SECTION 8: PARKING AND LOADING

STANDARDS

EXCEPT OR WHERE OTHERWISE STATED, THE FOLLOWING PARKING AND LOADING REQUIREMENTS SHALL APPLY:

MINIMUM STANDARDS FOR PARKING AND LOADING FACILITIES TO BE PROVIDED WITHIN ANY SITE

ANCILLARY NOTES AND REQUIREMENTS

1. All parking shall be provided within the site of the development proposed except for Land Use 1.9 (c) which is at the discretion of the Head: eThekwini Transport Authority.

2. Where the use proposed is not contained in this document, parking shall be provided at the discretion of Head: Development Planning and Management and Head: eThekwini Transport Authority.

3. The Head: Development Planning, Environment and Management and the Head: eThekwini Transport Authority may relax ANY parking bay requirements provided that the developer has demonstrated technically to the satisfaction of Head: Development Planning, Environment and Management and the Head: eThekwini Transport Authority any request for the relaxation of parking.

4. PFA = PROPOSED FLOOR AREA (as defined in this Scheme).

4.3 Parallel parking bays should be 2,5m wide and 4,9m long with a manoeuvring bay 2,5m in length between each pair of bays. A minimum adjacent aisle width of 3m should be provided for gaining access. (see 8.6.15. below)

4.4 Vehicles must be parked in such a way that each vehicle can be freely moved in and out of its parking bay in a single manoeuvre.

4.5 The parking layout should be so designed that structural members such as columns, beams, walls, etc shall not obstruct the free manoeuvring of vehicles into and out of parking bays.

4.6 In awkward situations or in cases where other particular factors arise, the requirement of 4.9m depth of parking bay may be relaxed down to a minimum of 4,6m provided that the number of 4,6m bays does not exceed 10% of the total parking bays provided.

4.7 The gradient of continuous ramps should not exceed 1 : 7 provided however that for short sections, and in special circumstances, this gradient may be steepened but in no case should it be steeper than 1 : 5. Ramps to loading areas shall be maximum 10%.

4.8 Vertical curves between the ramps and the street access and between the ramps and parking floors should be provided with a minimum radius of 30m.

4.9 Correct super-elevation should be applied transversely across curved ramps, such super- elevation varying according to the horizontal radius of the curve, subject, in all cases, to the super-elevation not exceeding 1 : 10.

4.10 The inside turning radius on continuous ramps shall not be less than 4,3m.

4.11 The maximum gradient across a parking area is 1:15

4.12 The width of one-way driveways, ramps and entrances shall be a minimum of 3m. The width of two- way driveways and ramps shall be a minimum of 5m and a maximum of 9m. For a two-way driveway or ramp serving 6 or less parking bays, a 3m width may be allowed. A minimum 1,2m sidewalk must be provided along at least one side of the driveway or ramp. Minimum distance between physical obstructions for one-way driveways and ramps and two-way driveways and ramps must be 5m and 7m respectively.

4.13 Entrance widths shall be minimum 6m except for residential uses with less than 6 parking bays. A minimum of one access (ingress and egress) point must be provided for every 400 parking bays. The minimum height clearance for parking areas shall be 2,5m.

4.14 The Head: eThekwini Transport Authority may relax the provision of the Guiding Rules for Off-Street Parking in those cases where it is difficult or impractical to meet the required standards on account of one or more of the following factors:-

(a) The shape of the site. (b) There exists an approved building of significance. (c) The locality and character of the proposed development.

5. PARKING DISTRICTS: DURBAN CBD AREA

ANCILLARY NOTES AND REQUIREMENTS 1. This Section must be read in accordance with figure 1 of this sub-section. This figure indicates the CBD and demarcates it into a number of parking districts. 2. All parking shall be provided on the application site. 3. The design of ingress/ egress points to both parking within a building and Parkades shall:- I. Afford motorists leaving a clear view of approaching pedestrians on both sides whilst the vehicle is wholly within the site or an alternative method of control acceptable to the Head: ETA, and II. Ensure that the appearance of those points preserve or enhance the continuity of the street frontage of existing buildings. 4. Access to parking within a building shall be to the satisfaction of the Head: DPEM and Head: ETA. 5. Loading requirements will be to the satisfaction of the Head: ETA.

