MIUTES FOR THE 39th MEETIG OF THE COASTAL ZOE MAAGEMET AUTHORITY TO BE HELD O 20/02/2008.

39.1 Item o. 1 The minutes of the 38 th GCZMA meeting held on 12/12/2007 and circulated vide letter no. 7 /13 /90 /STE /DIR /3549 dated 31/01/2008 were confirmed.

39.1 Item o. 2 (Development in CRZII Areas) 39.2.1 Case o.1 Proposed Reconstruction / Repair / Modification of and existing house in Chalta o. 5,6,7,27,28A 28B,30 & 42 of P.T. Sheet o. 02 at Ribandar, city, Taluka, by Mr. Eric Sequeira (GCZMA//1/07/77). Decision: Approved from CRZ angle, subject to the repairs and renovation confirming to the local building byelaws and prior permission from Town and Country Planning Department.

39.2.2 Case o.2 Proposed construction of Compound wall, swimming pool and renovation of existing house in Chalta o. 2 and 4 of P.T. Sheet o. 3, Ribandar village Tiswadi Taluka, by M/s Infrastructure Logistics Pvt. Ltd.. (GCZMA//1/07/81 ). Decision: Approved from CRZ angle, subject to the repairs and renovation confirming to the local building byelaws and prior permission from Town and Country Planning Department.

39.2.3 Case o.3 Proposed construction of Ravindra Bhavan at Baina, Vasco city by Directorate of Art and Culture, Govt. of Goa. (Chalta o. 37, 44, 45, 35(Part), 96, 42(Part) of P.T. sheet 135 of Vasco city). Decision: Expost facto approval from CRZ angle granted.

39.3 Item o. 3 (Repair & Renovation/Development in CRZIII Area). 39.3.1 Case o.1 Proposed repairs of existing compound wall, laying of paversblocks/tiles and building of additional nallah in Sy. o. 86/16 of ReisMagos village, Bardez Taluka, by Highstreet Cruises and Entertainment Pvt. Ltd. (GCZMA//1/07/69) (the proposal has been referred by Village Panchayat ReisMagos on behalf) Decision: Deferred. The project proponent should submit a complete proposal for the type of development intended and EIA report, if required.

39.3.2 Case o.2 Proposed construction of a jetty in Sy. o. 89/1 of ReisMagos village, Bardez taluka, by Advani Pleasure Cruise Company Private Limited (GCZMA//1/07/34). Decision: Deferred: The issue be first referred to the Government for an inprinciple decision on whether offshore casinos are to be allowed to put up jetties within the precincts of the river or they should all be asked to put up jetties along the sea coast.

39.3.3 Case o.3 Proposed repairs and renovation of existing structure in Sy. o. 431/1 of Colvale village, Bardez Taluka, by Mr. Keshav Shridhar Borkar (GCZMA//1/07/47). Decision: Approved, subject to the condition that the plinth and the FAR remains the same.

39.3.4 Case o.4 Proposed repairs and renovation of existing Sports Complex Hall in Sy. o. 120/29 of Agonda village, Canacona Taluka, by Fabrica de Igreja de Agonda (GCZMA/S/1/07/20). Decision: Approved, subject to the condition that the plinth and the FAR remains the same.

39.3.5 Case o.5 Proposed repairs and renovation of the existing house in Sy. o. 135/15 of agorcem Palolem village, Canacona Taluka, by Shri Arvind S. agarsekar (GCZMA/S/2/07/30). Decision: Approved, subject to the condition that the plinth and the FAR remains the same.

39.3.6 Case o.6 Proposed repairs and renovation of existing structure in Sy. o. 73/29 of Anjuna village, Bardez Taluka, by Mrs Blanche D’Souza (GCZMA//1/07/ ). Decision: Approved, subject to the condition that the plinth and the FAR remains the same.

39.3.7 Case o.7 Proposed repairs and renovation of existing structure in Sy. o. 01 of Penha de Franca village, Bardez Taluka, by Mrs Liberata Joaquina Fernandes (GCZMA//1/07/82). Decision: Approved, subject to the condition that the plinth and the FAR remains the same.

39.3.8 Case o.8 Proposed repairs and renovation of existing structure in Sy. o. 130/33 of Anjuna village, Bardez Taluka, by Mr. Vithal S. Raut (GCZMA//1/07/ ). Decision: Approved, subject to the condition that the plinth and the FAR remains the same.

