INTRODUCTION

NIGG WIND FARM NIGG WIND FARM ENVIRONMENTAL STATEMENT CHAPTER ONE: INTRODUCTION

1.1 THE APPLICATION

1.1.1 This Environmental Statement (ES) supports an application to The Council by Falck Renewables Ltd for consent under the Town and Country Planning (Scotland) Act 1997 for construction of a five turbine wind farm and associated ancillary developmen at Wester Rarichie, Nigg, in . The proposal will be referred to as the Nigg Wind Farm.

1.1.2 The development site lies 4 kms south-west of Balintore in Easter Ross. The site is currently used for the grazing of cattle and sheep. The Talisman Oil terminal and the Nigg platform fabrication yard lie some 5km south west of the site. The nearest individual properties are Strath of Picalnie which is 920m from the nearest turbine as well as the holiday cottage at Bayfield Loch and Wester Rarichie farm cottages which are 1.1 km and 1.3 km away respectively. The planning application boundary encompasses a total area of 298.3 hectares. Figure 1.1 (Volume 3) shows the site location. The OS national grid reference for the site centre is approximately NH835723 (1:50,000, OS Landranger Sheet 21).

1.1.3 Each wind turbine will be rated at between 2-2.5 megawatts (MW), with a maximum total generating capacity for the site of up to 10MW.

1.1.4 The maximum base to blade tip height of the turbines would be up to 125m at the point where the blades reach their highest point. The maximum height to the hub would be 80m.

1.1.5 Ancillary development will include the construction of approximately 2307 metres of new access track, 2020 metres of upgraded access track, an underground electricity cable network, crane hardstandings adjacent to each turbine, a temporary construction compound/storage/office area, one 80 metre anemometer mast and a site control building. Figure 1.2 provides details of the site layout.

1.2 THE APPLICANT

1.2.1 Falck Renewables is investing in renewable energy generation across the UK that will contribute to the Government’s renewable energy targets, the

country’s energy self sufficiency and CO2 reductions. Falck Renewables directly, and through its joint venture with RDC, currently has over 300MW of wind energy projects in development or operational in Scotland, England and Wales. The nearest operational wind farm which Falck Renewables has developed is the seven turbine 14MW Boyndie Wind Farm, and within The Highland Council area the company also has windfarms in construction at Kibraur near Golspie, Millennium near Fort Augustus and Ben Aketil on Skye.

1.2.2 Atmos Consulting is acting as agent to manage the application process on behalf of Falck Renewables.

1.3 THE ENVIRONMENTAL STATEMENT

1.3.1 The Environmental Statement (ES) has been prepared in accordance with Schedule 4 of the EIA (Scotland) Regulations1. It describes all of the elements of the wind farm development, its construction, operation and decommissioning, the nature of the site and its surroundings, the likely effects of the development, and measures proposed to mitigate any adverse impacts on the environment.

1.3.2 The purpose of the ES is to:

• Explain the need for the proposals and describe the physical characteristics, scale and design of the wind farm; • Examine the existing environmental character of the application site and the area likely to be affected by the wind farm; • Predict the possible environmental impacts of the wind farm; • Describe measures which would be taken to avoid, offset or reduce adverse environmental impacts; and • Provide the public, the planning authority and other consultees with information on the proposals, which would assist the planning authority in the determination of the wind farm application.

Assessment of Environmental Effects and Their Significance

1.3.3 The environmental effects and the impact of the proposal have been assessed using a combination of the sensitivity of the environment to change, and the degree of alteration or 'magnitude of change' which is predicted to arise as a result of the development. The significance of these effects is defined in relation to their magnitude, geographical extent, duration, frequency, reversibility and any regulatory standards that might apply. It does not necessarily follow, for example, that a high magnitude change will always be significant; conversely a low magnitude change will not necessarily always be insignificant. Where an assessment of significance cannot be determined (due to lack of information, unpredictable nature of an effect or uncertainty over magnitude of change) this is highlighted and discussed within the text.

Scoping

1.3.4 The EIA Regulations provide for obtaining a scoping opinion from the planning authority as to the information to be provided in the ES. The planning authority is then obliged to consult other 'consultation bodies' before issuing their opinion.

1.3.5 The scoping report, submitted to The Highland Council in May 2007, described the proposed EIA methodology and the key issues to be addressed, along with a description of the project. The project size at that time was, as now, five turbines although the turbine layout has subsequently evolved. A formal scoping opinion reporting on the responses from the consultation bodies was issued by the planning authority, The Highland Council, on the 12th July 2007. This in combination with scoping responses received from the RSPB, Community Councils, Talisman Energy and others as well as comments from individual members of the public helped to define and focus the aspects to be covered in the ES.

1.4 CONSULTATION

1.4.1 As part of the consultation process, scoping and/or consultation documents were sent to the following consultees in addition to The Highland Council (Table 1.1):

1.4.2 Three public exhibitions detailing the proposal were held. These were at Seaboard Memorial Village Hall on 5 September 2007 (16.00 to 20.000), at Nigg Community Hall on 6 September 2007 (16.00 to 20.00) and the West Church Cromarty on 21 November (19.00 to 20.00). To advertise the Seaboard and Nigg exhibitions, posters went up throughout the Fearn Peninsula the week before. In addition, letters were sent to all the community councils in the area detailing the timings. The exhibition timings were also promoted on Moray Firth Radio and BBC Highland. The exhibitions and the launch of the bespoke web site, www.niggwindenergy.co.uk, received publicity in the Ross-shire Journal and North Star.

