EXECUTIVE ORDER

The Governor’s Executive Order 2004-18 calling the Forty-ninth Legislature into First Extraordinary Session was read at length as follows:

To the Honorable Members of the House of Representatives and the Honorable Members of the State Senate of Oklahoma:

I, Brad Henry, Governor of the State of Oklahoma, pursuant to the authority vested in me by the provisions of Section 7 of Article VI of the Oklahoma Constitution, hereby convoke the First Extraordinary Session of the Forty-ninth to convene at the State Capitol at 1:30 p.m. on May 19, 2004. I recommend for consideration the conducting of a comprehensive and detailed investigation of the activities of the Insurance Commissioner, Carroll Fisher, pursuant to HR 1040, for the purpose of determining whether Articles of Impeachment should be preferred against him and, if impeachable offenses are found, to institute impeachment proceedings.

Copies of this Executive Order shall be distributed to every member of the Oklahoma House of Representatives, every member of the Oklahoma State Senate, the Clerk of the House of Representatives, the Secretary of the Senate, and the Director of the Office of State Finance.

A Resolution relating to a study and investigation of Carroll Fisher, Insurance Commissioner of the State of Oklahoma; creating a Special Investigating Committee; stating purpose; providing for appointment of committee members; authorizing certain contracts; specifying authority and duties of the committee; providing for service of process and witness fees; and requiring report of findings and recommendations.

MOTION

Representative Rice, pursuant to Article V, Section 30 of the Oklahoma Constitution, moved that the House request the Honorable Senate to adjourn the First Extraordinary Session of the Forty-ninth Legislature for more than three days beginning May 19, 2004, and ending at the Call of the Chair and consents to the adjournment of the Honorable Senate for more than three days beginning May 19, 2004, and ending at the Call of the Chair, which was the order.

MESSAGE FROM THE SENATE

Pursuant to Article V., Section 30, Oklahoma Constitution, the Senate requests the Honorable House of Representatives to adjourn the First Extraordinary Session of the Forty-ninth Legislature for more than three days beginning on May 19, 2004, and ending at the call of the Chair and grants the request of the Honorable House of Representatives to adjourn for more than three days beginning on May 19, 2004 and ending at the call of the chair.

The Speaker announced the following appointments:

May 19, 2004 – Representative Toure appointed as Chair and Representatives Davis, Ferguson, McCarter, Nance, Rice, Roan and Roberts appointed as Members of the Special Investigative Committee. (Pursuant to HR 1001, First Extraordinary Session, Forty-ninth Legislature)

Representative Rice moved that when the clerk's desk is clear, the House stand adjourned to reconvene at the Call of the Chair, which was the order.
