1 INTRODUCTION

1.1 Project Profile

Chongqing Urban-Rural Infrastructure Development Demonstration Project financed by Asian Development Bank (ADB) includes a total of 13 sub-components, 5 of which involves ethnic minorities, respectively, rural roads from Qianjiangba to Huangxi, Meijiang in Xiushan County to Yunai, Youyang rural roads (Jizhen in Ganxi -Ganxi railway station, Shuicao-Yaojiatuo and Heishui-Maoba ), Yaoling in to Qingshui and water supply project which includes two small projects in Longtan and Mawang Town of Youyang County. During the project implementation, due to the planning adjustment, sub-components in Qianjing, Youyang, Yunyang applied for the use of domestic funds. Therefore, the monitoring of the first two phases didn’t include the above 3 sub-components. However, according to the requirements of ADB inspection team, the aim of the above sub-components has not been changed and they are still in the scope of the project. Thus, we also make an understanding of these sub-components in this phase.

Youyang rural way includes the following three parts: 1. The road from Ganxi to Ganxi Railway Station: 2.2km of the road has been completed, including 0.9km-length and 4.5m-width rural road with cement concrete pavement, 1.3km-length and 7m-width municipal road, with a total investment of four million yuan which comes from the special funds of agricultural development and self-financing of villages and towns. 2. Xiushan County Xiushan County belonged to Shangyu area in Shang and Zhou Dynasties (3000 years ago) - southern part of Ba State in Spring and Autumn period (2500 years ago) - the Qianzhong County in Qin Dynasty (2500 to 2207 years ago). In Han Dynasty (202 B.C. to 220 A.D.), the Qianzhong County was divided into Ba County and Wuling County. Since then all dynasties set up the county in Xiushan. Xiushan County has already begun to communicate with the central plain culture since 3000 years ago, and after 1000 years until Han Dynasty, the "Han" appellation appeared. It can be seen that the aboriginal residents of XiuShan County have mutual exchanges and integration with the Hans for over 3000 years, so their culture, language and customs have been deeply influenced by Hans. With the development of history, there is no difference between the aboriginal residents and Hans. On April 4, 1983, Tujia and Miao was founded, which returned all local

3 residents to ethnic minorities’ identity again. 2. Qianjiang District Qianjiang District belonged to Pu and Ba State in Shang and Zhou Dynasties (1600 B.C. to 1000 B.C.)-Ba County in Qin dynasty (300 B.C.)-Fuling County in early Han Dynasty(202 B.C.). Since then, Qianjiang was set up or divided in history. Until the November of 1983, all local residents were restored ethnic minorities’ identity again with the approval of the state council. Qianjiang is a minorities-settled district, Tujia and Miao are two main minority groups; in addition, Qianjiang is scattered with Hui, Mongolian, Tibetan, Manchu, Uygur, Yi, Zhuang, Buyi, Korean, Dong, Yao, Bai, Hani, Kazak, Dongxiang, Li, Wa, Salar, Gaoshan, Tajik, Ewenki, Pumi, Shui totally 24 minority groups. On November 1, 2010, the six national population census data showed that Qianjing had a total population of 445000, in which 118840 was Hans, 256246 was Tujia, 69553 was Miao, and 373 was other ethnic minorities, minorities account for 73.3% of the total population. 3. Youyang County Youyang was set up as a county in Western Han Dynasty (202 BC) and replaced by state in Yuan Dynasty, totally more than 2200 years. Similar to Xiushan County, with the interaction and integration for over 2000 years, residents in Youyang have been completely accustomed to using the language and customs of the Hans. In the November of 1983, approved by the State Council, Youyang Tujia and Miao Autonomous County was founded, and on November 11, 1984, all local residents was restored ethnic minorities’ identity again.

4. Qingshui Township, Yunyang County As the only ethnic minorities township in Yunyang, Qingshui Tujia Township was found in 2002. According to the historical data, aboriginal residents in Qianjiang, Xiushan,

Youyang and Qingshui have interacted with the Hans for thousands of years, they shared the same language and customs with each other. Approved by the State Council, Qianjiang District, Xiushan County and Youyang County were restored to ethnic minorities in 1983 and the Qingshui Township was founded in 2002.

