Report on Flooding - January 2014.

The report on flooding was taken as read. Mr. Pat Brannelly, Senior Executive

Engineer gave an overview of the report and responded to questions from the

Members. The Members thanked the Area Engineer and the staff of Operations

Department for the really good work carried out during the recent flooding events.

Grange Road, Baldoyle - Traffic Management.

The report on Grange Road, Traffic Management was read. Following discussion the report was NOTED.

The report was taken as read. Following discussion, during which Ms. Mary Egan,

Sutton that was damaged several years ago by construction trucks contracted on behalf of the Council?”

Reply: Roncalli Road, Sutton road surface is in general adequate, except for a small section at the junction with Pacelli. This section will be included in the Area Engineer’s

Works Programme 2014.

Reply: Public lighting has been provided along the roadside footpath on the northern side of the ‘Lambchop’ open space. There is currently no budget provision for the installation of new public lighting across this open space.

Reply:

The tarmac surface on the open space at Pacelli Avenue which is close to Sarto

Park has been cleaned. The Residents’ Association should contact the Operations

In relation to the request for trees to be pruned and cut back at various locations: a) The tree on Roncalli Road, Sutton is a semi-mature Hornbeam (Carpinus betulus), growing within 5 metres of a lamp standard and with overhead services located within the crown of this tree. This tree is listed for removal as part of the Fingal Tree

Strategy. However, due to the presence of the overhead services and the associated dangers of working close to these lines, the ESB will first be contacted to carry out pruning works to clear away the branches in close proximity of these wires. b) There are two semi mature Norway Maple (Acer platanoides) trees at this location. Pruning works were carried out on these trees in 2013 and these works are complete. c) A contractor was employed to carry out tree felling as well as pruning works at Sarto Lawn in 2013. As these works were being carried out, residents from a nearby estate protested against these works. On grounds of health and safety, the contractor had then to vacate the area. The contactor will return to finish these removal and pruning works in the near future. d) There are two semi-mature Norway Maple (Acer platanoides) trees outside the property at Del Val Court. These trees have been examined and there are no plans to carry out pruning works as they are not causing any issue in relation to public safety. e) This is a semi mature Norway Maple (Acer platanoides) growing in a concrete path. This tree is listed for pruning works this season. f) This is a semi mature Norway Maple (Acer platanoides) growing in a concrete path. This tree is listed for removal this season. g) This is a semi mature Norway Maple (Acer platanoides) growing in a concrete path with overhead wires running through its canopy. GIRO d’ITALIA

Report:

The Giro d’Italia is one of the most prestigious great cycling events in the world. This year the Giro will be staged in Ireland for the first time commencing in Belfast with stage 3 of the race travelling from Armagh to Dublin on Sunday, 11th May, 2014. The race will comprise of approximately 200 riders and more than 100 promotional and support vehicles.

In order to facilitate this event, it will be necessary to close the route of the race. In Fingal’s area this means the closure of roads from the border with Meath through to

Kilbarrack Road.

The R132 will be closed from Balbriggan to the Estuary Roundabout. The race then travels along Estuary Road, Old Yellow Walls Road, Yellow Walls Road, Dublin

Road and through Malahide Village. The route then goes along the Coast Road to

Portmarnock, into Baldoyle Village and Warrenhouse Road. The race then travels into the city along the Dublin Road. The expected time of arrival of the race in

Malahide is between 3.30 & 4.00pm.

It is expected that roads will be closed for a period of approximately two and a half hours as the race passes through each point. The Gardai in conjunction with the event organisers will be managing the closing and re-opening of the route. Details of exact times of closures, route crossing points and viewing points have yet to be finalised with the event organisers. It is proposed to advertise the road closures in the public press in late March.

The staging of the Giro in the Fingal area will inevitably cause some disruption to traffic, businesses and residents in the area. However, it is one of the world’s largest sporting events which broadcasts to 165 countries across all continents with an audience of some 775 million people which will bring a huge economic benefit to the County.

