Procedural Direction Enbridge Northern Gateway Project

On 27 May 2010, Northern Gateway Pipelines Limited Partnership (Northern Gateway) submitted an application to the National Energy Board for the Enbridge Northern Gateway Project (Project). The Joint Review Panel (Panel) established to review the proposed Project, pursuant to the National Energy Board Act and the Canadian Environmental Assessment Act is examining the information filed.

The Terms of Reference for the joint review of the Project (which can be found at www.gatewaypanel.review-examen.gc.ca, require the Panel to conduct sessions with the public and Aboriginal groups to seek comments on the following:

• a draft List of Issues; • additional information which Northern Gateway should be required to file; and • location(s) for the oral hearing.

The Panel is of the view that it would be useful and appropriate to obtain these comments prior to issuing a Hearing Order or initiating further procedural steps in the joint review process. Therefore, the Panel is issuing the attached Procedural Direction outlining the way in which

Procedural Direction

Background and Purpose The Joint Review Panel (the Panel), established to review the Enbridge Northern Gateway Project (Project), has a broad mandate to assess the potential environmental effects of the Project and to determine if it is in the public interest.

Prior to issuing a Hearing Order or initiating further procedural steps in the joint review process, the Panel seeks comments from the public and Aboriginal groups on the following three topics:

1. the draft List of Issues, attached as Appendix I;

2. additional information which Northern Gateway should be required to file; and

3. location(s) for the oral hearings.

While the Panel encourages written comments, it will hold three sessions to collect oral comments. Both written and oral comments will be considered equally by the Panel.

Written Comment

Written comments on the above three topics may be submitted to the Panel using the attached Written Comment Form (see Appendix II), or separate correspondence clearly marked “Joint Review - Enbridge Northern Gateway Project - Comment” including information requested on the Written Comment Form.

Written comments must be received, no later than noon (Mountain Daylight Time) Wednesday, 8 September 2010.

Sessions will begin at 9:00 am local time on the first day in each location, and continue as directed by the Panel. The Panel expects to accommodate those interested in making an oral presentation by holding both daytime and evening sessions. As guidance, the Panel suggests that oral presentations addressing the three topics would likely be in the range of 30 minutes or less.

2 Registration for Panel Sessions

Participants who wish to provide comment orally are requested to register for one of the Panel session locations. To register, use the attached Panel Session Registration Form (see Appendix III). The form must be received no later than the registration deadline listed above.

Following the registration deadline, registered participants will be advised of the approximate scheduling for their oral comment. Registered participants who have not been contacted by the Friday prior to the scheduled Panel session should contact Louise Niro, Regulatory Officer, at 403-299-3987 or toll free at 1-800-899-1265.

As a guideline, the Panel suggests that oral presentations addressing the three topics would likely be in the range of 30 minutes or less. Participants who believe that additional time is required to provide their comments, are encouraged to use the written comment option, either in addition to or in substitution of oral comment or to specifically seek additional time to be scheduled for their oral comment at the time of registration by contacting Louise Niro, Regulatory Officer, at 403-299-3987 or toll free at 1-800-899-1625. When making an oral presentation, participants will not be allowed to read or review their written comments.

Participants who did not register by the set deadline may still have an opportunity to provide their comments to the Panel. The Panel may, at its discretion, allow presentations from participants who have not registered, if time permits.

Comment by the Applicant

Northern Gateway is directed to send a copy of this Procedural Direction and covering correspondence to: • all persons and groups who were provided a copy of the Project application or notification of its electronic filing by Northern Gateway; • all Aboriginal groups referred to in Table 2-1 of Volume 5A of the application;

3 • the Enbridge Pipelines Inc. Interested Parties List for toll filings; • additional interested persons identified in Appendix IV; and • other persons or groups who have advised Northern Gateway of an interest in receiving materials associated with the filing of the Project application.

Publication

Northern Gateway is directed to publish the attached Notice (Appendix V) in the publications referred to in Appendix VI. Northern Gateway is directed to provide written confirmation to the Panel of the last date of such publication.

Part I – Scope of the Project The Project includes the construction, operation, decommissioning and abandonment of the following components: • An oil pipeline commencing near Fort Saskatchewan, Alberta and terminating at a new marine terminal located in Kitimat, British Columbia; • A condensate pipeline commencing at a new marine terminal in Kitimat, British Columbia and terminating near Fort Saskatchewan, Alberta; • The right-of-way for the two pipelines as well as any temporary workspace required for the construction; • Associated pump stations, a pressure letdown station (oil) and a pressure initiation station (condensate); • Tunnels through North Hope Peak and Mount Nimbus to facilitate crossing of the Coast Mountains by the pipelines; • A tank terminal, including hydrocarbon tanks, pump facilities and other land facilities, adjacent to the marine terminal; • All-weather road access and electrical power requirements for the pump stations, the tank terminal and the new marine terminal in Kitimat, British Columbia; • Block valves located at pump stations, selected watercourse crossings and other locations along the route; • Pigging facilities at either end of the pipeline system and in selected intermediate locations; • Cathodic protection system for the pipelines and tanks, including anode beds at selected locations along the pipeline route; • Two marine loading and unloading berths (one each for oil and condensate) including: loading and unloading platforms; • breasting dolphins; • mooring dolphins; • gangway tower; • walkway bridges between platform and breasting dolphins; • utility boat floating dock; • oil contingency deployment system with storage platforms; • fire fighting systems; • offshore anchorages in Kitimat Arm or elsewhere; and • pipeline interconnects between the berths and the tankage.

