Dear Chairman Goudy:

The U.S. Environmental Protection Agency's January 14,2016, letter requested an indication of whether the Yakama Nation would like to initiate consultation regarding the draft final Engineering Evaluation and Cost Analysis (EE/CA) for a non-time critical removal action at the former Boeing Electronics Manufacturing Facility located near the Duwamish River.

Ms. Laura Castrilli of my staff has communicated with Mr. Brady Kent of the Yakama Nation Environmental Management Program. It is the EPA's understanding that the Confederated Tribes and Yakama Nation will defer to the local tribes. The local federally recognized tribes for consultation on this matter are the Suquamish and Tribes. Thus far, a request for consultation has not been received from either tribe. If no request for consultation is received by February 29, 2016, the EPA plans to share the draft final EE/CA with the Lower Duwamish Waterway Tribes, Trustees, and Community Group (LDW TTC). After LDW TTC review, there will be a public comment period.