STABILISING THE DUNES, VELVET STRAND, PORTMARNOCK

Report: During the weekend of 3rd January to 6th January 2014, a combination of high tides and storm surges resulted in damage to sections of the timber sleeper wall and erosion behind sections of the sleeper wall, at the northern end of Portmarnock

Beach.

On request, Consultants RPS visited Portmarnock Beach on 14th January 2014 in order to carry out an evaluation of the damage and make recommendations.

RPS submitted a report to Fingal County Council on 3rd February, entitled “A synopsis of current and future management techniques at Portmarnock”.

In the report, RPS recommend actions to stabilise the existing dune system at the damaged/eroded sections at the northern end of the beach. The recommendations include replacement of rotted or damaged sleepers and filling behind the sleepers.

It is proposed to carry out repair work of the timber sleepers, guided by the RPS report, over the coming period.

The cost of the works is estimated at €35k. An application for funding of this work was made to the OPW, as part of the Repair Works arising from the recent Coastal

Storm Damage scheme. Applications are currently being assessed by OPW.

In the report, RPS point out that the recommended repairs are only short term solutions to ongoing coastal erosion, and that the life expectancy of wooden sleepers that are exposed to continual wave and tidal action is 5 to 10 years. The long term solution to help mitigate against coastal erosion at the northern end of the beach would be a revetment constructed from rocks or concrete blocks, the toe of which would extend deep into the beach.

1 INTRODUCTION

Baldoyle Bay [Site code: 4016] is a designated Special Protected Area (SPA) under the EU Birds Directive. The bay is also a candidate to become a Special Area of Conservation (cSAC) [site code: 000199]. Baldoyle bay extends from just below Portmarnock village to the west pier at Howth, Co. Dublin. It is a tidal estuarine bay protected from the open sea by a large sand dune system (see Figure 1).

The dune system at Portmarnock is also granted protection under Article 3 of Directive 92/43/EEC on the conservation of natural habitats and wild flora and fauna, as part of the

NATURA 2000 network. The velvet strand is contained within the Portmarnock barrier beach complex and is the most southerly of a series of such complexes on the north Dublin coast and provides seaward margin to the Baldoyle estuary. 1.1 RECENT EROSION AND DUNE CONSERVATION SCHEMES AT

PORTMARNOCK The beach and dunes of Portmarnock is part of an ever changing dynamic system that is subject to the continuous natural processes of erosion and deposition. While erosion is a normal occurrence in coastal areas, rates of erosion may be accelerated due to several different pressures, one of the most drastic of which is storm-induced erosion. In 2000, the dune system at Portmarnock gradually deteriorated as a result of a series of successive storm events, this prompted Fingal County Council (FCC) to undertake interventive action to repair and protect the dune system along the Velvet Strand (see Figure 2). The work undertaken included constructing a revetment made from wooden sleepers at the northern end of beach to around the end of the original foreshore owned by FCC before the land swap. Railway sleepers were inserted into the sand at an angle of 60 degrees.

1.2 CURRENT EROSION AT PORTMARNOCK

In early January of 2014, a combination of gale force winds, storm surges and high tidal levels resulted in Met Eireann issuing a series of nationwide weather warnings. During this period it was reported that the dune system at Portmarnock suffered severe storm- induced erosion, resulting in over-steepened dune faces and the partial wash out of the fore dune in localised regions of the system.

