(Lond), B.L., is a member of the Irish and English Bars and a practising barrister in Dublin. She is Reid Professor of Criminal Law, Criminology and Penology at Trinity College Dublin, and taught previously at the University of Kent, the University of North London and the National College of Ireland. She is co- author of Abortion and the Law (Kingston and Whelan with Bacik, Dublin, Round Hall, 1997) and co-editor of Crime and Poverty in Ireland (Bacik and O’Connell (eds), Dublin, Round Hall, 1998). She co-ordinated an EU-funded study on rape law in different European jurisdictions, The Legal Process and Victims of Rape (Bacik, Maunsell and Gogan, Dublin Rape Crisis Centre, 1998), and is co-author of Towards a Culture of Human Rights in Ireland (Bacik and Livingstone, Cork University Press, 2001). She has contributed chapters on sentencing practice and on women and criminal law to the major Irish criminological text, O’Mahony (ed), Criminal Justice in Ireland (IPA, 2002). She has carried out consultancy and training work in Europe and internationally with the Council of Europe, the British Council and the International Labour Organisation (ILO). She has been Editor of the Irish Criminal Law Journal since 1997. Cathryn Costello, B.C.L., (N.U.I.), LL.M. (Bruges), B.L. (Honorable Society of King’s Inns). Cathryn Costello holds law degrees from University College, Cork, the College of Europe, Bruges and the Honorable Society of King’s Inns. In October 2003, she took up a Fellowship in Public and EC Law at Worcester College, Oxford. Prior to this she was Lecturer in European Law since 1998 at the Law School, Trinity College Dublin, where she taught the mandatory general course on EU law as well as advanced courses in various other aspects of EU law and WTO law. Her areas of EU law specialisation include fundamental rights and equality law, the judicial system, and the development of common immigration and asylum policy. Since 2000, she has also held the position of Director of the Irish Centre for European Law, where she is responsible for organising an extensive conference and research programme. She has published extensively in the equality field, and has co-edited a major volume on the new EC equality directives (Costello and Barry (eds) Equality in Diversity: The New Equality Directives (Dublin, ICEL No 29, 2003). 5129 NEW G-injustice - A/W 18/4/08 1:40 PM Page 5 Eileen Drew, BA, M.Sc. Dip MIS, Ph.D, with degrees from Trinity College Dublin and the University of Bradford, was elected to Fellowship of Trinity College Dublin in 1999. She is a Senior Lecturer in the Department of Statistics and Centre for Gender and Women’s Studies at Trinity College, where she teaches in the areas of Women, Work and Employment and Data Analysis. She has undertaken extensive research using national and EU data sets. This includes an examination of Gender and Part- time Working in Ireland and other EU countries, the issue of Low Pay for Women Workers, Integration of Women into the Irish Labour Market and an international Comparative Leadership Survey of women and men in 27 industrialised countries. Recent publications include Off the Treadmill: Achieving Work Life Balance (Family Friendly Framework Committee 2003), Gender Equality in the Civil Service (IPA 1999) and Women, Work and the Family in Europe (Routledge 1998). She is a member of the Executive Committee for the Centre for Gender and Women’s Studies and the M. Phil. Programme in Women’s Studies. Her career has included research, training and consultancy in an EU New Opportunities for Women (NOW) project ‘Putting the ‘E’ Into Quality’, with Excellence Ireland, and the EU Leonardo da Vinci Project on ‘Management in the Millennium’. Dr. Drew was appointed to the European Science Foundation Network for Gender Inequality in the New Regional Europe.     TEXT OF THE INTRODUCTORY ADDRESS delivered by DR HUGH BRADY Pro-Vice-Chancellor of the University, President of University College Dublin – NUI, Dublin, on 21 April 2004 on the occasion of the Conferring of the Degree of Doctor of Laws honoris causa upon MELLA CARROLL A Sheansailéir, agus a mhuintir na hOllscoile: The Honorable Ms. Justice Mella Carroll was born in Dublin in 1934. She came to University College Dublin in the 1950’s and graduated with a BA in French and German. She subsequently went on to study Law at King’s Inns and was called to the Irish Bar in 1957. In 1976 she was called to the Bar in Northern Ireland and, a year later, became a Senior Counsel and a member of the Inner Bar. For a period she was the only female Senior Counsel practising in the Irish State. In 1979 she was elected Chairperson of the Bar Council. Then in 1980 Mella Carroll received the signal honour of being appointed the first woman judge of the High Court. She is now the longest serving member of that Court and during the intervening years has discharged the duties and responsibilities of her judicial office with great distinction, unfailing courtesy, and enormous integrity. Her formidable forensic talents were put to excellent use in another judicial context. For fifteen years she served on the Administrative Tribunal of the International Labour Organisation which is based in Geneva and, for a time, was appointed Vice-President of that Tribunal. The esteem in which Ms Justice Carroll is held by her fellow jurists was further evidenced by her appointment as President of the International Association of Women Judges.

