(“Opposer”), a limited liability company, located and doing business at 425 NE 22 Street,

Miami, Florida, is and will be damaged by Applications Serial No. 87/675665 and 87/978781 (the

“Applications”), and hereby opposes the registration of same.

As grounds for opposition, Opposer alleges as follows:

1. Opposer is a real estate developer that has offered services related to commercial and residential real estate agency services; commercial, industrial, and residential building construction services; land development services; and architectural design services under the marks MELO, MELO GROUP, MELO and Design, MELO ARCHITECTURE and Design,

MELO DEVELOPMENT and Design, and MELO CONTRACTORS CORP. and Design

(collectively, the “MELO Marks”) since at least as early as 2002.

2. Opposer has a significant online presence via its website located at themelogroup.com, along with printed brochures and other published materials identifying

Opposer’s services, a representative sample of which is attached hereto as “Exhibit A.”

3. Opposer’s services identified by the MELO Marks has prominently been featured in real estate-related news and publications, a representative sample of which is attached hereto as

4. As a result of Opposer’s substantially exclusive and extensive use and promotion of the MELO family of marks, its trademark has acquired enormous value and recognition in the

United States, all of which inures to the benefit of Opposer.

5. Put simply, the MELO Marks are a symbol of Opposer’s quality, reputation and goodwill, and serves as an instant source identifier for Opposer.

6. Opposer owns the entire right, title and interest in and to the WHITE FOX trademark, and has obtained the following U.S. Trademark Registrations for its various MELO

States Patent and Trademark Office (“PTO”), Applicant loanDepot.com, LLC (“Applicant”) is the record owner of the Applications for the mark MELLO (“Applicant’s Marks”).

8. Applicant filed the Applications for Applicant’s Marks on November 7, 2017 based on Applicant’s intent to use Applicant’s Marks in connection with “Operating online marketplaces for sellers and buyers of goods and services related to home purchasing and home ownership,

9. Applicant’s Marks are confusingly similar to Opposer’s MELO Marks in that

Applicant’s Marks are virtually identical except for the extra letter “L” in the middle of Applicant’s

Marks. In addition, the overall commercial impressions of the marks are very similar, which erroneously suggests an affiliation with Opposer.

10. In view of the similarity of Applicant’s Marks to Opposer’s MELO Marks, and the fact that the parties are offering related and overlapping real estate services, it is alleged that

Applicant’s Marks so resemble Opposer’s MELO Marks as to be likely to cause confusion, mistake, or deception under Trademark Act §2(d), 15 U.S.C. §1052(d), or otherwise.

11. Moreover, Applicant’s Marks will injure Opposer by impairing Opposer’s ability to register other marks in connection with real estate-related services.

PRAYER FOR RELIEF

WHEREFORE, Opposer respectfully requests that the opposition be granted and

Applications Serial No. 87/675665 and 87/978781 be denied registration in Classes 35 and 42.