Following the high energy event, RPS investigated data recorded by several hydropgraphic instruments including the tidal gauge at Howth and Marine Institutes' M2 weather buoy located in the Irish Sea to indentify the event that was most likely to have resulted in the erosion observed along the shore-line. As can be seen in Figure 3, there was a series of successive storm surges that significantly increased the sea surface elevations in a short period of time. Although any of the events highlight in Figure 3 may have caused the significant storm induced erosion witnessed at Portmarnock in early January of 2014, it is most likely that it was event three that increased the sea elevation to such an extent that the revetment constructed from the wooden sleepers was overtopped. 1.3 THE FAILURE OF THE EXISTING BEACH DEFENCES Despite having coastal defence measures in place, the dune system at Portmarnock still suffered extensive storm-induced erosion along the northern shore of the beach during this extreme event. The following section addresses several reasons as to why these defences were unable to protect against recent storm conditions

The disruptive nature of the wooden revetment Under normal circumstances, there is a complex interchange of sand between the dune and beach systems that enables the dune system to act as a sand reservoir and feed sand onto the beach to facilitate the conservation of the overall beach level. However, as the wooden revetment at Portmarnock is a hard engineering solution designed to be an impermeable defence against wave and tidal action, it has disrupted the natural beach-dune interaction and the exchange of sand between these systems. Consequently, over the course of the revetments lifespan, the beach levels at Portmarnock have gradually dropped by as much as 1 metre in localised regions. As wave heights at the shoreline are a function of water depth, a drop in beach levels, such as that observed at Portmarnock can result in a significant increase the height of the incident waves attacking the dune line. This has had a notable morphological effect on the coastal profile at Portmarnock; the increased scouring at the toe of the revetment has depleted the beach level further, allowing larger incident waves to overtopping the defence and cause significant erosion above and behind the revetment. The amount of scour at the revetment toe or erosion above the revetment can vary considerably and depends on whether:

· The waves break before reaching the revetment;

· Waves break, reflect or overtop the revetment; · The sediment properties in front of the revetment which will affect the sand mobility.

The design of the wooden revetment

The gradual decrease in beach levels since in the installation of the defence has also reduced the penetration depth of the wooden sleepers that were driven into the sand at 60 and 90 degree angles. Consequently, during periods of extreme water levels the sand surrounding the sleepers temporarily lose shear strength as it becomes saturated with sea water and liquefies. Under these conditions sleepers briefly lose vital support from the sand and slump seawards, decreasing the overall height of the defence. Inevitability, this increases the fraction of incident waves that overtop the revetment and results in significant erosion behind the sleepers. Many hard engineering techniques including revetments reflect wave energy, ultimately removing sand from the beach and decreasing the beach levels further. As wave heights at the shoreline are a function of water depth, the decreased beach levels increase incident storm wave energy striking the shoreline and increase erosion by scouring the toe of the defence and overtopping the defence.

The condition of the wooden revetment Recent observations suggest that the current revetment, which is comprised of wooden sleepers, has become severely deteriorated and left numerous voids along the line of defence. This is exacerbated by the fact that a significant number of sleepers have completely rotted to the extent that there is a significant number of voids in the defence, each of which are approximately 250mm wide.

As the revetment no longer acts as a complete impermeable barrier, during periods of extreme sea surface elevations such as those observed in early January of 2014, water levels would have been sufficient to allow water to pass through the voids between sleepers. This would scour the dune system immediately behind the revetment and release backfill out from behind the defence. Over the course of one extreme event, this process could result in significant erosion to the area of existing damage behind the sleeper wall.

2 RECOMMENDED ACTION The following recommendations were made with a view to continue to stabilise and conserve the existing dune system at the Velvet Strand, Portmarnock. The principal recommendations are as follows:

· To replace any of the wooden sleepers that has been completely rotted, or deteriorated. These defunct sleepers should be replaced with wooden sleepers of similar shape and size. Any sleeper that has been damaged to such an extent whereby it is no longer an effective impermeable barrier against wave and tidal action should also be replaced. The area behind the sleepers should be filled with appropriately sized rocks and shingle.

