1.1 N/02/00191/OPP: Kildonan: Site to South of Cnoc Farm

Marriott Builders, Old Pier Shop, , , have applied for outline planning permission for the erection of six dwellinghouses at a site to the south of Cnoc Farm, Kildonan, Isle of Arran. Objections have been received from Arran Civic Trust, 3 Glen Place, ; R. & E. G. Cheshire, Ocean Breeze, Shore Road, Kildonan; K. & A. S. Cheshire, Herons Cliff, Shore Road, Kildonan (two letters); M. Gee, Brooklet, Kildonan; and A. McKelvie, Brooklet, Kildonan, all Isle of Arran.

The Sub Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions: -

1. That the approval of North Council as Planning Authority with regard to the siting, design and external appearance of, landscaping and means of access to the proposed development shall be obtained before the development is commenced.

2. That the design of the houses to be submitted with the application(s) required by condition 1 above shall be in accordance with the guidance contained in the letter from Architectural Design Services dated 28 October 2002 to the satisfaction of Council as Planning Authority.

3. That visibility splays of 2.5 metres by 60 metres in both directions shall be provided and maintained on land within the applicant's control, such that there is no obstruction to visibility above a height of 1.05 metre measured above the adjacent carriageway level to the satisfaction of North Ayrshire Council as Planning Authority.

Page 1 4. That the access road hereby approved shall be constructed in accordance with the Roads Development Guide, incorporating a 5.5 metre wide carriageway, a ramped entry detail and parking provision for both plots and visitors.

5. That the first 2.0 metres of the driveway for each plot, measured from the shared surface shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.

6. That effluent disposal arrangements shall comply with the current code of practice BS6297:1983, to the satisfaction of North Ayrshire Council as planning authority.

7. That prior to work commencing on site the developer shall secure the implementation of an archaeological watching brief, to be carried out by an archaeological organisation acceptable to North Ayrshire Council as Planning Authority, during construction work; the retained archaeological organisation shall be afforded access to the site at all reasonable times and allowed to record and recover items of interest and finds; terms of reference for the watching brief will be supplied by West of Archaeology Service; and the name of the archaeological organisation retained by the developer shall be given in writing to North Ayrshire Council as Planning Authority and to West of Scotland Archaeology Service not less than 14 days before development commences.

8. That any application(s) submitted under the terms of Condition 1 above shall be accompanied by a flood risk assessment which assesses the likelihood of the development site suffering a 1 in 200 year flood event (i.e. a flood with a 0.5 per cent chance of being equalled or exceeded in any year) which addresses both coastal and fluvial flooding, and taking account of the latest government advice on climate change and addresses the minimum requirements of Annex B of the SEPA/Planning Authority protocol "Development at Risk of Flooding: Advice and Consultation".

9. That any application(s) submitted under the terms of Condition 1 above shall include the proposed landscaping scheme and management arrangements for the maintenance of the communal open space area within the development site and no development shall commence until the arrangements have been agreed in writing by North Ayrshire Council as Planning Authority.

1.2 N/02/00626/OPP: : Site to North of Rhurioch

Christine E. Black, Sealladh-na-mara, Pirnmill, Isle of Arran, has applied for outline planning permission for the erection of a three bedroom dwellinghouse at a site to the north of Rhurioch, Pirnmill, Isle of Arran. An objection has been received from Arran Civic Trust, 3 Glen Place, Brodick.

Page 2 The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions: -

1. That the approval of North Ayrshire Council as Planning Authority with regard to the siting, design and external appearance of, landscaping and means of access to the proposed development shall be obtained before the development is commenced.

2. That visibility splays of 2.5 metres by 60 metres in both directions shall be provided and maintained on land within the applicant's control, such that there is no obstruction to visibility above a height of 1.05 metre measured above the adjacent carriageway level to the satisfaction of North Ayrshire Council as Planning Authority.

3. That the first 2.0 metres of the driveway to be provided, measured from the metalled portion of the A814 fronting the site shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.

4. That the detailed application required to be submitted by Condition 1 above shall include the provision of a vehicular turning area in order to allow vehicles to enter and leave the site in a forward gear.

5. That any dwellinghouse to be erected on the site shall conform to the design guidance contained in Part 2 of the adopted Isle of Arran Local Plan to the satisfaction of North Ayrshire Council as Planning Authority.

6. That the application required by Condition 1 above shall include a survey of the existing tree cover on the site and a plan showing the trees to be retained and those to be felled, and no other trees shall be felled without the express written consent of North Ayrshire Council as Planning Authority.