2 MONITORING AND ASSESSMENT OF THE IMPLEMENTATION OF ETHNIC MINORITIES DEVELOPMENT PLAN

2.1 Monitoring and Assessment Agency

The external monitoring and assessment of the Ethnic minorities development plan is undertaken by Chongqing Duojie Investment Consulting Co., Ltd. This monitoring will conform to the relevant policies of ADB and outlines of external monitoring and assessment of the ethnic minorities development plan. Based on the Phase Ⅲ monitoring, the agency will carry out the Phase Ⅳ monitoring according to the implementation effects of the ethnic minorities development plan.

2.2 Monitoring and Assessment Task

The main task of Phase Ⅳ external monitoring and assessment of the Ethnic minorities development plan: ⑴Visit and Assessment of project implementing agencies; ⑵Investigation of Social and Economic Situation of Typical Villages; ⑶Visit and Investigation of Typical Families; ⑷Visit and Investigation of Special Groups; ⑸Investigation and Assessment of Construction Site; ⑹Reflect the Problems Found in the Monitoring to Project Implementing Agencies and Put Forward Corresponding Suggestions; ⑺Write the Reports for Phase Ⅳ Monitoring and Assessment of the Ethnic Minorities Development Plan.

2.3 Monitoring and Assessment Method

Literature research——making a systematic and targeted collection of various literatures related to the implementation of the ethnic minorities development plan, such as summary reports, statistics, special investigation data of owners and project implementing agencies.

Analysis of internal monitoring reports——mastering the problems in the implementation of the ethnic minorities development plan and formulating corresponding plans and methods through detailed scrutiny of the internal monitoring reports. Visit of project implementing agencies——making visits to the project owners and project implementing agencies (Tourism Bureau, Education Bureau, Women's Federation, Labor Bureau, and Civil Affairs Bureau) and understanding the current measures, achievements and problems of the project implementing agencies. By these visits, the monitoring and assessment agency can also make a monitoring and assessment of the capacity of the project implementing agencies. Household interview——through in-depth interviews with the affected ethnic minorities families, understanding the social and economic situation, the recovery measures of livelihood, the implementation of the ethnic minorities development plan, the benefits of the project, and the views and suggestions on the project of the ethnic minorities families. Symposium——the external monitoring and assessment personnel attend the symposium which includes the representatives of county (district), town (or street office), village (or neighborhood committee) and minority residents in the affected minority population relatively concentrated area, collecting the following information: social and economic overview of project area (mainly for the development situation of community or village collective), the development situation of women and poverty groups, the implementation situation of the ethnic minorities development plan, the benefits and effects of the project, the views and suggestions of the minority residents representatives and the issue solutions in the implementation of the plan. Field trips——paying field visits to project construction area to understand the actual progress, measures, arrangements and effects of the construction unit in the implementation of the ethnic minorities development plan. According to the problems

found in field visits, the external monitoring and assessment agency would put forward the corresponding suggestions and countermeasures.

2.5 Monitoring and Assessment Content

Based on the outlines of the external monitoring and assessment of the ethnic minorities development plan and the Phase Ⅲ monitoring results, the agency would carry out Phase Ⅳ monitoring and assessment, mainly on the following aspects: ⑴Project Construction Schedule; ⑵Social and Economic Development Situation of the Project Area; ⑶Social and Economic Situation of Typical Villages; ⑷Social and Economic Situation of the Ethnic Minorities Families; ⑸Implementation of the Ethnic Minorities Development Plan; 8

⑹Capacity-building of the Ethnic Minorities Development Plan Implementation Agency; ⑺The Problems and Suggestions Put Forward by Affected Ethnic Minorities Residents; ⑻Implementation Effects of the Ethnic Minorities Development Plan; ⑼Internal Monitoring Situation of the Ethnic Minorities Development Plan; ⑽Monitoring of Other Related Content.

2.6 Monitoring and Assessment Period

The external investigation of this monitoring began on November 1, 2014, ended on July30,2015, investigation, consultation and data collection were made several times in project area within half a year. Monitoring units sent out 2 external investigation groups of 8 people and made investigation of typical villages, typical families, special groups and project implementing agencies in the affected counties.

3 MONITORING RESULT

,3.1 Project Construction Schedule

The construction schedule of the five subprojects having been monitored in this phase is available in Table 3-1.