· The remaining sleepers that are structurally sound should be mechanically driven further into the sand at an angle of between 60 and 90 degrees to a depth of circa half of the length of the sleeper. This would ensure that the sleepers would not lose structural stability and slump if a fraction of the surface sand was to liquefy or if the toe of the defence was scoured during periods of increased wave activity. · As the beach levels have dropped over the life time of the wooden revetment, if new wooden sleepers were driven halfway into the beach to ensure their structural stability, it is unlikely that the overall height to which the defence is effective too would be sufficient to prevent overtopping. This would result in significant erosion above and behind the defence. · To overcome this, it is recommended that area behind the sleepers is filled in with appropriately sized rock; a grasscrete slope could then be constructed to cover the stone infill. The slope should extend from the top of the defence to several metres behind the structure. The grasscrete structure would protect the area immediately behind the defence from overtopping and subsequent scouring, whilst also increasing the general stability of this area which is currently used for recreational purposes.

· The old weld mesh fencing should be completely removed from the length of the shoreline, most of which has been severely deteriorated to the extent that it poses a significant hazard to the public's health and safety.

7 D01 It is important to acknowledge that the solutions recommended above are only short term solutions to an ongoing coastal erosion problem. As attested by the current sleepers, the life expectancy of wooden sleepers that are exposed to continual wave and tidal action, along with regular wetting and drying is between 5 and 10 years. An alternative long term solution to the help mitigate the coastal erosion problem at the northern end the Velvet Strand, Portmarnock would be a revetment constructed from rocks or concrete blocks, the toe of which would extend deep into the beach. A revetment would help protect the fore-dunes behind the structure against high energy wave impacts and mitigate erosion resulting from scouring and overtopping.

The Portmarnock Sports and Leisure Centre was awarded a Sports Capital Grant from the Department of Transport, Tourism and Sport in 2012. This grant is for the upgrading of their all-weather facilities and other works at the tennis courts adjoining the PSLC at Carrickhill, Portmarnock. The land on which these works are proposed is leased to the PSLC from Fingal County Council.

The proposed works include:

• The upgrading of the existing court surface;

• The provision of 3 no. pitches (26m x 40m each);

• The installation of lighting columns 10m high;

• The provision of 2.4m high fencing with netting above.

It is intended to initiate a Part VIII procedure of the Planning and Development

Regulations 2001 (as amended) for these proposed works.

JUNCTION IMPROVEMENT AT BALDOYLE ROAD/DUBLIN ROAD

Motion: Councillor C. O’Callaghan “That the Manager extend the two lane layout at the Dublin Road Western approach to the Baldoyle Road/ Dublin Road junction to improve the efficient flow of traffic during peak times at this busy junction.”

Report: Significant Improvement works were carried out on the Baldoyle Road/Dublin Road junction in 2013. An additional left turning lane was added on the Dublin Road which has reduced the queuing time for traffic especially during evening peak time. The extension of the two lane layout would impact adversely on access to driveways and reduce the road space available for cyclists. The junction in its current layout is functioning well and it is not considered necessary at this time to further extend the two lane layout.

“That the Manager given the shortage of adult exercise equipment in the Howth

Malahide area that the council commit to increasing the provision of such equipment and to identify areas in Howth Malahide where this equipment could be placed.”

Report: Adult exercise equipment will be installed in the Baldoyle Racecourse Park this year.

The following considerations are given to provision of such equipment:

• Availability of funding for initial installation and on-going maintenance

• Demand from the public for such facilities

• Supervision of site (active / passive)

• Availability of staff to carry out additional inspections of equipment

We have not received any new requests from residents for such equipment, but would welcome any comments from them in this regard.

“That the Manager report on what solutions can be put in place to improve road safety in the vicinity of Malahide yacht club building at the bottom of Sea Road and what plans the Manager has to implement safety improvements.”

Report:

Extensive signing and lining has already been carried out on Sea Road. Currently there are slow markings painted on the road, chevrons and other warning signage.

Consideration will be given to rumble strips at locations where there are no houses subject to funding. The lining will be examined and any lining requiring renewal will be included in the list and will be carried out when funding and resources allow.

Blue Flag in 2014

Motion: Councillor J. Dunne

"That the Manager provide an updated report on the water quality measurements of the beaches in the Howth-Malahide area, and to state if any may qualify for a Blue Flag in 2014.”

