COMMISSION STAFF'S AMENDED PROPOSED ORDER

COMES NOW the Staff (Staff) of the Public Utility Commission of Texas (Commission), representing the public interest and files this Proposed Order and Attachments. In support thereof, Staff shows the following: I. BACKGROUND

On October 11, 2018, the North American Numbering Plan Administrator (NANPA), in its role as the neutral third-party Numbering Plan Area (NPA) relief planner under the North American Numbering Plan, petitioned the Commission on behalf of the Texas telecommunications industry to approve an all-services distributed overlay NPA for relief of the 214/469/972 NPA. NANPA submitted the petition based upon its projection that, absent NPA relief, the supply of central office codes for the 214/469/972 NPA will exhaust during the third quarter of 2021. On October 15, 2019, the Administrative Law Judge issued Order No. 3 and adopted a revised proposed procedural schedule for the processing of this project. Order No. 3 requires a Commission Order prior to beginning the customer education and network preparation period. Pursuant to Order No. 3, Staff submits an amended proposed order along with a memorandum from Alicia Maloy of the Commission Infrastructure Division. Staff also attaches two maps showing the geographic area for the overlay. AMENDED PROPOSED ORDER

This Order delegates the North American Numbering Plan Administrator (NANPA) the authority to implement numbering plan area (NPA) relief consistent with the recommendation in the Petition filed by NeuStar, Inc.,' in its role as the NANPA, on October 11, 2018, for the 214/469/972 NPA.

I. BACKGROUND On October 11, 2018, NANPA petitioned the Commission on behalf of the Texas telecommunications industry to approve an all-services distributed overlay for relief for the 214/469/972 NPA. The all-services distributed overlay would superimpose a new NPA over the same geographic area covered by the existing 214/469/972 NPA. NANPA estimated that the supply of central office (CO) codes for the 214/469/972 NPA would exhaust during the third quarter of 2021. The industry participants reached consensus to recommend to the Commission a nine-month schedule for implementation of the overlay with relief in place six months prior to the forecasted exhaust date. On February 5, 2019, Commission Staff (Staff) and NANPA filed a Joint Response to Order No. 1 and proposed a method for processing this project as well as a procedural schedule. The proposed method for processing this project involved a 30-day comment period and that affected customers be informed by a notice in their bill and with a Commission press release to major regional news organizations.

On October 14, 2019, Staff and NANPA filed a Joint Updated Processing Method and Procedural Schedule. Staff and NANPA proposed to maintain the 30-day comment period and

Commission press release, but no longer proposed that customers be informed by a notice in their bill because customers will not need to change their dialing methods because of the relief plan of an overlay proposed by NANPA. The parties also provided an updated method of processing the petition due to NANPA revising their forecast for the 214/469/972 to exhaust during the second quarter of 2021. On October 15, 2019, Order No. 3 approved the updated method of processing the petition and adopted the revised procedural schedule.

II. DISCUSSION Upon consideration of all of the information provided, including the forecasted date of number exhaust for the 214/469/972 NPA being the second quarter of 2021, the Commission orders that the all-services overlay for the 214/469/972 NPA be implemented according to the following schedule: EVENT DATES (approximate)

Start of Customer Education and Network 1' quarter 2020 Preparation Period Overlay Relief in Place with Commissioner 4th quarter 2020 Order Earliest Activation of CO Codes in the New At the Completion of Customer Education NPA and Network Preparation Period Exhaust Date 2nd Quarter 2021

III. Findings of Fact

Procedural History 1. On October 11, 2018, NANPA filed a petition stating that the April 2018 Numbering Resource Utilization/Forecast (NRUF), published by NANPA, indicated that the 214/469/972 NPA will exhaust the supply of CO codes during the third quarter of 2021.

2. In the petition, NANPA stated it met with Industry participants on September 6, 2018 to address relief for the 214/469/972 NPA.

3. In the petition, NANPA stated that Industry Participants reached consensus to recommend a nine-month schedule for implementation of the overlay with relief in place six months prior to the forecasted exhaust. Project No. 48765 Order Page 3 of 5

4. On January 16, 2019, Order No. 1 required a joint response by NANPA and Cornmission staff regarding the appropriate method for processing this proceeding.

5. On February 5, 2019, NANPA and Commission staff filed a Joint Response to Order No. 1 recommending a 30-day public comment period, a customer bill notice, and a Commission press release to major regional news organizations. Additionally, the NANPA and Commission staff proposed a procedural schedule to implement the new NPA by the third quarter of 2021.

6. On February 6, 2019, Order No. 2 established the processing method and procedural schedule.

7. On October 14, 2019, Commission staff and NANPA filed a Joint Updated Processing Method and Procedural Schedule recommending that the bill notice requirement be revoked because dialing methods would not change, and the procedural schedule be updated to reflect the updated NRUF forecasted exhaust date for the second quarter of 2021 for the 214/469/972 NPA.

8. On October 14, 2019, Order No. 3 approved the updated method of processing the petition and adopted the revised procedural schedule.

9. A map of the 214/469/972 NPA is attached to this Order as Exhibit A.

IV. Conclusions of Law

1. The Commission has jurisdiction over this matter pursuant to the authority delegated to state commissions by the Federal Communications Commission (FCC) in its rule at 47 C.F.R. § 52.19 and pursuant to the Public Utility Regulatory Act (PURA).

2. The Commission provided reasonable notice of this proceeding.

3. The Commission afforded interested persons a reasonable opportunity for public comment and participation in this project.

4. The all-services overlay and implementation schedule for the 214/469/972 NPA is in the public interest. Project No. 48765 Order Page 4 of 5

V. Ordering Paragraphs

In accordance with these findings of fact and conclusions of law, the Commission issues the following Order:

1. The Commission delegates to NANPA the authority to implement an all-services distributed overlay relief plan for the 214/469/972 NPA, as described in its petition filed on October 11, 2018.

2. The implementation period shall be as follows: EVENT DATES (approximate)

3. NANPA is ordered to convene and facilitate implementation meetings and/or conference calls of service providers and Commission Staff, as appropriate to discuss implementation of the relief plan in this Order.

1. My name is Alicia Maloy. I am employed as a Senior Infrastructure Analyst in the Infrastructure Division of the Public Utility Commission of Texas ("PUCT").

2. I am at least 21 years of age, fully competent and authorized to make the statements herein. Additionally, I have personal knowledge of the facts stated herein, and they are true and correct to the best of my knowledge.

New Area Code Proposed for Metroplex Area Overlay would join existing 214, 469, and 972 area codes

Austin, TX — The Public Utility Commission of Texas announced it is reviewing a Petition by the North American Number Planning Administrator (NANPA) for the addition of a new area code to accommodate continued growth in and around Dallas. (NANPA projects that the three existing area codes will run out of numbers by the second quarter of 2021.) The PUC is accepting comments regarding the proposal during the next 30 days in PUC docket number 48765. Comments may be submitted no later than November 16, 2019 to the Filing Clerk, Public Utility Commission of Texas, 1701 North Congress Avenue, P.O. Box 13326, Austin, Texas 78711- 3326.

The area code would overlay existing area codes 214, 469, and 972 in Grayson, Denton, Colin, Hunt, Tarrant, Dallas, Rockwall, Kaufman, Johnson, Ellis, and Hill counties. Click here to view a map of the affected region.

In the event the PUC approves the Petition and the area code is assigned, customers would not be required to reprogram existing equipment because an area code overlay requiring 10-digit dialing for local calls already exists in the affected region. Customers would retain their current numbers.