DISTRICT A

1. There is NO minimum parking requirement within this district. 2. A maximum of 1 bay per 100m2 of PFA. 3. A minimum street frontage of 30.0m for vehicular access is to be permitted. 4. Minimum spacing between vehicular access points of 30.0m. 5. Max of 300 bays served by each vehicular access point. 6. No Bonus bulk for parking shall be available /or considered within this district. 7. No Public Parkades shall be permitted within this zone.

DISTRICT B 1. No minimum parking requirement within this district. 2. When a proposal involves the provision of on-site parking, such parking provided, in terms of the number of bays provided, accessibility, and ingress / egress, shall be to the satisfaction of the Head: eThekwini Traffic Authority. 3. Within this district, in General Business (Central), bonus bulk shall be applicable and an amount representing not more than 20% of the total PFA shall not be taken into account where such amount is to be used for the parking of motor vehicles.

DISTRICT C 1. A minimum of 2 bays per 100m² of proposed floor area shall be provided. In the case of Kingsmead Office Park, the more onerous of these requirements and the requirements of the Precinct Development Framework Plan administered by the Lot Owners association shall apply.

2. The Head: DPEM may in consultation with the Head: ETA, and upon motivation received from the applicant relax either the minimum or maximum parking requirements.

The maximum coverage of all buildings on the site shall not exceed 80% of the site. d. There shall be a space free of all building of not less than 3,0 metres or a width calculated on the basis of 1,2 metres per storey, whichever is the greater, from all boundaries of the site other than a street boundary. The Executive Director (Physical Environment) may, by special consent, relax the requirements of this condition. e. No building line requirement shall apply. f. On-site parking shall be provided at the ratio of not less than one bay per 25m5 of gross floor area. g. Loading and off-loading facilities shall be provided to the satisfaction of the Executive Director (Physical Environment). h. Vehicular ingress and egress shall be provided to the satisfaction of the Executive Director (Physical Environment). i. The development is to occur substantially in accordance with the concept contained in the sketches 95080 REV. B which were submitted by the appellant on 2 September 1997, to the Department of Local Government and Housing

3. The following shall apply to Portions 4 and 5 of Erf 3172 Durban and the following conditions shall apply to any development of these sites-

a. The uses permitted within this site shall be restricted to that of shops/Medical office/Offices and restaurants. b. The total floor area of all buildings shall not be greater than that calculated in accordance with a plot area ratio of 0, 8 to 1. c. The maximum coverage of all buildings within the land comprising this site shall not exceed 70%. d. No portion of any building erected in this site shall exceed a height of 45 metres above mean sea level. e. No building line requirement shall apply. f. On-site parking shall be provided at the ratio of not less than one bay per 25m5 of gross floor area. g. The height requirements of this zone shall not apply to the properties described as Portions 2 and 3 of Erf 4261 .

4. 1. EXECUTIVE SUMMARY

1.1 Torbiouse Solutions CC was appointed by ATC South Africa Wireless Infrastructure (Pty) Ltd to compile and submit an application in terms of the Spatial Planning and Land Use Management Act, 2013 (Act No. 16 of 2013), in terms of Category 3 of the eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read with the Central Scheme of eThekwini Municipality, 2011, to the eThekwini Municipality for granting of Special Consent.

1.2 ATC South Africa Wireless Infrastructure (Pty) Ltd entered into an agreement with the registered owner of the subject property for the lease of a part of said property for the purposes of a telecommunication mast and base station.