Report:

There are four beaches in the Howth-Malahide area. They are Burrow Beach at

Sutton, Velvet Strand Beach at Portmarnock, Claremont Beach at Howth and

Malahide Beach.

Burrow Beach, Velvet Strand Beach and Claremont Beach are identified as ‘Bathing

Waters’ for the purposes of the Bathing Water Quality Regulations 2008. Malahide has not been identified as a bathing water since 2012 due to safety concerns.

Blue Flags are awarded by An Taisce to beaches that meet a range of criteria including environmental education and information provision, water quality, environmental management and safety and services. In terms of water quality, an identified ‘bathing water’ must generally achieve ‘Good’

Status for four consecutive years. In addition, the other criteria as outlined above must be met to be granted a Blue Flag. In those instances where bathing water quality is classified as ‘Sufficient’, it may still be possible for a beach to achieve a Blue Flag due to the statistical methods employed by An Taisce for the calculation of bathing water quality over a four year period. Table 1 shows bathing water classification of each of the four beaches at Howth-Malahide for the period 2010- 2013.

• Burrow Beach, Sutton is not eligible for a Blue Flag based on water quality;

• Velvet Strand Beach, Portmarnock is eligible for a Blue Flag based on water quality. An application has been made by Fingal County Council to An Taisce for a Blue Flag at this location;

• Despite achieving ‘Good’ status for the previous 4 years, Malahide is not eligible for a Blue Flag due to safety concerns;

• Claremont Beach, Howth is not eligible for a Blue Flag as it first became an identified ‘bathing water’ in 2012 and so therefore does not have sufficient bathing water quality data to date.

Report:

Litter picking on the open space at Sutton Park has been carried out. Works on shrubberies cannot take place at this time as such works are prohibited under the

Wildlife Act (Amendment) Act 2000.

The residents’ association should arrange to meet with the Operations Department to discuss any future works on this open space.

CAR PARKING SPACES Question: Councillor C. O'Callaghan

“To ask the Manager what is the required number of car parking spaces per unit in planning applications granted but not yet developed at the Coast Baldoyle and what wil be the future ratio of spaces to units for any future applications on these lands as per the Baldoyle Stapolin LAP and the Fingal Development Plan?”

Reply

The standard number of car parking spaces is one per one-bedroom unit, 1.5 per two-bedroom unit, and 2 per 3-or-more-bedroom unit.

Under the previous County Development Plan 2005-2011, these standards were maximums. However, developers were allowed to provide fewer car parking spaces in developments which were close to high quality public transport (either planned or existing). The two most recent significant permissions were:

F07A/0040 for 453 units, which had a standard parking requirement of 734 spaces, and provided 631, a reduction of 14%; and

F07A/1723 for 489 units, which had a standard parking requirement of 766 spaces, and provided 650, a reduction of 15%.

The reduction was justified due to the proximity of Clongriffin Railway Station.

The recently adopted LAP for Baldoyle-Stapolin refers (Paragraph 4B.7.1) to the car parking standards in the current County Development Plan. These are the same as the previous Plan, except that they allow visitor parking at a rate of one space per 5 units, and the standards are now norms (as opposed to maximums).

The LAP also states that, for all areas after Growth Area 1, “car parking standards for residential units should be reviewed to take into account any improvement in the frequency of public transport services”. Irish Rail is currently working on re-signalling in the city centre, which will increase the capacity from 12 trains per hour to 20 trains per hour. Consequently, it is likely that there will be a significant increase in the frequency of trains serving Clongriffin. However, the reason the Council imposes restrictions on car parking, is to discourage car-

NOT FOR PUBLICATION borne commuting. Restrictions are most effective at places of employment and education, and have little effect in residential developments. Therefore, there is little justification in reducing the number of car parking spaces from the

Development Plan norms.

Consequently, it is likely that the ratio of spaces to units for future applications will be as per the current County Development Plan norms ie one space per onebedroom unit, 1.5 per two-bedroom unit, and 2 per 3-or-more-bedroom unit, plus one visitor space per 5 units.

