PLAINTIFF’S NOTICE OF APPEAL

Notice is hereby given that Plaintiff VTran Media Technologies, LLC (“Plaintiff”),

Plaintiff in the above-named case, hereby appeals to the United States Court of Appeals for the

Federal Circuit from the Final Judgment entered in this action on December 23, 2010 [D.I. 106]

(“the Judgment”) and any and all adverse rulings incorporated in, antecedent to, and/or ancillary

to the Judgment. Plaintiff appeals from any and all adverse interlocutory judgments, decrees,

decisions, rulings, findings, instructions, and opinions that merged into and became part of the

Judgment, that shaped the Judgment, that are related to the Judgment, and/or upon which the

Judgment is based. Those adverse interlocutory judgments, decrees, decisions, rulings, findings,

instructions, and opinions include, but are not limited to:

a. Memorandum in Support of Order Regarding Claim Constructions [D.I. 57], entered in this action on July 17, 2009;

b. Order regarding Claim Constructions [D.I. 58], including, without limitation, the Court’s construction of the “requested time” and “television transmission system” terms in that Order, entered in this action on July 17, 2009;

c. Memorandum On Summary Judgment [D.I. 98], entered in this action on September 17, 2010;

d. Order Regarding Summary Judgment [D.I. 99], entered in this action on September 17, 2010;

e. Memorandum in Support of Separate Order Regarding Motion For Summary Judgment [D.I. 102], entered in this action on December 13, 2010;

g. Order closing the individual civil cases based on the Court’s grant of summary judgment and termination of the MDL case [D.I. 104], entered in this action on December 15, 2010; and

h. All other Orders entered by the Court in the above case that are appealable by Plaintiff; to the extent that those judgments, decrees, decisions, rulings, findings, instructions, and opinions are adverse to Plaintiff.
