The 260th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 31st August & 1st September, 2018 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 260th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

(1) The decision in respect of Department of Education, Bhupendra Narayan Mandal University, Vill- University Campus BNMU, Street/Road- NH106, Taluka/Mandal- Sadar, Town/City- University Campus BNMU, Dist.- Madhepura, Bihar-852113 (B.Ed. and M.Ed. course) (Government) (Application No. ERCAPP201646215) (ID No.-10837) in the 258th ERC meeting is as under:

“After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and no reply received in response to SCN issued after LOI, the Committee discussed the matter in detail and observed as under:

(a) Show Cause Notice u/s 14(3)(b) was issued on 07.06.2018 on the following ground:

(i) Faculty list submitted by the University is not duly approved by Registrar of the concerned affiliating body for each applied course.

(b) Reply from the institution has not been received within the stipulated period.

In view of the above, the Committee decided as under: The Committee is of the opinion that application bearing Code No. ERCAPP201646215 of the institution regarding recognition of applied B.Ed. and M.Ed. programmes are refused under section 14(3)(b) of NCTE Act, 1993”.

The above decision of ERC is rectified and may be read as under:

Since the Refusal Order vide No.57610 dated 01.08.2018 for B.Ed. and M.Ed. course was inadvertently issued, hence the said order is cancelled under intimation to all concerned.

received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after LOI, the Committee discussed the matter in detail and observed as under:

(i) In the submitted faculty list, the faculties viz. Gaurav Kumar Choudhary, Mritunjay Kumar, Baiju Bawara, Madhulata and Ranjan Kumar do not have NET/Ph.D. qualification as per Gazette Notification No.237 of NCTE published on 09.06.2017.

In view the above, the Committee decided as under: Show Cause Notice be issued to the institution as to why the application for recognition to B.Ed. course be not refused on the above point. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision.

For M.Ed. Course: After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after LOI, the Committee discussed the matter in detail and decided as under:

(i) As the show cause notice has been decided for B.Ed. course (ERCAPP201646215), hence the applied M.Ed. Course of the same application be kept in abeyance.

Therefore, a letter be issued to the institution stating the above position.

ATTENTION!

1. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

ER-260.2 [Court Case] Sukhdev Bramchari Institute of Education, Plot No.- 364, 365, Street No.-PWD Road, Vill.-Krishnapur, PO.-Saguna, Tehsil/Taluka- Kalyani, Town/City- Kalyani, Dist.- 1. 260.2.1 Nadia, West Bengal-741245 (D.El.Ed.) (Private) (West Bengal Board of Primary Education) (ERCAPP4172) As per decision of 218th ERC Meeting, recognition to D.El.Ed. Course was refused vide order dated 29.07.2016. The institution preferred an appeal to the NCTE HQs. against the refusal order of ERC and the Appellate Authority vide Order No. 89-748/2016 Appeal/7th Meeting-2018/23rd April, 2018 dated 16.05.2018 rejected the appeal and confirmed the order of ERC.

The institution preferred W.P. No. 9188 (w) of 2018 in the Hon’ble High Court of Calcutta. The Hon’ble High Court disposed of the matter on 03.08.2018 with a direction inter alia:

“Dispute on fact is regarding whether or not building is completed. In view of this disputed question of fact, whether or not it is a case of deficiency and can be removed, this Court is not inclined to go into. However, petitioners are at liberty to seek application of Regulation 7(17) by ERC-NCTE. After such application is made the authority will consider and dispose of expeditiously, positively within six weeks from making of application”.

The Committee considered the order of the Hon’ble High Court of Calcutta and decided as under:

The institution is to be informed that re-inspection be conducted on payment of fee of Rs.1,50,000/-.

The institution preferred W.P. No. 8032 (W) of 2018 in the Hon’ble High Court of Calcutta. The Hon’ble High Court disposed of the matter on 02.08.2018 with a direction inter alia:

“This Court on consideration of above materials makes direction upon respondent Nos. 2 to 4 to grant recognition regarding said two courses to petitioner, against B.Ed. course pursuant to order made in earlier writ petition and against D.El.Ed. course on disposing of pending application in light of said order and what

The Committee considered the order of the Hon’ble High Court of Calcutta and observed as under:

(i) Building completion certificate submitted by the institution is not approved & signed by the competent Govt. Engineer.

In view the above, the Committee decided as under: Show Cause Notice be issued to the institution as to why the application for recognition be not refused on the above point. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision.

