ORDER (Date of hearing 17.11.08)

The Petitioner signed a PPA with UPPCL on dated 14.6.2006 for supply of surplus power from its co-generation Sugar Mills at Khambar Khera District-

1 Lakhimpur and Thanabhawan District – Muzaffarnagar. The dedicated transmission lines for evacuation of power were to be constructed by the Petitioner from its generating station to 132 KV substation of UPPCL. Due to delay in construction, the Commission allowed temporary evacuation by solid tapping of existing lines up to February’07 vide order dated 21.11.06 in the petitions 412 and 413 of 2006 and further upto start of next crushing season in Pet.no.500/07 dt.17.3.08. The Petitioner has submitted that the work on Khamberkhera line is almost complete except a 100 mtrs. stretch left because of Railway crossing for which necessary permission from Railways is expected by the end of this month. The Petitioner has added that the crushing season is about to start as such permission for use of temporary evacuation system is being sought for further two months, the period in which the dedicated transmission line would be completed. In its reply submitted during proceedings, the Respondent has also acknowledged that the required clearances have been obtained and forwarded to Northern Railways for necessary permission which is expected by the end of month. In view of pending clearance from Railways, the Commission accord permission for use of temporary evacuation system till 31st January 2009. Regarding Thana Bhawan, the petitioner submitted that the dedicated transmission line was to be constructed from its plant to 132 Kv S/s Lalukheri (length of line - 22 Km) but could not be completed due to acute Right of Way (RoW) problems. The line was to be constructed by UPPTCL under deposit scheme and accordingly order for construction of line was placed by S.E. (transmission) to M/s Prem Power. Sri A.K. Srivastava, S.E. (E.T.D. Meerut), on behalf of the respondent, asserted that the work on transmission line could not commence due to severe RoW problems resulting withdrawal of M/s Prem Power from the contract. He further stated that it was informed vide letter dt. 18.6.08, of S.E. (ETDC, Lucknow) for change in routing from 132 Kv Lalukheri S/s to 132 Kv Thana Bhawan S/s (length of line - 5 Km). Sri S.N.M Tripathi, representative of the petitioner, informed that request for change in

2 interconnection was sent to M.D., UPPCL for necessary amendment in PPA however response is awaited. He further stated that the construction of line was still in impasse in absence of required permission for amendment in PPA from UPPCL while crushing season was going to start in the month of November 2008 as such the permission for use of temporary arrangement might be allowed till April 09. The petitioner also prayed for direction to UPPCL to amend PPA to incorporate change in respect to interconnection of the plant with 132 Kv Thana Bhawan S/s instead of 132 Kv Lalukheri S/s. In its written reply submitted during hearing, the respondent has neither addressed the issue nor objected to the prayer of the petitioner. In view of the RoW problem, Commission allows evacuation of power from through temporary arrangement till April 09 and also allows to connect the plant with 132 KV Thana Bhawan substation and directs the parties to carry out necessary modifications in the PPA. The observations and directions made in earlier Orders of the Commission regarding compliance, duties of various agencies, safety measures, commercial conditions, metering and monitoring of satisfactory operation in relation to the temporary arrangement shall also be adhered to.
