The merger of the 6 District and County Councils in April 2009 created the largest unitary authority in the country in terms of area and the largest provider of building control services in the county.

Around forty Surveyors, backed by technical support personnel, provide unrivalled experience on any building regulation subject.

The service carries out a number of statutory duties on behalf of the Council, all of which encompass the securing of health, safety, welfare, convenience and the conservation of fuel and power within the built environment.

Our main function is the administration of the Building Regulations and we do this by the provision of an independent Building Regulation assessment service. We are a client focused service who aim to help you to produce a successful building at the end of your project.

Charges are made to cover the cost of the Building Regulations part of the overall service we provide. Details of the charges are available on our website www.cornwall.gov.uk.

Full Plans Submission

A plan charge is required to be paid when the application is deposited. Once the work has started and the first inspection carried out you will be invoiced for the inspection charge, which covers all subsequent inspections. For some types of work the inspection charge is included with the initial charge.

Building Notice Procedure

The total fee is normally paid with the deposit of the Building Notice. It should be noted that: The charges indicated on the Schedule include VAT. Neither a Full Plans Submission nor a Building Notice are considered valid until the correct fee has been received. Payment for applications can be made by cash, cheque (please make payable to Cornwall Council) or by credit or debit card. Please contact us for further information. Finally, please ensure that you have all the necessary permissions and approvals for the proposed work, e.g. Planning and Listed Building Consent and that you have discharged your obligations under other legislation, e.g. Party Wall Act. If in doubt, please ask.

WHAT ARE THE BUILDING REGULATIONS?

The Building Regulations are a set of specific requirements which ensure that acceptable minimum standards of health and safety are achieved in and around buildings. They also require adequate access and facilities for all people to all buildings as well as specifying measures to control energy consumption.

It must be remembered that they seek to achieve minimum standards and are not a benchmark of quality of finish. The Approved Documents range from Parts A to P. HOW TO MAKE AN APPLICATION

You need Building Regulations approval when:

• You erect or extend a building

• You materially alter a building e.g. carry out structural alterations

• You extend or alter a controlled service within a building e.g. install a WC

• You want to change the building’s fundamental use

• The windows and doors in your property are replaced

• Certain works are carried out to domestic electrical systems

• Certain renovation work is proposed

There are two ways you can make a Building Regulation application, either by using the Full Plans or Building Notice routes.

Both application forms are available in either hard copy or as a download to your computer from the Council’s website.

Full Plans

You must use this method if you are proposing work to a commercial building or a building to which the Regulatory Reform (Fire Safety) Order 2005 applies, or you would prefer to have your plans checked in detail and have an approval issued. This may be more advantageous at a later date. Work can start on site as soon as a valid application has been deposited with the Council. A ‘Full Plans’ application will consist of: • Full construction drawings, details and specification. Two copies of the plans are normally required, however if your application is for a non domestic building four copies are required • A completed ‘Full Plans’ application form • A location plan showing the boundary of your site edged in red • The appropriate fee You may wish to use an architect or agent to prepare these details for you especially if you are not familiar with the Building Regulations. Once your application has been validated and acknowledged, a Building Control Surveyor will carry out a full appraisal of the submission. You may be contacted if additional information, clarification or amendment is required. When the submission is found to be satisfactory a formal Approval or Conditional Approval notice will be issued. Your Notice of Approval is valid for three years from the date of deposit of the application.

Building Notice

This can only be used for domestic buildings. It is by far the easiest of the two methods as detailed plans and specification are not required and is ideal for straightforward small projects such as the installation of a bathroom. However, in certain circumstances the Building Control Surveyor may ask for further details to assist them in determining compliance with the regulations. Typically this will happen with projects such as loft conversions or where structural calculations are required to substantiate an element of your proposals. A Building Notice submission will consist of; • A location plan showing the boundary of your site edged in red and if applicable the extent of any proposed extension • A completed Building Notice form • The appropriate Building Notice Charge Once the Building Notice has been validated you will receive an Acceptance notice. It is important to note that this does not in any way give you or your builder prior approval of your proposals even if you have provided details. Close liaison and co-operation between the Council’s Building Control Surveyor and you and / or your builder is essential with the Building Notice procedure.

The basic criteria for exemption are relatively simple. However, you would be advised to contact Building Control Services for clarification and/or confirmation. The following list will provide sufficient guidance in most cases for you to establish exemption where applicable: 1. A detached single storey building having an internal floor area which does not exceed 30m2, which contains no sleeping accommodation and is a building: a) No point of which is less than 1m from any boundary; or b) Which is constructed substantially of non- combustible material. 2. A detached building having an internal floor area which does not exceed 15m2 and which contains no sleeping accommodation. 3. The extension of an existing building by the addition at ground level of a: a) Conservatory, Porch, Covered Yard, or Covered Way; or b) Car Port open on at least two sides – Where the floor area does not exceed 30m2, provided that in the case of a Conservatory or Porch which contains glazing, that satisfies the requirements of Part N and is at ground level. Should you have any doubts or wish to double check your own conclusions please contact Building Control Services. We will be only too happy to clarify the situation for you and potentially save you considerable difficulties in the future with the sale of your property. The extension of a heating system or electricity supply in connection with any of the above work is not exempt. It is important to note that exempt work under the Building Regulations may require approval under other legislation and in particular Planning Permission and you are therefore advised to contact Planning Services (0300 1234 151). CHOOSING YOUR AGENT AND BUILDER Work you carry out on your property is one of the biggest investments you are likely to make; if you are employing people to submit your application and carry out the building work you should consider your choice carefully.

