Trauger ) BRAD DOUGLAS PAISLEY, et al., ) ) Defendants. ) MEMORANDUM Before the court is the Motion for Summary Judgment (Doc. No. 115) filed by defendants Brad Paisley, Kelley Lovelace, Chris DuBois, Frank Rogers, Carrie Underwood, Sea Gayle Music, LLC, EMI April Music Inc. (“EMI April”), and Sony Music Entertainment. Also pending is Defendants’ Motion to Exclude the Reports and Testimony of Judith Finell (Doc. No. 113). In their Motion to Exclude, the defendants do not challenge Finell’s qualifications to be an expert. Instead, they argue that her testimony and reports are unreliable and irrelevant, asserting essentially the same points raised in support of their Motion for Summary Judgment. The court finds that Finell’s testimony and reports are not inherently unreliable or irrelevant and will therefore deny the Motion to Exclude. The court has considered Finell’s reports and testimony in ruling on the defendants’ Motion for Summary Judgment. Nonetheless, as discussed below, the Motion for Summary Judgment will be granted and this case dismissed. I. FACTUAL AND PROCEDURAL HISTORY1 The plaintiff, Amy Elizabeth Connor Bowen, lives in Dallas, Texas, but she previously resided in Nashville while she pursued a country songwriting career under the name “Lizza Connor.” Defendant Brad Paisley is a country songwriter and performer. Defendants Kelley Lovelace and Chris DuBois are country songwriters. Defendant Frank Rogers is a songwriter, record producer, and music publisher. He produced Paisley’s 2011 album, This Is Country Music. -

Honors Director Date ON THE HISTORICAL AND FUTURE ROLE OF THE MUSIC PRODUCER 3 Abstract The research completed in this thesis is designed to review the historical role of the music producer and track its evolution into the modern era. Focus on the history of the producer will include formal research from the time and a review of individuals who pioneered significant change in the industry. The thesis will then explore the role of the contemporary record producer and raise questions about the impact of modern technology and practice. The creative aspect of the thesis will be completed by fulfilling the role of producer for a local artist: coordinating, engineering, mixing, and ultimately producing a four-track Extended Play (EP) project that will include the final professional audio project and approximately ten pages of production documentation organized as a separate document. Inequality on Country Radio: 2019 in Review By Jada E. Watson in partnership with CMT’s Equal Play Campaign This research is supported by an Insight Development Grant from 17 February 2020 Twenty years ago, today, the Dixie Chicks celebrated their third consecutive week in the #1 position of the Billboard Hot Country Singles & Tracks Chart with “Cowboy Take Me Away”. Joining the trio in the chart’s top positions were Faith Hill with “Breathe” at #5, Reba McEntire with “What Do You Say” at #6, Martina McBride with “Love’s the Only House” at #10, Jo Dee Messina with “Because You Love Me” at #11, SheDAISY with “This Woman Needs” at #12, LeeAnn Rimes with “Big Deal” at #15, and Chely Wright with “It Was” at #19. That’s 8 songs by women in the Top 20 positions of the radio chart – making up 40% of the week’s top songs. An additional 12 songs by female artists charted outside of the Top 20 on the 19 February 2000 chart, bringing the count to 20 songs (26.7%) on the chart.1 Last year in this same week, just 2 songs by women were in the Top 20 – Carrie Underwood’s “Love Wins” at #14 and Kelsea Ballerini’s “Miss Me More” at #18, making up 10% of the top songs. Eight other songs by women ranked in the bottom 40 positions of the chart – bringing the count to just 10 songs (16.7%) of the week’s chart.2 Over the course of this 20-year period, the culture of Billboard’s airplay chart changed so drastically that the percentage of songs by women in the Top 20 declined 75%. -

Knowing that she risks losing the dream that has inspired her since the age of four, she takes the bold step to use her public capital, not to better her career, but to speak out on one of the most polarizing civil rights issues of our time. Growing up in Wellsville, Kansas, in the heart of the Bible Belt, she prays daily, “Dear God, please don’t let me be gay.” Arriving in Nashville at seventeen, she quickly realizes that she will have to keep her sexual identity under wraps to make it in this town. No Country star had ever come out as gay, and there is no way she will be the first. But even at the height of her success, she remembers looking in the mirror and whispering, “Who are you? What are you doing?” Finally, having painted herself into a corner, she realizes that she cannot survive the life she has created. -

Message in the Music: Do Lyrics Influence ell-Being?W Abstract Music has long been an effective way to communicate to the masses, and lyrics have played a massive role in delivering this communication. Yet the opportunity for research on the role lyrics play in well-being is vastly underutilized. This paper is an exploration of the relationship between lyrics and positive psychology. I will discuss a brief origin of lyrics, examine the body of literature on lyrics as well as its gaps, and finally suggest potential application of lyrics ot increasing various aspects of well-being. We are only beginning to have the language to discuss the positive and negative effects of lyrics. The results of this exploration indicate that lyrics have the potential to increase two of the five elements of well-being in the PERMA model, positive emotions and meaning. It is suggested that you can increase well-being by mindfully listening to meaning-filled lyrics bolstered by music’s ability to influence emotion. -

ABSTRACT Days Up and Down They Come: Townes Van Zandt and the Search for the Meaning of Life and Death Hunter H. Hewell Director: Prof. Robert Darden Texas has had a long standing tradition of excellent songwriting, and has been known to produce outstanding songwriters in each generation. Perhaps no time was filled with more prolific Texas songwriters than the late 1970’s in which artists such as Willie Nelson and Waylon Jennings dominated the country music scene. However, no songwriter from that era is as highly regarded in folklore and legend as the portentous Townes Van Zandt. Despite a long struggle with alcohol and drugs, Van Zandt's songwriting abilities have been unrivaled in music. Each of his songs have a literary quality that allows them to tap into otherworldly truths. Through study of his life and music, I have attempted to find out what Van Zandt has to say about what it means to live and die, topics on which he frequently writes. The music of Van Zandt gives an interesting look on the meaning of life, death, and sorrow given from the perspective of a true artist and poet. An interview with singer/songwriter Jackson Gillies on his return to the stage in his concert from the Marjorie Luke Theatre By Rod Lathim Santa Barbara has watched singer/songwriter and now producer Jackson Gillies blossom into a prolific creator and performer, having graced just about every venue in the area since he was the ripe young age of 15. After a considerable hiatus marked by exporting himself to study music and songwriting in London, and then a forced return and quarantine in the hills of Santa Barbara due to COVID-19, Gillies returns to the stage. In a recent interview, Gillies referred to himself as “the new Jackson” numerous times. And that’s who we will see in an acoustic concert, supported by some of the area’s most respected musicians, recorded recently onstage at the Marjorie Luke Theatre and streaming for free at www.luketheatre.org beginning December 18. The “new Jackson” has, by his own admission, evolved musically and emotionally. The young man who won Teen Star in 2016, was a TEDx Speaker, performed with Kenny Loggins, Michael McDonald and David Foster and other music icons, and competed on “American Idol” in 2019, has taken an inward journey and emerged a more mature, mindful, centered soul. His new songs are heartfelt, authentic, and intimate. His singing style is no longer about being the biggest voice in the room and has fewer vocal acrobatics. As with most people who have taken an inward journey, Jackson’s new sound, lyrics, and music are sensitive, contemplative, and reflective of his struggles, losses, and newfound awareness of life’s gifts.