1.3 The application to obtain special consentfrom theeThekwini Municipality for the construction and operation of the aforesaid expansion of the base station of the existing telecommunication mast and base station is lodged on behalf of ATC South Africa Wireless Infrastructure (Pty) Ltd with consent of the owner of the subject property. ATC South Africa Wireless Infrastructure (Pty) Ltd will also be responsible for the construction of the said telecommunication mast and base station according to engineering standards. Annexure 2hereto contains the power of attorney signed by the owner of the subject property.

1.4 Please note that original approval or the existing telecommunications mast and base station was granted. The application for special consent is for the expansion of the base station of the existing telecommunication mast and base station (BTTS) to accommodate additional service providers on the existing site (Co-location). Annexure 4 herewith contains the Decision Notice by Town Planning.

2. PROPERTY PARTICULARS

2.1 PROPERTY DESCRIPTION, OWNERSHIP AND SIZE

2.1.1 The subject property is described as Remaining Extent of Erf 286 Kenville Ext 1in terms of Deed of Transfer no. T19144/1999(Attached herewith asAnnexure 3).

2.1.2 The subject property is registered in the name ofKistanNynanPillay and Sarojini Pillay,married in community of property, as confirmed in the abovementioned deed of transfer.

2.1.3 The subject property measures 1014m²in extent.Also, refer to the Title Deedattached hereto as Annexure 3.

2.2 LOCATION

2.2.1 The subject property is situatedat 246 Smithfield Road, Kenville, Durban North. Thelocation of the subject property is illustrated on thepreliminary building plans, attached herewith as Annexure 13.The coordinates for the proposed telecommunication mast and base station are: 2.2.1.1 Latitude: -29° 47’ 24.36” S and 30° 00’ 08.06” E. (Degree, Minutes, Seconds), or 2.2.1.2 Latitude:-29.79010S and 31.00224E (Decimal Degree)

2.2.2 ATC South Africa Wireless Infrastructure (Pty) Ltd has additional service providers (MTN; Neotel and Telkom) interest on the proposed site, hence the need to expand the base station of the existing telecommunication mast and base station is to accommodate additional service providers. Please refer to page 4 of 7 of the preliminary building plans attached herewith asAnnexure 13.

2.3 ZONING AND LAND USESCHEME

2.3.1 The predominant zoningsof the surrounding properties are presumed to be Residential.The majority of the properties in the surrounding area are mainly utilised forDwelling houses.Thepreliminary building plans is attached herewith as Annexure 13.

2.3.2 The subject property iszoned “Limited Commercial” in terms of theCentral Scheme of eThekwini Municipality, 2011,and utilised for the purposes of a shop and tavern. The zoning certificate is attached herewith as Annexure 6.

2.4 CONDITIONS OF TITLE, AND SERVITUDES

2.4.1 The deed of transfer of the subject property contains noconditions of title restricting the construction of the proposed telecommunication mast and base station at its current location. Please refer toAnnexure 3 for further details.

2.4.2 There are no servitudes registered against the Deed of Transfer of the subject property that affects the placement of the proposed telecommunication mast and base station.

3. APPLICATION PARTICULARS

3.1 This application is submitted in terms of the Spatial Planning Land Use Management Act, 2013 (Act No. 16 of 2013), in terms of category3 of the eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read withthe Central Scheme of eThekwini Municipality, 2011,for the granting of Special Consent by the eThekwini Municipality pertaining to a part of the subject property.

The documentation provided complies with all applicable requirements contained in the Spatial Planning and Land Use Management Act, 2013 (Act No. 16 of 2013), in terms of category 3 ofthe eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read with the Central Scheme of eThekwini Municipality, 2011.

3.2 The abovementioned approval is required for the approval of building plans for the expansion of the base station of an existing telecommunication mast and base station. The building plans will be formally submitted for approval in terms of the National Building Regulations and Building Standards Act, Act 103 of 1977, once approval for the application for special consent is obtained.

