant to own and/or license trademarks and other intellectual property related to legacy and defunct sports teams. See, e.g.,

Class 41 registrations for MONTREAL EXPOS (Reg No 1873010 – baseball), HOUSTON

OILERS (Reg No 1069143 – football), SEATTLE SUPERSONICS (Reg. No 1084317- basketball) and ATLANTA THRASHERS (Reg No 2411175 hockey). Fountain Decl. at ¶ 3,

Exhibit B (TSDR printouts); See also App No 87407131, Response to Office Action, dated

January 5, 2018, Exhibits 7-10.

Sports leagues primarily license these intellectual properties for apparel and for use with

“throwback nights” and other very popular fan events (e.g., fan fests, fundraisers, etc.) celebrating the legacy of these sport teams. Fountain Decl. at ¶ 4. Indeed, Applicant owns and/or licenses intellectual properties related to legacy and defunct baseball teams, including the

3 Portland Mavericks, which it refers to as its Hometown Collection. Fountain Decl. at ¶ 5, Exhibit

C (Hometown Collection 2018 logo pennant promotion).

Applicant and/or one of its member baseball teams own Class 41 registrations for The

89ERS (Reg. No 207909 - defunct Oklahoma-based baseball team) and the MEMPHIS CHICKS

(Reg. No. 4295465 – defunct Memphis-based baseball team. Fountain Decl. at ¶ 6, Exhibit D

(TSDR printouts); See also App No 87407131, Response to Office Action, dated January 5,

2018, Exhibits 4-5).

From time to time, however, “legacy” names and marks return into everyday usage. For

instance, Applicant secured a Class 41 registration for TAMPA TARPONS (Reg. No. 4289111)

as a legacy mark but subsequently the mark was assigned to its member baseball team which was

renamed TAMPA TARPONS. Fountain Decl. at ¶ 7, Exhibit E (TSDR printout); See also App

No 87407131, Response to Office Action, dated January 5, 2018, Exhibit 6. In another case, one

of Applicant’s affiliated teams in Jackson, Tennessee adopted the name JACKSON

GENERALS, a name that was previously used by another affiliated team previously located in

Jackson, Mississippi. Fountain Decl. at ¶ 7. Accordingly, sports leagues such as Applicant take

great care to preserve the significant goodwill associated with these names and marks. Fountain

Decl. at ¶ 7. This is especially true for Applicant where due to the dynamic nature of Minor

League Baseball, teams move and change names on a more regular basis than Major League

Baseball. Fountain Decl. at ¶ 7. Other Minor League baseball team names including the

BEAVERS, JAMMERS, DIABLOS, CAPTAINS, and RIVER BANDITS have moved and/or

been used by multiple teams. Fountain Decl. at ¶ 7.

Applicant licensed its Hometown Collection trademarks (which includes PORTLAND

MAVERICKS) to a number of apparel companies including Ebbets Field Flannels, New Era Cap

Co., ’47 Brand, Original Retro Brand, Wincraft and American Needle. Fountain Decl. at ¶ 9.

Applicant has provided Opposer copies of the representative license agreements on a confidential basis. Fountain Decl. at ¶ 9, Confidential Exhibits 2 through 4 (license agreements). Applicant started selling licensed PORTLAND MAVERICKS apparel at least as early as October 2014.

Fountain Decl. at ¶ 9, Exhibit G (Application and TSDR for abandoned application no.

87417204 and 87417147). Applicant sells officially licensed hats, shirts, jerseys and pullovers for its Hometown Collection teams, including Portland Mavericks apparel, on its website.

Pursuant to the license agreement, for Applicant’s Hometown Collection, Ebbets Field

Flannels began selling merchandise in 2014 and advertised on Instagram, Twitter and various other websites to promote Portland Mavericks apparel including

The Hillsboro Hops is a member baseball team of Applicant based in the Portland,

Oregon area. Fountain Decl. at ¶ 11 Exhibit J. In October 2014, Hillsboro Hops entered into a

license agreement with Applicant relative to the use of the name PORTLAND MAVERICKS

7 and the applied-for logo in connection with baseball games and exhibitions during the 2015 season. Fountain Decl. at ¶ 12, Confidential Exhibit 5.

