    MINISTRY OF ENVIRONMENT AND FORESTS

    NOTIFICATION New DeIhi, the31st May, 2012 S.O.IlS9(E).-Whereas, the Puma Wildlife Sanctuary is one of the richest and compact 1iio:dlversity . patches covered on all sides by very good quality teak forests along with bamboo patches dotted in between and it maintains very rich bio-diversity comprising 61 tree species, 31 species of herbs and shrubs andl g species of climbers, 24 manunal species which include some rare species, 18.species of reptiles, more than 3000 species of insects and more than 142 species of birds;

    And whereas, . it is necessary to conserve and protect the area around the protected area otI>uma: WIldlife Sanctuary as Eco-sensitive Zone from ecological and environmental point of view by habitat management aiming at improving and preserving the genetic resources of Puma Wildlife Sanctuary, reintroduction and rehabilitation of local species through breeding progranunes, promote environmental education and ecological research;

    And whereas, a draft notification tinder sub-section (I) read with clause (v) and clause (xlv) of'su~section (2) of section 3 of the Environment (protection) Act, 1986 (29 of 1986) was published in the Gazette of India, Extraordinary, vide notification of the Government of India in thy Ministry of-Environment and Forests number S.O. 1266(E), dated the lSI June, 2011, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, inviting objections and suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

    And whereas, all objections and suggestions received in response to the draft notification have been duly considered by the Central Government;

    Now, therefore, in exercise of the powers conferred by sub-section (l) read with clause (v) and clause (xiv) of sub ~. section (2) of section 3 of. the Environment (Protection) Act, 1986 (29 of 1986) and sub-rule (3) of rule 5 of the Environment (Protectlon) Rules, 1986, the Central Government hereby notifies the area upto 2 kilometers from the boWJdary of the protected area of Puma Wildlife Sanctuary, enclosed within the boundary described below in the State of as the Eco-sensitive Zone (herein after called as the Puma Eco-sensitive Zone). 1. Boundaries of Puma Eco-slmsitive Zone.-

    (a) Puma Wildlife Sanctuary is situated between latitude 20° 51' 15" N and 21° 31' 22" N and between 73° 32' 20" E and 73° 48' 30" E longitude; (b) the total area covered is 160.8451 square kilometer. Entire sanctuary comes in Dangs district with the headquarters at ; (c) the extent of Eco-sensitive Zone surrounding Puma Wildlife Sanctuary Protected Area is 25036.49 ha. The range of radius of the Eco-sensitive zone is 0-2 kilometer on all sides and mean distance is 1.5 kilometer surrounding the Protected Area; (d) Mahal is a central place of sanctuary, the area of north is a continuous ridge with steep slope, which is boundary of division ( district), other side of the sanctuary falls in Dangs district; (e) forests of the surrounding areas are also used by the Wild animals of Sanctuary; (f) the map and boundary Global Positioning System points of Puma Wildlife Sanctuary and Puma Wildlife Sanctuary Eco-sensitive Zone is appended with . this notification as Annexure I and the list of the villages falling within Puma Eco-sensitive Zone is appended as AIlnexure II.

