Mishna Yomi Bechoros 2:9-3:1 Taanis 3 PARSHA QUESTION OF THE WEEK HOW INVOLVED WAS MOSHE ?

There are two accounts of the story of the spies: one in our Parsha , as it occurred (chs. 13-14); and the second in Devarim, where Moshe repeats the story as part of his recounting of the Jewish People’s short history (1:22-46). There is a significant difference between the two accounts with regard to Moshe’s involve- ment. In our Parsha , Moshe is not involved in conceiving the plan at all; he is only instructed to execute it. Likewise, when the spies return it is not Moshe who responds to them, but Yehoshua and Calev (14:6-10). By contrast, in Moshe’s account in Devarim, he describes himself as party to the planning of the mission of the spies (1:23), and he describes himself as responding to their negative report (1:29-33). Note as well that while here in Bamidbar Moshe is not punished for the incident with the spies, implying no personal involve- ment, in Devarim (1:37) he seems to say that his not going to was punishment for the story of the spies, implying that he was involved. What is the real story? How involved was Moshe? HALACHA OF THE WEEK: A FEATURE OF THE BJSZ DAILY HALACHA BENTSCHING OVERLAP

We have learned that one is obligated to include mention of the special quality of the day- by recita- tion of Retzei or Yaaleh veYavo - in the third Bracha of Birchas HaMazon (Boneh Yerushalayim ). We need to define however whether this obligation is contingent on the time the meal occurs or on the time that the Bentsching is recited. Thus, for example, if one ate Shalosh Seudos on Shabbos but did not Bentsch until dark, would they recite Retzei because they had eaten on Shabbos , or would they not because they are Bentsching after the conclusion of Shabbos ? In this case the Shulchan Aruch (OC 188:10) clearly rules that one would recite Retzei as we consider the beginning of the meal to be determinative. Interestingly, where the situation is reversed, i.e. if one ate a meal before Shabbos and Bentsched on Shabbos, there is a difference of opinion, with the Shulchan Aruch (OC 271:6) of the opinion that we do say Retzei as the Bentsching is being said on Shabbos, but the Rema disagreeing and saying that we do not as the meal was not eaten on Shabbos. A more complex scenario is when Rosh Chodesh occurs on Motzei Shabbos , and Bentsching for Shalosh Seudos occurs after dark. Many are of the opinion that in such situations one must avoid eating after dark, as this would then compel the person to mention both Retzei and Yaaleh veYavo , something which is inherently contradictory as Shabbos and Rosh Chodesh are on two different days. As such, one would make sure to con- clude eating before dark, and then when Bentsching – even after dark – only Retzei would be said. Others are of the opinion that one may eat both before and after dark and then both Retzei and Yaaleh veYavo would be recited (see MB 188:33).