On April 29, 2015, the Hillsboro Hops announced its 2015 Promotional Schedule including its PORTLAND MAVERICKS night. Fountain Decl. at ¶ 13, Exhibit K. On April 30,

2015, the Hillsboro Hops PORTLAND MAVERICKS night was further promoted on The

Oregonian/Oregon Live and Twitter. Fountain Decl. at ¶ 13, Exhibit L; Exhibit M. PORTLAND

MAVERICKS merchandise continued to be produced and sold in 2015. Fountain Decl. at ¶ 13,

Exhibit N.

On August 20, 2015, the Hillsboro Hops held PORTLAND MAVERICKS night at Ron

Tonkin Field. Fountain Decl. at ¶ 13. Hillsboro Hops players wore licensed Portland Mavericks jerseys and the Portland Mavericks logo was featured in advertising. Below is one of the application specimens of record submitted with each of the opposed applications when the applications were on an actual use basis on April 11, 2017.

Sales of merchandise and promotion of the PORTLAND MAVERICKS team and merchandise continued through 2016. Fountain Decl. at ¶ 13, Exhibit O (MiLB Twitter page

June 9, 2016).

Internal discussions began in early 2017 to further promote the legacy of the Portland

Mavericks through expanded merchandising and through baseball games and exhibitions.

Fountain Decl. at ¶ 14.

9 By April 20, 2017, production of an official jersey commenced and other apparel was

sold under the marks. Fountain Decl. at ¶ 15, Confidential Exhibit 6. Applicant promoted this

official jersey and other apparel through its MiLB Store on Twitter several times beginning at

least as early as June 2017. Fountain Decl. at ¶ 15, Exhibit P. Applicant also advertised its

Hometown collection online in December 2017. Fountain Decl. at ¶ 15, Exhibit Q.

Upon learning of the Portland Mavericks night hosted by the Portland Pickles baseball

team, an independent baseball team comprised of college all-stars, Applicant entered into a

license agreement in June 2017 with the Portland Pickles to ensure quality control in use of its

PORTLAND MAVERICKS marks. Responses to Office Action, dated January 5, 2018, Exhibit

11, License Agreement; See also 16 TTABVUE 72-87; 23 TTABVUE 14-29.

In early March 2018, the Hillsboro Hops and Applicant entered into a further licensing agreement for the 2018 season and the Hillsboro Hops announced in a press release a MAVS

Monday mini-plan promoting baseball and exhibitions under the marks. Fountain Decl. at ¶17,

Confidential Exhibit 7; Exhibit R. The press release featured the below photograph:

The press release also featured the following quote:

“The Portland Mavericks are such a cool story and they are part of the fabric of baseball in the Portland-metro area,” said Hillsboro Hops President K.L. Wombacher. “We’ve been looking for an opportunity to bring these uniforms back since we wore them in 2015, and we’re excited to expand the Portland Mavericks connection with Hops fans.” Id.

The Hillsboro Hops continued to promote the PORTALND MAVERICKS events on its

Twitter feed. Fountain Decl. at ¶ 17, Exhibit S. On August 15, 2019, Opposer posted information on its Twitter feed about Applicant’s PORTLAND MAVERICKS night scheduled for August

20, 2019. Fountain Decl. at ¶ 17, Exhibit T.

The Mavericks nights were a smashing success. Applicant continued marketing and promotional efforts under the mark including additional Maverick Mondays games played in

ARGUMENT

SUMMARY JUDGMENT STANDARD

Summary judgment is only appropriate in cases in which the moving party establishes there are no genuine disputes as to material facts and it is entitled to judgment as a matter of law.

