Proceedings of the 14 th meeting of State Coastal Zone Management Authority (KSCZMA) held on 5 th April, 2016 at 03:00 PM at District Commissioner’s Office, Mangalore under the chairmanship of Additional Chief Secretary to Government, Forest, Ecology & Environment Department.

The Chairman welcomed the members present. All the files were placed before the Authority for perusal and the subjects were deliberated as per the Agenda.

14.1 Confirmation of the proceedings of the previous KSCZMA meeting held on 30.01.2016. The proceedings of the previous KSCZMA meeting held on 30.01.2016 were read out. The proceedings were confirmed as there were no comments or amendments received from the members.

14.2 Action Taken Report on the proceedings of the previous KSCZMA meeting held on 30.01.2016.

Action Taken Report at Annexure – I was perused and the Authority noted the action taken.

14.3 Preparation of State Coastal Zone Management Plan :

Government of India Gazette Notification regarding extension of validity of CZMP upto 31 st January, 2017, notification dated: 22.03.2016 for the information of the Authority (Annexure IA) The Authority took note of the amendments notification issued by MoEF&CC. Further, the chairman emphasized that the CZMP of the state should be prepared as early as possible and get the approval of the NCZMA. The Secretary E&E to pursue the matter with the NCSCM, Chennai.

14.4.1 Integrated Coastal Zone Management Plan (ICZMP) Phase II :

1. The Ministry of Environment and Forests has initiated the World Bank assisted Integrated Coastal Zone Management Project (ICZMP) with a budget outlay of Rs. 1155.63 crores (US$262 million). 2. For implementation of the above project the Society of Integrated Coastal Management (SICOM) has been established as a registered body at MoEF & CC. 3. SICOM is implementing the following four components, namely, (i)National Coastal Management Programme (ii)ICZM West Bengal (iii)ICZM Orissa (iv)ICZM Gujarat.

4. Sharing pattern: 90:10. Only 10% sharing by State Govts. 5. Now GoI took decision to extend the project to all coastal states with increased budget outlay.

Broad objective of the ICZMP as follows :

1. The overall objective of the project is to support the Government of India and selected states in developing and implementing an improved strategic management approach for India’s coastal zone to preserve the long-term productivity of this highly populated region for continued sustainable development and economic growth. 2. This objective will be achieved through specific project components both at national and state level. 3. Approaches to achieve specific objectives are different for state to state.

The salient features of the project are as under :

1. The funding pattern is 90 : 10 ratio, wherein state has to contribute only 10% of the project cost 2. The project is integrated in nature, aiming at building sustainable management of coastal resources to provide livelihood for the coastal population. The activities included; protection, conservation and development of natural resources like estuaries, back waters, mudflats, mangroves areas, eco sensitive coastal zones, breeding and spawning grounds of economically important marine resources. 3. Apart from the above, the project also aims at building up of infrastructure for the coastal population both in urban and rural areas, which includes roads for fishermen colonies, erosion prevention structures, salt water intrusion prevention structures and providing basic amenities to local population. 4. The size of the project may vary from Rs. 400 crs to 1000 crs depending on the identification of components. 5. The MoEF has identified the National Centre for Sustainable Coastal Zone Management, Chennai, an autonomous organization of MoEF, to prepare DPR for all coastal states. 6. Various components included in the ongoing projects in West Bengal, Gujarat and Odissa are as follows:

a. Conservation(Mangrove afforestation, coral reef generation, turtle nesting sites, conservation of other ecological sensitive areas) b. Livelihood c. Infrastructure d. Tourism e. Pollution

f. Coastal erosion g. Disaster h. Climate change related i. Capacity building and awareness j. Fisheries and allied activities k. Scientific research l. Coastal Zone Management Plans/ICZMP m. Non-Conventional energy n. Portable water o. Carrying capacity study p. Area coverage

The following are the decisions taken in the meeting held on 17.08.2015 at Ministry of Environment, Forests and Climate Change, New Delhi :

