Despite our Hundreds of E-mails, Objection Letters, Telephone Calls, and the 142 Technical Errors, Our Council Voted in Favour of This Gravel Pit. WHY?

Why This Pit Is So Different From Any Other Pit In Ontario!! ▪ This proposed below water gravel pit contains a “highly vulnerable aquifer”, the Boyne River, Tosorontio Creek, a known floodplain, wetlands, woodlands, endangered species, residents living in close proximity, hydro towers, a busy on- site bridge to be built across a fish habitat creek, a planned over-development in the area and two important local community businesses residing close by. ▪ Nottawasaga Valley Conservation Authority (NVCA) spokesperson admitted that developing this pit would, “create a point of no return for the Boyne River” which flows into Earle Rowe Provincial Park, the Nottawasaga River and . ▪ In October, our municipal council voted 5-2 in favour of the pit before agency reports from MNRF and NVCA had been received.

Not only did council also break four of their own by-laws from their Official Plan, but according to the Aggregate Resources Act (ARA), council was not even obliged to vote!

On January 22, 2015, Nelson/LaFarge placed an announcement in the Herald for a below water table extraction of sand and gravel, which under the ARA gave the community 45 days to object. No other notice was given to the community by our township. ▪ THERE WERE 142 OBJECTIONS to Nelson’s Submissions due to technical errors, inconsistencies or omissions noted by Burnside Engineering, the NVCA and the Ministry of Natural Resources and Forestry (MNRF)!! ▪ More than 160 objection letters were sent to Nelson/Lafarge and the MNRF. ▪ At two large public meetings, the community adamantly objected to this proposal for a myriad of good reasons. Council has never answered the repeated question, “What are the benefits to our community?” As well, two councillors’ questions for Nelson/LaFarge were never answered. ▪ CCAT Inc. was created to make an application to the Ontario Municipal Board (OMB) regarding this egregious vote. Due to CCAT’s appeal, the rezoning from Protected Aggregate to Industrial Aggregate is on hold. ▪ At their January council meeting, the County of Simcoe, whose members had been given the information regarding the detrimental effects of this proposed pit still, unfortunately, voted in favour of this proposed pit after listening to a speech by our mayor. CCAT Inc. also appealed County of Simcoe’s decision to the OMB.

▪ The overwhelming response, with 94% re-objection letters as well as support from First Nations, demonstrates our solidarity in opposition to the pit. By becoming a member of CCAT and donating funds, a quality lawyer who understands Municipal Law and the OMB can be hired. As a community, we can all stop this atrocity!