See Fed. R. Civ. P. 56(a). In deciding motions for summary judgment, the Trademark Trial and

Appeal Board follows the well-established principles that all evidence must be viewed in a light most favorable to the non-movant, and all justifiable inferences are to be drawn in the nonmovant’s favor. The Board may not resolve disputes of material fact, but ascertains whether such disputes exist. See Lloyd’s Food Prods. Inc. v. Eli’s Inc., 987 F.2d 766, 25 USPQ2d 2027

(Fed. Cir. 1993); Opryland USA Inc. v. Great Am. Music Show Inc., 970 F.2d 847, 23 USPQ2d

1471 (Fed. Cir. 1992); Olde Tyme Foods Inc. v. Roundy’s Inc., 961 F.2d 200, 22 USPQ2d 1542

(Fed. Cir. 1992). The party moving for summary judgment has the initial burden of

13 demonstrating that there is no genuine dispute of material fact remaining for trial and that it is

entitled to judgment as a matter of law. See Celotex Corp. v. Catrett, 477 U.S. 317 (1987);

Sweats Fashions Inc. v. Pannill Knitting Co., 833 F.2d 1560, 4 USPQ2d 1793 (Fed. Cir. 1987).

As fully explained below, Opposer has failed to meet its burden.

BONA FIDE INTENT-TO-USE

The Board has consistently held that “determination whether an applicant has a bona fide

intention to use the mark in commerce is an objective determination, based on all the

circumstances.” Swatch AG v. M.Z. Berger & Co., Inc., 108 USPQ2d 1463, 1471 (TTAB 2013), aff’d 114 USPQ2d 1892 (Fed. Cir. 2015), citing Boston Red Sox Baseball Club L.P. v. Sherman,

88 USPQ2d 1581, 1587 (TTAB 2008). Evidence “is ‘objective’ in the sense that it is evidence in the form of real life facts and by the actions of the applicant, not by the applicant's testimony as to its subjective state of mind.” Research in Motion Ltd. v. Corp., 92 USPQ2d 1926, 2009 WL

4694941, at *6 (TTAB 2009). The “evidentiary bar is not high,” but “the applicant's intent to use the mark [must have been] firm and not merely intent to reserve a right in the mark.” M.Z.

Berger, 787 F.3d at 1376.

“A party can prove that it had a bona fide intention to use a mark by evidence that had some experience in the field in the past and had the immediate ability to market the goods or services listed in the application.” 3 McCarthy on Trademarks, §19:14 (5th Ed. 2020).

Existing use on related goods or services may serve as objective evidence of bona fide intent to use. Rolex Watch U.S.A. v. PRL USA Holdings, Inc. 114 USPQ2d 1705, 1710 (S.D.N.Y.

2015)(“The brand concept behind this family of trademark could have easily and organically embraced watches and jewelry.”); RXD Media, LLC v. IP Application Development, 377

14 F.Supp.3d 588, 593-594 (E.D. Va 2019)(“Viewing this in the context of the strength of Apple’s brand, and its breadth of products and services, this evidence is sufficient to demonstrate Apple’s bona fide intent to use the IPAD mark [for cloud storage] rather than simply reserve rights in the

IPAD mark.”)

In addition, activities referenced under Rule 2.89(d) for showing “good cause” for an extension of time to file a statement of use – including “product or service research or development…manufacturing activities, promotional activities…or other similar activities” – may serve as objective evidence of an applicant’s bona fide intent to use the mark in commerce.

M.Z. Berger & Co., Inc. v. Swatch AG, 787 F3d. 1368, 1376, n.5, 114 USPQ2d 1892 (Fed. Cir.

2015).

Although bona fide intent to use relates to the filing date of the application, post- application activities may be probative of intent at the time of the application filing date. Lane

Ltd. v. Jackson International Trading Co., 30 USPQ2d 1351, 1355 (TTAB 1994)(“[W]e find that this correspondence, which occurred in October-December 1992, was sufficiently contemporaneous to the application filing date in January 1992 to serve as corroboration of the applicant’s declaration in the application of a bona fide intention to use the mark in commerce

…. [W]e find that the circumstances support applicant’s claim of bona fide intention.”); Spin

Master Ltd. v. Zobmondo Entertainment LLC, 778 F. Supp. 2d 1052, 1061, 100 USPQ2d 1513

(C.D. Cal. 2011)(Activities five to eight months after ITU application proved that applicant had a bona fide intention to use the mark).

