It is to submit that, based on credibre information that the officials of APTDC (Andhra Pradesh Transport Department check post), Renigunta, chittoor District are indulging in corrupt practices by collecting bribes from the vehicle drivers passing through the check post and causing pecuniary loss to the government exchequer by allowing vehicres having irregurarities to pass through with check post by accepting bribes, a surprise check was conducted on oz /08-02-2018 from 21-00 hrs to 04-00 hrs in the presence of two mediators. A surprise check report was drafted incorporating all the facts in proceedings at the check post.

The surprise check team members entered the check post at about 20.45 hrs on 07 -o2-2ol8 and on seeing the surprise check team, two persons who were clad in civil dress tried to skulk away from the premises of the check post. But with the active assistance of the ACB team the DSp caught hold of them, took them into the check post and there noticed two Home Guards in uniform and another person clad in civil shirt and Khaki trousers. Then the DSP, ACB disclosed his identity and identity of other team members by which the person in civil shirt and khaki trousers became panic. Then the DSp, ACB, Tirupati enquired about the identity of the officers on duty and other persons present in the check post and upon that they stated as follows- (U sri Maddirevula Jayalakshmi Padmabhushana Reddy, S/o. vasudeva Reddy, aged about 34 years, AMVI, APTDC check post, Renigunta, R/o. Flat No.110, CBR Hill Ridge, Leela Mahal circle, Tirupati, (who was clad in civil shirt and Khaki trousers) (2) Sri Subramanyam Dhanasekhar, S/o. Sri Subramanyam, aged about 35 years, Home Guard-1235/CT, APTD Check post, Renigunta, R/o. D.No. 15-2894, Ambedkar Nagar, Greamspet, Chittoor district {3f Sri Agaduru Veera Prathapudu, S/o. A. Veeraish, aged about 31 years, Home Guard No. 1691/CT, APTD check post, Renigunta, R/o. D.No.t1-14, Ranga Reddy colony, , (4) Sri Kanniappan Ravi, S/o. Sri Kanniappan, private person, R/o. D.No. 15-864, Srikalahasthi road, Renigunta, and (5) Sri Narra Chalapathi, S/o. Sri N. Ramaiah, aged about 53 years, private person, R/o. D.No.S- 1-93, Sarojini Devi Layout, Tirupati.

Then on enquiry by the DSP, ACB, Tirupati, Sri M.J. p. Reddy, AMM stated that Sri. P.Vijayabhaskar, MM who was on duty from Og:OOhrs to 21:00hrs on oz -o2-2o18 has just left the check post hurriedly in his personal car without handing over the charge or the general cash to him. on further enquiry Sri M. J. P. Bhushan Reddy, AMVI stated that at about 2O:OOhrs on o7-o2-2o18 Sri P. Vijayabhaskar, MVI called him over cell phone from his cell phone no. 9121029989 to his cell phone no. 9000690682 and asked him to come to the check post immediately stating that he has some urgent work. Accordingly he left his house immediately to come to the check post. In the mean while at about 20:2O hrs, Sri Madhu, the driver of Sri P. Vijayabhaskar, MVI made a call to him from his cell phone no. 2299448654 to his cell phone no.900069o682 and asked about his whereabouts stating that MVI Sri p. Vijayabhaskar was asking him to come to check post immediately and he said to him that he was on the way and he would reach the check post within 10 minutes. He reached the check post at about 2O:35 hrs and Sri p. Vijayabhaskar, MVI went out of the check post hurriedly along with his driver Sri Madhu and left in his personal swift Dzire car bearing No.Ap03 BH 22ZZ immediately.