3.2 Social and Economic Development Situation of the Project Area1

1. Xiushan County In 2014 the total production value of RMB yuan, up 10.8%. Fixed asset investment to complete the yuan, up 20.1%. Yunyang County 2014, Yunyang County, the total production value of yuan, up 11.8%. In the second industry, the industrial added value of RMB yuan, an increase of 16.1%; the construction industry added value of yuan, an increase of 23.1%. In the third industry, the wholesale and retail industry increased by 10.4% yuan, an increase of; accommodation and catering industry increased by 8% yuan, an increase of in real estate, an increase of 4.3%. The three industrial structure is 21.6:43.3:35.1.

3.3 Social and Economic Situation of Typical Villages 2

Based on PhaseⅠⅢreport, this monitoring will make a comparative analysis of Qingxiang Village, Mawang Town in Youyang County, Caitang Village, Meijiang Town and Yunai Village, Zhongling Township in Xiushan County.

As we can see from the table, in different phases, the population, families, food production and the per capita net income of typical villages have increased in different degrees while the area of cultivated lands had a little decrease which resulted from rural infrastructure construction and housing construction.

3.4 Social and Economic Situation of the Ethnic Minorities Families

The social and economic situation analysis of typical families will be based on fundamental investigation, the three external monitoring and sampling data of Phase

Ⅳ, making an analysis of the whole project’s effects reflected by families’ income from the beginning.

According to the comparative analysis of the social and economic situation of typical families, the per capita income of affected ethnic minorities families increased in different degrees, which accorded with the present situation of rural economy; meanwhile, the project promoted the development of local economy. The reasons for the income increase were as follows:

⑴Earnings from the project construction

⑵The optimization of the industrial structure and the development of large-scale

cultivation, such as honeysuckle, cork, eucommia;

⑶ Earnings from migrant working, etc.

3.5.1 Implementation of the Ethnic Minorities Development Plan

During the implementation, the project construction may bring the local ethnic minorities a series of negative effects including noise, outdoor security of residents and students, surface water pollution result from damage to local irrigation and drainage systems, influences on residents’ religious activities, security of construction site, traffic congestion and accidents caused by construction trucks. Rural Roads of Xiushan County, Water Supply Projects of Longtan Town and

Mawang Town, Youyang County have started. The relevant measures and implementation situation are available in Table 3-4.

To ensure that women of minority ethnics in the project-affected area enjoy equal

social and economic status and interests, county/district at all levels involving ethnic

minorities should fully respect women’s rights and interests when compiling “The

Ethnic Minorities Development Plan ". Bedsides, the Women’s Federation of each

county/district should participate in the compiling process.

Considering that women depend more on land than men do, while women’s

educational and technical level is lower than men, suitable job opportunities should

prioritize women, especially those from land acquisition and relocation families, to

increase their income.

Bureaus and offices of each district/county issue certificates after the training is completed, and give recommended job opportunities of social recruitment units.

According to the investigation, local recruitment units include: hotels, restaurants, repair factories, clothing factories and so on. The recruitment types are: housekeeping, repairing workers, salespersons and so on.

3.5.4 Support for the Vulnerable Groups of Ethnic Minorities

The construction will inevitably lead to home and land losing for people in the affected area. And they will, as a result, suffer from a higher risk of poverty. To alleviate the impact of the project on vulnerable groups, authorities of townships and villages have promised to give assistance to them in the arrangement of their relocation and production.

According to the monitoring, water supply project involves no vulnerable groups in Longtan and Mawang towns of Youyan county, while it involves 25,31, 42 and 5 residents respectively in Xiushan county, Qianjiang district, Youyan and Qingshui county in Yunyang district. Supporting measures now taken vary according to different situations in each county/district, and the measures primarily include providing small-sum guaranteed loan, free skill training and technical guidance to vulnerable families, and giving them more limited job recommendations without payment, as well as facilitating the relocation of the vulnerable families with free labor forces and transportation tools. Detailed descriptions are in Table 3-7.

3.5.5 The Establishment of the Appeal Mechanism and the Appeal Situation

According to the surveys, all construction units, relevant governments and their competent departments have established a sound complaints and appeal mechanism in terms of construction activities, health protections and project employments, in order to ensure the rights and interests of the ethnic minorities and increase the benefits of them.

