Situation and Description The land is situated within the heart of the rolling South Hams picturesque countryside whilst being conveniently located within approximately 5 miles of the A38 Devon Expressway and approximately 6 miles of the market town of Totnes.

The land offers potential for a variety of uses subject to necessary consents and permissions including the current agricultural use or as amenity or hobby farming as well as equestrian.

The Land Formerly having formed part of Crabadon Cottage Farm, the land comprises six useful sized pasture fields which surround a further area of natural regeneration broadleaf woodland with the land extending in total to 34.30 acres (13.87 hectares).

The Grassland The pasture fields total 29.62 acres (11.98 hectares) with OS3546 being gently north facing below the central woodland area, OS Numbers 1232, 2932 and 4534 being more level with a very gently east facing gradient to the higher side of the woodland and with OS5633 to the east being more south-east facing. OS1421 to the south-west is both south and east facing running down the valley towards the natural water supply.

The various field boundaries are predominately solid Devon hedge banks with some added supplementary stock fencing to some boundaries including sheep netting and barbed wire and field boundaries also having semi-mature tree growth interspersed.

The Woodland

The woodland runs in a tongue through the mid-section of the land and is a natural broadleaf regeneration woodland with predominately Ash and Oak trees with a hazel coppice understorey. The woodland floor is abundant with wildflowers such as bluebells, orchids, primroses, celandines and provides an attractive wildlife habitat as well as potentially providing some shelter for livestock.

Access Access is via a part stoned track leading off the Crabadon Cross to Rolster Bridge Road which runs up to the eastern side of the land. To the bottom/southern end of the track is a 10’0 (3.048m) gateway.

N.B. Whilst the track is owned and included in the sale, there are rights over the track to neighbours’ fields to the north of the track and also to the Vendor’s woodland to the south gateway (point ‘A’).

Fencing The Vendor will be erecting a new stock proof boundary between points C-D with the minimum specification of sheep netting, two strand barbed wire on tanalised wooden posts. This fence will be the responsibility of the purchasers to preserve and maintain. The Vendor will also install a gateway on the boundary C-D to enable access, if required, to maintain the pipework to the spring supply.

The southern boundary of OS5633 between points ‘F’ and ‘G’ will be the responsibility of the purchasers to erect a stock proof fence to be a minimum specification of sheep netting, two strand barbed wire on tanalised wooden posts within 30 days of completion.

Services Water The land will benefit from a natural water supply from a right to connect into the springs that rise to the south-west of OS Part 1421, which the Vendor will give a right to the purchaser to take water for the purposes of livestock drinking from point ‘B’ below the domestic water tank and spring area and to connect two ballcock water troughs approximately at point ‘E’ or similar point to be agreed on the new fence boundary between points ‘C’ and ‘D’.

N.B. The Vendor will reserve the right to utilise water from the spring area which also serves retained adjoining land and property to the south.

Electricity There is no electricity currently connected to the land. The Vendor will reserve a wayleave right over field OS Numbers 1232 and part 1421 to lay and connect an electric cable over or under any part of those fields to supply retained land and property.

Basic Payment Scheme The land has been registered for the Rural Payments Agency’s Basic Payment Scheme for the 2018 scheme year. The Basic Payment Scheme entitlements for the eligible areas of the land are included in the sale and the entitlements will be appropriately apportioned to the land. The Vendor/Vendor’s Agents will use their best endeavors to facilitate a transfer of these to the Purchasers at the appropriate time.

Other Stewardship Schemes The land is not subject to any Entry Level, Higher Level or Mid-Tier Stewardship Agreements and no restrictions are understood to apply.

Wayleaves, Rights & Easements The property is sold subject to any Rights of Way, Wayleaves, Rights or Easements which exist at the time of sale whether they are mentioned in these particulars or not. Please note that the Vendor will retain a right of way up the access track to the gateway identified as point ‘A’ on the sale plan to then access into the woodland area to the south and east being retained. In addition, a right of access exists to the field adjoining the northern side of the access track which is in separate ownership.

The Vendor also will retain a right across OS Numbers 1232 and part 1421 to connect into and run either overhead or underground cables under/over them to supply retained land and buildings to the south of the land.

Restrictive Covenants The Vendor will be placing appropriate restrictive covenants prohibiting construction of buildings in OS1421 and on the southern sections of OS Numbers 1232, 2932 and 4534 where visible from retained land/property. No restriction on such buildings will be placed relating to the northern section of those fields.

There will also be a restrictive covenant on the use of the land for scramble/motocross or similar obtrusive/noisy uses. Use for the agricultural, equestrian amenity or hobby farming will not be restricted.

Tenure The land is freehold and offered with vacant possession upon completion. N.B. The land is let on a short-term grass keep basis, however, this will be terminated immediately upon completion.

Directions From Totnes take the A381 Road and after approximately 3 ½ miles within the village of Harbertonford turn right just before the Maltsters Inn and take the Rolster Bridge Road past the old mill buildings on the left-hand side and after approximately half a mile at Rolster Bridge turn left over the bridge, then taking the first left again heading towards Crabadon. After approximately three quarters of a mile the access track leading to the land will be found immediately adjoining your right-hand side just before a sharp right-hand turn in the road.

Alternatively, at the top of the Kingsbridge Hill bypass traffic lights turn right onto the Higher Plymouth Road and follow this road for approximately 4 miles and just past Blue Post Garage on your right-hand side turn left at Shorter Cross following the signs for Diptford. Proceed up Kerswell Hill and after around 1 mile at Diptford Down keep right at the fork (not turning left to Diptford) and stay on the road heading towards after a further 2 miles at Crabadon Cross turn left proceeding down the hill past Crabadon Manor on your right and follow the road sharp right then left and the access track to the land will be found adjoining this road on your left-hand side after a short distance.