1. State/ UT Government shall identify and establish a nodal agency and nominate a nodal Officer, this nodal agency shall be declared as SPMU and the same shall be informed to SICOM by 1 st September, 2015. 2. The Senior Officers from the existing SPMUs namely, Gujarat, Odissa and West Bengal shall assist the neighboring States/ UTs in setting up of SPMUs with requisite personnel’s including experts in the area of finance, procurement and other specialized areas. 3. State/UT Government shall identify two to three priority sites in their respective State/UT where ICZM project shall be taken up. However, the UTs which have very small coastal stretch could include the entire stretch of the UT or the entire geographical area in case of Islands as per the Island Protection Zone (IPZ) Notification, 2011. The above details will be informed to SICOM within two weeks i.e., by 1 st September, 2015. State/UT Governments shall make a commitment for 10% financial contribution to the total cost estimate that is being projected by the State/UT Governments. 4. The budget for the preparation of the DPRs and establishment of SPMU shall be borne by SICOM as per the budget approved by the Cabinet Committee on Economic Affairs (CCEA) on 21 st July, 2015. 5. With regard to upper budget limit for each State/UT, the State/UT Administration shall make a reasonable estimate keeping in view the financial structure or the limits being followed in the ongoing ICZM Project. 6. NCSCM shall assist the State/UT Governments to prepare the DPRs based on the template accepted by the State/UT Government 7. The draft DPRs shall be prepared by the State/UT Administration in consultation with NCSCM and the same shall be submitted by end November, 2015. 8. A Priority activity relating to remediation of critically polluted coastal areas shall be included as a National Component.

9. The preparation of DPRs and establishment of the SPMUs in the remaining ten coastal States/UTs shall be within the budget earmarked in the CCEA which is approximately Rs. 5 crore per State/UT.

As per the decision taken in the meeting, the EMPRI has been designated as nodal agency to coordinate with the NCSCM, Chennai for preparation of DPR. Accordingly, EMPRI has written to all line departments to furnish the baseline data required for DPR as well as the activities to be proposed in the ICZMP. Further, the EMPRI conducted a workshop involving all line department technical officers to create awareness on collection of data for DPR with the help of Director, NCSCM, Chennai on 22.02.2016 at Bengaluru. Very detailed discussion were taken place in the said workshop.

Further to have indepth knowledge on the DPR preparation, on 08.03.2016, a team of officers from Department of Forest, Ecology & Environment and EMPRI lead by the Secretary to Government, Ecology & Environment Department visited NCSCM, Chennai to have detailed discussion regarding preparation of DPR. During the discussion, the NCSCM officials shared the information regarding preparation of Base document preparatory to DPR which has to be sent to MoEF. Apart from the above, the various criteria to be adopted for selection of sites were also discussed. During the discussion, the officials of NCSCM have emphasized that once, the area are selected for the project, the same has to be discussed and approved in the State Coastal Zone Management Authority. In this direction, a meeting was organized under the chairmanship of the Secretary to Government, Ecology and Environment Department to discuss about selection of area for ICZMP. The Regional Directors of all 3 Coastal districts and Director, EMPRI have been involved in identification of sites for the project based on the critical nature of the coastal zone and the biodiversity richness. Accordingly the following talukas have been proposed :

District Taluka Criteria for selection Uttara The Karwar town is on the bank of Kali estuary and highly sensitive and as per the CRZ Notification Karwar is identified as Critically Vulnerable Coastal Area. Kumta Because of Aghanashini estuary complexes, entire Kumta Taluk is selected. Aghanashini estuary complex is very critical from the point of its marine biodiversity and its inter dependency for the livelihood of local inhabitants.

Udupi Udupi The following are the sites in .

St. Mary’s Island: It is very unique and fragile geological formation within the marine ecosystem. It is rich in coral reef. From the point of zonation potential as also it is very important.