7. That no permission is hereby granted for the use of red roof tiles as specified on the application form submitted with the application and an alternative specification shall be submitted with the detailed application required by Condition 1 above.

8. That effluent disposal arrangements contained in the detailed application required by Condition 1 above shall comply with the current code of practice BS6297:1983, and direct the foul effluent arising from the site to a septic tank and soakaway arrangement to the satisfaction of North Ayrshire Council as planning authority.

2. // Local Plan Areas

2.1 N/02/00361/PP: Stevenston: 113 Glencairn Street: Unit 1

D. & L. Motor Company, Unit 1, 113 Glencairn Street, Stevenston, have applied for planning permission to change the use of the existing bus garage to form a Vehicle Repair Centre, MOT station and Car/Van Hire Centre at that address. Objections have been received from Mrs F. O'Boyle, 17 Sharphill Road, Saltcoats; and Mr H. M.

The Sub Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions: -

1. That the use hereby permitted shall be discontinued and the land restored to its former condition on or before 16 December 2007.

2. That all servicing and repairs of vehicles shall be carried out from within buildings on the site.

3. That the use hereby permitted shall not operate outwith the hours of 0830 to 1800 Mondays to Fridays and 0830 to 1300 on Saturdays unless North Ayrshire Council as Planning Authority gives written consent to any variation.

2.2 N/02/00362/PP: Stevenston: 113 Glencairn Street: Unit 2

Mr D. S. Ross, 13 Corsehill Drive, , has applied for planning permission for the change of use from a vehicle storage facility to a storage, assembly and packaging facility for decorative lighting at Unit 2, 113 Glencairn Street, Stevenston. An objection has been received from Mr H. M. Harper, 13 North Crescent Road, Ardrossan.

The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions: -

1. That the planning permission hereby granted shall enure not for the benefit of the land to which it relates but for the benefit of the applicant only.

2. That the premises shall be used for the purposes of the storage, assembly and packaging of decorative lighting and for no other purpose.

3. That the use hereby permitted shall not operate outwith the hours of 0830 to 1630 Mondays to Fridays and 0830 to 1300 on Saturdays unless North Ayrshire Council as Planning Authority gives written consent to any variation.

3. Irvine/ Local Plan Area

3.1 N/02/00635/PP: Kilwinning: 13 Lochwood Close

Mr Alridge, 13 Lochwood Close, Kilwinning, has applied for planning permission for a two storey side extension to form a lounge and a garage on the ground floor, and two bedrooms on the first floor at that address.

Page 4 The Sub Committee agreed to refuse the application on the following grounds: -

1. That the proposed development would be contrary to Policy HOU10 of the adopted Irvine and Kilwinning Local Plan in that: (i) the scale of the extension would represent over-development of the site which would be detrimental to the character and amenity of the surrounding housing area; and (ii) the design and location of the proposed extension would create an inadequate standard of amenity for the occupants of the dwellinghouse by virtue of an unsatisfactory outlook from the rear facing windows.

4. North Coast and Cumbraes Local Plan Area

4.1 N/02/00257/PP: : 45 Moorburn Road

Aberness Foods Limited, PO Box 33, Broadfold Road, Bridge of Don, Aberdeen, have applied for planning permission for the change of use of the existing flat at 45 Moorburn Road, Largs, to form an extension to the shop at that address. An objection has been received from Elspeth Lloyd, 47 Moorburn Road, Largs.

The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions: -

1. That prior to the commencement of the use of the flat as an extension to the shop, the sound proofing and separating floor as detailed on the plan hereby approved shall be provided to the satisfaction of North Ayrshire Council as Planning Authority.

2. That the existing entrance to the flat shall be used only as an emergency exit.

4.2 N/02/00463/PP: Largs: Cathcart Road: Douglas Park Nursery

Douglas Park Nursery, Cathcart Road, Largs, have applied for planning permission for the erection of timber decking to the east side of the pavilion at that location, and for retrospective permission for the erection of a timber hut and timber decking to the north side of the pavilion. Objections have been received from C. N. Betteley, 4 Cathcart Road; and Lindsay G. Brodie, Childwall Cottage, 6 Cathcart Road, both Largs.

The Sub Committee, having considered the terms of the objections, agreed to grant the application subject to the following condition: -

1. That the hut and decking hereby permitted shall be removed and the land restored to its former condition on or before 16 December 2012.

Mrs McAlpine, 15 Pencil View, Largs, has applied for planning permission for the development of the attic of the dwellinghouse at that address, including the formation of two dormer windows and one ridge located cupola.