    2018 – A Year of Anniversaries The 2018 Pankhurst Lecture, University of Manchester Lady Hale, President of The Supreme Court 8 February 2018 2018 marks the anniversary of some very important dates in the history of women’s participation in public life. We all know that 2018 is the 100th anniversary of women getting the vote, although not on same terms as men. Most of us probably know that it is also the 100th anniversary of women getting the right to stand as candidates and be elected to Parliament, this time on the same terms as men. Why the difference? I believe that there were two reasons why only some women got the vote. One was that the same Act of Parliament gave the vote to all men, irrespective of whether they had any property. Giving the vote effectively only to middle class women – those who either had property of their own or were married to men who did or who had University degrees – softened the effect of enfranchising the working-class men. Another was that in 1918, because of the slaughter of the First World War, there were more many more adult women than there were adult men – allowing them to vote on equal terms would have meant that they were in a majority. But there was no risk that more women than men would be elected to Parliament – the whole idea was laughable – so equality there would do no harm. Voting equality was achieved ten years later, in 1928. So we should celebrate 2018 as the 90th anniversary of women getting the 1 right to vote on equal terms with men and have an even bigger celebration in ten years’ time.

    Reconciling Ireland's Bail Laws with Traditional Irish Constitutional Values Kate Doran Thesis Offered for the Degree of Doctor of Philosophy School of Law Faculty of Arts, Humanities and Social Sciences University of Limerick Supervisor: Prof. Paul McCutcheon Submitted to the University of Limerick, November 2014 Abstract Title: Reconciling Ireland’s Bail Laws with Traditional Irish Constitutional Values Author: Kate Doran Bail is a device which provides for the pre-trial release of a criminal defendant after security has been taken for the defendant’s future appearance at trial. Ireland has traditionally adopted a liberal approach to bail. For example, in The People (Attorney General) v O’Callaghan (1966), the Supreme Court declared that the sole purpose of bail was to secure the attendance of the accused at trial and that the refusal of bail on preventative detention grounds amounted to a denial of the presumption of innocence. Accordingly, it would be unconstitutional to deny bail to an accused person as a means of preventing him from committing further offences while awaiting trial. This purist approach to the right to bail came under severe pressure in the mid-1990s from police, prosecutorial and political forces which, in turn, was a response to a media generated panic over the perceived increase over the threat posed by organised crime and an associated growth in ‘bail banditry’. A constitutional amendment effectively neutralising the effects of the O'Callaghan jurisprudence was adopted in 1996. This was swiftly followed by the Bail Act 1997 which introduced the concept of preventative detention (in the bail context) into Irish law.

Tis is the frst time that the Supreme Court will sit outside of a courthouse since the Four Courts reopened in 1932, the frst time the court sits in Galway, and only its third time to sit outside of Dublin. To mark the importance of this occasion, we are running a series of events on campus for the public and for our students. I would like to thank the Chief Justice and members of the Supreme Court for participating in these events and for giving their time so generously. Dr Charles O’Mahony, Head of School, NUI Galway We are particularly grateful for the Supreme Court’s willingness to engage with our students. As one of Ireland’s leading Law Schools, our key focus is on the development of both critical thinking and adaptability in our future legal professionals.
