NOTICE OF APPLICATION APPLICATION NO. 1512940 COUNTY AND CHIEF MOUNTAIN GAS CO-OP LTD.

Take Notice that the Energy and Utilities Board (the EUB) may continue to process this application without further notice if no valid objections are received on or before July 24, 2007 .

Nature of the Application An application has been filed with the EUB by Cardston County (the County) for approval to enter into a natural gas distribution franchise agreement (the Agreement) with Chief Mountain Gas Co-op Ltd. (the Co-op) pursuant to Section 45 of the Municipal Government Act (the Application).

Currently, the Co-op has an exclusive right to provide service to customers within its entire service area pursuant to a general rural franchise under the Gas Distribution Act . The Agreement gives the Co-op the exclusive right to continue to deliver natural gas for 20 years to a portion of its service area within the County immediately outside the municipal boundaries of the Towns of Cardston and , in accordance with the terms of the Agreement. Some of the noteworthy terms of the Agreement include clarification of responsibility for utility relocation costs caused by municipal purposes, provision of extra services, options for purchase of the distribution system by the municipality, and provisions respecting third-party use of the distribution system.

The Agreement has been based on a standard natural gas franchise agreement negotiated by the Alberta Urban Municipalities Association for use by all municipalities in the province. The standard natural gas franchise agreement has been previously reviewed by the EUB. However, in the circumstances of the present Application, the EUB has not yet determined what role, if any, it may have in relation to the specific Agreement between the County and the Co-op.