3.3 The existing telecommunication mast is approximately 36m high, constructed as a Monopole Mastto allow for sharing capacity and reduce impact on the physical environment. The existing base station site measures approximately 64m² in extent. The proposal to extend the existing base station with an additional 8m² to make provision for additional service providers will increase the base station to total area of 72m².For further details in this regard please refer to the preliminary building plans, attached herewith as Annexure 13.

4. PARALLEL APPLICATIONS, APPROVALS AND/OR PERMISSIONS

4.1 Approval of the Department Economic Development, Tourism and Environmental Affairs (EDTEA) was obtained, attached herewith as Annexure 8.

4.2 No historical buildings or land marks will be affected by the proposed telecommunication mast and base station, therefore the approval of the AmafaaKwaZulu-Natali Heritage Council is not required for the approval of the said application.

4.3 No mineral resources will be affected by the proposed telecommunication mast and base station, therefore the approval of the Department of Minerals and Energy Affairs is not required for the approval of the said application.

4.4 Approval of the South African Civil Aviation Authority was obtained, attached herewith as Annexure 9.

4.5 Permission from the South African Council for the Architectural Profession confirms that the person submitting drawings for the installation of a telecommunication base station are exempt from registering with this council, attached herewith as Annexure 12.

4.6 A letter from the Department of Health indicated there are no confirmed scientific evidence of health hazards related to low public exposure to a cellular base station, attached herewith as Annexure 10.

5. ENGINEERING SERVICES

5.1 CIVIL ENGINEERING SERVICES

5.1.1 The proposed telecommunication mast and base station does not require water and sewer engineering services to function. No upgrading of the civil engineering services infrastructure will therefore be required as a result of the approval of this application.

5.1.2 Access to the part of the subject property, on which the proposed telecommunication mast and base station will be situated, will be gained via the existing access from 246 Smithfield Road. There will be no noticeable increase in traffic volume as a result of the approval of this application. No upgrading of the roads infrastructure will therefore be required as a result of the approval of this application.

5.1.3 Therefore, no upgrading of the civil engineering services infrastructure as a whole will be required as a result of the approval of this application.

5.2 ELECTRICAL ENGINEERING SERVICES

5.2.1 The electricity currently available on the subject property is deemed to be sufficient for the operation of the proposed telecommunication mast and base station. No upgrading of the electrical engineering services infrastructure will therefore be required as a result of the approval of this application.

5.2.2 The connection required for this application will be obtained to the current connection of the property, subject to the approval of the electricity department.

6. GENERAL CONSIDERATIONS AND MOTIVATION

6.1 The proposed expansion of the base station of the existing telecommunication mast and base station site is aligned with the Central Ethekwini Municipality Scheme principles of Co-location, to make provision for accommodating additional service providers at existing telecommunication mast and base station (BTTS) sites.

6.2 Cellular telecommunication technology is an integral part of modern day life and licensed cellular telecommunication service operators have an obligation in terms of their license agreements, as stipulated by national government, to provide the services throughout South Africa within the allocated bandwidth spectrum. The cellular telecommunication user base is still increasing (quantitative growth) and users must be enabled to choose the services rendered by any of the licensed operators anywhere in South Africa (choice and availability). The expansion of service types and content (content and technology growth) furthermore requires continuous equipment and network fine-tuning, upgrades and expansion. The user base also expects a continuous quality service to be provided and therefore network capacity and capabilities are under constant review to maintain or improve quality coverage (qualitative growth).

6.3 The immediate benefits of the activity to society in general can be summarised as follows: • Increased national telecommunication network coverage footprint enabling users to communicate on the preferred network wherever they are. • Additional fulfilment of one of government’s objectives to ensure the establishment of national communication network grids and services as part of a sustainable economic growth pattern. • New infrastructure development within an established area is likely to rejuvenate the area and lead to the increase in property values. • Creating jobs and alleviating poverty. • Enhancing the safety and security of residence and businesses within the area of the proposed application.

6.4 The motivation and benefits to society in general above apply to the local community directly. It will furthermore ensure that the communication capability and capacity of the community will keep pace with the ever growing and availability of communication facilities nationwide.

