2 Information Requirements

This assessment and report accompanies the Resource Consent Application, and is provided in accordance with Section 88 and Schedule 4 of the Resource Management Act 1991 (the Act).

5 The Proposal

The application is for land use consent to upgrade the recreational facilities at Memorial Park, Kaikohe (refer to Appendix A for plans). The proposed upgrades will be staged over a number of years as funding allows and include the following:

• Construction of an outdoor basketball court and footpaths (Stage 1 - Priority Works) • Construction of a family BBQ area, exercise area and public toilet (Stage 2 - Future Projects) The proposed activity areas will be used during daylight hours. Lighting of the basketball court is planned in the future but does not form part of this application. The court area will not be fenced and court side seating will be provided.

The public toilet will be connected to the reticulated wastewater, water and stormwater networks. In addition stormwater from the basketball court will be collected and discharged to the reticulated network.

Earthworks are required to create the foundations for the activity areas including the basketball court.

6 3.1 Any Other Activities that are Part of the Proposal

Clause 2(1)(d) of Schedule 4 of the Act requires the applicant to identify other activities that are part of the proposal. This in intended to capture activities which need permission or licensing outside of the Act, for example, activities under the Building Act 2004. No further consents are required.

3.2 Permitted Activities that are Part of the Proposal

Clause 3(A) of Schedule 4 of the Act requires that information about related permitted activities be provided in the resource consent application. As assessment of the activities that form part of the proposal that are permitted is provided in Section 5 of this report.

4 The Existing Environment

4.1 Existing Environment

Section 104(1)(a) of the Resource Management Act 1991 (RMA) provides that when considering a consent application, the consent authority must, subject to Part 2, have regard to the actual and potential effects on the environment of allowing the activity. Case law has determined that the environment must be read as the environment which exists at the time of the assessment and as the environment may be in the future as modified by the utilisation of permitted activities under the plan and by activities authorised by resource consents that are being exercised, or that are likely to be exercised in the future.

4.2 Location and Physical Characteristics

The subject site (known as Memorial Park) is located on the corner of Memorial Avenue and Station Road, Kaikohe.

Memorial Park sits at the urban periphery of the Kaikohe Township and the surrounding environment is characterised by the recreational activities to the south including the Pioneer Village and Lindvart Park, light industrial development to the west commercial development to the north and east.

The site is flat and contains a number of existing activity areas including footpaths, a skate bowl, playground and lawn. Parking is provided by way of a formed and sealed carpark accessed off Memorial Avenue.

The site is zoned Recreational Activities in the operative Far North District Plan and bounded by commercially zoned properties.

4.3 Legal Interests

The parcel of land, Lot 1 DP 98178, vested on deposit in 1980 as a recreation reserve. There is no title associated with the land and as such no legal interests registered against it (refer to Appendix C).

4.4 Exiting Consents

There are no known existing resource consents or building consents relating to the subject site.

1 4.5 Archaeology

Heritage Pouhere Toanga (HPTNZ) was consulted regarding the proposal as there is a recorded site (P05/207) within proximity to the park. HPTNZ archaeologist James Robinson advised that the recorded site refers to a Maori Reserve (wahi tapu) on the north side of Memorial Avenue and as such, the subject site is not within the area of the archaeological site. On that basis HPTNZ advised they are happy for work to proceed under and ADP (Refer to Appendix C).

5 Reasons for Application

5.1 Operative Far North District Plan

An assessment of the relevant District Plan rules is set out in the table below.

The basketball court has a TIF of 50 (50 per court). The family picnic area could realistically cater for 20 persons therefore has a TIF of 40 (2 per person facility is designed for). The toilet (assuming 2 pan) has a TIF of 4 (2 person facility is designed for). The total TIF for new activities is

calculated to be 94.

In terms of the existing recreational uses it is estimated the skate bowl could cater for a

max of 20 person, and the playground 10 persons bring the TIF's for existing activities to 60 (2 per person facility is designed for).

In terms of the existing recreational uses 5 parks are required for the skate bowl, 2.5 for the playground.

The total number of parks required is 16. There are 18 existing formed and sealed

LD parks available on the site.

Based on the assessment above resource consent is required for breaches of the following permitted activity rules:

• Rule 9.6.5.1.5 Stormwater Management - 24.9% impermeable surface coverage exceeds both the permitted (10%) and restricted discretionary (15%) thresholds - Discretionary Activity.

• Rule 12.3.6.1.2 Excavation and/or Filling - The estimated volume of 500m3 exceeds the permitted threshold of 300m3 cut and/or fill in any 12 month period - Restricted Discretionary Activity.

5.2 Overall Status of Application

Overall the proposal is assessed as being a Discretionary Activity in accordance with 9.6.5.3 Discretionary Activities of the District Plan.