Applicant has presented evidence of use in each of these categories.

15 Capacity and License Activities

Applicant clearly presented evidence of its experience in the field and capacity to use the mark. Applicant is an association of minor league baseball teams. Fountain Decl. at ¶ 2.

Applicant owns and/or owned registrations in Class 41 for “baseball games and exhibitions” for other legacy teams including the 89ERS, the MEMPHIS CHICKS and TAMPA TARPONS.

Fountain Decl. at ¶ 6-7. Applicant markets these legacy teams under its Hometown Collection.

Fountain Decl. at ¶ 8. Applicant has entered into licensing agreements for clothing, hats, jerseys and other apparel for its Hometown Collection and such licenses include the subject marks.

Fountain Decl. at ¶ 9.

Applicant entered into licensing agreements for using the subject marks with baseball

games with the Portland-area based Hillsboro Hops. Its 2014 and 2018 license agreements have

been produced in the discovery. Fountain Decl. at ¶ 9 and ¶ 17. It also entered into a license

agreement with the Portland Pickles concerning its use of the subject marks with baseball

services which was also presented in discovery. Fountain Decl. at ¶ 16.

Use with Related Products

Artwork for the PORTLAND MAVERICKS was added to Applicant’s Hometown

Collection design style guide for distribution for licensees in approximately July 2014. Fountain

Decl. at ¶ 8. Applicant sells officially licensed hats, shirts, jerseys and pullovers for its

Hometown Collection teams, including Portland Mavericks apparel, on its website. Fountain

Decl. at ¶ 10. Applicant has sold PORTLAND MAVERICKS apparel since 2014. Fountain Decl. at ¶ 9, Confidential Exhibits 2-4.

16 Advertising, Promotion and Rendering of Services

Beginning in 2014, Applicant’s licensees have marketed and promoted PORTLAND

MAVERICKS merchandise on various websites. Fountain Decl. at ¶ 10. On August 20, 2015,

Applicant advertised and rendered baseball services under the marks. Specifically, the Hillsboro

Hops hosted a Portland Mavericks night where the team players wore Portland Mavericks jerseys and caps and advertised its starting lineup in connection with the subject marks. Fountain Decl. at ¶ 13. On April 29, 2015, the Hillsboro Hops announced its 2015 Promotional Schedule including its PORTLAND MAVERICKS night. Fountain Decl. at ¶ 13. On April 30, 2015, the

Hillsboro Hops PORTLAND MAVERICKS night was further promoted on The

Oregonian/Oregon Live and Twitter. Fountain Decl. at ¶ 13. PORTLAND MAVERICKS merchandise continued to be promoted and sold in 2015. Fountain Decl. at ¶ 13. Sales of merchandise and promotion of the PORTLAND MAVERICKS team and merchandise continued through 2016. Fountain Decl. at ¶ 13. Applicant promoted an official jersey, and other apparel through its MiLB Store on Twitter and its Hometown collection online marketing throughout

2017. Fountain Decl. at ¶ 15.

The Hillsboro Hops hosted additional baseball games and exhibitions in 2018 and 2019, including a Mavericks Mondays package, and prominently featured the marks in the advertising, promotion and rendering of these services. Fountain Decl. at ¶ 17. Opposer even promoted

Applicant’s PORTLAND MAVERICKS night on its Twitter feed on August 15, 2019. Fountain

Decl. at ¶ 17, Exhibit T. Opposer is clearly very aware of Applicant’s use of the marks since

Opposer’s own Twitter feed states “all the information you need about the Portland Mavericks

Night August 20 @HillsboroHops is right here …” Fountain Decl. at ¶ 17, Exhibit T. Opposer is claiming Applicant did not have a bona fide intent to use the PORTLAND MAVERICKS marks

17 while at the same time promoting Applicant’s actual use of the PORTLAND MAVERICKS marks.

Applicant engaged in actual use, adverting and promotion of the PORTLAND

MAVERICKS marks with the applied-for services (“Entertainment services in the nature of baseball games and exhibitions”) through “throwback” nights both before and after the filing date.