6.5 The proposed extension of the base station of the existing telecommunication mast and base station must be seen as a part of a whole network of telecommunication masts in and around the area that enables the whole network base to benefit from the enhanced communication infrastructure and internet data transferral. Therefore all the separately placed base stations enhance the effectiveness of the whole network.

6.6 The existing position of the mast will have little or no impact on the current alignment of the road and possible future upgrading. There will be no increase in the current traffic volumes nor future traffic volumes, for further detail please refer to Annexure 13.

6.7 The proposed expansion of the base station to the existing telecommunication mast and base station is to make provision to be shared by other service providers.For further details in this regard please refer to the preliminary building plans, attached herewith as Annexure 13.

6.8 The subject proposal will furthermore promote integrated land development between rural and urban areas in support of each other by improving connection and communication potential between said areas via telecommunications.

6.9 The proposed expansion of the base station to the existing telecommunication mast and base station is in line with the Development Principles, Section 7, of the Spatial Planning and Land Use Management Act, 2013:

6.8.1 The Principle of Spatial Justice: The operation of a telecommunication mast will therefore improve well needed telecommunication services in such areas thereby integrating rural and urban areas on a technological and communicative level.

6.8.2 The Principles of Spatial Sustainability: The existing telecommunication mast development promotes spatial sustainability by improving the telecommunication network base within the areas allowing users to communicate anywhere they want at anytime. The placement of the base station must be seen as a part of a whole network of telecommunication masts in and around the area that enables the whole network base to benefit from the enhanced communication infrastructure and internet data transferral. Therefore all the separately placed base stations enhance the effectiveness of the whole network.

6.8.3 The Principles of Efficiency: Theproposed expansion of the base station to the existing telecommunication mast and base stationdoes not require water and sewer engineering services to function. No upgrading of the civil engineering services infrastructure will therefore be required as a result of the approval of this application. Access to the part of the subject property, on which the proposed expansion of the existing telecommunication mast and base station will be situated, will be gained via the existing access from Smithfield Road. There will be no noticeable increase in traffic volume as a result of the approval of this application. No upgrading of the roads infrastructure will therefore be required as a result of the approval of this application. Therefore, no upgrading of the civil engineering services infrastructure as a whole will be required as a result of the approval of this application.

6.8.4 The Principle of Spatial Resilience: The proposed expansion of the existing telecommunication mast and base station adheres to the objectives by potentially contributing to economic growth and infrastructure development resulting in the improvement of livelihoods on a technological and communicative level. Telecommunications can be viewed as a result of residential and employment opportunities due to access allowed for the integration between places of work and places of residence allowing one to work from wherever.

6.8.5 The Principle of Good Administration: Is addressed as the proposed expansion of the existing telecommunication mast and base station is in line with the Spatial Planning and Land Use Management Act, 2013 (Act No. 16 of 2013), in terms of category 3 of the eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017),read with the Central Scheme of eThekwini Municipality, 2011.

6.9 To conclude,the application is aimed at promoting the integration of social, economic, rural and urban development by means of providing improved and sustainable telecommunication services.

7. CONCLUSION

7.1 The applicant has demonstrated that the application forspecial consentfor the proposed expansion of an existing telecommunication mast and base station on the subject property can be regarded as being desirable and sustainable.

7.2 The application, with supplementary documentation, was compiled in accordance with the regulations of the Spatial Planning and Land Use Management Act, 2013 (Act No. 16 of 2013) and Town Planning Ordinance, 1949 (Ordinance No. 27 of 1949), in terms of category 3 ofthe eThekwini Municipality Planning and Land Use Management By-Law 2016 (Municipal Notice 114 of 2017), read withthe Central Scheme of eThekwini Municipality, 2011.

