LOCAL NEWSBRIEFS Court says Topfree legal By Susan Jordan New York State's highest court dismissed charges on July 7 against Ramona Santorelli and Mary Lou Schloss, rwo of the seven Ibp­ free activists arrested in 1986 for taking their shirts off as a protest against what they say is a law discriminating against women. The other women arrested in 1986 did not pur­ sue their cases in court. The Court of Appeals said that the law banning public exposure of women's breasts "should not be applied to the noncommer­ cial, perhaps accidental, and cerulnly not lewd, exposure alleged.*' However, the court did not declare thc 1983 law unconstitu­ tional, in spite of the fact that two of the six judges criticized the decision, saying that the statute should be ruled unconstitutional. Mary Lou Schloss said, "I am disappointed that they didn't deal with the constitutional challenge. The unanimous decision was only three pages long, and Judge Utone wrote a lengthy 11-page treatise, signed also by another of the judges, making it clear that chey tiiink the law should be declared unconstitutional.