Malpe: Major fishing harbor with high dependency of fisherman community for coastal resources. Apart from the above, there is Udyavara estuary which is very critical from conservation point of view. Kundapura As per CRZ Notification, this town is classified as Critically Vulnerable Coastal Area. Apart from Critically Vulnerable Coastal Area, there are good number of variety of Mangroves on the banks of river Seetha and Sowparnika etc which require conservation efforts. Mangalore Mangalore Mangalore is considered as Economic Growth Centre of coastal Karnataka. As large number of industries are located on the coast and Gurupura estuary, the site is taken as important for consideration in ICZMP. Apart from the above, Ullal area is known for sea erosion.

Based on the above inputs, the Authority deliberated on selection of sites for preparation of the base document to be submitted to MoEF & CC by NCSCM, Chennai. After considering various criteria and the inputs from expert members of the Authority the following Talukas have been selected for preparation of Base line document for ICZMP Phase II. 1) Uttara Kannada District- Kumta Taluk 2) Udupi District-Kundapura Taluk 3) Dakshina Kannada District-Mangalore Taluk

Further, the authority after discussion, decided to write letters to Dy. Commissioners of Uttara Kannada, Udupi & Dakshina Kannada Districts, to have a meeting of all the line departments along with EMPRI officials to get the baseline data & to complete this within 20 th of this month. The EMPRI should submit the data to NCSCM by 20-04-2016 without any delay.

14.4.2 HTL demarcation for preparation of CZMP:

Team of officers lead by Secretary to Government, Environment and Ecology visited the NCSCM, Chennai who have been assigned with HTL demarcation by MoEF. The team of officers verified the HTL demarcation online at the NCSCM. The following are the observations:

• HTL demarcation has been completed for the entire stretch of Karnataka. • HTL is based on aerial photography with 9 cm accuracy of 2011 from SOI. • HTL demarcation is made on 36 grids of 1 : 25,000 scale of topo map. • The entire HTL has been viewed and verified for any discrepancies. It was opined that by and large the HTL demarcation is acceptable except in the following cases:

i. In case of creeks and river there is a possibility of HTL demarcation extended beyond the salinity level of 5 ppt. This needs to be checked by NCSCM. Accordingly, the Centre was requested to revisit in such cases. ii. HTL demarcation for aqua culture land parcel need to be relooked. Accordingly, the Centre was requested to revisit.

After finalization of HTL demarcation the same is to be submitted to MoEF&CC, thereafter the MoEF&CC will share the information with the State Government.

The HTL forms the basis for further demarcation of coastal regulation zones viz., CRZ-I, CRZ-II, CRZ-III, CRZ-IV and CRZ-V. The Secretary to Govt E&E suggested that preparation of Coastal Zone Management Plan may be entrusted to NCSCM as they have already identified sensitive areas and HTL and it becomes easy for the institution to prepare CZMP.

Further it was informed by the Secretary to Govt that the States like Goa and Maharastra have already placed their request with NCSCM for preparation of CZMP.

After discussion, it is opined that assigning the preparation of CZMP along with demarcation of HTL to NCSCM is of advantage as the Centre has already identified CRZ-I areas ie; eco-sensitive areas and further they have the baseline data required for preparation of CZMP. As the NCSCM is an arm of MoEF&CC and the institute is involved in evolving policy at MoEF&CC, it is better to entrust CZMP to the centre. The Authority after discussion has decided to get quotation from Centre for Earth Science Studies(CESS), Trivandrum & NCSCM, Chennai regarding quote & time line for the preparation of CZMP, and finalize to which institute the CZMP preparation to be entrusted.

14.5 Deferred Proposals:

14.5.1. Request for issue of CRZ Clearance from The Commissioner of Police, Mangaluru City, Mangaluru for construction of Police Parade Ground, DCP Office Complex, CDP residence and Plice Research Centre at Sy. No. 2(P)2 and 52(P) of Bengre Village (FEE 75 CRZ 2016)

The Commissioner of Police, Mangaluru City, Mangaluru has requested to issue NOC for construction of Police Parade Ground, DCP Office Complex, CDP residence and Plice Research Centre at Sy. No. 2(P)2 and 52(P) of Bengre Village. The Regional Director (Environment) has inspected the proposed site and reported that project site is at jurisdiction of CRZ is 500 mts from HTL of Sea and 100 mts from HTL of River. It is classified at CRZ-II. The G.P.S. readings are N 12 0 53’ 09.9’, E 74 0 48’ 54.8’.