1.5 LIST OF CONSULTANTS

1.6.2 This Environmental Statement, Volume 2, contains the Environmental Impact Assessment including the reports on the surveys and assessments. The structure of Volume 2 is as follows:

CHAPTER 6: CULTURAL HERITAGE

6.1 EXECUTIVE SUMMARY

6.1.1 This chapter considers the likely effects on cultural heritage interests of the construction and operation of the proposed wind farm. The assessment has been undertaken by CFA Archaeology Ltd informed by information provided by Historic Scotland and The Highland Council Archaeology Unit.

6.1.2 Twelve sites of cultural heritage interest have been identified by the assessment within the application area boundary, using a range of desk- based sources, consultations and a reconnaissance field study (Figure 6.1 in Volume 3 of this ES).

6.1.3 258 sites in the wider landscape are predicted to receive indirect visual effects on their settings that are considered to be not significant.

6.2 INTRODUCTION

6.2.1 This chapter considers the likely effects on cultural heritage interests of the construction and operation of the proposed wind farm. The assessment has been undertaken by CFA Archaeology Ltd, informed by comments and information provided by Historic Scotland and The Highland Council Archaeology Unit.

6.2.2 Figure 6.1 depicts the proposed development layout and the locations of archaeological sites and monuments identified by the study within the application area boundary. A gazetteer of those sites is provided as Appendix 6.1.

6.2.3 Figure 6.2 shows the proposed wind farm in its wider landscape setting together with the zones of theoretical visibility (ZTV) and the locations of key cultural heritage receptors within 15km of the proposed development that have a predicted view of the turbines. Appendix 6.2 in Volume 4 of this ES contains a list of key receptors that have theoretical views of turbines, based on the ZTV, and provides a summary of the predicted indirect visual impacts, on a site by site basis.

6.2.4 The specific objectives of the cultural heritage study were to:

• Identify the cultural heritage baseline within and in the vicinity of the application area;

• Assess the application area in terms of its archaeological and historic environment potential;

• Consider the potential and predicted effects of the construction and operation of the proposed development on the baseline cultural heritage resource, within the context of relevant legislation and planning policy guideline; and,

• Propose measures, where appropriate, to mitigate any predicted significant adverse effects.

6.3 PLANNING POLICY CONTEXT

Context

6.3.1 Cultural heritage resources include:

• Scheduled Ancient Monuments and other archaeological features;

• Listed Buildings and other buildings of historic or architectural importance;

• Conservation Areas and other significant historic townscapes; and,

• Historic Gardens and Designed Landscapes and other significant historic landscapes.

6.3.2 Those relevant to this assessment are Scheduled Ancient Monuments and archaeological features, Listed Buildings, and Conservation Areas. Planning policy discussed in this chapter for cultural heritage interests can also be found in Chapter 4 of this Environmental Statement.

6.3.3 Unless directly affected by the development, Historic Gardens and Designed Landscapes are considered in the Landscape and Visual Assessment section of the Environmental Statement (Chapter 7), which considers the effect of the wind farm on the surrounding landscape. Historic Gardens and Designed Landscapes are frequently the setting of important listed buildings, and it is acknowledged that they are of cultural heritage importance in their own right. Nevertheless, impacts on the cultural setting of these historic sites are indistinguishable from those on their landscape setting as considered in Chapter 7.

6.3.4 Scottish Planning Policy 6 – Renewable Energy (SPP6) sets out how the planning system should manage the process of encouraging, approving and implementing renewable energy proposals when preparing development plans and determining planning applications. The aim of SPP6 is to provide support for renewable energy developments, while at the same time protecting and enhancing Scotland’s natural and historic environment in accordance with the policies set out in the relevant National Planning Policy Guidance (NPPG) and Planning Advice Note (PAN) documents.

6.3.5 Historic Scotland’s Scottish Historic Environment Policy 1 – Scotland’s Historic Environment (2007) (SHEP1), sets out the Scottish Ministers’ vision and policies for the historic environment. It states that the protection of the historic environment is not about preventing change. Ministers believe that change in this dynamic environment should be

managed intelligently and with understanding, to achieve the best outcome for the historic environment and for the people of Scotland. The three key aims of the policy are to ensure that:

1) the historic environment is cared for, protected and enhanced for the benefit of our own and future generations;

2) there is increased public appreciation and enjoyment of the historic environment amongst all the people of Scotland and visitors to the country; and,

3) the historic environment’s importance as a key asset in Scotland’s economic, social and cultural success is recognised and skilfully harnessed. Scheduled Ancient Monuments and other Archaeological Features 6.3.6 Under the Ancient Monuments and Archaeological Areas Act 1979 (1979 Act), the Scottish Ministers are required to compile and maintain a Schedule of monuments considered to be of national importance. The statutory consent of the Scottish Ministers is required before any works are carried out which would have the effect of demolishing, destroying, damaging, removing, repairing, altering, adding to, flooding or covering up a Scheduled Ancient Monument (SAM). In addition, effects of proposed development works upon the setting of a SAM form an important consideration in the granting or refusal of planning consent to conduct development works. Further information on development control procedures relating to SAMs is provided in National Planning Policy Guideline 5, Archaeology and Planning (NPPG 5) and Planning Advice Note 42, Archaeology (PAN 42).

6.3.7 Archaeological sites and monuments without statutory protection are curated by the local planning authority. NPPG 5 and PAN 42 provide national planning policy guidance and advice on the treatment of this resource. PAN 42 indicates that the principle that should underlie all planning decision-making is preservation of cultural resources, in situ where possible, and by record if destruction cannot be avoided. It is recognised in the document that preservation may not always be possible, and where damage is unavoidable various mitigation measures may be proposed.