When he enquired Sri P. Vijayabhaskar, MVI about the General Cash which was collected from O8:00hrs to 13:Oohrs and from 13:Oohrs to 21:O0hrs on 07 -O2-2O18 and about the charge to be given to him before leaving the check post, he went hurriedly stating that the DTC, Chittoor has called him. He made calls to Sri P. Vijayabhaskar, MVI over his cell phone no. gl2lo2gggg from his cell phone no. 9000690682 at 20:37 hrs and at 2O:4lhrs and Sri p. Vijaya bhaskar, MVI did not give any reply to him over cell phone, he enquired about the General Cash and the charge to be handed over to him by the said MM. Then he made a call to DTC, Chittoor over his cell phone no.9g4g52g33g from his cell phone no.9000690682 at 20:43 hrs to find whether he had called MVI, for which the DTc, chittoor Sri ch.Prathap stated that he did not call the Sri. P. Vijayabhaskar, MVI. The Sri M. J. p. Bhushan Reddy, AMVI further stated that the ACB officials led by the DSp, ACB, Tirupati along with mediators entered the check post at about 20:45 hrs and asked him about the officials on duty for which he revealed to them that the sri p. Vijayabhaskar, MVI who was on duty from 08:00hrs to l3:00hrs and from l3:00hrs to 2l:00hrs on 07 -o2-2o18 had just left t}te check post without handing over the General cash and the charge to him. He also stated that he enquired with HG- 1235 sri s. Dhanasekhar whether Sri p. Vijayabhaskar, MVI had given any General cash to him collected from 08:00hrs to 13:00hrs and from l3:00hrs to 2l:oohrs on 07 -o2-2or8 for which the said HG stated that the MVI did not give any such cash to him.

Later the Sri M.J.P. Bhushan Reddy, AMVI opened the cash chest present in the MVI room in the presence of mediators and found Rs. 1,25,ooo/- in the said cash chest. The amount is bundled with elastic and denominations are labeled on a small piece of white paper tagged to it. when he verified the general cash book in the computer system of the check post in cFST vide user narne MJPBR and password dal722$, he found that an amount of Rs.1,25,000/- was collected from 08:00hrs to l3:Oohrs on or -o2-2org and as such he revealed to the mediators that the amount of Rs. 1,25,o00/- found in the cash chest was nothing but the said amount colrected during the said period. He took out print out of the same from the printer of the check post. when he verilied the Generar cash book in the GFST, he found that an alnount of Rs.1,o8,830/- was collected from 13:o0hrs to 21:oOhrs on 07-o2-2o18. He took out the print out of the same, but the said amount was neither found in the cash chest nor in the table drawers of the official table of the Sri P.vijayabhaskar, MVI situated in the office room of the MVI. when further enquired, the Sri M.J. p. Bhushan Reddy, AMVI stated that Sri p.vrjaya Bhaskar, MVI did not speak about any illness to him wh e leaving the check post' The Sri M'J.P. Bhushan Reddy, AMVI gave a signed statement to that effect in the presence of mediators which was seized by the DSp, ACB, Tirupati after due attestations by DSp and the mediators on it. Then the DSp, ACB, Tirupati seized the print outs pertaining to the collection of Rs. 1,2s,0o0/- and Rs.1,08,830/- of General cash book from o8:00hrs to l3:oohrs and 13:oo hrs to 21:00hrs respectively, after due attestations by the mediators and the DSp on the same. The AMVI further stated that the total revenue collected on the previous day will be deposited in the state Bank of , Main Branch, Tirupati on the subsequent working day through challans.