6 Notification Assessment

An assessment of the notification provisions under section 95A - G, is provided below:

• For the purpose of section 95A, the proposal does not require public notification as none of the three criteria of section 95A(3) apply and the application is not precluded from public notification pursuant to section 95A(5). The application is not required to be publicly notified in accordance with Section 95A(8), noting that an assessment of effects under Section 95D is provided further in this report. There are no special circumstances that exist as per section 95A(9).

10 • For the purpose of Section 95B, there are no affected protected customary rights groups and the proposed activity is not on land subject to any statutory acknowledgement. The criteria under Section 9513(6) do not apply to the proposal. In terms of Section 956(7) and (8), no persons are considered to be adversely affected by the proposal. An assessment of affected persons is provided further in this report.

Therefore, it is requested that this application be processed as a non-notified application on the basis of the information provided in this application.

7 Assessment of Effects on the Environment

The following assessment addresses those matters considered relevant under Section 95D, Section 104, and the Fourth Schedule of the Act. In doing so, the assessment also addresses the matters to which council's discretion restricted under rule 12.3.6.2.1 Excavation and/or Fill and the assessment criteria set out in section 11.3 Stormwater Management of the Operative Far North District Plan.

7.1 Permitted baseline

In considering an assessment of effects Section 95D(b) and Section 104(2) provide for consideration of the permitted baseline, being activities that La consent authority may disregard an adverse effect of the activity on the environment if a national environmental standard or the plan permits an activity with that effect.'

No further impermeable surfaces on the site are permitted. In this case it is considered that there is no permitted baseline that can be used to assist in assessing the effects of the activity.

7.2 Stormwater Effects

The site currently has 15.2% impermeable surface coverage.

The existing impermeable surfaces includes: a sealed carpark where stormwater is directed to the reticulated stormwater network via kerb and channel; and the footpaths and skate bowl where stormwater runoff is discharged to ground and naturally disperses.

The plans (SK-01) show impermeable surfaces for the first stage of the development as being 20.4%.

Stage 2 involves the construction of a toilet block, access footpaths and impermeable structures within the whanau BBQ area and exercise area. These facilities have not been designed and so impermeable calculations are not available.

Given that the total impermeable surfaces are uncertain at this stage, it is considered pragmatic for stormwater management design purposes to assume that an area of 1235m2 (derived from SK-03 brown rock fill area) will be impermeable. The first stage of the development will result in an additional 666rrd of impermeable surfaces (see SK-01). While it is considered unlikely that the second stage will result in an additional 569m2 of impermeable surfaces the applicant has decided to take a precautionary approach to ensure that further consent or upgrades to the stormwater management system won't be necessary for the second stage.

All stormwater runoff from the court and seating areas will be directed to cesspits, collected in a detention storage area onsite (this could be tanks and/or a detention pond/soakage pits) and then discharged at a controlled rate (attenuated) into the reticulated stormwater network. Any stormwater from the additional footpaths will discharge to ground and naturally disperse as currently occurs.

11 FNDC's Stormwater Engineer has prepared an assessment of the predevelopment and post development flows from the 1235m2 development area (refer to Appendix C) and had determined that the detention storage of 45,595 L is required to cater for a 1 :100 year rainfall event.

Given that no decision has been made as to the best practicable option for stormwater detention storage at the time of preparing the application, it is proposed that a condition of consent be included that requires the final stormwater management design be submitted for approval prior to construction commencing.

Stormwater from the new impermeable surfaces will not be directed to adjoining properties and no adverse stormwater effects to those properties are anticipated.

The proposal has been assessed against the relevant criteria set out under 11.3 Stormwater Management of the District Plan.

7.3 Earthworks Effects

• The location of vehicular access and egress has not been provided. It is expected that the access location will be in the most practicable location (taking into consideration ease of access and safety) to the works area. This likely to be off Station Road. If there is no existing vehicle crossing in place a temporary crossing will be installed to avoid damage to kerbing and footpaths.

• There is no reason to expect that the proposal will adversely affect cultural of spiritual values and there are no areas of significant indigenous vegetation or significant habitats of indigenous fauna impacted by the development.

• It is proposed that a condition of consent be imposed requiring a Construction Management Plan that sets out the following:

(i) The timing of building demolition and construction works, including hours of work, key project and site management personnel.

(ii) The transportation of construction materials from and to the site and associated controls

on vehicles through sign-posted site entrance/exits and the loading and unloading of materials.

(iii) Control of dust and noise on-site and any necessary avoidance or remedial measures.

(iv) Prevention of earth and other material being deposited on surrounding roads from vehicles and remedial actions should it occur.

(v) Publicity measures and safety measures, including signage, to inform adjacent landowners and occupiers, pedestrians and

other users of the roads.

(vi) Erosion and sediment control measures to be in place for the duration of the works.

Overall, it is considered that earthworks can be appropriately managed/mitigated during construction, to ensure that the adverse effects will be less than minor.