Listed Buildings

6.3.8 Under the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 (1997 Act), the Scottish Ministers are required to compile a list of buildings of special architectural or historic interest. Such buildings are classified into Categories A, B and C(s), in decreasing order of importance. Sustainable development is the principle underlying Government policy towards the historic environment. Planning authorities and the Scottish

Ministers are required to have special regard for the desirability of preserving Listed Buildings and their settings and any features of special architectural or historic importance they possess. The term ‘setting’ has no definition in the Act, although the Memorandum of Guidance on Listed Buildings and Conservation Areas 1998 (Memorandum; published by Historic Scotland) advises planning authorities to interpret the term broadly. The Memorandum states that a Listed Building should at all times remain the focus of its setting, and that attention should not be distracted from it by the presence of any new development. Government policy and guidance is also stated in National Planning Policy Guideline 18, Planning and the Historic Environment (NPPG 18).

Conservation Areas

6.3.9 Under the 1997 Act, areas of special architectural or historic interest can be designated as Conservation Areas, the character or appearance of which it is desirable to preserve or enhance. Planning authorities are required to consider planning applications affecting the appearance, character or setting of Conservation Areas.

Regional and Local Planning Policy Guidance

Structure Plan

6.3.10 The Highland Structure Plan Written Statement March 2001 establishes the Council’s strategic framework for land use and sustainable development. The Structure Plan notes that Highland’s towns and villages, including their historic and modern buildings, are an integral part of the region’s heritage, and that Highland contains extensive archaeological remains of national and local importance. It states that it is important that new development is sympathetic to existing patterns of development and that opportunities are taken to preserve and promote the built heritage. Strategic Policy G2 states that proposed developments will be assessed by The Highland Council on the extent to which they impact upon the cultural heritage and demonstrate sensitive siting and high quality design in keeping with, amongst other considerations, the historic environment.

6.3.11 Policy BC1 states that archaeological sites affected by development proposals should be preserved, or in exceptional cases where preservation is impossible, the sites will be recorded at the developer’s expense to professional standards.

6.3.12 Policy BC3 requires that Local Plans identify and zone areas of exceptional archaeological and historic interest, and make appropriate provision for the protection and interpretation of features of interest.

6.3.13 Policy BC5 seeks to preserve Highland’s buildings and groups of buildings of historic or architectural interest.

Local Plan

6.3.14 The East Local Plan (2007) provides no general guidance as regards cultural heritage and the built environment but provides detailed policies for the protection and enhancement of the cultural heritage resource of Ross and Cromarty based on the strategies and policies laid out in the Structure Plan. Part of the council’s vision is to provide strong safeguards for the environment.

6.4 APPROACH TO ASSESSMENT

Data Collection and Consultations

6.4.1 This assessment was conducted in accordance with the Institute of Field Archaeologists Code of Conduct (IFA 2006) and Standard and Guidance for Archaeological Desk-based Assessment (IFA 2001).

6.4.2 Consultation letters and requests for information on cultural heritage resources relevant to the assessment were sent to Historic Scotland and to The Highland Council Archaeology Unit. Up-to-date information was obtained from those sources on the locations of cultural heritage sites with statutory protection and non-statutory designations either within or in the vicinity of the application area. 6.4.3 Information on the character and condition of known archaeological sites and monuments within the application area was obtained from the National Monuments Record of Scotland (NMRS), and from The Highland Council Sites and Monuments Records (SMR). 6.4.4 Ordnance Survey maps and other historic maps held by the Map Library of the National Library of Scotland were examined, to provide information on sites of potential archaeological significance and on historic land-use development. The National Archives of Scotland map collection database was searched for any archive maps pertaining to the application area.

6.4.5 An assessment was made of vertical aerial photograph collections held by The Royal Commission on the Ancient and Historical Monuments of Scotland (RCAHMS). Sorties dating from 1946, 1970 and 1989 were available for examination.

6.4.6 Bibliographic references were consulted to provide background and historical information. No attempt was made within the remit of this study to conduct detailed historical analysis.

6.4.7 A reconnaissance field survey was undertaken of the application area in order to:

• assess the information obtained through the desk-based assessment;

• identify the extent and condition of any visible archaeological and/or historical sites, monuments and features,

• assess the topography and geomorphology of the application area for its potential to contain buried remains of other archaeological sites and features.

6.5 ASSESSMENT OF SIGNIFICANCE OF EFFECTS

6.5.1 The type of effects of the proposed development on cultural heritage interests are assessed in the following categories:

• Direct: where there would be a physical effect on a site caused by the proposed development. Direct effects may be caused by a range of activities associated with the construction and operation of proposed development features. Construction activities may include: tree felling; ground-disturbing excavations for turbine foundations, cable trenches, access roads and borrow pits. In addition, above-ground disturbance, such as caused by vehicle movement, and soil and overburden storage, may produce irreversible effects upon archaeological features. Direct effects on cultural heritage features are normally adverse, permanent and irreversible.

• Indirect: where the setting of a site may be affected. Indirect effects may relate to new development reducing views to or from cultural heritage features with important landscape settings, may result from increased noise or vibration, or may cause increased fragmentation of the historic landscape and the loss of connection between its component parts. Such effects are likely to occur during the construction phase of the development and persist throughout the operational phase. Indirect effects on cultural heritage features can be adverse, neutral or beneficial in effect.

• Uncertain: where there is a risk that the works may impinge on a site, for example where it is not clear where the location or boundaries of a site lie or where the baseline condition of a site cannot be established satisfactorily.

6.5.2 Potential effects, direct and indirect, have been assessed in terms of their longevity, reversibility and nature (beneficial / neutral / adverse).