Then on enquiry by the DSp, ACB, Tirupati the two private persons who were clad in the civil dress voluntarily confessed before the mediators, that they were private persons/ agents engaged by the Transport department officials of the check post and on that particular day i.e. 7.2.2ora, they were engaged by sri P. Vijayabhaskar, MVI for collecting unauthorized amounts from the drivers/ cleaners of the vehicles passing through the check post and for that they were being paid an amount of Rs. 1000/- per day. on or -o2-2olg they have been collecting unauthorized amounts/ mamools from og:o0hrs from drivers/cleaners passing through the check post on behalf of Sri p. vijayabhaskar, MVI as per his directions. so saying the private person sri Kanniappan Ravi took out a wad of currency notes from the right pocket of his trousers. The mediator no.2 sri P. vishwanadhan took the currency notes produced by the private person Sri Kanniappan Ravi and found it to be Rs.45,56o/-. similarly the private person sri Narra chalapathi took out a wad of currency notes from the back pocket of his trousers and produced the same before the mediators, stating that it was the amount collected by him from 08:00hrs on 07 -O2-2O18 on behalf of Sri P. Vijayabhaskar, MVI. The mediator no.1 sri r.Pothuraju Eswar Kumar took it from him, counted and found it to be Rs.39,34O/-. The DSP, ACB seized the above unaccounted cash for taking further necessary action in the presence of the mediators.

Then the ACB team conducted a thorough search of the premises of the check post. During the searches an amount of Rs.18,OOO/- was found in the iron safe (in between the files) situated in the kitchen of the check post and an amount of Rs.2O,97O/- was found in the iron safe (in between the records) situated in the record room of the check post. The DSp, ACB seized the above unaccounted cash for taking necessary action in the presence ofthe mediators.

Then on enquiry by the DSP, ACB, Tirupati Sri Subramanyam Dhanasekhar, S/o. Sri Subramanyam, aged about 35 years, Home Guard- l235lCT voluntarily revealed before the mediators, that he has been on duty in the check post from O8:00hrs to 21:00hrs on O7-O2-2O18 and the private persons sri. Kanniappan Ravi and sri Narra chalapathi collected mamools from the drivers/cleaners of the vehicles passing through the check post on behalf of Sri P. Vijayabhaskar, MM. He also stated that Sri p. Vijayabhakar, MVI made phone calls to Sri M.J.P. Bhushan Reddy, AMVI at about 2o:00hrs and asked him to come to the check post immediately. The Sri p. vijayabhaskar, MVI left the check post along with his driver in his private car at about 20:35 hrs on O7-O2-2O18 without handing over the charge and General cash to the Sri M.J.P. Bhushan Reddy, AMVI and etc., facts. Nothing incriminating was found on his persons when he was searched.

Then on enquiry by the DSP Sri Agaduru Veera prathapudu, S/o. A. Veeraish, aged about 31 years, Home Guard No.169l/CT revealed that he has came to the check post at about 20:30 hrs to attend his duties from 21:00hrs on o7-o2-2o18 to 08:00hrs on 08-02-2018. He further stated that the sri M.J.P. Bhushan Reddy, AMVI attended the check post duty at about 20:35 hrs and Sri P. vijayabhaskar, MVI left the check post hurriedly at the same time without giving charge and the general cash collected till then to him. During the proceedings, it was noticed that the, Sri G.S.V. Rajeswara Rao, AMVI attended to the check post at about 21.20 hours on oz.o2.2olg. During the proceedings, when the DSP, ACB tried to contact Sri p. Vijaya Bhaskar, MVI over his cell phone, he did not respond.

Then the following records of the check post have been verified and seized by the DSP in the presence of mediators.

1. Personal Cash register: It has been maintained from 01.01.201g. On verification, it was found that, the MVI who was on dut5r from 0g.00 AM to 9.O0 PM on O7.O2.2O18 has made his signature in the register showing a cash of Rs. 50O/- in his possession on page Nos. 1O & 11 of the register. 2. Attendance Register: It has been maintained from 0 1 .0 1 .201g. On verification, it is noticed that, Sri p. Vijaya Bhaskar, MVI has appended his initials on 07.o2.2078 as mark of his attendance to the check post. J. Duty Chart of the Check Post from O1.O2.2O18 to 28.o12.2018 where in the shift duties of the two MMs and 4 AMVIs working in the check post were found mentioned. 4. Duty Reglster: It has been maintained from O1.O1.2018. It has been found that Sri P. Vijaya Bhaskar, MVI has appended his initials on 07.O2.2O18 from 8.0O AM to 9.00 PM as a mark of his attendance to the check post.