The Regional Director (Environment) has submitted the proposal along with application in the prescribed format, site inspection report, sy. map of site, site plan and building plan, estimate, agreement, copy of challan about payment of processing fees, CZMP map sheet, google map, inspection report of Regional Director (Environment) and proceedings of DCZMC meeting held on 28.01.2016. The DCZMC recommended the proposal for issue of NOC in the DCZMC meeting held on 28.01.2016.

In the 13 th KSCZMA meeting held on 30.01.2016, the Authority after discussion and deliberations decided to defer the proposal of the issue of CRZ clearance to the Commissioner of Police, Mangaluru City, Mangaluru for construction of Police Parade Ground, DCP Office Complex, CDP residence and Plice Research Centre at Sy. No. 2(P)2 and 52(P) of Bengre village as the proposal requires detailed examination. Further, the concerned Regional Director was instructed to get the opinion of the Forest Department on the status of the land.

The report from the Forest Department is awaited. However, since the meeting is being held at Mangalore, the CCF, Mangalore Circle has been invited for offering his opinion.

The Authority inspected the proposed parcel of land. During the inspection, the Authority noticed that the proposed land is covered with fully grown Casuarinas, Acacia plantation with natural species coming up as under growth. Due to plantations, the sand has been stabilized and there is no erosion. There are two parts in the proposed land parcels; one on the sea ward side of the road, which appears that it is a land parcel within the intertidal zone classified as CRZ I. The other one is riverside from the road, may be in CRZ II or CRZ III which required to be ascertained by survey. In the land parcel falling in the intertidal zone, activities proposed are construction of DCP office and parade ground. These activities are not allowed in CRZ I. Housing project proposed in the land parcel is abutting generates sewerage and are high rise buildings. The CCF Mangalore circle who was present in the meeting submitted that the land in question is Deemed Forest as per the recent report submitted to the Govt by DC and as such

Page 7 of 32 for diversion of such lands for non forestry purpose; it requires prior forest clearance from MoEF under section 2 of FC Act 1980. Further, the CCF, Mangalore Circle, submitted that, the area is ecologically sensitive & there is a need to conserve the bio-diversity of the area & he has also stated that, Forest department is planning to introduce some local tree species in that area wherever gaps are there. Dr. Jayappa, Professor of Marine Geology, Mangalore University and also Authority expert member opined that, the casuarinas, Acacia plantations are raised with an objective of protecting the coast from sea erosion and they are acting as wind shelters belts and they need to be protected instead of cutting them. The DC, Dakshina Kannada, suggested an alternative area of 7.5 acres along the Highway within the city limits, which belong to KSFIC. The Authority opined that it is better to explore the possibility to identify alternate area as suggested by DC Mangalore as an alternate non CRZ area for the proposed project instead of the proposed CRZ lands. Accordingly, the Authority decided to defer the matter till the proponent and the DC Mangalore explore the possibility of exploring non CRZ lands required for the project as suggested by DC, Mangalore. Further, it is opined that, In case alternate area is not available, the Authority may consider allowing the activities other than housing only on the river side land parcel.

14.5.2. Request for issue of CRZ Clearance from The Commissioner of Police, Mangaluru City, Mangaluru for construction of City Armed Reserve Police Quarters at Sy. No. 3(P)2 of Bengre Village (FEE 77 CRZ 2016)

The Commissioner of Police, Mangaluru City, Mangaluru has requested to issue NOC for construction of City Armed Reserve Police Quarters at Sy. No. 3(P)2 of Bengre Village. The Regional Director (Environment) has inspected the proposed site and reported that project site is at jurisdiction of CRZ is 500 mts from HTL of Sea and 100 mts from HTL of River. The distance is approximately 25 mts to 30 mts from HTL of River and 180 mts from HTL of Sea. It is classified at CRZ-II. The G.P.S. readings are as follows: North: N 12 0 53’ 9.40’, E 74 0 49’ 4.30’. South: N 12 0 53’ 1.66’, E 74 0 49’ 4.53’