The Sub Committee agreed to refuse the application on the following grounds: -

1. That the proposed development would be contrary to Policy HOU8 in the adopted North Coast and Cumbraes Local Plan in that the siting, design and appearance of the dormers and cupola would detract from the appearance of the house which would be detrimental to the character and amenity of the surrounding housing area.

4.4 N/02/00519/PP and N/02/0570/LBC: Skelmorlie: Station Road: Morland House: Flat 1

Mr and Mrs Hastings, Flat 1, Morland House, Station Road, Skelmorlie, have applied for (i) planning permission and (ii) listed building consent for the installation of garden entrance gates and railings at the same address. An objection has been received from Tim Spence, Flat 3, Morland House, Longhill, Skelmorlie.

The Sub Committee, having considered the terms of the objection, agreed (a) to grant the application for planning permission; and (b) subject to Section 12 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 to grant listed building consent.

4.5 N/02/00733/PP: Skelmorlie: Road: Site to East of 7 Halketburn Terrace

Burnfield Builders and Demolishers Limited, 10 Gardens, , have applied for planning permission for the erection of a dwellinghouse at a site to the east of 7 Halketburn Terrace, Skelmorlie Castle Road, Skelmorlie. An objection has been received from J. Mackenzie, Holmlea, Skelmorlie Castle Road, Skelmorlie.

The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions: -

1. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority exact details or samples of the proposed external finishes and surface finish to the driveway.

2. That the vehicular access to the site shall be provided with a drop kerb footway crossing to be formed as detailed in Sections 5.2 and 10.8 (and fig 10.16) of the Roads Development Guidelines.

3. That prior to the occupation of the house a 2m wide footway shall be constructed along the entire frontage of the site to the satisfaction of North Ayrshire

4. That the first 2 metres of the access, measured from the heel of the footway shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.

5. Garnock Valley Local Plan Area

5.1 N/01/00846/RMA: : Threepwood Road: Site to West of Townhead of Threepwood

John Kerr, Brownhill of Shutterflat, Beith, has applied for approval of reserved matters in respect of the erection of a dwellinghouse at a site to the west of Townhead of Threepwood, Threepwood Road, Beith. Objections have been received from John Cunninghame, Townhead of Threepwood, Cottage 2, Beith; M. Morton and D. Morton, East Cottage, Townhead of Threepwood, Beith; Mr Norman Jackson per Walker Laird, 9 Gilmour Street, Paisley; and Mr Maurice Morton per MacRoberts, 152 Bath Street, Glasgow.

The Sub Committee, having considered the terms of the objections, agreed to grant the application.

5.2 N/02/00179/PP: Beith: 55 Head Street

R. Burns, 7 Glenburn Crescent, Largs, has applied for planning permission for an extension to the existing residential care home to form a laundry and store to the rear of Thistleknowe Residential Home, 55 Head Street, Beith. Objections have been received from Mr and Mrs J Bell, 1A Aitken Drive; R. & C. M. Davis, 32 Head Street; Mr and Mrs Fisher, 6 Aitken Drive; R. and S. Harkness, 4 Aitken Drive; Mr and Mrs Kelly, 8 Aitken Drive; L. J. Lewis, 36 Head Street; Mr and Mrs A. McGill, 34 Head Street; and A. Scott, 2 Aitken Drive, all Beith.

The Sub Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions: -

1. That no development shall take place until agreement has been reached with Scottish Water to connect the proposed extension to the public sewer.

2. That the existing mature tree indicated in green on the approved plan shall be retained and shall not be lopped, topped or felled without the express written approval of North Ayrshire Council as Planning Authority.

6. Tree Preservation Order: Isle of Arran: : Whitehouse

Submitted report by the Assistant Chief Executive (Legal and Protective) seeking confirmation of a provisional Tree Preservation Order at White House, Lamlash, Isle of Arran.

Page 7 As a result of the threatened felling of trees, the Assistant Chief Executive (Legal and Protective) exercised delegated powers to serve an urgent provisional Tree Preservation Order under Section 163 of the Town and Country Planning (Scotland) Act 1997 in respect of land at White House, Lamlash, Isle of Arran. The Order was made provisional on 12 September 2002.

The Planning Authority has six months from an Order coming into effect to provisionally confirm it in the form already served or confirm it subject to any modifications as a result of the representations or objections received.

No objections to the Order have been received.

The Sub Committee agreed to confirm the provisional Order in its provisional form, without modification.
