A. Filing of Criminal Complaints for Preliminary Investigation

Before proceeding, please check the following:

 No. of copies: five (5) copies for every offense or count plus one (1) copy for each respondent  Filled-out Investigation Data Sheet (IDS)  Notarization of affidavits

Procedure Employee Time Fee

1. Present for assessment the complaint affidavit with all supporting Receiving Clerk and documents including witness affidavit/s, properly bound and 3 minutes None SRS Assessor paged, and fill out the Service Request Slip (SRS).

2. If Investigation Data Sheet (IDS) has not been accomplished yet, secure one from OCP if complaint documents are assessed to be Receiving Clerk 5 minutes None complete.

3. Ask for referral to available prosecutor if the affidavits and IDS have not been notarized yet. (Complainant and witnesses should Receiving Clerk 7 minutes None appear for the purpose.)

4. Have the IDS duly received/stamped with date and time of receipt Receiving Clerk 3 minutes None along with the assigned NPS docket number.

B. Filing of Interlocutory Pleadings (e.g., Motion to Reduce Bail, Motion for Extension to File Counter-Affidavit, etc.) from Parties

Before proceeding, please check the following:

 No. of copies: three (3) copies for OCP if the case is still pending, one (1) copy if already filed in court  If case is still pending, proof of receipt by other party of a copy of the pleading either by signature if through personal service or registry receipt if through registered mail

Procedure Employee Time Fee

1. Present for assessment the documents to be filed and fill out Receiving Clerk and 3 minutes None the Service Request Slip (SRS). SRS Assessor

2. If case is still pending, furnish first a copy of the document/s to the other party with a signature on the document/s attesting to such receipt if through personal service or attach Receiving Clerk 3 minutes None the registry receipt on the document/s for receiving if through registered mail.

3. If the other party has already been furnished a copy, present the required number of copies for OCP and personal file Receiving Clerk 3 minutes None copy and have them stamped received by the receiving clerk.

4. If case is already filed in court, present the document/s for Receiving Clerk 3 minutes None receipt by the receiving clerk.

C. Filing of Motions for Reconsideration or Reinvestigation

Before proceeding, please check the following:

 No. of copies: three (3) copies for OCP if the case is still pending, one (1) copy if already filed in court  If case is still pending, proof of receipt by other party of a copy of the motion either by signature if through personal service or registry receipt if through registered mail

D. Request for and Issuance of Certification for Status of Cases, True Copy of Documents, Exhibits

Before proceeding, please check the following:

 Photocopies of the documents to be certified  Original copies of the documents

Procedure Employee Time Fee

1. Present the documents for assessment and fill out Receiving Clerk & SRS 5–10 minutes depending on the number of None the Service Request Slip (SRS). Assessor documents P75.00 + 2. Pay the required legal fee. Collection Officer (CO) 3 minutes P2.00/page in excess of 3 pages

3. Present the receipt and the machine copies to be Receiving Clerk 3 minutes None certified.

4. Print your full name and sign on the line indicated Receiving Clerk 5–10 minutes None on the machine copies.

5. Return the machine copies for notarization by Receiving Clerk 5 minutes None available prosecutor.

6. Receive the duly certified true copies of your Receiving Clerk 1 minute None documents.

Before proceeding, please check the following:

 Government-issued IDs or Clearance/Police Clearance

1. Present IDs or Barangay Receiving Clerk Clearance/Police Clearance and fill 2 minutes None & SRS Assessor out the Service Request Slip (SRS).

Collection P50.00 - Local Employment 2. Pay the required legal fee. Officer/Authorized 3 minutes P100.00 - Foreign Employment Personnel P200.00 - Foreign Travel

3. Present the receipt and IDs/Barangay Clearance/Police Clearance for Clerk 3 minutes None database search.

4. Wait while document is being Receiving Clerk 5 minutes None prepared and signed.

5. Receive the Prosecutor’s Clearance. Receiving Clerk 1 minute None

F. Request for and Rendition of Legal Assistance