The Regional Director (Environment) has submitted the proposal along with application in the prescribed format, site inspection report, sy. map of site, site plan and building plan, estimate, agreement, copy of challan about payment of processing fees, czmp map sheet, google map, inspection report of Regional Director (Environment) and proceedings of DCZMC meeting held on 28.01.2016. The Regional Director (Environment) has inspected the proposed site and reported that project site is at jurisdiction of CRZ is 500 mts from HTL of Sea and 100 mts from HTL of River. The distance is approximately 125 mts from HTL of River and 115 mts from HTL of Sea. It is classified at CRZ-II. The G.P.S. readings is N 12 0 53’ 10.00’, E 74 0 49’ 00.65’.

The Regional Director (Environment) has submitted the proposal along with application in the prescribed format, site inspection report, sy. map of site, site plan and building plan, estimate, agreement, copy of challan about payment of processing fees, czmp map sheet, google map, inspection report of Regional Director (Environment) and proceedings of DCZMC meeting held on 28.01.2016. Request for issue of CRZ Clearance from Raftar Terminals Private Limited for the storage of Acetic acid, MEG (Mono Ethylene Glycol), Naptha Motor Spirit at Sy. No. 46/1(P), 47/1(P), 47/2(P), 47/3(P), 47/7(P1), 47/7(P2), 47/8(P), 47/13(P), 47/14(P), 47/15, 47/16(P), 47/3P, 47/9(P), 47/10(P), 47/7(P3) of Thannirubhavi Village, Mangalore (FEE 364 CRZ 2015)

M/s Raftar Terminals private Limited has requested CRZ clearance for the storage of Acetic acid, MEG (Mono Ethylene Glycol), Naptha Motor Spirit at Thannirubhavi village. The Regional Director (Environment) has inspected the proposed site and reported that project site is at distance of 150 mts from river & 500 mts from sea (as per CZMP approved 1996). It is classified as CRZ III. The Distance from HTL is Approximately 205mts from HTL of sea, & approximately 150 mts from HTL of river.

The Regional Director (Environment) has inspected the site and reported that the area falls under CRZ-III as per approved Coastal Zone Management Plan 1996. The proposal was placed in DCZMC meeting held on 29-06-2015. The committee after discussions, deferred the case and decided to re-inspect the site with committee members. Accordingly the committee inspected the spot on 30-06-2015 and submitted a report for having violated the Para 3(iv) of CRZ Notification 2011. Para 3(iv) says “Land reclamation, bunding or disturbing the natural course of seawater” is prohibited activity. But again on 09.10.2015, the committee members inspected the site and after detailed verification, it is found that:-

1. The said area is not at all coming under the natural course of sea water and not disturbing the natural course of seawater. Hence no voilation is noticed. 2. The said area is adjacent to the G.M.R foundation project which is being executed long back where CRZ clearance has been obtained. 3. This land belongs to KIADB Industrial area, which is purchased on lease by M/s Raftar Terminals private Limited. 4. In this area no Mangroves species is found.

5. The project involves storage of petrolium products i.e Naptha, Motor Spirit, Acetic acid and Mono Etylene Glycol (MEG).

The Regional Director (Environment) has submitted the proposal for the storage of Acetic acid, MEG (Mono Ethylene Glycol), Naptha Motor Spirit at Thannirubhavi village, submitted by M/s Raftar Terminals private Limited, along with the application in the prescribed format, checklist, Form-I, survey sketch of site. Karnataka Industrial Areas Development Board possession certificate, material safety data sheet satellite image (10 Ms radius), tank farm facility layout, pipeline facility layout, site location showing the survey numbers, contour of the Site, green area, overall area and used area, connectivity map, pipeline road corridor, storm water layout, fire fighting layout, water NOC, fire NOC, MESCOM NOC, aerial view of the site, CRZ map and report by IRS, Anna University, geotechnical investigation report, risk assessment study report, copy of challan about payment of processing fees, CZMP of the proposed site, google map, inspection report of Regional Director(Environment), proceedings of DCZMC meeting held on 29-06-2015 & 16-11-2015. The DCZMC recommended the proposal to issue NOC in the DCZMC meeting held on 16-11-2015 with a condition that, the storage of Acetic acid & MEG were not there in the Annexure II of the Notification, and they have to take necessary permission for the storage of the same from the concerned department.

