DELEGATIONS AND PRESENTATIONS:

1. Jeunifer Walker-Larsen, Stakeholder Engagement Advisor, BC Hydro Re: Update on the Revelstoke Unit 5 Project

Ms. Walker-Larsen provided an update to Council on BC Hydro in Revelstoke as Revelstoke is a busy area for BC Hydro plus Ms. Walker-Larsen provided an overview of BC Hydro's initiatives in including an update on BC's Growing Electricity Demand, the Clean Energy Act, Revelstoke's Unit 5 project, Mica projects and the Water Use Plan.

Council were updated on the Revelstoke Dam operations and iniormed that Unit 5 is being tested and as of late December Unit 5 was being used at peak times of demand. Unit 5 will make it possible to release more water in a shorter period of time to reach peak demand. With Unit 5 in operation reservoir levels may fluctuate more often during winter and spring but the sudden drawdowns in early spring are expected to happen less often. For the mitigation of Unit 5 BC Hydro involved many stakeholders in the review process and from this review BC Hydro took away seventy six commitments to maximize project benefits and minimize project impacts. A few key mitigation programs Ms. Walker-Larsen reviewed are the Revelstoke Golf Course riverbank protection, public safety signage, helping to build trade training in Revelstoke including a contribution to the Revelstoke Housing Society Project, supporting local and First Nations equity hire and a contribution to the Westside Road repairs.

Ms. Walker-Larsen reviewed Mica projects which will involve $1.2 billion over the next five years, they will be expanding the Mica Creek camp and BC Hydro made forty-four commitments on these projects to maximize project benefits and minimize project impacts.

Council were iniormed that the Columbia Water Use Plan is running about thirty projects in recreation, fisheries plus a wide host of studies, The Columbia River will now have a minimum flow at all times from the Revelstoke Dam which is expected to be a benefi t to fisheries.

a. Proposed Budget Reduction

Moved by Councillor JOMston, seconded by Councillor Bender that Council direct staff in each City department to prepare a proposed budget for their respective department providing for a 5% expenditure reduction from 2010 levels over a two year period at approximately 2.5% per year and a further proposal with a 10% reduction from 2010 levels at 5% per year. Reductions are to be to items affecting tax increases/decreases and savings should be sustainable and not merely deferrals. If possible a brief statement of possible service impacts should be noted with any Significant reductions. CARRIED

b. Budget Process Clarification

Moved by Councillor Welock, seconded by Councillor Frew that Council Bylaw No. 1984, being a bylaw to provide for the borrowing of such sums of money as may be requisite to meet the current lawful expenditures of the City of Revelstoke for the year 2011, be given first, second and third readings. CARRIED

d. Consideration and direction to staff regarding a Density Bonusing Bylaw

Moved by Councillor Welock, seconded by Councillor Frew that Council considers and directs staff to investigate a Density Bonusing Bylaw to collect fIl11ds from developments over two stories in height, which would be used for Revelstoke Fire Rescue Services' future reserves. CARRIED

e. Approval to Purchase an Aerial Platform Apparatus

Moved by Councillor Welock, seconded by Councillor Bender that Coundl give direction to the Fire Chief to look at the option to purchase a Demonstrator Aerial Ladder Apparatus within the reasonable prices indicated and that delivery of the apparatus be for later in 2011 year or preferably in the 2012 budget year and that the Fire Chief give Council time to prepare an alternate approval process as necessary. CARRlED

Councillor Johnston noted that this motion only permits the Fire Chief to investigate apparatus' to purchase and does not commit the City to the purchase of an apparatus.

f. Renewal of Lease Agreement between the City of Revelstoke and the Senior Citizens' Association

Moved by Councillor Welock, seconded by Coundllor Frew that Council approve the Lease Agreement renewal with The Senior Citizens' Association for use of the Seniors' Centre at the Revelstoke Community Centre and to authorize the Mayor and acting Chief Administrative Officer to sign the lease agreement on behalf of the City of Revelstoke, subject to Notice of Property Disposition and Assistance.

1. Council Procedures Amendment Bylaw No. 1982 - consideration of adoption

Moved by Councillor Frew, seconded by Councillor Welock that Bylaw No. 1982 a Bylaw to Amend Council Procedure Bylaw No. 1739 be adopted by Council.