    2. Zonal Master Plan for the Puma Eco-sensitive Zone.-

    (1) A Zonal Master Plan for the Puma Eco-sensitive Zone shall be prepared by the State Government in such manner as are specified under the Wild Life (Protection) Act, 1972 (53 of 1972), the law relating to town and country planning for the time being in force in the State, the divisional working plans and the guidelines issued by Central Government, within a period of two years from the date of this 'notification and apptoved by the Centnil Government in the Ministry of Environment and Forests. (2) The Zonal Master Plan shall be prepared with due involvement of all concerned State Departments of Envitonment, Forest, Urban Development, Tourism, Municipal, Revenue and the Gujarat State Pollution Control Board for integrating environmental and ecological considerations into it. (3) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment· areas, watershed management, groundwater management, soil and moisture conserVation, needs of local community and such other aspects of the ecology and environment that need attention.     (4) The Zonal Master Plan shall demarcate aU the existingworshlwing places, Village settlements, types and kinds of forests, agriculturaI areas, fertile lands, green areas, horticulturaI areas, orchards, lakes and other water bodies. (5) No change of land use from green uses such as tea gardens, horticulture areas, agriculture, parks and others like places to non greCn uses shall be permitted in the Zonal Master Plan. However, to meet the residential needs of the local residents due to the natural growth of existing local population, strictly limited conversion of agriculturaI lands may be permitted, with the prior approval of the State Government. (6) The Zonal Master Plan shall be a reference document for the Monitoring Committee . for any decision to be taken by them including consideration for relaxation. (7) All the human habitation areas with populations of 5000 and above shall have ¥ea Development Pian and be prepared under the guidance of local self Government. (8) Pending the preparation of the Zonal Master Plan for Eco-sensitive Zone and approval thereof by the Ministry of Environment and Forests all new constructions and other developmental activities shall be referred to the Ministry of Environment and Forests by the Monitoring Committee as per sub-para (4) of paragraph 4 of the notification. (9) There shall be no consequential reduction in Green area such as forest area, agriculturaI area, etc. and the unused or unproduCtive agriculturaI areas may be re­ forested. (10) The Central Government and the State Government may specifY other measures, if it considers necessary, in giving effect to the provisions of this notification.

    3. Regulated or restrictive activities in the Eco-sensitive Zone.- All activities in the Puma Eco-sensitive Zone shall be governed by the provisions of the Wildlife (Protection) Act, 1972 (53 of 1972) the Forest (Conservation) Act, 1980 (69 of 1980) and the Environment (protection) Act, 1986 (29 of 1986). Subject to the provisions of this paragraph, the activities in the Eco-sensitive Zone shall be regulated in accordance with Annexure m to this notification.

    (1) Industrial Units: On or after the pUblication of this notification in the Official Gazette, no new polluting industries shall be allowed within the Eco-sensitive Zone and the non­ polluting industries in the region may be considered with the provision of minimum of 50 meter wide green belt.

    (2) Quarrying and Mining: (a) No mining and crushing shall be allOWed within the Eco­ sensitive Zone; provided that the quarrying of sand for local use in river J;eds in Tapi and Ahwa-Dangs Districts may be permitted at selected sites in consultation with Forest Department with due safe guards, as per the existing rules and regulation prevailing for the purpose;

    (b) no fresh mining lease shall be granted in eco-sensitive zone and the, existing mining . leases, if any, shall be phased out with the term of current lease and no extension of those mining lease shall be allowed:

    Provided that the permission to collect sand and stone from river bed for local use at locations may be permitted at sites approved vide no. 8-104, 89-FC, dated 26/07/1990 under FCA-1980 by the Ministry of Environment and Forests. TIlE GAZEITE OF INDIA: EXIRAORDINARY [pAJIT ll-Soc. 3(ii») (3) Trees: Felling of trees on forest should be as per the Working Plan or Management Plan approved by the Competent Authority and the felling of trees on private or revenue lands may be allowed in accordance with the State regulations.

    (4) Tourism: Tourism activities shall be as per the Tourism Master Plan which sh3I1 emphasize on ecotourism, eco-ed.ucation and eco-development and be prepared by the Department of Tourism in consultation with the Department of Environment and Forest and shall be a component of the Zonal Master Plan.

    (5) Ground Water:

    (a) Extraction of ground water for bona-fide agricu1tura1 and domestic consumption of the occupier of land shall be allowed. (b) Extraction of ground water for indu'ltrial, commercial use shall require prior written permission, including the amount that can be extract!ld, from the State Ground Water Board. (c) Appropriate steps shall be taken to prevent contamination or pollution of water, including from agriculture activities.