After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply to LOI, the Committee discussed the matter in detail and observed as under:

(i) As per submitted faculty list, only one Language lecturer appointed instead of two as per NCTE Norms.

In view the above, the Committee decided as under: Show Cause Notice be issued to the institution as to why the application applied for permission be not refused on the above point. The Committee therefore, provides last opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision.

ER-260.12 [Misc. Cases] Jote Kanuramgarh Mahatma Primary Teachers Training Institute, Vill./P.O.- Jot 6. 260.12.1 Kanuramgarh, PS- Daspur, Dist.-Paschim Medinipur, West Bengal-721212 (D.El.Ed.) (Private) (West Bengal Board of Primary Education) (APE00706) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time and reply in response to Show Cause Notice, the Committee discussed the matter in detail and observed as under:

(i) The institution is required to submit CD for improvement of infrastructural and instructional facilities as per deficiencies mentioned in the withdrawal order. (ii) Faculty list duly approved by the concerned affiliating body along with all testimonials of each appointed faculty is required to be submitted. (iii) Registered land document as required under NCTE Regulations. (iv) Original FDRs of Rs. 5.00 lakhs & Rs. 7.00 lakhs towards Endowment & Reserve fund converted into joint mode are required to be submitted. (v) Bills submitted towards improvement of facilities do not reflect VAT and TAN Number.

ER-260.4 [Appeal Case] J. P. College of Education, Vill.-Biyabani, Street/Road:- NH-31, Taluka/Mandal:- 7. 260.4.1 Biharsharif, Town/City- Biyabani, Dist.-Nalanda, Bihar-803101 (B.Ed.) (Private) (Magadha University) (ERCAPP201646257) (ID No.10915)

As per decision of 239th ERC Meeting, recognition to B.Ed. Course was refused vide order dated 02.05.2017. The institution preferred an appeal to NCTE HQs. against the refusal order of ERC and the Appellate Authority vide Order No. 89-549/E-10593/2018 Appeal/10th Mtg.-2018/25th & 26th May, 2018 dated 12.07.2018 remanded back the case to ERC with a direction to consider the NOC to be submitted by the appellant, and take further action as per the NCTE Regulations, 2014. The appellant is directed to forward to the ERC a copy of the NOC within 15 days of receipt of the orders on the appeal.

The ERC re-viewed the matter in accordance with the appeal order as well as representation dated 23.07.2018 submitted by the institution along with copy of NOC issued by the Registrar, Magadh University and decided as under:-

Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve fund in the joint name of RD, ERC, NCTE and institution with the reply of letter of intent.

Patna Training College, Dariapur, Bankipore, Patna, Bihar-800004 (B.Ed.) 8. 260.4.2 (Government) (Patna University) (File No.BR-S/E-6/96) The institution was granted recognition for B.Ed. course time to time by ERC vide order dated 12.02.1997 from the academic session 1997-98 with an intake of 60, order dated 24.11.1998 from the academic session 1999-2000 with an intake of 60, order dated 22.02.1999 from the academic session 1999-2000 with an intake of 90, followed by revised order vide No.32514 dated 30.05.2015 with an intake of 100 (two basic units) from the academic session 2015-2016 as per NCTE Regulations, 2014.

As per decision of 244th ERC Meeting, recognition granted to B.Ed. course was withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session vide order No. ER-244.17.7/(BR-S/E-6/96)/B.Ed./2017/54770 dated 23.10.2017.

The institution preferred an appeal to NCTE HQs. against the withdrawal order of ERC and the Appellate Authority vide order No.89-384/E-77120/2018 Appeal/14th Mtg.-2018/30th & 31st July, 2018/68855 dated 07.08.2018 decided to set aside the order of withdrawal dated 23.10.2017. The appellant is however, required to submit to ERC a complete and comprehensive list of faculty as per norms and standards of NCTE Regulations, 2014 along with the action plan to conduct the course uninterruptedly when temporarily appointed faculty is replaced by regular faculty recommended by Bihar Public Service Commission in due course.

The ERC re-viewed the matter in accordance with the appeal order and observed as under:

(i) The institution is required to submit complete and comprehensive list comprising 16 full time (regular) faculty, in the NCTE prescribed proforma duly approved by the concerned affilating body along with all testimonials of each faculty, with qualification prescribed as per Norms & Standards of NCTE Regulations, 2014 and subsequent amendment vide Gazette Notification No.237 of NCTE published on 09.06.2017.