Racecourse, Baldoyle and the Coast Road is safe and has the Council examined the wall from its Western side?”

Reply:

Building Control has inspected the eastern side of this wall and the

Inspectorate Division have concluded that it is currently not a dangerous structure. To close this file the Inspectorate Division intend to inspect the western side of this wall and in order to conduct this inspection, contact was made with the wall owner’s agent to gain access to the land. The Inspectorate

Division were subsequently notified in writing by the owner’s solicitor that the owner of the wall will employ the consulting engineers to carry out the inspection of the wall in question.

On 20th January 2014, Building Control sent a letter to owner’s solicitor requesting the copy of the inspection report. This request was not complied with and on 21st February 2014, the Inspectorate Division sent a reminder letter to the solicitor advising that the consulting engineer’s inspection report has not yet been submitted and that the Inspectorate Division need this report as soon as possible.

The Litter Warden inspects Bayside on a regular basis. In the event of suitable evidence being discovered, fines will be issued under the Litter

Pollution Acts 1997 – 2009.

Bayside junior and senior schools have both been involved in the Green

Schools programme for several years so they would be still maintaining the

“litter and waste” theme which examines the impact of litter and waste on the environment and explores practical means for reducing and minimising the amount of litter and waste produced by the school. St Fintan’s High School on

Dublin Road, Sutton is currently working on the litter and waste theme and it is hoped they will be awarded the first green flag within the next few months.

Reply:

Unfortunately, the historical search in the Valuation Office and Land

Registry are inconclusive. However, the Inspectorate Division have uncovered old deed maps which show that the St.Laurence O’Toole

Dioscesan Trust originally owned the land in this area.

In November 2013, the Inspectorate Division wrote a letter to St.

Laurence O’Toole Dioscesan Trust requesting confirmation in relation to occupancy and ownership of the lot and laneway in question. Later that month, the Inspectorate Division received a written response from

Archdiocese of Dublin, Finance Secretariat, confirming that they are investigating the ownership of the laneway

On 21st February 2014, the FCC Inspectorate Division wrote to the

Archdiocese of Dublin, Finance Secretariat, for an update on their investigation of ownership of the laneway. A reply is awaited.

STATION ROAD – DRAINAGE SYSTEM

Question: Councillor C. O'Callaghan “To ask the Manager will the Water Services Department take action to improve the water drainage system at Station Road, Sutton to prevent the build-up of surface water on the road close to the junction with Sutton Cross?”

Reply: Following an initial investigation and response by the Operations Division the above matter was referred to Water Services Drainage Operations for further examination.

Given the repeated recent localized flooding at the location it has now been decided that a camera survey should be undertaken to confirm a suspected pipe collapse under the Sutton Cross junction. This survey needs to be carried out outside of normal working hours and may take a number of days, due to the high traffic volumes through the junction. In tandem with, and to complement, the survey, jetting of the local pipe system will be undertaken in the first week of March. It is hoped that the survey can be completed shortly thereafter, so that the exact cause of the problem can be determined and to propose remedial action.

Reply:

The woodland footpath in question is in excess of 2,000 linear metres in distance and a complete resurface of the current footpath would cost approximately €70,000. These monies are not available within the councils capital programme.

The condition of the footpaths are reviewed and assessed on a regular basis and any hazards are addressed on an ongoing basis. If specific hazards are identified, these will be addressed as a matter of urgency.

“To ask the Manager what is the procedure for the removal of abandoned vehicles on Council lands?"

Reply:

Upon receipt of a complaint of an abandoned vehicle, registration details are sought from the Motor Tax Office, Dublin City Council, who manage the vehicle registration database.

Upon receipt of the registration details, the registered owner is contacted and asked to verify whether they are still the owner of the vehicle and if so, do they propose to remove the vehicle in question.

They are also provided with details of two authorised treatment facilities in the

Fingal area where their vehicle may be recycled free of charge.