Agent An agent can help you with the design and technical details and can submit an application for you if you require. Builder

A builder will initially use the plans and details prepared by your agent to give a quotation for the work. On site, the plans and details are used to ensure that the finished project is as you imagined and that it complies with the Building Regulations. Try and get quotes from at least three different builders and try to get personal recommendations from friends and neighbours. If possible arrange to view previous work they have undertaken. Be suspicious of anyone offering a cheap deal for cash! Use the JCT (Joint Contracts Tribunal) Building Contract for homeowner /occupier to confirm your agreement with a builder. For a minimal charge the contract confirms the precise arrangements for the work to be done and sets out simply and clearly what is expected from you and your builder. CONSIDER YOUR NEIGHBOURS

Take a few moments to run through this checklist when planning a project. It could save time and delay later. Are you certain of the exact boundaries of your land? Have you shown a copy of your plans to your neighbour? Have you spoken specifically about the following? • Encroachment of the building or foundations slightly over the boundary • The exact detailing at the junction of walls and roofs between properties • Eaves and guttering overhanging the boundary • New drainage connections • Future access for maintenance and repair • Overlooking windows • The position of new and existing flues and chimneys By giving regard to these issues you will help to avoid the potential for a dispute to occur. The Local Authority has no jurisdiction over these matters and our approval under Building Regulations rarely addresses the legalities of boundaries, rights or ownership. Clearly where the Council has no legal consideration it could be that the additional expense of a Civil Action is borne by the parties in trying to reach a satisfactory resolution.

It is very important that we are able to inspect the critical parts of the building work, and this is carried out when we are told that the work is ready (we call this “notify”). Some notification stages of the work are legal requirements (statutory), and there are other stages that we also consider to be important in our assessment of your project. For this reason the Building Control Surveyor will issue you with a Site Inspection Log clearly indicating the stages of work we wish to inspect; this may not include all of the statutory notifications. You may notify us in one of several ways, for example by writing, telephone, fax, email or online methods. We would prefer commencement of work notification in writing. Whilst many inspections are carried out on the same day, (subject to contacting us before 10:00am Monday-Friday) some may require an appointment. Remember that there is a legal requirement to “notify” and there can be considerable problems where omissions are made which prevent the issuing of a Completion Certificate. Failure to give the required notifications could result in enforcement action being taken against you and / or your builder. This will inevitably result in unnecessary inconvenience, delays, disruption, remedial works and additional costs to your project. For this reason it is important that you clarify the responsibility for inspection notices with your builder. The Certificate together with the Approval Notice / Acceptance letter is required when selling a property or any transaction that may call for a property search to be carried out. This might include raising finance or property transfer. The Certificate is not a Guarantee, and neither does it suggest that absolutely everything has been seen or complies. Our surveyors are required to make judgments based upon the previous inspection records and what can reasonably be seen at the time of the visit. The Regulations are technical requirements and rarely does our role extend to the general quality of work.

WORK CARRIED OUT WITHOUT BUILDING REGULATION APPROVAL This is a breach of the Building Regulations and an offence. The penalties for this are, on summary conviction, a fine and possibly enforcement action to remove the offending work. It is possible to ‘regularise’ unauthorised work constructed after the 11th November 1985 and outside the last 12 months. A Regularisation Certificate can be applied for using the appropriate form and relevant fee. Where building work, to which the Building Regulations would have applied, has been carried out without first applying for Building Regulation Approval, the regularisation process gives the owner of the property the opportunity to apply retrospectively to Building Control Services with a view to regularising the situation. The process of achieving the Certificate is disruptive due to the extent of works that may have to be opened up for inspection, can be time consuming and may be costly depending on the nature and extent of the work and the amount of remedial work needed. Experience suggests that the requirement for a Regularisation Certificate will come at the most inconvenient time, i.e. when selling your property. It is likely therefore to delay, or prevent, the sale of your property. This procedure is not the Council taking enforcement action against you – it is merely an opportunity for you to regularise a situation that should enable you to complete the sale of your property. You are under no obligation to submit an application and the Council is under no obligation to accept an application.

Whilst our main function is the delivery of a statutory Building Regulation Service, we also provide a number of other services related to building standards and public safety.

Dangerous Buildings

The control of dangerous buildings and structures forms a very important element of the Building Control Service. Unstable brickwork, roofs, boundary walls, fire damaged buildings etc. represent, potentially, a very high risk to public safety and are therefore given high priority. You can contact us during office hours by telephoning any of the numbers shown with the map or outside office hours on 0300 1234 151. If the building or structure poses a potential danger to public safety or building occupants, we take the appropriate action to remove the danger. When necessary we have legal powers to require the owners of buildings or structures to remedy the defects or if necessary we direct our contractors to carry out works to make the building or structure safe. In addition, we also provide advice on the structural condition of buildings to the Fire Brigade and the Police Service.

Demolitions

Anyone intending to carry out demolition work within the district is required to notify the Council. Certain conditions may be specified relating to site safety and the manner in which the work is undertaken. This process normally only takes a few days. We must however be notified at least 6 weeks before the demolition is to be carried out. We control both public and private sector demolition, should you have concerns regarding either please contact us.

FACILITIES FOR THE DISABLED