NEW BUSINESS:

Note: Councillor Frew advised that he was in a conilict of interest situation on the following matter due to being a contractor with BC Hydro. Councillor Frew retired from the meeting at 4:05 p.m.

1. Centennial Boat Ramp Maintenance

The Director of Planning informed Council that the concerns of the Centennial boat ramp had been brought forward to the City by the Rod and Gun Club and that staff had met with the Rod and Gun Club and BC Hydro on November 26,2010 to discuss funding proposals for the Centennial boat ramp.

Ms. Walker-Larsen provided Council with background to the studies that have taken place since 2007 on the Centennial boat ramp, the Shelter Bay boat ramp plus other alternatives around the surrounding area for a boat ramp. Ms. Walker-Larsen informed Council that from a previous meeting with a variety of stakeholders that the feedback from the Centennial boat launch users was that the ramp should be maintained for core users to use but not to encourage new users to the ramp due to safety hazards.

Mr. Gadbois from the Rod and Gun club noted the safety hazards that arise with the use of the Centennial boat ramp and informed Council that the Shelter Bay boat ramp is the preferred boat launch to be used. Mr. Gadbois suggested that the funding from the Water Comptroller be shifted to be spent on upgrading the Shelter Bay boat ramp.

Moved by Councillor Johnston, seconded by Councillor Halberstadt that Council write to the provincial Comptroller of Water Rights (CWR) requesting that his decision to approve improvements to the Centennial boat ramp, that supports existing use, be re-evaluated based on safety concerns; and suggest a site visit by the Water Comptroller and BC Hydro representatives to discuss safer access options. CARRIED

Moved by Councillor Halberstadt, seconded by Councillor Johnston that Council invite the provincial Comptroller of Water Rights to meet with Council if the Water Comptroller is in Revelstoke on a site visit. CARRIED

Moved by Councillor Johnston, seconded by Councillor Welock that Council receive the Manager of Development Services report dated January 4, 2011 regarding the Revelstoke Resort Mountain Density for information. CARR[ED

Moved by Councillor Johnston, seconded by Councillor Welock that Council receive the Manager of Development Services report dated January 4, 2011 regarding the applications reviewed by the Design Review Committee for information. CARRIED

4. Request for letter of support from AI Raine, Mayor of Sun Peaks

Moved by Councillor Johnston, seconded by Councillor Frew that Council writes a letter to the Federal and Provindal Governments encouraging both levels of government to implement taxation polides which will encourage increased tourism to Canada.

5. Council Resolution in support of Towns for Tomorrow application

Moved by CoundIlor Frew, seconded by Councillor Johnston that Coundl approves a resolution in support of an application to the Towns for Tomorrow Program for funding for the Illecillewaet pedestrian bridge and connecting trails project.

7. Master Plans Timeline Update

Moved by Councillor Welock, seconded by Councillor Bender that Council receive the Master Plans Timeline updated January 5, 2011 for information.

8. Revelstoke First Responder Program Report

Council noted their concern with the First Responder Program being a municipal program and questioned if the program was covering for short falls in the British Columbia Ambulance Services and if it should not be a provincially funded program.

Councillor Welock noted that once the data for the program is collected up to June 30,2011 a letter and the statistics from the First Responder Program will be sent to the provincial government for review.

Moved by Councillor Welock, seconded by Councillor Bender that Council receive the Fire Chief's report dated January 11, 2011 regarding the First Responder Program since it was implemented under the mandate of the Revelstoke Fire Rescue Services for information and that Council considers and selects one of the five options contained presented by the Fire Chief for direction on the Revelstoke First Responder Program.

Social Development Coordinator - Report to Council- January 25,2011

The committee contributes to achieving the Community Vision by supporting all citizens through a responsible and caring social system. An annual work plan is developed to guide the committee on priority actions. Its primary objecti ve is to facilitate proactive planning for positive social change in Revelstoke.

The city's Department of Community Economic Development continues 10 provide administrative support and contract management.