    (6) Use of Plastics: No person shall use plastic carry bags within the Eco-sensitive zone area and the disposal of plastic articles shall be strictly regulated.

    (7) Noise poHutien: The Environment Department or the State Forest Department, Gujarat shall be the authority to draw up guidelines and reauJations for the control of noise in the Eco-sensitive Zone.

    (8) Disdlarge of emuents:" No untreated or in4ultria1 eftluent shall be permitted to be discharged into ,any water body or on land within the Eco-sensitive Zone and the treated effluent shall meet the provisions of the Water (Prevention and Control of Pollution) Act, 1974.

    (9) Solid Wutes: (a) The solid waste disposal shall be carried out in accordance with the provisions of the Municipal Solid Waste (Management _ Hand1iag) Rules, 2000 notified by the Central Government vide notification number S.O. 901 (E), dated the 25th September 2000, as amended from time to time.

    (b) (i) the local authorities shall draw up plans ,for the sepegation of solid wastes into biOdegradable .. andnon-biodegradable components; (ii) the biOdegradable material may' be 'recycled prefenbly through composting or veI'mi.culture; (iii) the inorganic material may be disposed in an environmentally acceptable' manner at site identified outside the Eco-sensitive Zone; and (iv) no burning or incineration of solid wastes shall be permitted in the Eco-sensitive Zone.

    (10) Natural Spriap: The catchment areas of all springs shall be identified and plans for their conservation and rejuvenirtion of those that have run dry, in their natural setting shall be incorporated in the Zonal Master,Plan and the strict guidelines shall 8e,dra~ up by the State Governmentto ban development activities at or near these areas, ...... o'" . ['l1'I ,,-~ 3(ii)] , 21 (11) Awaren~ss: The stat~ Environment and Forests Department shall regularly carned out nat~~ educatIOn. an? ~VlrOIl1~ental awareness campaigns in each village falling in Eco­ sensitive Zone, highhghtmg the Importance and usefulness of the Wildlife Sanctuary. 4. Monitoring Committee. -

    (I) In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes a • Cornmittee to be called the Puma Eco-sensitive Zone Monitoring Cornmittee to monitor the compliance of this notification. (2) The Monitoring Cornmittee referred to in sub-paragraph.(I) above, shall consist of not mQre than ten members who shall represent the following, namely:- (a) Collector, Dangs - Chairman; (b) a representative of the Ministry of Environment and Forests, Government ofIndia -Member; (c) one representative of Non-governmental Organizations working in the field of environment to be nominated by the Government ofIndia - Member; (d) Regional Officer, Gujarat State Pollution Control Board, Dangs - Member; (e) Senior Town Planner ofthe area- Member; (f) a representative of the Department of Forests and Environment, Government Olf Gujarat - Member; (g) one expert in the area of ecology and environment to be nominated by the Ministry of Environment and Forests, Government oflndia - Member; (h) Deputy Conservator of Forests (In Charge of the Sanctuary), Dangs - Member Secretary.

    (3) The powers and functions of the Monitoring Cornmittee shall be restricted to the compliance of the provisions of this notification. (4) In case of activities requiring prior permission, under the provisions· of the notification of the Government of India in the Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), the Monitoring Committee shall refer all such matters to the Central Government in the Ministry of Environment and Forests for prior clearances under the provisions of the said notification. (5) The Monitoring Committee may invite representatives or experts from concerned· Departments or Associations to assist in its deliberations depending on the requirements on issue to issue basis. (6) The Chairman or the Member Secretary of Monitoring Committee shall be competent to file complaints under section 19 of the Environment (Protection) Act, 19!f6 for non­ compliance of the provisions of this notification. (7) The Monitoring Committee shall submit its annual action taken report of its activities by the 31 sl March of every year to the Central Government iii Ministry of Environment a!)d Forests. (8) The Ministry of Environment and Forests shall give directions, from tilne to time, to the Monitoring Committee for effective discharge of the functions of the Monitoring Committee.