HEALTH EFFECTS OF CELLULAR BASE STATIONS AND HANDSETS

The Directorate: Radiation Control is the section within the National Department of Health that is responsible, from the viewpoint of human health, for regulating electronic products producing non-ionising electromagnetic fields (EMF), i.e. where the frequency of such EMF is less than 300 GHz. In carrying out this responsibility, the Directorate has been utilising the World Health Organization’s (WHO) International EMF Project (www.who.int/peh-emf/en/) as its primary source of information and guidance with respect to the health effects of EMF. The International EMF Project was established by the WHO in 1996 to (i) assess the scientific evidence for possible adverse health effects of non-ionising electromagnetic fields on an on- going basis, (ii) initiate and coordinate new research in this regard, and (iii) compile health risk assessments for different parts of the electromagnetic spectrum. The Department of Health has been a member of the International Advisory Committee of the International EMF Project since 1998.

In June 2005 the International EMF Project hosted a workshop that was specifically aimed at considering the possible health consequences of the emissions from cellular base stations and wireless networks. The findings of this workshop were summarised in a 2-page Fact Sheet (http://www.who.int/peh-emf/publications/facts/fs304/en/). The following extract from this Fact Sheet is still considered by the WHO as a summary of the findings to date, i.e.“Considering the very low exposure levels and research results collected to date, there is no convincing scientific evidence that the weak RF signals from base stations and wireless networks cause adverse health effects.”

Another WHO Fact Sheet was published in June 2011 and reviewed in October 2014, i.e. Electromagnetic fields and public health: mobile phones. This Fact Sheet can be found at http://www.who.int/mediacentre/factsheets/fs193/en/) and the conclusion is stated as follows:

The WHO recommends utilising internationally recognised exposure guidelines such as those published in 1998 by the International Commission on Non-Ionizing Radiation Protection (ICNIRP) and reconfirmed in 2009 for the frequency range 100 kHz – 300 GHz (i.e. including all the frequencies employed by the cellular industry). The Department of Health likewise recommends the use of these ICNIRP guidelines to protect people against the known adverse health effects of EMF.

The numerous measurement surveys, which have been conducted around the world and in South Africa, have shown that the actual levels of public exposure as a result of base station emissions invariably are only a fraction of the ICNIRP guidelines, even in instances where members of the public have been really concerned about their exposure to these emissions. At present there is no confirmed scientific evidence that points to any health hazard associated with the very low levels of exposure that the general public would typically experience in the vicinity of a cellular base station. The Department is therefore satisfied that the health of the general public is not being compromised by their exposure to the microwave emissions of cellular base stations. This also means that local and other authorities, in considering the environmental impact of any particular base station, do not need to and should not attempt, from a public health point of view, to set any restrictions with respect to parameters such as distance to the mast, duration of exposure, height of the mast, etc.

The Department of Health is not able to make any pronouncements about the specific levels of EMF that a member of the public would experience at any particular base station site when it is in operation. However, generally-speaking unless a person would climb to the top of a mast (or other structure supporting an antenna) and position him/herself not more than a few meters away right in front of the active antenna, such a person would have no real possibility of being exposed to even anywhere near the afore-mentioned ICNIRP guideline limits. Since these base stations are typically cordoned off by means of barbed wire fencing and locked gates/doors in order to protect the sensitive and expensive technology, getting to a mast and actually climbing it despite the afore-mentioned security measures would certainly not be considered responsible behaviour. Even then the only real threat to the health of the person would be falling at any height from the structure in question. Based on the results of numerous global and local surveys, the experience has been that the exposure to base station EMF at ground level is typically in the range of between 0.001 – 1.0 % of the afore-mentioned ICNIRP guideline limits. Against this background of available data, there

Although the Department of Health currently neither prescribes nor enforces any compulsory exposure limits for electromagnetic fields, the Department does advise all concerned (whether they be a government department, the industry or the public) that voluntary compliance with the afore-mentioned ICNIRP exposure guidelines is the recommended and science-based way to deal with any situation involving human exposure to the non-ionising electromagnetic fields emitted by cellular base stations and handsets.