Women’s Training College, Patna University, North Gandhi Maidan, Patna, Bihar- 9. 260.4.3 800001 (B.Ed.) (Government) (Patna University) (BR-S/E-5/96)

The institution was granted recognition for B.Ed. course vide order dated 11.02.1997 from the academic session 1997-98 with an intake of 80, order dated 22.02.1999 from the academic session 1999-2000 with an intake of 120 by the ERC, NCTE, followed by revised order vide No.32510 dated 30.05.2015 with an intake of 100 (two basic units) from the academic session 2015-2016 as per NCTE Regulations, 2014.

As per decision of 244th ERC Meeting, recognition granted to B.Ed. course was withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session vide ERC order No.ER-244.17.8/(BR-S/E-5/96)/B.Ed./2017/ 54769 dated 23.10.2017.

The institution preferred an appeal to NCTE HQs. against the withdrawal order of ERC and the Appellate Authority vide order No.89-383/E-76994/2018 Appeal/14th Mtg.-2018/30th & 31st July, 2018/68859 dated 07.08.2018 decided to set aside the order of withdrawal dated 23.10.2017. The appellant is however, required to submit to ERC, a complete and comprehensive list of faculty as per norms and standards of NCTE Regulations, 2014 along with the action plan to conduct the course uninterruptedly when temporarily appointed full time faculty is replaced by regular faculty recommended by Bihar Public Service Commission in due course.

The ERC re-viewed the matter in accordance with the appeal order and observed as under:

Sabhapati Mishra Institute of Education, Vill.-Mohammadpur, Naya Bhojpur, Street/Road- Maharaja Path, Taluka/Mandal- Dumraon, Town/City-Mohammadpur, 10. 260.4.4 Naya Bhojpur, Dist.- Buxar, Bihar-802136 (D.El.Ed.) (Private) (ERCAPP201646040) (ID-10151) As per decision of 240th ERC Meeting, recognition to B.Ed. and D.El.Ed. Course was refused vide order No.53450 dated 30.05.2017. The institution preferred an appeal to NCTE HQs. against the refusal order of ERC and the Appellate Authority vide order No.89-763/E-54767/2017 Appeal/10th Mtg.-2018/25th & 26th May, 2018 dated 12.07.2018 remanded back the case to ERC with a direction to issue an independent appropriate order in repsect of the D.El.Ed. Course.

The ERC re-viewed the matter in accordance with the appeal order and observed as under:-

(i) Recognition to B.Ed. course of the said institution was refused vide order dated 30.05.2017 as decided in 240th ERC meeting, hence the application for D.El.Ed. Course comes under the category of standalone institution, which is not permissible as per NCTE Regulation, 2014.

In view of the above, the Committee decided as under: The Committee is of the opinion that application bearing Application No. ERCAPP201646040 of the institution regarding recognition of applied D.El.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993. Kameshwar Singh Darbhanga Sanskrit University, Darbhanga, Bihar-846008 (Shiksha 11. 260.4.5 Shastri-B.Ed. Course) (Itself affiliating body) (APE00247) The institution was granted recognition for Shiksha Shastri-B.Ed. course vide order No.ERC/7-57.8.4/2005/1927 dated 21.06.2005 with an intake of 100 from the academic session 2005-2006 by the ERC, NCTE, followed by revised order vide No.32553 dated 30.05.2015 as per NCTE Regulations, 2014.

As per decision of 244th ERC Meeting, recognition granted to Shiksha Shastri-B.Ed. course was withdrawn under section 17(1) of NCTE Act, 1993 from the next academic session vide ERC order No. ER-244.17.10/APE00247/ Shiksha Shastri-B.Ed./2017/54781 dated 23.10.2017.

The institution preferred an appeal to NCTE HQs. against the withdrawal order of ERC and the Appellate Authority vide order No. 89-766/E-55703/2017-Appeal/2nd Mtg.-2018/3rd & 5th Feb., 2018 dated 16.03.2018 decided to set aside the impugned order dated 23.10.2017. The Appellant is required to submit copy of its reply dated 28.01.2015 to ERC along with enclosures within 15 days of the issue of appeal orders and should also state the status of appointment of part-time lecturer in Physical Education.

The ERC in its 254th meeting re-viewed the matter in accordance with the appeal order and on later occasions, as decided by ERC in its meetings, issued Show Cause Notice dated 02.05.2018, 12.07.2018 and 03.08.2018 respectively to the institution. The institution had complied with the documents relating to appointment of faculty as per NCTE Regulations, 2014 and subsequent amendment vide Gazette Notification No.237 of NCTE published on 09.06.2017.