• Marine transportation of oil and condensate within: • the Confined Channel Assessment Area, as defined by the proponent, which includes the marine and shoreline area of Kitimat Arm, Douglas Channel to Camano Sound, and Principe Channel to Browning Entrance;

9 • Hecate Strait; and • the proposed shipping routes to be used for the Project that are within the 12 nautical mile limit of the Territorial Sea of Canada.

• All related works and activities including: • all temporary electrical power supply lines, such as those supplying energy for camps and worksites; • temporary work camps; • temporary access roads; • bridges and watercourse crossings (new or modified); • management and treatment of wastewaters and waste management; • water withdrawals; • borrow pits and quarries; • management of excavation material, including stockpiles (e.g. overburden); • log handling and storage facilities • construction worksites, storage areas and staging areas; • handling and storage of petroleum products and hazardous materials; • handling, storage and use of explosives; and

• Any other components described by the proponent in its Preliminary Information Package, filed with the National Energy Board on November 1, 2005

Any additional modifications or decommissioning and abandonment activities would be subject to future examination under the National Energy Board Act and consequently, under the Canadian Environmental Assessment Act (the Act), as appropriate. Therefore, at this time, the Proponent will be required to examine these activities in a broad context only.

Part II -Factors to be Considered During the Joint Review

The joint review will include a consideration of the following factors listed in paragraphs 16(1) (a) to (d) and subsection 16(2) of the Act: • The environmental effects of the Project, including the environmental effects of malfunctions or accidents that may occur in connection with the Project and any cumulative environmental effects that are likely to result from the Project in combination with other projects or activities that have been or will be carried out; • The significance of the effects referred to above; • Comments from the public and Aboriginal peoples that are received during the review; • Measures that are technically and economically feasible and that would mitigate any significant adverse environmental effects of the Project; • The purpose of the Project; • Alternative means of carrying out the Project, that are technically and economically feasible and the environmental effects of any such alternative means; • The need for, and the requirements of, any follow-up program in respect of the Project; and

10 • The capacity of renewable resources that is likely to be significantly affected by the Project to meet the needs of the present and those of the future.

In accordance with paragraph 16(1)(e) of the Act, the assessment by the Panel will also include a consideration of the following additional matters: • Need for the Project; • Alternatives to the Project; • Community knowledge and Aboriginal traditional knowledge received during the review; • Measures to enhance any beneficial environmental effects; and • Environmental protection, environmental monitoring, and contingency and emergency response plans.

NOTICE

The Joint Review Panel (the Panel), established to review the Enbridge Northern Gateway Project (Project), has a broad mandate to assess the potential environmental effects of the Project and to determine if it is in the public interest.

Prior to issuing a Hearing Order or initiating further procedural steps in the joint review process, the Joint Review Panel (Panel) seeks comments from the public and Aboriginal groups on the following three topics:

1. the draft List of Issues for the Joint Review;

2. additional information which Northern Gateway should be required to file; and

3. location(s) for the oral hearings.

The Panel has set up a written comment period and scheduled oral Panel Sessions at three (3) locations in advance of the oral hearings to receive comments from the public and Aboriginal groups on the above three topics. This information is being sought in advance of the issuance of a Hearing Order or the initiation of further procedural steps.

Project Details

The proposed Project involves the construction of two pipelines and the construction and operation of the Kitimat Marine Terminal. The two pipelines are each approximately 1,170 kilometres in length, between Bruderheim, Alberta and Kitimat, British Columbia. One 914 mm (36 inch) outside diameter line would carry approximately 525,000 barrels per day of petroleum products west to Kitimat. The other line, a 508 mm (20 inch) outside diameter pipeline, would carry approximately 193,000 barrels of condensate per day east to Bruderheim. Condensate is used to thin petroleum products for pipeline transport. The Kitimat Marine Terminal would have two ship berths and storage for three condensate tanks and 11 petroleum tanks. It would also include a radar monitoring station and first response capabilities.

Panel Sessions

Panel sessions to hear oral comment on the above topics, will be held at the following locations, starting on the dates indicated:

Sessions will begin at 9:00 am local time on the first day in each location, and continue as directed by the Panel. The Panel expects to accommodate those interested in making an oral presentation by holding both daytime and evening sessions. As guidance, the Panel suggests that oral presentations addressing the three topics would likely be in the range of 30 minutes or less. When making an oral presentation, participants will not be allowed to read or review their written comments.

Registration for Panel Sessions

Anyone wishing to provide comments orally should register for one of the Panel Sessions, listed above, using the Panel Session - Registration Form at www.gatewaypanel.review- examen.gc.ca, no later than the registration deadlines noted. Participants who did not register by the set deadline may still have an opportunity to provide their comments to the Panel. The Panel may, at its discretion, allow presentations from participants who have not registered, if time permits. Participants who wish to provide oral comments at one of the Panel Sessions by teleconference, (rather than attending in person) should contact Louise Niro, Regulatory Officer, at 403-299-3987, or toll free at 1-800-899-1265.