Accordingly, Applicant clearly and sufficiently presented evidence of bona fide intent-to- use relating to: its capacity to use the marks; its licensing activities; its use with related products and services; its use in the advertising, promotion and rendering of the services. Although

Applicant believes that such evidence conclusively demonstrates its bona fide intent-to-use and actual use, at the very least, such evidence raises material issues of fact on the issue. Therefore, summary judgment must be denied under the circumstances.

APPLICANT’S DISCOVERY RESPONSES

In addition to ignoring the substantial evidence of record, Opposer seeks the entry of summary judgment based on a single response to a confusing and compound Request for

Production of Documents. 16 TTABVUE 188, Exhibit R (Response no 55[sic]).

As can be seen from the document, Applicant mistakenly referred to no documents relevant to Request No. 51, not Request No. 55. Applicant hereby withdraws its lack of personal knowledge objection as this related to an earlier position on a different request.

Therefore, Opposer was advised to refer to Applicant’s document production for support of its

responses that were not unqualified admissions, including Applicant’s unqualified denial of

Request for Admission No. 16.

In light of the overwhelming evidence of record which, at the very least, raise issues of

material fact precluding summary judgment on the issue of Applicant’s bona fide intent to use its

PORTLAND MAVERICKS trademarks, Applicant’s misinterpretation of a single poorly worded, ambiguous and confusing discovery request considered in isolation is improper. Rather, when all of Applicant’s discovery responses are properly considered, Applicant clearly demonstrates that it had a bona fide intent to use the subject marks as of the filing date and points

Applicant raises genuine disputes of material facts rendering summary judgment inappropriate. Applicant provided substantial and significance evidence relevant to Applicant’s bona fide intent to use the subject marks. Opposer’s reliance on a single discovery response is misplaced especially when the responses are considered in their entirety and otherwise contradicted by the record. Therefore, Applicant respectfully requests that summary judgment be denied.

1. I am counsel for The National Association of Professional Baseball Leagues, Inc.

(“Applicant”). I make this Declaration based on my personal knowledge of the facts and

circumstances stated below.

2. Applicant is an association of minor league baseball teams and trades under the

name Minor League Baseball. Applicant’s website is attached as Exhibit A from the following

url: http://www.milb.com/milb/history/general_history.jsp.

3. It is common practice for sports leagues such as Applicant to own and/or license

intellectual properties related to legacy and defunct sport teams. TSDR printouts are attached as

Exhibit B for Class 41 registrations for MONTREAL EXPOS (Reg No 1873010 – baseball),

HOUSTON OILERS (Reg No 1069143 – football), SEATTLE SUPERSONICS (Reg. No

1084317 – basketball) and ATLANTA THRASHERS (Reg No 2411175 hockey).

4. Sports leagues primarily license these intellectual properties for apparel and for use with “throwback nights” and other very popular fan events (e.g., fan fests, fundraisers, etc) celebrating the legacy of these sport teams.

5. Applicant owns and/or licenses intellectual properties related to legacy and defunct baseball teams, including the Portland Mavericks, which it refers to as its Hometown

Collection. A brochure from the Hometown Collection offering a free historic logo pennant which includes the Portland Mavericks team is attached as Exhibit C.

6. Applicant and/or its member baseball team own Class 41 registrations for The

89ERS (Reg. No 2079095 - defunct Oklahoma-based baseball team) and the MEMPHIS

CHICKS (Reg. No. 4295465 – defunct Memphis-based baseball team). TSDR printouts for these registrations are attached as Exhibit D.

7. There are multiple instances where “legacy” names and marks return into everyday usage. Accordingly, sports leagues such as Applicant take great care to preserve the significant goodwill associated with these names and marks. Applicant secured a Class 41 registration for TAMPA TARPONS (Reg. No. 4289111) as a legacy mark but subsequently the mark was assigned to its member baseball team which was renamed TAMPA TARPONS.