In view of the above, the Committee decided as under:

Recognition for B.Ed. course is continued.

ER-260.7 [Reply of SCN after VT] Coochbehar Advancement and Prosperity College of Education, Plot NO- LR 6948, 6949, 6950, 6952(P), Street No- 6948, Vill.- Khagrabari, PO- Khagrabari, 12. 260.7.1 Tehsil/Taluka- Kotowali, Town/City- Cooch Behar, Dist- Cooch Behar, West Bengal- 736179 (B.Ed.) The institution was granted recognition for B.Ed. course with an intake of 50 (one basic unit) from the academic session 2016-2017 vide order No. ER-210.5.55/ERCAPP3629/B.Ed./2016/45829 dated 01.05.2016 by the ERC, NCTE. The institution preferred an appeal to NCTE Hqrs. against the recognition order of ERC. The Appellate Authority vide its Order No.89-540/E-949/2017 Appeal/18th Meeting-2017/60939 dated 29.11.2017 remanded back the case to ERC with a direction to issue a reasoned order to the appellant for grant of recognition for one unit only. The ERC in its 248th meeting re-viewed the matter in accordance with the appeal order and reasoned order was issued on 14.02.2018 to the institution.

The institution filed W.P.(C) No.5197 of 2018 in the High Court of Calcutta. The Hon’ble High Court disposed of the matter on 16.07.2018 with a direction inter alia:

“Mr. Dhatt, learned advocate appears on behalf of NCTE and submits, the institution has cause violation of regulations. There will be more than 25 students per teacher if intake capacity is to be increased. Furthermore, the second Mathematics teacher appointed is not duly qualified. There are further and other reasons including that the institution must apply afresh upon fulfilling all such requirements which prevents his client from dealing with the review.

NCTE has not been able to demonstrate that a review is impermissible under the regulations. All that the institution is asking is for a review of its decision on changed circumstances of appointment of second Mathematics teacher pursuant to impugned order, challenge to which the institution is not pressing. If the authority has reasons to turn away petitioner, it must do so by disclosing those reasons in dealing with the review. NCTE will deal with and dispose of the review application of petitioner disclosed at pages 57 to 62 of writ petition within a period of four weeks from the date of communication of this order. Reasons are to be given for its decision to be made known to petitioner within the time directed”.

The ERC in its 258th meeting considered the order dated 16.07.2018 of the Hon’ble High Court of Calcutta and Show Cause Notice dated 01.08.2018 issued to the institution. Now, the reply dated 30.07.2018 submitted by the institution (on the basis of proceedings uploaded on ERC website) received in this office on 07.08.2018, was considered by ERC.

In view of the above, the Committee decided as under: In addition to 50 intake already granted for B.Ed. The ERC in its 256th meeting considered the order dated 21.03.2018 of the Hon’ble High Court of Delhi and reasoned order dated 11.06.2018 was issued informing the institution that the previous order for one basic unit 50 intake of D.El.Ed. from the academic session 2016-2017 issued vide order dated 02.05.2016 remain unchanged.

The NCTE HQrs. vide letter dated 29.05.2018 requested to consider the petitioner case in the RC meeting as per the provisions available under NCTE Act and Regulation. The ERC in its 259th meeting considered the order of the Hon‘ble High Court of Calcutta and Show Cause Notice dated 23.08.2018 issued to the institution. (i) There are 26,335 surplus trained graduate teachers to be added with 4350 trained graduate teachers in the year 2017-2018 on annual basis.

(ii) There are 4914 surplus trained graduate teachers in primary schools to be added with 6550 trained graduate teachers in the year 2017-2018 on annual basis. (iii) The State Government in collaboration with NITI AAYOG is undertaking reforms/rationalization/ transformation in the Department and cadre which would likely result in merger of 4200 schools. (iv) After finalization of AADHAAR seeding by the students, schools having less than 10 students are being closed and the teachers of the said schools are to be adjusted and relocated. (v) Government of India, Ministry of HRD has launched a programme to train the untrained teachers on distance mode. (vi) There is a current of decline in the child population as per the decennial growth of 2001 census was 2.1 and the same has come down to 1.4 in 2011 census in the State of Odisha and it is further expected to fall to 0.8 in 2021 census.

b. The above decision of Government of Odisha has been taken into consideration by ERC.

In view of the above, the Committee decided as under: The Committee is of the opinion that application bearing Code No. ERCAPP2466 of the institution regarding recognition of applied B.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993.