• permanent effects are those that persist beyond the predicted operational lifetime of the proposed development. All direct effects are considered to be permanent;

• temporary effects arise as a result of the presence of elements of the proposed development but which would be removed by the dismantlement of those elements. Temporary effects can be short- term (e.g. construction phase effects); or long-term (arising from the

long-term presence of buildings or other structures affecting the setting of a receptor);

• reversible effects are those that are removed by the decommissioning / dismantling of the proposed development;

• irreversible effects are those that persist beyond the lifetime of the proposed development. All permanent and direct effects are irreversible;

• beneficial effects are those that contribute to the value of a receptor through enhancement of desirable characteristics or the introduction of new, positive attributes;

• neutral effects occur where the development can be accommodated comfortably by the receptor while neither contributing to nor detracting from the value of the receptor; and,

• adverse effects are those that detract from the value of a receptor through a reduction in, or disruption of, valuable characterising components or patterns, or the introduction of new inappropriate characteristics.

6.5.3 The assessment of significance of effects was undertaken using two key criteria: sensitivity of receptor and magnitude of effect. In gauging sensitivity, the importance of cultural heritage resources is assessed principally according to the criteria published in NPPG5 and the Memorandum. The main thresholds of archaeological importance defined in NPPG5 are national importance, regional and local importance, and lesser importance. Sites of national importance comprise those sites protected by scheduling under the 1979 Act, and sites of "schedulable quality". Scheduling is an ongoing process and not all sites of "schedulable quality" are currently scheduled. The Highland Council’s SMR contains a Non-Statutory Register (NSR) of archaeological sites and monuments, some of which are considered to be of national importance but which are not protected by scheduling. Sites with NSR codes C or V are unscheduled sites considered, respectively, to be almost certainly or very probably of national importance. However, only a proportion of The Highland Council’s SMR has been classified by the NSR criteria and the NSR is therefore of limited use. Sites of regional and local importance are those that do not merit scheduling, but which have significance within a regional or local context. This may, for example, apply to their importance to regional or local history, or they may be the only local example of a monument type. Sites of lesser importance may constitute component parts of a landscape rich in archaeological monuments, and thereby gain greater significance. The Memorandum states that Category A Listed Buildings are of national or international importance, Category B buildings are of regional or more than local importance, and Category C(s) structures are of local importance. Historic Gardens and Designed Landscapes contained with the Inventory are considered to be nationally important. Table 6.1

summarises the relative importance of key cultural heritage resources relevant to the assessment.

Sites of National Importance are more capable of absorbing low magnitude temporary and reversible indirect impacts on their setting than they are low magnitude permanent and irreversible impacts on their character. For that reason low magnitude direct impacts on sites of National Importance are considered to produce moderate and significant effects, whereas low magnitude impacts on the settings of such sites are considered to produce minor and non-significant effects.

6.5.7 All Scheduled Ancient Monuments, Category A and B Listed Buildings, Conservation Areas and Historic Gardens and Designed Landscapes within a 15km viewshed around the area of turbines have been assessed against the theoretical ZTV map. All visual impacts on cultural heritage sites beyond 15km are considered to be not significant in terms of the Environmental Impact Assessment Regulations (Scotland) 1999. Indirect impacts on Category C(s) listed buildings outwith the proposed development site boundary have been excluded from assessment. The Memorandum states that Category C(s) listed buildings are lesser examples of any period, style or building type and simple, traditional buildings. In the context of the proposed development, such locally important sites are considered to have localised landscape settings and indirect visual effects are considered to be not significant for such designations.

6.6 BASELINE CONDITIONS

6.6.1 Twelve sites of cultural heritage interest have been identified within or directly adjacent to the application area (Figure 6.1). Site numbers are shown in bold and in brackets in the following text. Appendix 6.1 provides tabulated gazetteer information on the character and baseline condition of sites within the proposed development area. Appendix 6.2 provides details on designated sites and non-designated sites considered to be of national importance within 15km of the proposed development area that are predicted to have views of the development based on the ZTV model.

Consultation Responses

6.6.2 In their response to the scoping report (14/06/07) Historic Scotland set out their underlying principles for assessing the impacts of the development on the cultural heritage resource. Historic Scotland noted that there are numerous SAMs and Listed Buildings in the vicinity of the proposed development. Historic Scotland also identified two SAMs within the proposed site boundary, as shown in the scoping report. These sites are a dun 650m SW of Easter Rarichie (5) and a fort and dun 600m S of Easter Rarichie (6). Historic Scotland acknowledged that the proposed locations of the turbines indicated in the scoping response are outside the scheduled areas and advised that the impact upon the setting of these, and other SAMs in the vicinity, should be taken into account and fully assessed during the EIA. Historic Scotland provided data on Scheduled Ancient Monuments, Listed Buildings and Historic Gardens and Designed Landscapes within 15km of the application area, for assessment purposes. Information was provided in a digital GIS format.

6.6.3 In response to the scoping report (12/07/07) The Highland Council Archaeology Unit (HCAU) set out their preferred approach to EIA assessment. The HCAU also identified several SAMs which lie in the wider landscape and recommended that as a minimum a visual assessment be carried out to assess the impact of the proposed development on their setting and on the setting of any other SAM deemed to have their setting altered by the proposed development. The specific sites identified are Dunskeath Castle at North Sutor (3319), a dun 650m SW of Easter Rarichie (5) and a fort and dun 600m S of Easter Rarichie (6), a chapel 500m NNW of Hilton of Cadboll (90320), a cross slab clach a-charridh (Shandwick Stone) (1674), and Cadboll Castle (5697). The Highland Council Archaeology Unit also provided information on sites held in their SMR that lie within and in the vicinity of the application area, and information on NSR sites within 15km of the application area boundary. Information was provided in a digital GIS format.