Last September, the committee approved the 2010/11 work plan. Highlights are as follows:

Objective 1. Facilitating communication and collaboration amongst community organizations to support them to work togetber On community socia! cballenges and opportunities Continue to have mruntrun an accessihle office in a downtown location with access to a larger room for meetings if necessary Continue to ensure high level of preparation for steering committee meetings - The committee remains engaged with a high level of participation and good meeting attendance Continue to distribute appropriate information to social sector through email network Attend meetings of social sector organizations and groups, including but not limited to: I. Early Childhood Development Committee 2. Revelstoke Literacy Action Committee 3. Seniors' Volunteer Coordinator Steering Committee 4. Health Care Advisory Committee 5. Transit Committee 6. Substance Use Strategy implementation: Youth Initiative (see below), Harm Reduction Strategy, Safe Bar Program Supporting our Seniors - Volunteer Coordinator programs getting off the ground (Volunteer Transportation Program; Good Morning Program; Computer Classes); Grit Box Pilot Project; Facilitated UBC/lH research project to study mobility for rural dwelling older adults - focus groups took place in late November. I will be receiving this repon when it is released in the spring. Transportation Provided input to BC Transit's comprehensive service review Youth - Initiated Revelstoke Youth Initiative in October; organized focus groups to provide input to CBT's Youth Strategy in November; hosted Youth Engagement Workshop in January; will support OC to complete a comprehensive youth needs assessment in the coming months; upcoming presentation to school board in February 'Welcome to Revelsloke' A Guide for Newcomers - project funded by EmbraceBC & developed in partnership with ~C. It is off to the publishers! Objective 3. Help support new and existing organizations and collaboratives wben needed

Provided assistance to Victim's Services when asked, including assisting Paul Carter to articulate concerns and suggesting creative solutions to building capacity for the program

Objective 4. IdentifYing new social challenges and opportunities in the community and identiry ways to meet these challenges and access these opportunities. Both the Substance Use Strategy & CDAP update have proven to be an excellent venues for identirying both achievements & social Challenges in our community

Objective 5. Providing the City of Revelstoke with information and recommendations on community social challenges and priorities

SUBJECT: Smoke-Free Outdoor Public Places

We are writing on behalf of the Heart and Stroke Foundation of BC & Yukon and the BC Lung Association, which make up the Clean Air Coalition of B.C. The Coalition's mission is to raise public awareness about the serious health risks of tobacco use and exposure to second-hand smoke. We are writing to encourage you to pursue legislated smoke­ free environments in your municipality.

Increasingly, municipalities in BC and around the world are implementing smoke-free policies and bylaws. The most recent trend is to extend these smoking restrictions to outdoor public places as, contrary to long held public belief, second-hand smoke does not quickly dissipate in outdoor settings. Depending upon the specific situation, smoke levels generallydo not decrease to the background level for fine particles or carcinogens until approximately 7 metres, or about 25 feet, from the source, even in outdoor settings.

The health hazards associated with second-hand smoke are well documented and irrefutable. In a 2006 report, the U.S. Surgeon General concluded that second-hand smoke causes cancer, coronary heart disease, and respiratory illnesses, and that there is no safe level of exposure to it. Health conditions, such as asthma, emphysema, high blood pressure and diabetes are exacerbated by even brief exposure to second-hand smoke.

Children in particular are more susceptible to these health problems associated with exposure to second-hand smoke since their lungs and respiratory systems are not yet fully developed. As such, banning smoking in places where children play, such ·as parks, playgrounds and beaches, is of even greater importance.

Cigarette litter also poses a health and environmental risk. Many people who smoke cigarettes routinely dispose of their cigarette butts on the ground. This litter may pose a potential fire hazard, especially in periods of dry weather. The litter leaches toxins into the ground and waterways which damages living organisms that are in contact with the toxins. Cigarette filters do not break down easily, resulting in costly clean up of this litter on a routine basis.

There is strong public support for expanding smoke-free laws in British Columbia. A BC Stats poll conducted for the Clean Air Coalition of B.C. in January 2008 for the Imagine! A Smoke-Free Be campaign, found that 73% of British Columbians support smoking bans in outdoor public places. Given that eighty-five percent of British Columbians aged fifteen and older do not use tobacco products, the balance in society is shifting to

.. ./2 Page 2 support expanding more outdoor smoke-free environments. As the public becomes more aware of the health risks of exposure to second-hand smoke, they no longer accept the premise that breathing other people's smoke - even in outdoor settings - is a nuisance to be tolerated.