39.3.9 Case o.9 Proposed Swimming Pool and Wooden Jetty in Sy. o. 476a & 47/7 of Penha de Franca village, Bardez Taluka, by Gurbachan Singh Dhingra, co/o V.G. Properties Pvt. Ltd. (GCZMA//1/07/72). Decision: GCZMA approved the construction of the wooden jetty from CRZ angle. The proposal for construction of a swimming pool is deferred.

39.3.10 Case o.10 Proposed expansion of Factory building in Sy. o. 258/0 of Usgao village, Ponda Taluka, by M/s MRF Ltd. (GCZMA//1/07/11). Decision: As per the report of the Member expert, the proposed construction does not attract the provisions of the CRZ otification, 1991. The matter be referred back to the TCP.

39.3.11 Case o.11 1) Proposed construction of Barge Loading and Unloading facility in the property bearing Survey os. 18/3, 18/4 & 18/5 of Cottombi village, Bicholim Taluka, Counto Metals and Mining Company Pvt. Ltd. (GCZMA//1/07/28) 2) Proposed dredging of the river Mandovi near the existing jetty belonging to Alcon Cement Company at Pale Cottombi abutting survey no. 27/15, 14, 12 & 27/ 9. Decision: 1) The proposed construction of Barge Loading and Unloading facility is approved from CRZ angle. 2) The proposed dredging is permitted subject to the navigational requirements and requisite approvals of the Captain of Ports. However the dredged material should not be deposited in the DZ areas. GCZMA decided that dredging of the entire riverine navigational channels in Goa being used for transporting mineral ore should be undertaken, and for this purpose a meeting with the Mining organizations, State Deptts., GSPCB should be held, so that a long term river management plan is put in place.

39.3.12 Case o.12 Proposed dredging at Sanvordem jetty belonging to M/s V. S. Dempo & Co. Pvt. Ltd. abutting survey nos, 48 of Curchorem near Sanvordem bridge. Decision: The proposed dredging is permitted subject to the navigational requirements and requisite approvals of the Captain of Ports. However the dredged material should not be deposited in the DZ areas.

39.3.13 Case o.13 Regularization of the construction of Barge Loading jetty bearing Survey o. 27/16 at Tixem Cottombi village, Bicholim taluka, by Vassantram Metha and Company Pvt. Ltd. (GCZMA//1/07/80). Decision: Deferred. The matter is referred to the GSPCB to ascertain whether the conditions to establish and operate have been fulfilled in the instant case and also to verify that the construction has been carried out as per the approved plans.

39.3.14 Case o.14 Proposed OC for beautification of the area in front of St. Anthony’s ChurchSiolim, Siolim village, Bardez taluka, by Village Panchayat SiolimMarna (GCZMA//1/07/70). Decision: Approved from CRZ angle.

39.3.15 Case o.15 PROJECT: Construction of toilet and pantry blocks by M/s Info Tech Corporation of Goa Ltd. at Aldona –Corjuem under the Aldona bridge. (GCZMA//1/07/71). Decision: Approved from CRZ angle.

39.3.16 Case o.16 Proposed repair of Bund wall/Retaining wall in Survey o. 8/1 and 8/2 OldGoa village, Tiswadi taluka, by M/s Dempo Shipbuilding and Engineering Pvt. Ltd. (GCZMA//1/07/76) Decision: Approved from CRZ angle.

39.4 Item o. 4 (Barge Repair / Ship yards) 39.4.1 Case o. 1 Proposed .O.C for Barge Repair Workshop in Sy. o. 209/1 of Sancoale village, Mormugao Taluka, by Jose Maria Alberto Vales (GCZMA//1/07/06). Decision: Approved from CRZ angle, subject to the size of the shed being reducted to 8 x6 x 4 mtrs.

39.4.2 Case o. 2 Proposed .O.C for Barge Repair Workshop in Sy. o. 30/8 of Cortalim village, Mormugao Taluka, by M/s De Sa Engineering (GCZMA/S/349). Decision: Deferred.

39.4.3 Case o. 3 Proposed OC for extending fueling facilities and repair of existing retaining wall at retail outlet to barges plying on Zuari River in Sy. o. 207/4 BorimShiroda village Ponda taluka at Bharat Petroleum Corporation Ltd. (BPCL) (GCZMA//1/07/59) Decision: Approved from CRZ angle subject to the environmental mitigation measures and plan being put in place.

39.4.4 Case o. 4 Proposed .O.C for Barge Repair Workshop at Rassaim Loutolim by M/s Allan Faleiro, (GCZMA//1/07/06). Decision: Approved from CRZ angle to carry out activities in open space.

39.4.5 Case o. 5 Proposed .O.C for construction of Shipyard in Survey o.153/1 of Village Chicalim, Mormugao Taluka by M/s Pinky Shipyard Ltd. Decision: Approved from CRZ angle.