Sites within the application area

6.6.4 A scheduled dun (5) 650m south-west of Easter Rarichie lies within the application area boundary and a scheduled fort and dun (6) 600m south of Easter Rarichie, lies immediately adjacent to the east of the application area boundary.

6.6.5 There are no Listed Buildings within the application area and no part of the application area lies within a Conservation Area or Historic Garden and Designed Landscape.

6.6.6 The NMRS and SMR contain records relating to four cultural heritage features (3, 4, 5, 10) within and one site (6) directly adjacent to the application area boundary. These sites are buildings (3, 10), two mill

ponds (4) and the scheduled fort and dun 600m south of Easter Rarichie (6).

6.6.7 Examination of cartographic sources provided further information on three sites recorded in the NMRS and The Highland Council SMR (3, 4, 10). In addition, two groups of buildings (1, 2), a building and enclosure (7) and a track (9) were identified from examination of the Ordnance Survey 1st Edition map (1881).

6.6.8 Documentary sources provided no relevant information specific to the application area.

6.6.9 Field survey allowed the character and condition of the sites identified through the desk-based study to be assessed and identified three further sites; a track (8), a circular enclosure (11) and a structure (12).

Prehistoric Remains

6.6.10 The remains of a dun (5) and a fort and dun (6) are Scheduled Ancient Monuments and are of probable Iron Age date. The dun (5) is situated on the top of a prominent knoll within the application area, which has been flattened to accommodate it. The dun survives as a circular structure 20m in diameter over a turf-covered rubble wall spread to an average of 5m. The fort (6) survives as three defensive banks with an entrance to the east, located on a prominent knoll immediately adjacent to the east boundary of the application area. The dun (6), measuring 17.5m in diameter over turf covered walls 3.5m thick, stands in the centre of the fort.

Medieval and Later Remains Buildings

6.6.11 A smithy (1) comprising two rectangular roofed buildings, two small roofed buildings and a well is depicted on the Ordnance Survey 1st Edition map (1881). Two modern residential buildings now occupy this site.

6.6.12 Three roofed buildings (2) are depicted to the south of the smithy (1) on the Ordnance Survey 1st Edition map (1881). The footings of one of these buildings (NH 8384 7395) survive as turf and stone earthworks in a rough pasture field. Field survey identified no visible trace of the other buildings although buried remains may survive. The location of one of the buildings is now within an arable field.

6.6.13 Two roofed rectangular buildings, a small roofed building with an enclosure, a small square roofed building, an enclosure and a well (3) are depicted on the Ordnance Survey 1st Edition map (1881). One of the roofed rectangular building, an ‘Old Gravel Pit’ and the well are depicted on the Ordnance Survey 2nd Edition map (1907). The footings of one of the buildings (NH 8387 7373) and the gravel pit survive.

6.6.14 A building and attached enclosure (7) are depicted on the Ordnance Survey 1st Edition map (1881) and survive as ruinous upstanding features.

6.6.15 A roofed rectangular building (10) belonging to ‘Andrew Ross’ is depicted on Bell’s map of 1763 and is also depicted on the Ordnance Survey 1st Edition map (1881). There are no surviving visible traces of this building but buried remains associated with this building may survive.

6.6.16 A small rectangular structure (12), identified as a possible shieling hut during the field survey, stands on the summit of a hill in an area of rough pasture.

Other features

6.6.17 Further sites of medieval or later date include two mill ponds and an associated lade (4) and two tracks (8, 9). The mill ponds and lade (4) are depicted on the Ordnance Survey 1st (1881) and 2nd (1907) Edition map. There is no surviving visible evidence of the southern mill pond as an oil pipeline has been laid through it and the northern pond is presently infilled with farm debris. The lade survives as a ditch, revetted with a stone wall on both sides, which has collapsed in places, and still carries water from the hill down to Wester Rarichie and beyond.

6.6.18 A short length of track (8) was identified during the field survey as a grassy terrace winding up a slope. Another track (9) is depicted running between the group of buildings (1-3) and the higher ground on the Ordnance Survey 1st Edition map (1881). This track (9) has been partly replaced by a modern farm track.

Unknown

6.6.19 A circular enclosure (11) was identified during the field survey on a south- facing slope above the Allt nan Damh. It consists of a circular enclosure c.19m in diameter over turf banks spread to c.4m wide and 0.7m high. There is a gap c.5m wide in the south arc. The enclosure may be the remains of a hut circle or, alternatively, the denuded remains of a sheepfold.

Assessment of Archaeological Potential of the Application Area as a Whole

6.6.20 The sites identified by this study within the application area are of Prehistoric and medieval and later date. Prehistoric activity is represented by two scheduled monuments, both of which are defended settlement sites of probable Iron Age date, and a possible hut circle. The remaining sites relate to medieval or later use of the landscape and include settlement sites, an associated track and evidence of the exploitation of the water resource in the form of mill ponds and a lade. The proposed turbine area contains one possible prehistoric site, a possible hut circle.

6.6.21 The NMRS and SMR contain records of numerous sites in the vicinity of the application area which range in date from the prehistoric period up to the recent past. Prehistoric sites include a field system directly to the south-west on the Hill of Nigg, shell middens c.4km to the south near North Sutor, a standing stone and possible standing stone c.3km to the west in Nigg Churchyard, a possible barrow c.3km to the south-west at Pitcalzean and numerous findspots including a Roman coin at Nigg, urns and a jet necklace near the North Sutor, and several cists at Balintore, Shandwick and Nigg. Sites of later date include the Medieval Motte at Dunskeath Castle, the Medieval castle of Miltown, numerous medieval and post-medieval farmsteads, and 20th century military defence installations on the North Sutor.