Moreover, scientific peer reviewed studies have concluded that comprehensive smoking bans save lives. Smoking bans are the Impetus for many people to quit smoking, which in turn leads to lower levels of acute and chronic illnesses associated with smoking.

We have listed on the Clean Air Coalition of B.C. website the Provincial regulations on smoking bans in public places, as well as all municipalities in BC thai have implemenled smoke-free public places bylaws that exceed provincial regulations. This information can be found at http://www.cleanaircoalitionbc.com/ktf smokefree legislation.hlm!. Outdoor public places where smoking has been banned in several municipalities, around which is a no-smoking buffer zone, are: • Customer service area patios i.e. of bars and restaurants • In parks, on playgrounds, on playing fields, in outdoor stadiums and other public gathering places where people sit or stand in close proximny, and on beaches • At special events where people sit or stand within close proximity • At public transit or vehicle for hire (i.e. taxi) stops

Jerry Silva, Revelstoke and Area Emergency Management Plan Program Coordinator, announced to Council that a public notice would be released advising the public of an avalanche that occurred at the Lanark Slide site, which is 400 metres West of the Glacier Park Boundary, on the TransCanada Highway. He explained that there was a back up of the Illecillewaet River due to some avalanche debris affecting the flow of the river, however the Illecillewaet River was continuing to flow at this time. The City of Revelstoke, Columbia Shuswap Regional District, Parks Canada, and the Ministry of Transportation would be monitoring the situation as avalanche control continues. Mr. Silva was optimistic that this matter would be resolved in the coming days. Emergency services were being proactive and an Emergency Operations Centre had been activated in accordance with the Revelstoke and Area Emergency Management Plan.

He concluded with that a further update would be released by the City of Revelstoke at 12 noon, Wednesday, January 19, 2011, or sooner if the status changed. Updates on the Lanark Slide would be posted online at www.revemergency.com. DELEGATIONS AND PRESENTATIONS: (Continued... )

2. ReveIstoke City Museum - 2010 Update

Cathy English, Museum Curator/Archivist presented Council with an update of the 2010 Museum events complete with the 2011 budget and the 2010 financial statement. She explained to Council that 2010 had been an exceptionally busy year with visitors to the museum up over 1,000 from the previous year. Ms. English was enthusiastically optimistic that the museum would continue to prosper in the new year as staff was planning many upcoming events, listed in the report to Council. She also summarized the success of the new gift shop and the youth programs. Ms. English mentioned that the Parks, Recreation and Culture Master Plan did not include the City Museum in any comprehensive way and that she would be preparing a report with respect to the Museum's concerns. She concluded her presentation thanking Council for their continued support with the maintenance of the beautiful heritage building. Councillor Bender thanked Ms. English for her presentation.

a. Proposed Budget Reduction

The Director of Finance presented the results from the directive from Council to prepare alternative budgets reflecting a 5% reduction and a 10% reduction over two years. The Director of Finance summarized the proposed budget reductions for each department including the proposed cuts for Capital Projects. Mr. Inglis concluded with stating he would recommend the 5% budget reduction as it was achievable, would have the least impact on services, would balance the budget and result in a 0% increase in taxes in 2011, accomplishing what Council requested. Council expressed some concern regarding the proposed cuts to the Street Sweeping and Sidewalk Maintenance as there was some community priorities with respect to the Air Quality Plan, the Age Friendly Plan, the Official Community Plan as well as other Plans previously established by Council.

Moved by Mayor Raven that the Committee of the Whole recommends to Council that the report regarding Council's direction to staff to provide alternative financial plans based on 5% reductions on 2010 costs and phased in over 2 years, be received for information and further discussion. a. Economic Development Commission Meeting Minutes October 6, 2010

Council reviewed the minutes from the October 6, 2010, Economic Development Meeting and expressed some concern regarding the recommendation to direct staff to conduct an independent cost recovery analysis on municipal expenditures and city operations and efficiencies. Council referred to the cost and time for such a project stating that an independent cost recovery study has just been completed by the Planning Department and management had just spent considerable time cutting costs in each department resulting in a balanced budget for 2011. Council was unsure of what exactly the request was referring to and asked for clarification.