Lambay Island, Rush, Co. Dublin. Lambay Island or parts thereof form part of, or are adjacent to, a

Natura 2000 site, a Special Area of Conservation, a Special Protection Area, a proposed Marine

Special Area of Conservation and a proposed

Natural Heritage Area. The development will consist of:

1. Alterations to the Castle, a National

Monument, and to the linked Guest Wing including installation of upgraded central heating, plumbing and electrical systems; in the Castle, conversion of a sluice room to a shower room, construction of a toilet extension, modifications to fixtures and fittings in two bedrooms and in a toilet; in the Guest Wing, conversion of three bedrooms to bathrooms, works to fixtures and fittings in the kitchen, scullery, bedrooms and utility rooms.

2. Internal layout alterations to the Whitehouse building including the provision of additional internal; bathrooms in both east and west wings, upgrading of the existing bathrooms at ground and first floor in the central wing, alterations to the layouts of the three existing kitchens and installation of upgraded central heating, plumbing and electrical systems.

3. Internal layout alterations to the existing Bothy building including construction of upgraded toilet, bathroom and kitchen facilities.

Cottages Nos. 1 and 2. 5. Remedial and reinstatement works to the existing Real Tennis Court.

6. Conversion of existing barn and livestock accommodation within the Farmyard complex to accommodate an energy centre accommodating fuel storage, boilers, electrical plant and generators.

7. Alterations to and extensions to Mason's

Cottage including demolition of an existing extension and provision of a photovoltaic installation adjacent to the cottage.

8. Demolition of, reconstruction of, and layout alterations to Walton's Cottage including provision of a photovoltaic installation adjacent to the cottage.

9. Works to the services and utilities infrastructure on the island including replacement of the existing wind turbine and associated underground cabling, construction of solar and photovoltaic panel arrays in the liex field immediately to the east of the proposed farmyard energy centre, upgrading and extension of the sewer network to include the installation of sewage treatment plants adjacent to the

Whitehouse and to the Bothy, installation of a septic tank serving Mason's Cottage and Walton's

Cottage, installation of underground heating and service mains linking the proposed energy centre with the Castle, Guest Wing and Whitehouse, provision of an upgraded water supply system to include a new reservoir in Little Mason's Field and a water treatment plant adjoining the existing reservoir.

10. Planting of a 0.5 hectare area of a field to the south east of the Castle complex to provide biomass fuel for the energy centre.

A Natura Impact Statement has been prepared in respect of the proposed works and is included with this application.

“That the Manager report on what action will be taken to improve the appearance of the large site at the front of Waterside estate, Malahide where the hoarding has come down.”

Report:

The developer has recommenced building in at this location. There is new green mesh fencing being erected at present in order to improve upon the aesthetics and encourage commercial activity. These works should be completed towards the end of March 2014 and will improve and enhance the appearance of this development.

DOLDRUM BAY, HOWTH Motion: Councillor C. O'Callaghan “That the Manager report on progress been made to divert the untreated waste water that discharges at Doldrum Bay, Howth into the main waste water treatment network.”

Report: Following submission of an Options Review Report to DECLG which identified and costed potential scheme solutions for the existing outfall at Doldrum Bay, FIngal

County Council were notified that the preferred scheme solution did not meet the

Departmental Guidelines for environmental justification or cost. However in order to progress the matter of eradicating the discharge totally a further meeting was held with the DECLG to discuss the viability of other options identified during the previous deliberations. This meeting was held in December 2013 and

Fingal County Council Water Services Project Office was advised that the scheme would not be progressed by the DECLG due to Irish Water’s takeover of responsibility for managing water services beyond 1st January 2014. Currently Fingal County Council Water Services has submitted details of the scheme to Irish Water setting out a business case for advancing the scheme. To date there has been no further information from Irish Water on this matter.

DISABILITY CARE FACILITY

“That the Manager report on how the objective of the Broomfield LAP that the

Planning Authority ensure that a site for a disability care facility is identified within the LAP and that prior to the lodgement of any application for planning permission in the Local Plan lands a site for the provision of a disability care facility shall be identified and agreed with the Council is being advanced.”