6.6.22 The proposed turbine area occupies an area of high ground on the Hill of Nigg. The current land use is as improved grazing. Evidence from historic map sources suggests that this area has not been intensively farmed or settled in the past. Roy’s map of 1747-55 depicts a barren hill with cultivation on the lower ground around the base of the hill to the north and west. A similar landscape is depicted on the Ordnance Survey 1st (1881) and 2nd (1907) Edition maps.

6.6.23 The number, distribution and condition of sites identified within the application area and the available evidence on historic and current land use suggest that the potential of, as yet undetected, buried remains of medieval or earlier archaeological sites surviving within the application area boundary is moderate.

Key Receptors in the Vicinity of the Application Area

6.6.24 Twenty-eight SAMs within 15km are predicted to have theoretical views of the proposed wind farm based on the ZTV model. Two SAMs are also Category B Listed Buildings.

6.6.25 There are twenty-two Category A Listed Buildings and 195 Category B Listed Buildings within 15km of the proposed development which are predicted to have theoretical views of the proposed wind farm. Two of the Category B Listed Buildings are also SAMs.

6.6.26 There are four Conservation Areas, two of which are considered outstanding, within 15km of the proposed development that are predicted to have theoretical views of the proposed wind farm.

6.6.27 There are sixty-six NSR sites (twenty-four category C and forty-two category V) within 5km of the proposed development that are predicted to have theoretical views of the proposed wind farm.

6.7 ASSESSMENT OF IMPORTANCE OF CULTURAL HERITAGE FEATURES

6.7.1 Using the criteria detailed in Section 6.5 (Table 6.1), Appendix 6.1 includes a column which provides an assessment of the importance of each cultural heritage site identified by the baseline study.

6.7.2 One cultural heritage feature, the scheduled dun 650m to the south-west of Easter Rarichie (5), within the application area boundary is considered to be of National importance. One site adjacent to the east of the application area boundary, the scheduled fort and dun 600m south of Easter Rarichie (6), is considered to be of national importance.

6.7.3 The Highland Council considers the remains of a settlement (3) and two mill ponds with an associated lade (4) to be of regional importance.

6.7.4 There are five cultural heritage features considered to be of local importance within the application area. These sites are buildings (1, 2, 7, 10) and a small structure (12).

6.7.5 Two tracks (8, 9) which lie within the application boundary are considered to be of lesser importance.

6.7.6 One site, a possible hut circle (11), is considered to be of unknown importance. There is insufficient baseline information on this site to provide a more accurately assessment of importance.

6.8 EFFECTS AND MITIGATION

Assessment of Effects within the Application Area

6.8.1 The assessment of predicted effects has been carried out with reference to the design layout shown on Figure 6.1. Using the assessment criteria detailed in Section 6.5, Appendix 6.1 provides a final column which provides an assessment of the predicted effects of the proposed development on the identified cultural heritage sites within the application area. Three Dimensional (3D) site modelling software, Topos, was also used to aid the assessment of effects.

Direct Effects

6.8.2 Two sites (9, 11) are predicted to receive direct effects from the proposed development.

6.8.3 The proposed access road will cross track 9. Field survey identified no visible trace of this trackway at this location although buried remains may survive. Any surviving remains of this track would be directly affected by the construction of the proposed access track and is predicted to receive direct effects of imperceptible magnitude and negligible significance.

6.8.4 The circular enclosure (11) lies close to the location of a proposed Met Mast. Works associated with the erection of the mast have the potential to directly impact this site. Uncertain Effects 6.8.5 In addition to site-specific predictions above, ground-disturbing excavations associated with the proposed development could have an adverse effect on any unrecorded, buried archaeological remains present in those areas. Baseline information suggests that the area that would be affected by the development work is moderate. Taking account of the limited extent of the proposed ground disturbance generated by the construction of access tracks, turbine bases, met mast, substation, borrow pit and area of hard-standing, the likelihood of encountering significant archaeological remains is probably low.

Indirect Effects

6.8.6 Effects on the settings of cultural heritage sites have been assessed using the criteria detailed above in section 6.5 and tables 6.1-6.3. Scheduled Ancient Monuments, nationally important NSRs, Listed Buildings and Conservation Areas up to 15km from the application area are assessed. Historic Gardens and Designed Landscapes are dealt with in Chapter 7, Landscape and Visual Assessment. Two sites within or adjacent to the red line boundary have been assessed (5, 6). A summary of the predicted effects on the settings of these two sites is presented below. A list of cultural heritage receptors within 15km of the proposed development area and predicted by the ZTV to have views of one or more turbines are presented in Appendix 6.2 which also provides an assessment of the predicted effects on a site-by-site basis.

6.8.7 The assessment of magnitude of effects has been based on analysis of the blade tip ZTV and the Topos model, taking into account the distance of the assessed site from the proposed wind farm and the number of turbine blade tips visible. The ZTV model is, however, a coarse predictive tool based on bare-earth surface topography and maximum blade-tip heights. It takes no account of obstructions to intervisibility caused by existing forestry and other vegetation or buildings and other man-made features. The Topos model provides a more realistic indication of effect. Photomontages were also produced to illustrate the predicted effects on the fort and dun (6; Figure 6.3), Chapel at Hilton of Cadboll (90320; Figure 6.4) and the Shandwick Stone (1674; Figure 6.5).

6.8.8 All assessed effects on external receptors are indirect, long-term temporary and reversible in nature. They will arise during the construction of the wind farm, continue through its operation, and be removed with its decommissioning. Those sites that are considered to have no setting issue are assessed as such either because their settings are considered to be limited to their immediate environs and are unaffected by the proposed

development, or they are considered not to have long distance landscape views as an essential element in their function.