Moved by Councillor Frew that the Committee of the Whole recommends to Council that Council direct staff to conduct an independent cost recovery analysis on municipal expenditures and city operations and efficiencies.

Moved by Mayor Raven that the Committee of the Whole recommends to Council that Council recommends that the shed located adjacent to Landers Road be moved to comply with all zoning setback requirements: AND THAT the request to relax the rear yard setback from 6.0 metres to 2.75 metres for the proposed carport be denied for 685 Landers Road and that the existing partially built carport be removed: AND THAT Option 2 "redirecting, at the owner's expense, the existing drainage pipe around the encroachment of the building" dealing with the front yard setback and Right of Way encroachments be permitted as part of Development Variance Permit No. 2010-45. The front yard setback be varied from 6.0 metres to 5.15 metres only for the encroachment by the existing shop on the property; The front yard setback be varied from 6.0 metres to 3.75 metres, only for the encroachment by the principle building on the property. CITY OF REVELSTOKE BYLAW NO 1984

Being a Bylaw to Provide for the Borrowing of Such Sums of Money as may be Requisite to meet the Current Lawful Expenditures of the Municipality

WHEREAS pursuant to Section 177 of the Community Charter, the Council of the MUIlicipality is em­ powered by Bylaw to provide for the borrowing of such sums of money as may by requisite to meet the current lawful expenditures of the Municipality, such borrowing not to exceed in the aggregate:

I. Seventy-five per centum of the taxes levied for al1 purposes in the preceding year, and the whole amount of any sums of money remaining due from other governments.

AND WHEREAS the aggregate that the Council may presently borrow calculated in accordance with (1), seventy-five per centum of the taxes levied for al1 purposes in the preceding year and the whole amount of sums of money remaining due from other governments is $10,699,409.

AND WHEREAS to meet the current lawful expenditures of the Municipality it is requisite that the Council borrow the sum of Ten Million Six Hundred and Ninety Nine Thousand Four Hundred and Nine ($10,699,409).

NOW THEREFORE the Council of the City of Revelstoke in open meeting assembled enacts as fol­ lows:

I. It shal1 be lawful for the Council oflhe City of Revelstoke to borrow upon the credit of the Mu­ nicipality the sum ofTen Million Six Hundred and Ninety Nine Thousand Four Hundred and Nine ($\0,699,409) in such amounts and at such times as the same may be required and to pay interest thereon at a rate not exceeding prime lending rate.

2. All monies so borrowed and interest payable thereon shall be payable on or before the 31 st day ofJuly,2011.

3. The form of obligation or obligations to be given as an acknowledgement of the liability shall be a Credit Agreement bearing the Corporate Seal and signed by the Mayor and Director of Finance.

4. There is hereby set aside as security for the liability hereby authorized to be incurred: Ten Mil­ lion Six Hundred and Ninety Nine Thousand Four Hundred and Nine ($\0,699,409) being that part of the taxes for the current year deemed by the Council expedient to be set aside.

5. This Bylaw may be cited for all purposes as the "City of Revels toke Revenue Anticipation Bor­ rowing Bylaw No. 1984".

6. This Bylaw shall take effect upon the adoption thereof.

During 2008, the City of Revelstoke submitted an application to the Public Transit Infrastructure Program, administered by UBCM, for funding for the lIlecillewaet pedestrian bridge project. As the project has been delayed, we have been carrying this funding over each year since then.

UBCM has now indicated to liS that the funding needs to be spent by March 31,2011, and sent us an amendment to the agreement (attached). Staffhas clarified with UBCM that the funding can be used to pay contractors for materials and supplies prior to that date, and that the project does not have to be completed by March 31, 2011. The funding will be expended prior to March 3 J, 2011 to meet the requirements ofthe agreement with UBCM. PUBLIC TRANSIT AGREEMENT AND PUBLIC TRANSIT INFRASTRUCTURE PROGRAM FUNDING AGREEMENT AMENDMENT AGREEMENT (PT Agreement Amendment)

This PT Agreement Amendment is made as of ______---', 2010,

BETWEEN: CITY OF REVELSTOKE (the Recipient) AND: UNION OF BRmSH COLUMBIA MUNICIPALITIES as established under the Union of British Columbia Municipalities Act SBC 2006, c.18, as represented by the President. (UBCM) .