The area falls under CRZ-III as per approved Coastal Zone Management Plan. As per Para 8 III CRZ III (iii) and (e) of the CRZ Notification 2011, the above project is a permissible activity except for the storage of Acetic acid & MEG, for which permission may have to be obtained from the MoEF.

The Authority after discussion and deliberations had decided to send a team of officers consisting of Sri. A. Ramesh, SEO dealing with Hazardous Waste, concerned EO of Mangalore from KSPCB and RD, Mangalore to inspect the site and to get a report from them at the earliest before coming to final decision regarding giving CRZ clearance for the storage of Acetic acid, MEG (Mono Ethylene Glycol), Naptha, Motor Spirit, at Thannirubhavi Village, Mangalore.

As per the decision of the Authority, the above team inspected the spot on 07.01.2016 and has submitted its report on 16.01.2016. In this report it is recommended that the project can be considered for storage of motor Spirit and Naphtha and laying pipelines after taking into consideration all the aspects indicated in the report. However, the project proponent in his representation dated 14.01.2016 requested to permit the storage of Naphtha and motor spirit only.

In the 13 th KSCZMA meeting held on 30.01.2016, the Authority after detailed deliberations and discussion, decided to take up site inspection keeping in view the location of the project and sensitivity of the area and the subject is deferred.

The Authority Chairman, along with the members inspected the above site on 05- 04-2016 @ 10.30 AM.

The Authority after discussion and deliberations decided to issue CRZ clearance for the construction of storage tanks for storing Naphtha & Motor Spirit only with a condition to take onsite and offsite safety mitigation measures as proposed in the EIA report & to be regularly monitored by KSPCB officials & local RD regarding the storage of materials. Further, the Authority directed the project proponent to obtain all necessary statutory clearances before starting the project, including the Environment Clearance. 14.6 Sand Bar removal:

14.6.1. Proposal of removal of Sand from Sand Bar of Nethravathi River, Gurupuru river-Nandini river in Dakshina Kannada District for CRZ Clearance and issue of Environment Clearance (EC) [FEE 78 CRZ 2016]

The District Sand Monitoring Committee (CRZ), Dakshina Kannada District headed by the Deputy Commissioner Dakshina Kannada District, has submitted a proposal for CRZ clearance to Karnataka State Coastal Zone Management Authority (KSCZMA), for “Removal of Sand Bar which are obstructing the movement of fishing vessels and domestic boats in CRZ areas in Nethravathi River, Gurupuru River and Nandini River of Dakshina Kannada District” in the prescribed proforma. However, the proposals have not been examined by NITK, Suratkal as per the Office Memorandum dated 09.06.2011 of MoEF. The proposals were cleared in District sand monitoring committee (CRZ) meeting held on 06.01.2016 & DCZMA meeting held on 28.01.2016 and the proceedings of the both the meetings are enclosed along with the proposal. The proposals were received for CRZ clearance on 09-02-2016.

The Deputy Commissioner, Dakshina Kannada District has enclosed application in prescribed Form-I, sand bar maps and assessment details chart.

The MoEF, GoI has issued Office Memorandum dated 24.02.2011, 09.06.2011 and 08.11.2011 regarding removal of sand in the Coastal Regulation Zone area of rivers/estuaries by manual methods by traditional communities and implementation of provisions of Coastal Regulation Zone Notification, 2011. The Office Memorandums are enclosed as Annexure - II, Annexure - III and Annexure - IV respectively.