Attached as Exhibit E is a TSDR printout for this registration. In another case, one of Applicant’s affiliated teams in Jackson, Tennessee adopted the name JACKSON GENERALS, a name that was previously used by another affiliated team previously located in Jackson, Mississippi. The

PORTLAND BEAVERS name has also been used by multiple teams over various timeframes. It was used by the Albuquerque team in the Pacific Coast League who relocated to Salt Lake City in 1994. In 2001, the Albuquerque team relocated to Portland and became the PORTLAND

BEAVERS once again. Another example is the JAMESTOWN JAMMERS which was a team in

the New York-Penn League that relocated to Morgantown, West Virginia in 2015. Later, Minor

League Baseball licensed the JAMMERS name to a college league team in Jamestown. In

another case, the El Paso DIABLOS relocated to Springfield, Missouri and sold the DIABLOS

name to an independent team in El Paso. The CAPTAINS name has also been used by multiple

teams. First, by the Shreveport CAPTAINS, and then in 2003, the Columbus RedStixx relocated

to Eastlake, Ohio to become the Lake County CAPTAINS. In addition, the Quad City RIVER

BANDITS have changed name several times but are now back to the RIVER BANDITS.

Overall, “legacy” names and marks are vitally important to Minor League Baseball teams and

continually used with various teams.

8. Artwork for the PORTLAND MAVERICKS was added to Applicant’s

Hometown Collection design style guide for distribution to licensees in approximately July 2014.

Internal communications confirming this date are attached as Confidential Exhibit 1. Pages 1

through 13 and 120 through 121 of the current design style guide are attached as Exhibit F.

9. Applicant licensed its Hometown Collection trademarks (which includes

PORTLAND MAVERICKS) to a number of apparel companies including Ebbets Field Flannels,

New Era Cap Co., ’47 Brand, Original Retro Brand, Wincraft and American Needle. Applicant

has provided Opposer copies of the representative license agreements on a confidential basis.

Representative license agreements are attached as Confidential Exhibits 2 through 4. Applicant started selling licensed PORTLAND MAVERICKS apparel at least as early as October 2014.

Applications filed by Applicant including TSDR records for Class 25 goods on April 19, 2017

(Ser. Nos. 87417204 and 87417147) are attached as Exhibit G.

10. Applicant sells officially licensed hats, shirts, jerseys and pullovers for its Hometown

Collection teams, including Portland Mavericks apparel, on its website. Pursuant to the license agreement, for Applicant’s Hometown Collection, Ebbets Field Flannels began selling merchandise in 2014. Screen shots from Instagram, Twitter and various other websites promoting Portland Mavericks apparel in 2014 are attached as Exhibit I.

11. The Hillsboro Hops is a member baseball team of Applicant based in the Portland,

Oregon area. The website for the Hillsboro Hops from the following url: https://www.milb.com/hillsboro is attached as Exhibit J.

12. In October 2014, Hillsboro Hops entered into a license agreement with Applicant relative to the use of the name PORTLAND MAVERICKS and the applied-for logo in connection with baseball games and exhibitions during the 2015 season. A copy of the license agreement is attached as Confidential Exhibit 5.

13. On April 29, 2015, the Hillsboro Hops announced its 2015 Promotional Schedule including its PORTLAND MAVERICKS night. The announcement is attached as Exhibit K. On

April 30, 2015, the Hillsboro Hops PORTLAND MAVERICKS night was further promoted on

The Oregonian/Oregon Live and Twitter. The Oregonian and Twitter promotions are attached as

Exhibit L and Exhibit M. PORTLAND MAVERICKS merchandise continued to be promoted and sold in 2015 as shown on the attached Exhibit N. On August 20, 2015, the Hillsboro Hops

4 held PORTLAND MAVERICKS night at Ron Tonkin Field. Hillsboro Hops players wore licensed Portland Mavericks jerseys and the Portland Mavericks logo was featured in advertising. Sales of merchandise and promotion of the PORTLAND MAVERICKS team and merchandise continued through 2016. The MiLB Twitter page from June 9, 2016 is attached as

Exhibit O.