Report

It is an Objective of Broomfield LAP, as outlined under section ‘9.8.4 Disability

Care Facility’ that “The Planning Authority will ensure that a site for a disability care facility is identified within the LAP. Accordingly Objective UD13 will be applied to ensure that ‘Prior to the lodgement of any application for planning permission in the Local Plan lands a site for the provision of a disability care facility shall be identified and agreed with the Council’.”

In addition two further objectives relate to the LAP lands, namely:

9.8.3 Assisted Care Facility for the Elderly, whereby “The Planning Authority will encourage the provision of an assisted care facility for the elderly within the LAP lands.” and 9.8.5 Site for a Specially Adapted House for a Fingal Resident with Special Needs which states that “The need for a site for the provision for a specially adapted house for a Fingal resident with special needs has been identified. A specially adapted house may be provided in advance of the phasing requirements of this LAP, subject to the location of the site being agreed with the

Planning Authority.”

An application was received under F13A/0459 on 3rd December 2013, in which

RQB Malahide Ltd.(in receivership) is seeking permission for Phase 1 of the approved Broomfield LAP lands off the Back Road, Broomfield, Malahide, Co.

Dublin. The proposal identified a location for a disability care facility and a specially adapted house for a fingal resident with special needs, in accordance with objectives 9.8.4 and 9.8.5. The Planning Authority sought additional

NOT FOR PUBLICATION information on 4th February 2014. Item 3 of the Additional Information Request relates to an ‘assisted care facility’. However, this de facto appears to relate to the proposed unit for the fingal resident with special needs (under 9.8.5) being poorly located within the site. No details regarding the mechanism for delivery of the reserved site or proposed unit is included in the application to date.

Having regard to the specific objective of the LAP, the identification and reservation of the lands/site related a disability care facility is all that is required by the applicant at this stage under 9.8.4. This has been done under

F13A/0459. Therefore it would appear that this objective has been advanced as far as is practical at this stage.

“That the Manager report on the Blasting at the Quarry at Feltrim Hill

Swords and ensure that any such activity is done in accordance with what is permitted and is not interfering unnecessarily with local residents and property.”

Report:

A Warning Letter pursuant to Section 152 of the Planning and Development

Acts 2000 – 2012 issued on the 14th January 2014. The matter is currently under investigation by the Council.

This quarry is the subject of an application for Substitute Consent under

Section 261A of the Planning and Development Acts 2000 – 2012 and is currently awaiting a determination by An Bord Pleanála.

DOG LITTER IN BAYSIDE AND SUTTON PARK

“That the Manager take enforcement action with respect to dog litter in the

Bayside and Sutton Park areas while paying particular attention to the coastal walkway and the area around Bayside National School.”

Report:

A dog fouling hotline was launched on 25th November 2013. On receipt of a complaint being made to the hotline the information is passed to the relevant

Local Authority to investigate. To date, 9 calls have been passed to Fingal

County Council.

The Fingal County Council Dog Warden patrols the area on a regular basis and will be asked to pay particular attention to the Bayside, Sutton Park and coastal walkways areas and will issue fines where appropriate.

HIGHLAND CATTLE

"That the Manager report on the success of the introduction of Highland Cattle to Robswall Park and Racecourse Park and to state if there has been any difficulties with interference by dogs or the general public."

Report:

Highland cattle were introduced in the Racecourse Park and Robswalls Park in early autumn in 2013. There has been a very positive response from park users on the presence of these cattle in the park. There were several incidents with one dog owner in Robswalls Park in the first week after the introduction of the cattle, but this matter was resolved.

Report:

The Council has inspected the garden at this vacant dwelling and has arranged for it to be cut back and cleared. This work was completed on the 25th February

2014.

The dwelling, has been referred to the County Architect for examination and for a report on the extent of pre-let repairs to be carried out.