1. The Complaint Mechanism Procedure

All the project owners in the districts and towns have established the project

complaints mechanism procedure. The details are as follow:

Stage 1: If the local people or village committees have complaints about the

project construction activities, health protections, the project land

acquisition, the project employment and other relevant problems

caused by the project, they can submit an oral or written complaint to

the corresponding town government. If the complaint is oral, the

town government should deal with it within a week and keep a

written record;

Stage 2: If the complainant is unsatisfied with the result of Stage 1, he or she

can submit a complaint to the corresponding district or town project

management office after receiving the result of Stage 1. The district

or town project management office should deal with it within a week;

Stage 3: If the complainant is unsatisfied with the result of Stage 2, he or she

can submit a complaint to the corresponding district or town court.

The court should deal with it within 15 days.

The complainant can protect their rights and interests by following the procedure above or by submitting complaints to the courts.

The relevant departments should inform the local people of the procedure by convoking meetings or other means in order to let them know their rights to submit complaints. Meanwhile, the procedure should be propagandized through media. All the opinions and suggestions should be compiled into information clauses for the competent department to deal with them in time. The complaint channel is available in Figure 3-1. The contacts of people who are in charge of each stage of the complaint procedure are available in Table 3-8.

The complainants can also submit complaints to the external monitoring institutions, which are responsible for reporting the complaints to the project owner and the project management office. In addition, the complainants can also turn to the

ADB project leading group for help. If these kind attempts still do not work and the complaints are about the violation of the ADB’s security policy. The affected people can directly submit complaints to ADB according to the ADB’s accountability mechanism (2012)1.

All the districts and towns have established sound complaint mechanisms.

During the resettlement phase and construction process, the project office, the project owner, the local governments and the construction unit have negotiated with the local people. There is no complain and appeal during the report period.

3.5.6 Eco-Environmental Protection and Vegetation Restoration

To minimize the damage the construction does to the ecology system and environment, authorities from the main departments, project owners and construction units give the constructors education of ecological and environmental protection.

Civil engineering contractors take measures for temporary and permanent environmental protection as well as water and soil preservation. The noise level is

According to the Forest Law and “Interim procedures for levying forest vegetation restoration fee” issued by the Ministry of Finance and the State Forestry

Administration (CZ [2002] No. 73), owner units of each project have paid vegetation restoration fee to the local forestry bureau for the occupied forest land.

3.5.7 Utilization of Local Construction Materials and Transportation Resources

According to the investigation to construction unit, the construction materials like soil, gravel, stone, cement and lime etc., are all from the local place. With this method, it can reduce the building cost and enhance the support of local ethnic minorities to this Project. At the same time, the local transportation resources are fully utilized to transport the construction materials, which can promote the development of the local construction materials industry and transportation industry, and increase the ethnic minorities household income as well.

3.5.8 Protection of Public Health and Population Health

During the construction period, a large number of people gather at the construction site including construction personnel, subordinate personnel of the construction unit (the service personnel of the third industry who work under the construction unit.) and the local ethnic minority residents in the project site.

Therefore, there is a need to scientifically manage the public health and population health and take some corresponding measures.

The sanitary and security measures taken by the construction unit includes (a) setting up permanent garbage cans in construction areas; (b) leaving the daily garbage in one spot and cleaning the spot on a regular basis; (c) building toilets and covering the transportation cars, which are easily dirty with the stone and cement, with a tarpaulin etc.

With the help, support and cooperation of the owners and contractors, the Local

Sanitary and Anti-Epidemic Department has adopted a series of effective measures to control the breeding and spreading of the contagious diseases. The details are in the following Table 3-10.

4 Institution Capacity Assessment

4.1 Institution Establishment

In order to ensure the smooth proceeding of every project construction, district/county at all levels has to set up some needful coordination institutions to implement, coordinate and monitor the ethnic minorities development plan.