During removal of sand following condition shall be followed by the registered traditional communities:

a) Sand should not be removed to the depth beyond average bed level. b) If bank or bed erosion takes place sand should not be removed. c) Sand removal from the river bed other than the identified sand bar is prohibited. d) Sand should not be removed near nay vegetation or mangroves growth. e) Use of any mechanical methods for removal of sand is strictly prohibited.

f) If any damages to ecological system and the environment are observed, removal of sand should be stopped. g) Only day time (6am to 6pm) sand may be removed. h) No instruments/materials should be left behind in the river course. i) Minimum distance of 2 meter should be maintained from river bank for stocking of sand. j) In order to safe guard the river banks and roads sand removing/ transportation along the river banks should be prohibited in monsoon season i.e. June 15 to August 15.

The 19 proposals were recommended by the DCZMC for CRZ clearance by the KSCZMA

The subject was placed before the Authority for discussion. The Authority noted that, there would not have been much replenishment of sand in the rivers due to less rainfall & also in order to reduce the negative impact on the Benthic fauna, after discussion and deliberations decided to issue CRZ clearance by reducing the length of sand bar as shown in the Annexure-1. Further the Authority decided to impose the following conditions in addition to the conditions enumerated in para - 4 above:

i) The length of sand bars to be curtailed by 60 % except for the sand bar in Sl.no.2, for which, the length is to be curtailed by 50%, and accordingly, the lengths to be marked on the shore by putting boundary stones and showing all the details, like GPS readings, area of removal, quantity etc.,.(modified statement is enclosed as Annexure-1) ii) The Deputy Commissioner may permit removal of sand bars in the specified time period in a particular area along with specific quantity subject to such conditions, such as registration of local community persons permitted to remove the sand manually. iii) The Environmental Official at district level shall monitor the removal of sand and submit report to the Deputy Commissioner, as may be specified, say quantity of sand removed in the period concerned. iv) The above permit shall be renewed on yearly basis. v) The agenda and the minutes of the Seven Member Committee, permits issued by Deputy Commissioner and monitoring reports of the removal of sand would be uploaded on the website of the Deputy Commissioner’ office and also made available hard copy to Zila Parishad etc., as may be directed by the Deputy Commissioner. vi) The accumulation of sand bar, its removal process etc., shall be monitored by Deputy Commissioner with the help of satellite imageries, GPS, etc. It shall be ensured that the permits are not accorded in such areas which are identified as eco-sensitive zones, fish migratory and breeding grounds. The permits shall be given taking into consideration the local circumstances and ecological settings. vii) Deposit in the sand bars above the level of river bed only shall be removed by way of bar skimming and no pit excavation shall be permitted. viii) The sand deposits within the buffer zone of 50 meters from the existing mangrove shall not be disturbed. ix) Sand bars in the known breeding and spawning grounds shall not be disturbed.Removal of sand bars during the monsoon season which is generally the breeding season for the aquatic fauna shall be avoided. x) No pits in the river bed shall be formed as it tends to alter the entire river dynamics. xi) Sand bars at the vicinity of bridges and other engineering structures and the river banks shall not be disturbed.

xii) The projects authorities shall ensure that removal of sand bars do not disturb the habitants in order to conserve benthic flora and fauna that inhabit the sandy substrata. xiii) The project Authorities shall apply before SEIAA, Karnataka for Environmental Clearance for sand bar removal. xiv) The Authority reserves the right to cancel the NOC given under CRZ Notification for sand bar removal incase of any violation in the interest and conservation of coastal environment without giving any notice.

14.6.2. Proposal of removal of Sand from Sand Bar of Sowparnika River, Yadamavinahole river, Varahi river in Kundapura Taluk, and Seetha River Udupi Taluk of Udupi District for CRZ Clearance and issue of Environment Clearance (EC) [FEE 80 CRZ 2016 to FEE 109 CRZ 2016]

The District Sand Monitoring Committee (CRZ), Udupi District headed by the Deputy Commissioner Udupi District, has submitted a proposal for CRZ clearance to Karnataka State Coastal Zone Management Authority (KSCZMA), for “Removal of Sand Bar which are obstructing the movement of fishing vessels and domestic boats in CRZ areas in Sowparnika River, Yadamavinahole River, Varahi River and Seetha River of Udupi District” in the prescribed proforma. However, the proposals have not been examined by NITK, Suratkal as per the Office Memorandum dated: 09.06.2011 of MoEF. The proposals were cleared in District sand monitoring committee (CRZ) meeting dated 25.01.2016 and DCZMA meeting held on 25-01-2016 and the proceedings of the both the meetings are enclosed along with the proposal. The proposals were received for CRZ clearance on 05-02-2016.

