I, the Minister for Planning, in pursuance of section 7.17 of the Environmental Planning and Assessment Act 1979, give the following Direction.

1 Name of Direction

This Direction is the Environmental Planning and Assessment (Local Infrastructure Contributions) Further Amendment Direction 2018.

2 When Direction takes effect

This Direction takes effect on the date of its publication in the Gazette.

3 Consent authorities to which Direction is given

(1) This Direction is given to: (a) local councils, and (b) Sydney district planning panels and regional planning panels.

(2) To avoid doubt, this Direction also applies to: (a) any local planning panel when exercising, on behalf of a council, the functions of the council as a consent authority, and (b) any other officer or employee of such a council to whom the council delegates its functions as a consent authority. . 4 Amendment of Environmental Planning and Assessment (Local Infrastructure Contributions) Direction 2012

The Environmental Planning and Assessment (Local Infrastructure Contributions) Direction 2012 is amended as set out in Schedule 1.

[1] Clause 3

Omit clause 3. Insert instead:

(a) that plan is amended or repealed, or (b) any new or amended contributions plan that applies to the land also applies to other land.

Accordingly, a monetary contribution may be imposed as a condition of consent for development on any such land, if allowed by the applicable contributions plan, up to the maximum amounts set out in items 1 to 4 of the table to subclause (2), irrespective of whether the amended plan or the new plan is an IPART reviewed contributions plan.

(6) If, on or after 1 July 2020, the contributions plan that applies when development consent is granted is not the relevant specified contributions plan as in force at 28 July 2017 or an IPART reviewed contributions plan, the consent authority must not grant development consent subject to a condition requiring the payment of a monetary contribution that exceeds $30,000 for each dwelling or each residential lot.

[6] Clause 6B

Insert after clause 6B (2):

(3) To avoid doubt, this clause continues to apply in relation to land to which draft Rockdale Contributions Plan 2016 – Urban Renewal Area (as submitted to IPART for review) applies even if:

(a) that draft contributions plan, when approved under the Environmental Planning and Assessment Act 1979, is amended, or (b) the contributions plan, as approved, is amended or repealed, or (c) any new or amended contributions plan that applies to the land also applies to other land.

Accordingly, a monetary contribution may be imposed as a condition of consent for development on any such land, if allowed by the applicable contributions plan, up to the maximum amounts set out in items 1 to 4 of the table to subclause (2), irrespective of whether the contributions plan is an IPART reviewed contributions plan.

Duration Saturday 26 January 2019 – 9:00am to 5:00pm Detail Competitive ski races will be conducted on the navigable waters of Budgewoi Lake, Buff Point, as specified above, involving the use of high speed power vessels, persons being towed at speed using towlines, and persons in the water from time to time, presenting a significant potential hazard to other waterway users. An EXCLUSION ZONE is specified during the event between the times specified, which will be marked by buoys at the location specified above. The zone will also be indicated by the presence of support vessels managing the event. All vessel operators and persons in the vicinity of the event should keep a proper lookout, keep well clear of competing and support vessels, exercise extreme caution and heed the exclusion zone. MARINE SAFETY ACT 1998 MARINE NOTICE Section 12(2) REGULATION OF VESSELS – EXCLUSION ZONES AND SPECIAL RESTRICTIONS Regulated Area Sydney Harbour – from Goat Island to Steele Point, Vaucluse, comprising all navigable waters bounded by imaginary lines drawn from: • Balls Head to Balmain immediately West of Goat Island (inclusive of Darling Harbour) and; • Light to Steele Point. Duration From 3:00pm Friday 25 January 2019 to 10:00pm Saturday 26 January 2019 Detail The annual Day celebration on Sydney Harbour – a special event conducted by the Department of Premier and Cabinet and Sydney Festival – will take place within the waters of the regulated area specified above. Due to the potential to affect the safety of navigation and in order to safeguard the special event, this Marine Notice establishes Special Restrictions and Exclusion Zones pursuant to section 12(3) of the Marine Safety Act 1998.