The Public Transit Funding Agreement Under the Agreement on the Transfer of Funds for Public Transit made between the Recipient and the UBCM executed by the UBCM on June 20, 2008, (the Agreement), for the illeci11ewaet River Pedestrian Bridge project is hereby amended as follows:

1. In Section 3.1, paragraph (e) and (f) are out and the following is substituted: (e) agrees that unless otherwise agreed in writing in advance with the UBCM, any Funds remaining after paying all of the Eligible Costs of the Eligt'ble Projects, or at March 31, 2011, whichever is earlier, shall be repaid by the Recipient to the UBCM; (f) agrees that unspent Funds in accordance with paragraphs (e) are deemed to constitute a debt to the UBCM and, unless repaid by the Recipient to UBCM promptly upon completion of the Eligible Projects or by March 31, 2011, whichever is earlier, the UBCM shall take steps to recover the unspent Funds.

2. In Section 3.2, paragraph (a) sl:ruck out and the following is substituted: implement the Eligible Project(s) a diligent and timely manner, and has commenced '. or will commence carrying out the Eligible Project on or about June 1, 2008, or a later date approved by UBCM and will complete the Eligible Project{s) no later than March 31, 2011.

Discussion and Analysis:

Further to John Guenther's memo dated June 30, 2009 regarding local use of wood policy and 6 storey wood frame construction, staff have contacted communities which have supported the Wood First Act. These communities have shown their support by adopting policies or bylaws.

As Revelstoke is a major player in the wood industry it is believed that the City should support the use of wood on all City funded projects whenever it would meet the Health and Safety requirement of the BC Building Code. After reviewing other communities policies and bylaw, it is staff's recommendation that a policy be adopted for the use of wood within the City of Revelstoke.

Conclusion:

January 14, 2011 Be Hydro starts minimum flow from Revelstoke Dam to benefit fish and fish habitat

Revelstoke, B.C. - In an effort to benefit fish and fish habitat and following four years of data collection on mid-Columbia river productivity, BC Hydro has changed its operations at Revelstoke Dam to discharge water at or above a minimum flow. This minimum flow, as recommended by the 2007 Columbia River Water Use Plan (WUP), Is expected to benefit a variety of fish species Including mountain whitefish, burbot, rainbow trout, bull trout and white sturgeon.

BC Hydro is now maintaining water releases from Revelstoke Dam at or above 142 cubic metres per second. This Is the first time that a minimum flow has been maintained at the Dam and it is the level recommended by the 2007 Columbia River Water Use Plan.

As part of the WUP requirements, BC Hydro will continue monitoring productivity in the river for the next nine years with minimum water flows in place. This data will be compared with infonnation collected during the past four years when minimum flows were not In place and not required by the WUP. Through long-tenn monitoring enough information can be analyzed to distinguish between the effects of the minimum flow and the effects of other factors that influence river productivity.

"Water flows in the mid-Columbia River downstream from the Revelstoke Dam are highly variable," said Karen Bray, BC Hydro Natural Resource Specialist. "The minimum flow is intended to benefit production in the river from the bottom to the top of the fish food chain by providing a minimum amount of continuously wetted river habitat. Our monitoring program will evaluate this by comparing river productivity across the range of BC Hydro's Revelstoke Dam operations both with and without the minimum flow."

While the mid-Columbia River extends from the Revelstoke Dam south to Arrowhead, the benefits of the minimum flow are expected to be greatest in the upper reaches from the Revelstoke Dam to the Illecillewaet River.

While the minimum flow is the only operational change recommended in the Columbia River WUP, BC Hydro Is also delivering a large number of projects and monitoring programs. Those projects and programs are expected to benefit recreation, vegetation, fisheries, wildlife, and heritage Interests along the Columbia River.

The Columbia River Water Use Plan, approved in January 2007, has a 12 year implementation period and is now in Its fifth year. The total expected cost of delivering BC Hydro's projects and programs through the WUP over the full 12 years is $180 million.