The Deputy Commissioner, Udupi District has enclosed application in prescribed Form-I, sand bar maps and assessment details chart.

The subject was placed before the Authority for discussion and the Authority after discussion and deliberations decided to issue CRZ clearances to removal of sand bars except the sand bars SB-VR-7 (sl.no.7), SB-ST-13 (sl.no.13), SB – SW-17 (sl.no.17), SB – SW-19 (sl.no.19), SB – SW-22 (sl.no.22), SB – SW-24 (sl.no.24), SB – SW-27 (sl.no.27) as shown in Annexure – 2. Further the Authority decided to impose the following conditions in addition to

the conditions enumerated in para - 4 above:

Request for issue of NOC from M/s Agarwal Industries Corporation Ltd, Karwar Port Installation, Bhudvel temple road for construction of Liquid storage Tank Terminal for storage of Molasses, Edible oil and Bitumen at sy. No. 21A1/21A/1 & 21A2/149K of Goudwada, Baithkol Village, Karwar Taluk. [FEE 04 CRZ 2016]

M/s Agrawal Industries Corporation Ltd, Karwar Port Installation, Bhu Devi Temple road has requested to issue NOC for construction of Liquid Storage Tank Terminal to store Molasses, Edible Oil and Bitumen at Sy. No. 21A1/21A/1&21A2/149K of Goudwada, Baithkol Village, Karwar Taluk. The storage capacity of the tank terminal is 20000-22000 KL and there are 3 dedicated pipeline link of 1.3 Km length each from Karwar Port. The Regional Director (Environment) has inspected the proposed site and reported that project site is at jurisdication of 150 mts from HTL of River (as per CZMP approved 1996). It is classified as CRZ-III. The distance from HTL of sea is 30.22 mts. The G.P.S. readings is N 14 0 47’ 39.7’, E 74 0 06’ 30.0’.

The Regional Director (Environment) has submitted the proposal along with application in the prescribed format, Site inspection report, approved CZMP map sheet, draft digitized map showing the proposed area of construction, R.T.C. of the site, Project layout, EIA report and proceedings of DCZMC meeting held on 07.01.2016. The DCZMC recommended the proposal for issue of NOC in the DCZMC meeting held on 07.01.2016, for the storage of edible oils excluding Molasses and Bitumen.

As per the provisions under the Para 8 III CRZ III A (iii) (e) of the CRZ Notification 2011 facilities for receipt and storage of petroleum products and liquefied natural gas as specified in Annexure-II are permitted and as per Para 8 III CRZ III B (iv) of the CRZ Notification 2011 provision is there for storage of non-hazardous cargo such as, edible oil, fertilizers, food grain in notified ports. But, as per Para 8 III CRZ III A (i) of the CRZ Notification 2011. The NDZ shall not be applicable in such area falling within any notified port limits. The storage of Bitumen and Molasses are not included in Annexure- II of the CRZ Notification 2011. Subsequently the project proponent in his representation submitted on 10.12.2015, stated that Bitumen and Molasses are non hazardous and also not listed as per Hazardous Raw Material Notification 2000 and its amendments thereof. Further he has also stated that the committee has accorded similar permissions in the past for the following parties at Karwar Port for CRZ III terminals:

The same was placed before the Authority and the Authority was not convinced with the reply of the Port Officer. The Authority after discussion and deliberations decided to issue CRZ clearance for construction of Liquid storage Tank Terminal for storage of Edible oil only at sy. No. 21A1/21A/1 & 21A2/149K of Goudwada, Baithkol Village, Karwar Taluk as per the recommendation of the DCZMC, subject to confirmation from Port authorities that, the proposed industry falls in the Notified Port area. Member Secretary may confirm the same and issue CRZ clearance.