Preparation phase – 25 January 2019 From 3:00pm on Friday 25 January 2019, vessel operators authorized to use Sydney Cove are to navigate with extreme caution and must comply with advice and instructions from Maritime Control, Sydney Ports VTS and RMS control vessels. A barge, yachts, personal watercraft and support vessels will be engaged in preparation for the event in Sydney Cove. Entry and exit to Sydney Cove will be limited and wharf restrictions will apply at times when critical moves are being conducted. Exclusion Zones – 26 January 2019 Strict Exclusion Zones will be established in the regulated area at designated times (see detail below). These zones will be enforced by Roads and Maritime and Police patrol vessels, and may also be marked by a perimeter of yellow buoys. (a) 8:00am to 2:00pm – a moving exclusion zone forming a perimeter 200 metres ahead and 60 metres either side or astern of HMAS Choules while the vessel is underway between the Overseas Passenger Terminal and Garden Island; (b) 10.45am to 11:30am – a moving exclusion zone forming a perimeter of 50 metres around the bow, sides and stern of the “Emerald Class” ferries participating in the ‘Ferrython’ as they navigate on a course between Fort Denison, Rose Bay and the Sydney Harbour Bridge; (c) 11:45am to 12:30pm –a static exclusion zone between imaginary lines drawn from Milsons Point and Dawes Point (under the western side of the Sydney Harbour Bridge), and from the Sydney Opera House to Kirribilli Point, and Kirribilli Point to Milsons Point. This exclusion zone also incorporates Sydney Cove, and will be in place for the ‘Salute to Australia’ and the ‘Tug and Yacht Ballet’. This zone will be marked by the presence of Roads and Maritime and other control vessels; (d) 1.00pm to 2.00pm – a moving exclusion zone forming a perimeter of 50 metres around the bow, sides and stern of the Tall Ships participating in the ‘Tall Ships Race’ as they sail on a course from Bradleys Head north of Fort Denison to the Sydney Harbour Bridge; (e) 1:45pm to 2:15pm – an exclusion zone inside Farm Cove between Bennelong Point and Mrs Macquaries Point during the ‘Parachute and Flag Drop’. This zone will be marked by the presence of Roads and Maritime control vessels and yellow boundary buoys; (f) 7:00pm to 10:00pm – an exclusion zone for the entirety of Sydney Cove. All authorised vessels already within the cove must follow the directions from Maritime Control and control vessels and – if moving – must pass at a safe distance from the fireworks barges and tugs or remain alongside. No unauthorised vessels will be able to enter or depart Sydney Cove between these times. Commercial vessels and those taking part in the event may be allowed to stop and drift in the Transit Zone but must follow directions from control vessels; (g) 7:45pm to 8:15pm – an exclusion zone in all waters between imaginary lines drawn between Milsons Point Ferry Wharf (Luna Park) and Pier One at Dawes Point, then from Dawes Point to the Sydney Opera House, then to Mrs Macquaries Point, then to Garden Island, then back to to Fort Denison, back to Kirribilli Point and across to Milsons Point – to facilitate a Royal Australian Air Force flyover and flare demonstration. (h) All times – a moving exclusion zone is in place 500 metres ahead and 30 metres either side or astern of any seagoing ships while underway, and within 30 metres of ships when at anchor or moored within Sydney Harbour. NO UNAUTHORISED VESSELS OR PERSONS are to enter the Exclusion Zones under any circumstances. The regulated area will be patrolled by Police, Roads and Maritime, and other official control vessels. Times may be extended without notice by Roads and Maritime in the interests of public safety. Entry of unauthorised vessels or persons into the Exclusion Zone renders the vessel operator or person liable to an offence. Note: Provided that vessels stay outside the Exclusion Zones (and despite any existing signposted regulation), vessels are permitted to stop or drift within the Sydney Harbour Transit Zone from 11:45am to 12:30pm and 6:30pm to 10:00pm. In addition, a buoyed spectator area will be established in the vicinity of Jeffrey Street Wharf during the day to allow registered Harbour Parade entrants and small vessels to anchor or drift so that spectators can watch the events. Special Restrictions – 26 January 2019 Within the regulated area (but outside the exclusion zones), the following Special Restrictions apply: (a) A Speed Limit of 6 knots applies to all non-participating vessels within 200m of any Exclusion Zone for the duration of the events. Maximum Penalty $1,100.00 (Marine Safety Act 1998 s.12(5));

(b) A “No Wash Zone” will be enforced within 200m of any Exclusion Zone for the duration of the events. Maximum Penalty $1,100.00 (Marine Safety Act 1998 s 12(5)). (c) Certain commuter and commercial vessel wharves will not be accessible during various Exclusion Zone times. Operators should check availability prior to approaching a wharf. Directions Roads and Maritime advises: 1) Persons within the vicinity of the regulated area must comply with any directions given by a Boating Safety Officer or Police Officer in relation to marine safety. Primary Industries Notices BIOSECURITY ACT 2015 Instrument of Appointment of Authorised Officers and Approval of Functions – Department of Primary Industries and Local Land Services officers I, Craig Shadbolt, A/Director Biosecurity & Food Safety Compliance, in exercise of delegated authority of the Secretary and of the Secretary as Accreditation Authority under the Biosecurity Act 2015 (the Act) make the following appointments and approvals: 1) Pursuant to section 361 of the Act, I appoint the persons listed in Column 1 of the table set out in Schedule 1 as authorised officers for the purposes of the Act. 2) Pursuant to section 195 of the Act, I approve those authorised officers listed in Column 1 of the table set out in Schedule 1 to exercise the functions of a biosecurity certifier as specified in Column 2 of the table. Schedule to Order under Section 364 2019 amendments to Workers Compensation Commission Rules 2011 Rule Amendment 1.4 (1) Add a definition of “decision notice”

Add:

“decision notice” means a notice issued under section 78 or 287A of the 1998 Act, and includes a notice issued under section 74 and 54 of the 1998 Act as in force immediately before 1 January 2019.”

9.1 (1) Delete Rule 9.1 (1) and replace with the following:

“(1) This Part applies to proceedings that are commenced by application for expedited assessment, and matters that are referred under s 292 of the 1998 Act for expedited assessment.

(2) This Part is to be read in accordance with any relevant Workers Compensation Guideline and Practice Direction.”

9.2 (1) Insert after rule 9.2 (1) (e):

“(f) a work capacity decision made by an insurer under s 43 of the 1987 Act,”

9.3 Delete Rule 9.3(1)- (8) and replace with the following:

“(1) If a dispute is determined under section 297 of the 1998 Act, an interim payment direction must be issued to the parties as soon as practicable after the determination of the dispute. (2) A brief statement of reasons is to be attached to the interim payment direction setting out the Registrar’s reasons for the direction. (3) For the avoidance of doubt, a reference to the Registrar includes a reference to the Commission.”

11.1(9) Delete rule 11.1(9) and replace with the following:

“(9) Without leave of the Commission, the failure of a worker to notify of an injury as required by the Workers Compensation Acts may not be raised as an issue in the reply by the party joined if that issue has not been included in a decision notice given in accordance with the 1998 Act by the party joined.”

17.5(2) Delete rule 17.5 (2) and replace with the following:

“(2) Without leave of the Commission, the failure of a worker to notify of an injury as and when required by the Workers Compensation Acts may not be raised as an issue in the pre-filing defence served by the defendant if that issue has not been included in the decision notice given in accordance with the 1998 Act.”