6.8.9 Where Historic Scotland or The Highland Council Archaeology Unit have requested that a site be assessed, they are discussed below. One of the sites requested by Historic Scotland, Dunskeath Castle at North Sutor (3319), will not be intervisible with the proposed development based on the ZTV, 3D Topos analysis and on-site verification and this site is, therefore, not considered further. No significant effects are predicted on the settings of any of the cultural heritage receptors. 6.8.10 The remains of a dun (5), a SAM, lie c.1.3km to the north of the nearest proposed turbine. The remains comprise a circular turf-covered rubble wall, c.20m in diameter, located on top of a prominent knoll. They stand in a pasture field c.600m to the south-west of Easter Rarichie Farm. This site is one of several known duns in this area. The principle views from the dun are to the west, north and east over the low lying ground, which contain few modern intrusions. It also has clear views towards the scheduled fort and dun (6), located a short distance to the west. The wind farm would not be visible in these views and the proposed development would not affect the visual link between these two monuments. To the south the ground rises up towards the Hill of Nigg, blocking views from the dun towards the sea. The dun is not visible as a prominent feature in the landscape when viewed from the north and east, at which point the turbines would be visible in the same view, as it is backclothed against the hill. However, the dun is visible as a prominent feature against the sky when approached from the west. The ZTV and Topos model indicate that all of the turbines would be visible in views of the site from the north and in views southwards from the site. Since these views are not considered key to an appreciation of the site, the impact on the setting of this site is considered to be of low magnitude and minor significance. 6.8.11 A fort and dun (6), a SAM, lies c.1.4km to the north-east of the nearest proposed turbine. The surviving remains include three ruinous walls and two outer ramparts crowning a prominent knoll, with a later circular structure, a dun, located on the top. This site is one of several known forts and duns in this area. The principle views from the fort and dun are to the east, north and west over lower lying ground, which contains few modern intrusions. The wind farm would not be visible in these views. Views to the west include the scheduled dun (5) and the proposed development would not affect the visual link between these two monuments. To the south, the ground rises up towards Nigg Hill, blocking views towards the sea. The monument is not visible as a prominent feature in the landscape when viewed from the north and east, at which point the turbines would be visible in the same view, as it is backclothed against the hill. However, it is visible as a prominent feature against the sky when approached from the west. The turbines would not be visible behind the monument from this view. The ZTV, Topos model and photomontage indicate that all of the turbines would be visible in views of

the site from the north and in views southwards from the site. Since these views are not considered key to an appreciation of the site, the impact on the setting of this site is considered to be of low magnitude and minor significance.

6.8.12 A chapel 500m NNW of Hilton of Cadboll (90320), a SAM, stands c.5.6km to the north-east of the proposed development. All that now survives of this early Christian chapel are the foundations which stand within an enclosure close to the coast. The current setting of the chapel includes the enclosure in which it is located and views to the east, south-west and along the coast to the south incorporating views of the settlements of Hilton of Cadboll and Balintore. Views towards the proposed wind farm are partially screened by the natural topography and by buildings within Hilton of Cadboll. The ZTV, 3D Topos analysis and photomontage (Figure 6.4 parts 1 and 2) indicates that all of the turbines would be visible in a small arc of view to the south-west. Taking into account the current condition and setting of the chapel remains, the predicted indirect effect is considered to be of low magnitude and therefore of minor significance.

6.8.13 A cross slab, clach a-charridh (Shandwick Stone) (1674), a SAM, stands c.2.9km to the north of the proposed development. The stone was broken and repaired in antiquity and now stands within a glass case, to protect it from further deterioration. It stands on an east facing hillslope above the village of Shandwick. The current setting of the stone includes the glass case, which detracts from an appreciation of the stone itself, with views in all directions. The ZTV, 3D Topos analysis and photomontage (Figure 6.5 parts 1 and 2) indicates that all of the turbines would be visible in a small arc of view to the south. Taking into account the current condition and setting of the stone, the predicted indirect effect is considered to be of low magnitude and therefore of minor significance.

6.8.14 Cadboll Castle (5697), a SAM and Category B Listed Building, stands c.6.km to the north-east of the proposed development. This ruinous 16th century castle stands directly to the west of the 18th century Cadboll House. The current setting includes the house and associated buildings and gardens with limited views towards the proposed development. While the ZTV indicates that all of the turbines would be visible in a small arc of view to the south-west an on-site analysis reveals that views are restricted by the mature trees surrounding Cadboll House. Taking into account the current condition and setting of the castle, the predicted indirect effect is considered to be of imperceptible magnitude and therefore of minor significance.

Mitigation Strategy

6.8.15 The cultural heritage assessment has identified no significant direct effects arising from the proposed development. As such no site specific mitigation measures are required in connection with identified cultural heritage features.

Construction Phase

6.8.16 Should planning consent be granted for the proposed wind farm, an appropriate archaeological monitoring strategy would be agreed in advance with The Highland Council Archaeology Unit and incorporated within a Written Scheme of Investigation (WSI). Mitigation measures may include the following:

• Avoidance of the mill ponds and mill lade (4) and the enclosure (11), which lie close to development features. These sites would be fenced off from construction works to avoid accidental damage.

• Evaluation of those parts of track 9 that are crossed by elements of the wind farm infrastructure.

6.8.17 Written guidelines would be issued for use by all construction contractors, outlining the need to avoid causing unnecessary damage to known archaeological sites. That document would contain arrangements for calling upon retained professional archaeological support in the event that buried archaeological remains of potential archaeological interest (such as building remains, human remains, artefacts etc) should be discovered in areas not subject to archaeological monitoring. The guidance would make clear the legal responsibilities placed upon those who disturb artefacts or human remains.