The institutions established by the construction project for the implementation of the ethnic minorities development plan comprise of:

(1)County coordination leading group

(2)County Transportation Bureau, Water Conservancy Bureau and some other relevant bureaus

(3)Contractor unit

(4)Township work group

(5)Village committee and villagers’ group

(6)The external independent monitoring and assessment agency

4.2 Institution Capacity Assessment

In order to ensure the smooth proceeding of every project construction, the local governments at all levels actively implement the ethnic minorities development plan under the monitoring and coordination of competent departments in each district/county. The key duties of the competent departments are to (a) organize and coordinate the relationship with the bureaus at all levels; (b) monitor the implementation of ethnic minorities development plan. The bureaus at all levels

(Civil Affairs Bureau, Education Bureau, Health Bureau, Women’s Federation and

Labor Bureau etc.) are the main body to implement the development plan. Each county set up a work group with its county magistrate as the leader and the directors of relevant bureaus as the members, and every work group comprises of 8 to 12 person. According to the findings of the monitoring, local governments at all levels have a deep understanding and rich experience to the ethnic minorities development plan. Each village and town, which has been affected by the project, set up a work group with its township leader as the headman and the village secretaries as the members.

4.3 Internal monitoring

The internal monitoring agency in project area of each districts/counties has been established. Project Management Office in each county assumes the responsibility to supervise and monitor the implementation of ethnic minorities development plan on a regular basis, which includes the task, the project implementation schedule and the completion of the expected goals. The problems and suggestions found during the monitoring process are recorded in the monitoring report. The implementation status is announced regularly by a combination means of oral statement and written report.

If any serious problem occurs, the internal conference is immediately held to solve the problem in time.

5 Discoveries and Suggestions

5.1 Discoveries

(1) According to the project construction schedule, the ethnic minorities development plan is already under implementation. Based on The Ethnic Minorities

Development Plan, the project unit, governments at all levels and theirs competent departments are taking some relevant measures to minimize the negative impacts which the project construction has on ethnic minorities, and to ensure that the project is beneficial to ethnic minorities such as (a) using the local labor force; (b) training;

(c) supporting the house-building for vulnerable group; (d) relieving or eliminating the construction disturbance and impacts and (e) absorbing the labor force from the local ethnic minorities etc.

(2) The ethnic minorities residents in project area are warmly welcome the

Project. Having gone through the field trip and some local visits, the monitoring and assessment agency found that although the ethnic minorities residents think the

Project has some negative impacts such as land acquisition and relocation; it also produced some positive effects on (a) the improvement of the local transportation and water supply environment; (b) the promotion of local agricultural development; (c) the employment of local labor force and (d) the improvement of local women’s status.

The project is welcomed by the ethnic minorities residents in project area.

(3) Project construction provides employment opportunities for local residents.

Having gone through the field trip and some local visits, the monitoring and assessment agency found that many jobs have been created during the construction period. Therefore, the income of the local villagers is rising.

(4) The measures, such as promotion of labor force’s transfer, poverty alleviation and employment promotion etc., are being carried out by the governments at all levels and theirs competent departments. These measures are advantageous to realize maximum profits of the Project.

(5) Governments of each district/county attach great importance to the implementation of the ethnic minorities development plan. Through the communication and coordination with owners and construction unit, governments at all levels and theirs competent departments conscientiously implement the relevant regulations of the ethnic minorities development plan, which plays an enormous role in the development of ethnic minorities. 37

5.2 Suggestions

(1)Establishing an implementation and coordination agency of ethnic minorities development plan. Up to now, the ethnic minorities development plan is already in operation, however, part of the institutions doesn’t know enough about the regulations of the ethnic minorities development plan. Monitoring and assessment agency suggests that the project unit should establish an implementation and coordination agency which can effectively connect the construction unit with each district/county and its competent departments to ensure that the development plan is carried out timely and effectively. Thus, the goal, which ethnic minorities make benefits from the project, will be achieved.

(2) Project unit has to establish and perfect the report system and internal monitoring system of the ethnic minorities development plan implementation. In view of the newly-built internal monitoring system, project unit has to set up a sound report system and internal monitoring system of the ethnic minorities development plan implementation. Internal monitoring system includes (a) the implementation schedule of the ethnic minorities development plan; (b) implementation content; (c) fund implementation and (d) the completion of the expected goals. For example, to hire the local labor force, it has to establish a file management system to manage the relevant materials of long-term workers and contract workers, which can protect the rights of off-farm workers. The file management system includes (a) the number of the workers at the construction site; (b) utilization of the local construction materials