14. Internal discussions began in early 2017 to further promote the legacy of the

Portland Mavericks through expanded merchandising and through baseball games and exhibitions.

15. By April 20, 2017, production of an official jersey commenced and other apparel was sold under the marks. Contemporaneous internal communications concerning the official jersey are attached as Confidential Exhibit 6. Applicant promoted this official jersey and other apparel through its MiLB Store on Twitter several times beginning at least as early as June 2017.

The Twitter feed for the MiLB store from 2017 is attached as Exhibit P. Applicant also advertised its Hometown collection online in December 2017 as seen in the attached Exhibit Q.

16. Upon learning of the Portland Mavericks night hosted by the unaffiliated Portland

Pickles baseball team, Applicant entered into a license agreement in June 2017 with the Portland

Pickles to ensure quality control in use of its PORTLAND MAVERICKS marks.

17. In early March 2018, the Hillsboro Hops and Applicant entered into a further licensing agreement for the 2018 season and the Hillsboro Hops announced in a press release a

MAVS Monday mini-plan promoting baseball and exhibitions under the marks. A copy of the

2018 license agreement is attached as Confidential Exhibit 7. The press release is attached hereto as Exhibit R. The Hillsboro Hops continued to promote the PORTLAND MAVERICKS events

5 on its Twitter feed as seen in the attached Exhibit S. On August 15, 2019, Opposer posted information on its Twitter feed about Applicant’s PORTLAND MAVERICKS night scheduled for August 20, 2019. Applicant’s Twitter feed promoting Applicant’s event is attached as Exhibit

18. The Mavericks nights were a smashing success. Applicant continued marketing and promotional efforts under the mark including additional Maverick Mondays games played in