Operational Phase

6.8.18 No mitigation measures are practical to avoid or reduce the indirect impacts on the visual setting to Sites 5 and 6. The predicted significant indirect effects would last for the life of the wind farm, c.25 years, and would be removed once the wind farm has been dismantled.

Decommissioning Phase

6.8.19 No significant effects are predicted during the decommissioning of the wind farm, presuming that the same road infrastructure is used for the dismantling and removal of the built features of the proposed development.

6.9 STATEMENT OF SIGNIFICANCE

6.9.1 Twelve sites of cultural heritage interest have been identified by the assessment within or directly adjacent to the proposed development area, using a range of desk-based sources, consultations and a field study (Figure 6.1). Two of these sites are Scheduled Ancient Monuments of national importance. One site is considered to be of regional importance, five sites are considered to be of local and two of lesser importance. One site is of unknown importance. No significant direct effects are predicted on any of the identified sites. The possibility that additional, buried and

unrecorded remains of archaeological significance survive across the application area is considered to be moderate. Mitigation measures have been proposed to offset the any possible direct effects through an appropriate mitigation strategy to be agreed with The Highland Council Archaeology Unit in advance of construction.

6.9.2 No significant indirect effects have been predicted on the settings of key receptors within the proposed development boundary or within the 15km ZTV radius.

6.9.3 Two hundred and fifty-eight sites in the wider landscape and within 15km of the proposed wind farm are predicted by the ZTV to have views that would include the proposed turbines. None of the predicted indirect, visual effects is considered to be significantly adverse. The settings of the Shandwick Stone and Hilton of Cadboll Chapel have already been compromised by modern intervention and features, therefore the effect of the wind farm on the setting of these two features is not considered to be significant.

6.9.4 The development proposals have been assessed against the cultural heritage baseline. None of the predicted effects is judged to be significant. Overall, it is considered that the impact of the development on the cultural heritage resource would not be unacceptable in terms of local, regional or national planning policy and guidance.

Field survey identified the remains of a rectangular building at NH 8387 7373 and a large quarry. The building measures c.15m by c.6m over turf covered stone walls c.0.5m wide and up to 0.3m high. A possible entrance was identified in the south-east corner measuring c.1m wide. The quarry is irregular in plan and measures c.50m by c.30m and up to 4m deep. Both features correspond to features depicted on the Ordnance Survey 1st and 2nd Edition maps.

4 Mill ponds and mill NH87SW0075 283200 874300 SMR; maps; The SMR records that a "Mill Dam" (NH 83523 73810) with a Regional Direct lade NH87SW0076 aerial sluice on its north side and a mill lade that leads to the east side photographs; of Wester Rarichie Farm, is depicted on the Ordnance Survey 1st field survey Edition map. The SMR also records that a pond (NH 83574 73596) is depicted on the Ordnance Survey 1st Edition map. The mill lade is annotated and depicted running from the southern mill pond to the northern millpond and heading northwards to Wester Rarichie from NH 8346 7394 and NH 8357 7360, on the Ordnance Survey 1st Edition map. The southern mill pond is fed by two natural water courses. The mill dam, pond and lade are all depicted on the Ordnance Survey 2nd Edition map. The ponds and lade are visible on aerial photographs dating to 1970. Field survey identified no trace of the mill pond at NH 83523 73810. This area has been disturbed by the laying of a gas pipeline across it. There was no visible trace of the other mill pond at NH 83574 73596 the area of which is currently used to dump farm rubbish. The mill lade measures c.1m wide and is revetted by a stone wall on either side. 5 Dun 650m SW of NH87SW 8 / 284067 873661 Schedule HS; NMRS; The NMRS records that this dun crowns the top of a prominent National Indirect Easter Rarichie NH87SW0008 d 4781 SMR; field knoll which has been levelled to accommodate it. It consists of a survey circular turf-covered rubble wall spread to an average of 5.0m and measures overall 20m in diameter. There is a mutilated entrance gap in the east. It is very similar to the dun some 250m to the east (6) in respect of its position, size and condition. The dun is visible on aerial photographs dating to 1946 and 1970. Field survey confirmed that the dun is as previously described. 6 Fort and dun NH87SW 6 / 284335 873577 Schedule HS; NMRS; The NMRS records that this site is a fort consisting of three National Indirect 600m S of Easter NH87SW0006 d 5215 SMR; maps; ruinous walls and two outer ramparts, with a later circular Rarichie aerial structure crowning the top of the summit. The latter consists of photographs; a circular turf-covered wall about 3.5m thick, and 17.5m in field survey diameter with an entrance in the SE. Undoubtedly a dwelling, this is more likely to be a strong hut circle, rather than a robbed dun; it overlies the W arc of the fort wall. The innermost of the

fort defences encloses an oval area measuring about 30.0m east-west by 10.0m north-south. Outside, another wall encloses an oval area about 43.0m east-west by 26.0m north-south whilst a third wall encloses an area of c. 67.0m by 50.0m. The entrance, in the east, is offset. The fort is depicted and annotated ‘Danish fort (Remains of)’ on the Ordnance Survey 1st Edition map. It is depicted and named ‘Danish Fort’ on Bartholomew’s map of 1912. The fort and dun are visible on aerial photographs dating to 1946 and 1970. Field survey confirmed that this fort and dun are as previously described, located on a prominent knoll. 7 Building 284210 873530 Maps; aerial A roofed building and an enclosure are depicted on the Local None None None photographs; Ordnance Survey 1st and 2nd Edition maps. field survey The ruinous remains of a two-compartment building are visible on aerial photographs dating to 1970. The remains of the enclosure were identified as a low bank c.0.5m wide, 0.3m high and c.30m long to the west of the building.