14 7.4 Positive Effects

While there is no known management plan for Memorial Park the Lindvart Park Reserve Management Plan (which is located nearby) has the goal of being a sports hub for the area, but there is no space specifically set aside for basketball. Therefore it is consistent with the purpose of the Lindvart Park Reserve Management Plan that a basketball court is located on an adjoining reserve as it will enhance the vision of this area being a sports hub.

There are positive social effects, along with improved health and well-being associated with the proposed upgrades. The additional facilities (toilets, BBQ and exercise areas, courts) will encourage families and the community to gather and enjoy a number of recreational and sporting activities.

7.5 Summary of Effects

Overall all taking into consideration the assessment against the above matters of control it is considered that the adverse effects will be less than minor for the purpose of Section 95D and Section 95A(8)(b).

8 Affected Persons Assessment

In undertaking an assessment of the effects of the proposal, due consideration has been given to the extent of actual and potential effects on the wider environment and adjacent landowners.

No persons are considered to be adversely affected to a minor or more than minor extent by the proposal.

9 Statutory Assessment

9.1 Section 104(1)(a) Assessment of Affects

Section 104(1)(a) requires that when considering an application for a resource consent, the consent authority must, subject to Part 2, have regard to 'any actual and potential effects on the environment of allowing the activity'.

An assessment of the adverse effects of the proposal is set out in Section 7 above, where it was determined that the adverse effects will be less than minor.

Overall the proposal will have actual and potential effects on the environment that are acceptable.

9.2 Section 104(1)(b)

Section 104(1)(b) of the Act requires that when considering an application for a resource consent, the council must, subject to Part 2, have regard to: any relevant provisions of-

9.2.1 National Environmental Standard for Assessing and Managing Contaminants in Soil (NES)

The piece of land is not currently, nor is it known to have been historically used for an activity or industry on the Ministry for the Environment Hazardous Activities and Industries List (HAIL), therefore assessment of the activity against the NES is not required.

9.2.2 Regional Policy Statement

The Regional Policy Statement for Northland (RPS) aims to promote the sustainable management of Northland's natural and physical resources, with a focus on key management issues such as water quantity and quality, biodiversity, economic potential and social wellbeing, infrastructure, natural

hazard risk and natural character.

The proposal is considered to be in general accord with the RPS as it supports social wellbeing by providing improved recreational/activity areas while ensuring that any adverse effects on the environment are avoided.

9.2.3 Far North District Plan

The Far North District District Plan contains provisions to achieve sustainable management of the natural and physical resources of the Far North District. Of particular relevance to the application are the objectives and policies within Chapter 9.6 Recreational Activities Zone and Chapter 12.3 Soils and

Minerals.

The above assessment demonstrates that the proposal is consistent with the relevant objectives and policies of the Far North District Plan.

9.3 Section 104(1)(c) Other Matters

Section 104(1)(c) of the Act states that consideration must be given to "any other matters that the consent authority considers relevant and reasonably necessary to determine the application. There are no other matters considered relevant to the proposal.

9.4 Part 2 Assessment

As per recent case lawl, an assessment of the application against matters stated in Part 2 is not required unless there are matters of invalidity, incomplete coverage or uncertainty of meaning within the relevant planning documents. In this case, the Operative Far North District Plan is not considered to exhibit any of these matters. Therefore, no assessment of Part 2 is necessary.

9.5 Section 125 Lapsing of Consent

As detailed above it is proposed to carry out the development in stages. It is requested that the lapsing period specified on this consent be 10 years to allow the stages of the development to be progressed as funding allows.

17 10 Conclusion

FNDC is seeking resource consent to upgrade the recreational facilities at Memorial Park, Kaikohe.

The environmental effects associated with the proposal have been assessed as being less than minor and no persons are adversely affected.

The proposed development provides positive social effects and health and well-being benefits to the Kaikohe community by providing improved recreational facilities.

The proposal is considered to be consistent with the objectives and policies of the Far North District Plan, the Regional Policy Statement for Northland and achieves the purpose of Part 2 of the Act.

It is requested that the application be processed as a non-notified application on the basis of the information provided and that the consent have a 10 year lapse date.

Following out phone call I have discussed the situation with area Manager Mr Bill Edwards. He informed me that the site record P05/207 refers to Maori land on the north side of Memorial Avenue that is a Maori Reserve (wahi tapu). 1 have appended some photos below confirming this.

As such the FNDC proposed development of the basketball court is on the south side of Memorial Avenue and therefore is NOT in the area of the recorded archaeological site.

Please ignore my advice given to you over the phone Instead Heritage New Zealand is happy for the work to proceed in the area identified in blue in your email, under an accidental discovery protocol (ADP)

Some excavations will be required for the construction of the basketball foundations (approximately 400mm depth).

I have had a look at Archsite and note that P05/207 (grave, cemetary/urupa) is in proximity to where the works are proposed. I have read the site record (attached) and it appears the site was cleared at the time the area was developed for commercial use.

I would appreciate if you could advise if the proposed work can proceed under an ADP. I understand you are meeting with Robert Willoughby later today so he can answer any questions you may have regarding the project.