2019 and scheduled for 2020. Articles featured on MiLB.com and merchandise for sale on milbstore.com are attached as Exhibit U. The President of the Eastern League, Patrick T. Powers, Sponsorship was elected as the first President of the NAPBL. Fourteen leagues Charity partners and 96 clubs were members during the first season in 1902. The first NA office was established in Auburn, New York, under Umpires President Powers and successfully run by Secretary-Treasurer MiLB Office John H. Farrell. By the time Powers left office in 1909, there were 35 leagues and 246 clubs. Publications In 1910, Michael Sexton became President. In his first few years, Help Center wars between the Major Leagues and the outlaw Federal League hurt Minor League Baseball. The Federal League raided top Minor League Baseball teams, as well as National and American League teams, for players and territory. Sexton led a fight at the 1914 Baseball Winter Meetings to ward off a bid from radicals for Minor Jackie Robinson played for the Montreal Royals, League Baseball to desert the Major Leagues and back the a Dodgers farm team, before he integrated the Federal League. For 22 years, Sexton presided over Minor Major Leagues. (AP) League Baseball, leaving at the height of the Depression in 1932. But during his time, peace was restored and the Minor Leagues began to flourish. At the Winter Meetings of 1932, Judge William G. Bramham was elected President and served for 15 years. Bramham, who moved the NAPBL office to Durham, North Carolina, inherited 14 leagues and 102 clubs, but turned over 52 leagues and 388 clubs to George M. Trautman in 1947. During the height of World War II in 1943, the National Association had only 66 clubs and drew less than six million fans, an all-time low. But the end of the war would see fans again crowding into the ballparks in record numbers. Trautman moved the office to Columbus, Ohio, as he began a 16-year reign as President. The year 1949 saw 59 leagues and 448 clubs, both all-time highs, attract 39,640,443 fans, a record that stood for 54 years. However, the advent of television and, in Trautman's last two years, Major League expansion, would begin to cut into attendance. Following Trautman's death in March 1963, Frank Shaughnessy served as interim president until Trautman's assistant, Phillip Piton, was elected in December 1963. There were 20 leagues and 132 clubs in 1964 and attendance was only 10 million. By the time Piton left office in 1971, membership was back to 155 clubs. With the election of Henry J. Peters as President in December 1971, the NA was headed for another move. In September 1973, the office found its fourth home on Fourth Street South in St. Petersburg, Florida. Peters left in 1975 to become General Manager of the Baltimore Orioles. Robert R. "Bobby" Bragan SALE became President in January 1976, and by 1978 there were 158 clubs. On March 28, 1978, the office moved five blocks to $159.99 Bayshore Drive into the old clubhouse beside Al Lang Stadium, which was renovated and turned into an office building. The NA had phenomenal growth under the leadership of Moore, who retired in December 2007, after 16 years as President. In 1991, prior to becoming President, he established an agency agreement partnership between the Professional Baseball Promotion Corporation, a NAPBL subsidiary, and Major League Baseball Properties to authorize licensed merchandise. From a humble beginning in the early 1990s, merchandise sales in 2017 topped $70 million. At the Baseball Winter Meetings, the Promo Corp. conducts the annual Baseball Trade Show, where merchandisers and manufacturers display the goods that will fill stadium novelty stands and souvenir shops in the year ahead, and conducts business seminars for member teams. The Promo Corp. also runs Professional Baseball Employment Opportunities (PBEO), which assists candidates seeking jobs in pro baseball and the Minor League Baseball Promotional Seminar. There were several major accomplishments during the 1998 Joe DiMaggio, who debuted as shortstop with the season, including the realignment of Triple-A baseball from three 1932 San Francisco Seals, had a career average leagues into two, and establishing the Triple-A World Series, of .398 in the Minor Leagues. Minor League Baseball has been a continuing success story at the box office. The 2008 regular season attendance total of 43,263,740 established a new all-time record. In 2017, the 15 leagues with a total of 176 teams that charged admission attracted 41,832,364 fans. After serving 15 years as Chief Operating Officer, Pat O'Conner took over as Minor League Baseball's 11th President in January 2008. O'Conner was re-elected to a second term in December 2011 and a third term in December 2015. Highlights of O'Conner's first term in office include the extension of the Professional Baseball Agreement with Major League Baseball through the 2020 season; a five-year collective bargaining agreement with the Association of Minor League Umpires (AMLU) through 2016; realignment of four Class A leagues; the organization-wide bundling of Internet rights; a first-ever diversity initiative; an industry-wide health care program; a "Green Team" initiative to make Minor League Baseball teams and stadiums more eco-friendly and cost effective; and the location of new office space comprised of four buildings, totaling 18,000 square feet, on 16th Street North in St. Petersburg, Florida. In the first year of his third term (2016), O'Conner oversaw the use of 15-second pitch clocks in the Florida State League which led to a six-minute improvement in the time of FSL games. O'Conner also led the realignment of the Advanced Class-A California and Carolina Leagues following the 2016 season. In his second term, Willie Mays first played Minor League ball in O'Conner and Minor League Baseball launched Minor League Trenton, N.J., and then Minneapolis before Baseball Enterprises and Project Brand in 2013. Hillsboro Hops To Transform Into the Portland Mavericks for Monday Home Games During 2018 Season "Maverick Mondays" Start on July 2

HILLSBORO, OR (March 5, 2018) -The Hillsboro Hops (@HillsboroHops) announced that the team will re-brand themselves as the Portland Mavericks for Monday home games during the 2018 season starting on Monday, July 2. The Portland Mavericks nights are: July 2, July 16, August 20, August 27 and September 3.

The Hops will offer a "Mavs Mini-Plan" for fans wanting to purchase a mini-season ticket plan to the 5 games where the Hops will wear the Portland Mavericks uniforms made popular by the independent professional baseball team in the 1970s. The Mavericks rose to even greater prominence after the 2014 release of the documentary "The Battered Bastards of Baseball".

Fans can purchase tickets here or at the Hops ticket office. Purchasers of the Mavs Mini- Plan will receive access to purchase exclusive Portland Mavericks merchandise prior to the general public. "The Portland Mavericks are such a cool story and they are part of the fabric of baseball in the Portland-metro area," said Hillsboro Hops President K.L. Wombacher. "We've been looking for an opportunity to bring these uniforms back since we wore them in 2015, and we're excited to expand the Portland Mavericks connection with Hops fans."