39.5 Any other issues and matters with the permission of the Chair. 39.5.1 Progress report on the CRZIII survey and inquiry being conducted Member Secretary (GCZMA) apprised the members on the progress made so far in the conduct of survey and inquiry of CRZ-III areas. The present directions of the Hon’ble High Court regarding submission of the plans to the Village Panchayats were discussed. Chief Secretary/Chairman (GCZMA) directed that the plans be given to the Village Panchayat expeditiously and a meeting of the QAS committee be convened at the earliest to review further progress in the matter.

39.5.2 Illegal constructions of various structures, violation of stop work orders by M/s True Axiz Resorts, illegal construction of road, dumping of mud, rubble and stone boulders for construction of an illegal road, in DZ areas of Morjim village in CRZI / CRZIII areas. GCZMA went through the various site inspection details / pictures taken of various illegally structures which have come up in NDZ and CRZ-III areas of Morjim village adjacent to the turtle nesting beach in violation of the CRZ notification, 1991. The structures seen are apparently belonging to various Russian Nationals. It was decided that since these structures are built even after the ban period imposed by the High Court in 1999/2000, these structures should be immediately ordered for demolition. Chief Secretary/ Chairman (GCZMA) directed that the demolition notice be issued after identifying the details of the owners and the survey nos. and they should respond with approvals from GCZMA, or else the demolition notices should be confirmed. 2. GCZMA also took serious note of the fact that M/s Trues Axiz has violated the permission granted for wire fencing and has proceeded to construct a wall and also the fact that inspite of the stop work order issued and in force the works continued in violations of these orders. GCZMA members directed that the wall and the structure built should be demolished. If any permission by any other authority, like Electricity dept, PWD, Panchayat etc. has been taken the same are order to be revoked. 3. GCZMA members took strong objection to the illegal construction of road, dumping of mud, rubble and stone boulders for construction of an illegal road, in NDZ area adjacent to the M/s True Axiz site and the area running parallel to the beach / existing sand dunes of Morjim village in CRZ-I / CRZ-III areas. Chief Secretary / Chairman (GCZMA) directed that the area be restored immediately, since no one has claimed responsibility, as indicated during the site inspection and the PWD are asked to restore the area and take possession of the materials.

39.5.3 Matter regarding Competent Automobiles at Arrosim Member Secretary explained that the Supreme Court has granted additional time of 04 weeks to submit the environmental impact assessment report regarding use of the property for a hotel project. The EIA assessment was being carried out by GSPCB. So also since the concrete pole fencing has been removed by the party and also that the area is plain terrain it was proposed to drop the show cause notice issued. GCZMA decided to drop the show cause notices and Chief Secretary / Chairman (GCZMA) directed that the assessment to he EIA be expedited and the report analysed by the select Members of GCZMA so that the reply to Supreme Court can be submitted in time.

39.5.4 Restoration of the mangrove areas and illegal land filling done behind Hira petrol pump, KTC circle, Panaji Directions issued to the Attorney, Communidade of Morombi-o-pequeno and Administrator of Communidade, Central Zone was confirmed.

39.5.5 Show Cause otice issued to M/s Ramesh Shetty & Sunil Kotian in Sy. o. 170/11 of Calangute Village, regarding a structure which at the time of approvals did not fall in the CRZ area (beyond 500m) but now lies in 500 mtr as per new HTL demarcation. The earlier permissions were granted by the TCP considering old hydrographic charts in 1995, the structure was beyond 500 m and when after due approvals the party commenced construction, the works were stopped as a site now falls just before 500m as per new HTL demarcation. Since the approvals were in order and the party commenced construction now, the party was apparently not ware of the new HTL demarcation nor was the TCP Deptt. GCZMA decided to drop the show cause notice and direct the matter to the TCP Deptt. to verify / revise the plans as per applicability of CRZ guidelines.

39.5.6 Proposed acquisition of land for construction of road to Dedeshwar temple in Survey os. 3/1, 46/3, 5/1, 7/1, 2, 3, and 4 of arva, Sao Matias village, Tiswadi Taluka by Executive Engineer, W.D.II, P.W.D., Panaji. (GCZMA//1/07/38) The proposal was earlier deferred as there is an ancient built up pond and caves, besides the area falls in NDZ. The Village Panchayat of Sao Matias has requested to grant approval to make a pathway leading to the temple. The proposal could be considered for making a pathway by keeping sufficient setbacks from the caves / pond and the river bank. The site should be re- inspected to ascertain these details and matter put forth for approval.
