A1080/S1772 Prohibits smoking on state, county and local beaches and parks. Final version passed by NJ Senate and Assembly on 6/26/14 exempts wildlife refuges, reservoirs, golf courses (unless a town has a stronger ordinance), and allows towns and counties to exempt up to 15% of beach by their own local or county law. On 5/19/2014, S1772 voted through the Senate Health Committee with amendments to allow towns and counties to exempt up to 20% of all recreational areas, and exempt golf courses (sponsor Shirley Turner did not request these amendments). On 6/23/2014, only the amendments (up to 20% exemption and golf courses) were voted through the full Senate (30-3), but awaited full Senate vote on entire bill.

On 6/26/14, A1080 was substituted for S1772 and passed both the Senate and Assembly, but amended to only allow up to 15% of a town or county beach to be smoking permitted if the town or county passed a local or county law (no 15% exemption for parks or rec areas). On 6/26/14, S1772 passed the Senate (30-3), and passed Assembly in concurrence (63-8-5). Awaits the Governor’s signature.

Tax, Sales and Use

S1367 Establishes health care quality improvement fund grant program funded from tax rate increase on small cigars. Increases the tax on little cigars and cigarillos from 30% of the wholesale price to 150% of the wholesale price. Funds for the grants would be derived from 50% of the monies collected from the tax imposed on little cigars and cigarillos; of the remaining monies collected from this tax, 25% would be credited to the Department of Health and Senior Services for smoking cessation programs, and 25% would be credited to the General Fund for general State purposes. Little cigars and cigarillos are cigars which weigh, excluding packaging, no more than 3 pounds per 1,000 units, 6 and which resemble cigarettes in size and weight.