During the surprise check proceedings Sri G.Prasada Reddy, Inspector, ACB, Tirupati has examined and recorded the statements of following drivers/cleaners of the vehicles passing through the check post in the presence of mediators.

1. Sri Shaik Madhru Saheb, S/o Late Sri Sk. Bade Saheb, aged about 65 years, driver of lorry A\p 0a X 0199 ( DLNo: 66L719671, R/o. D.No: 221498, Asare Shareef street, Proddutur, YSR district, Cell No: 9949911909. 2. Sri Paruchuru Brahmaiah, S/o Late Sri P. Venkaiah, aged about 53 years, driver of lorry bearing no: A\p 27 Y 7317, R/o. D.No: 1-38, Maseed street, Ponnalur mandal, Prakasam district, Cell No: 9000784t42. 3. Sri Pasupuleti Suresh, S/o Koteswara rao, aged about 3O years, driver of Iorry no: A\p 27 Y 9576, R/o. D.No: 1-025, Jayavaram, Tangutur, Prakasam district, Cell No: 8096123504. 4. Sri Pallapati Venkateswarulu, S/o P.Narayana, aged about 36 years, driver of lorry bearing No: AP 2l TB 1024, R/o. D.No: 2-4O, Thamarajanapalle, Panyam mandal, Kurnool district, Cell No: 9490tOO769.

5. Sri Songa Sreenivasulu, S/o Late Padmanabham, aged about 50 years, driver of lorrybearing No: AP 26 TD 478a, Rlo. D.No: 5, 5ft street, Naidupet, Nellore district ( DL No: 745lTW I 1992, native of Padiri village, Vijayapuram mandal, Chittoor district, Cell No: 9492607407.

The gist of their statements is that they regularly used to pass through the check post and get their documents verified by the officials of the check post for over loading and other irregularities. It is usual to them that the authorities of the check post used to collect unauthorized amounts ranging from Rs. 10O/- to 500/- per vehicle though they have valid records for the vehicles and the goods carried in them. Today also they paid the amount to the check post authorities to pass through the check post.

When the DSP, ACB, Tirupati asked about the unauthorised cash found in the possession of the two private persons, the AMVI, Sri M.J.P. Bhushan Reddy and Sri G.S.V. Rajeswara Rao kept silent. In entire searches arl unaccounted amount of Rs.38,970/- was seized from the premises of the check post and Rs.84,9OO/- was seized from two private persons. (Total amount of Rs. I ,23,870/ -)

From the above it is evident that Sri p.Vijayabhaskar, Motor Vehicle Inspector, Andhra Pradesh Transport Department Check post , Renigunta, chittoor district is found indulging in criminal misconduct and misappropriation of Govt. Revenue/ exchequer and converting the same for his pecuniar5r gain and thereby misused his respective oflicial position for collection of illegal gratifrcation.

Upon that a detailed report was submitted to the Director General, ACB, AP., vijayawada. on perusal of the above, the Director General has instructed to register a case vide in Memo. No. OS/DES-TCT/2O18, Dt:06-07-2018 against Sri P.Vijayabhaskar Motor Vehicle Inspector, Andhra pradesh Transport Department Check Post , Renigunta, Chittoor district.

I registered the above occurrence report as a case in Cr.No.05/RCO_ TCTl2O18, U/s. 13(1) (c) (d) of prevention of Corruption Act, 1988 & 409 IpC of ACB, Tirupati Range, Tirupati on o9-o7 -2078 at 12:00 noon and submitted FIRs to the Honble special Judge for spE & ACB cases, Nellore, along with original Surprise check report dated 07/08-o2-2org (vide pages 01 to 06) and attested Xerox copy of Memo. No. os/DES-Tcr/2olg, Dt:o6-oz-2o18 of DG, ACB, AP, Vijayawada and copies to all concerned officers.
