RESOLUTION AUTHORIZING THE RENEWAL OF A CONTRACT WITH LIBERTY HUMANE SOCIETY INC. FOR ANIMAL CONTROL SERVICES FOR THE CITY OF JERSEY CITY.

COUNCIL offered and moved adoption of the following resolution:

WHEREAS, Resolution No. 17.358, approved on April 26, 2017, awarded a two-year contract in the amount of $1,217,678.00 to Liberty Humane Society Inc. for Animal Control Services for the City of Jersey City (“City”); and

WHEREAS, the Animal Control contract contained options to renew the contract for three additional one-year periods; and

WHEREAS, Resolution 19-372, approved on April 24, 2019, authorized the City to exercise the first renewal option pursuant to the Agreement for a sum not to exceed $569,281.00 for a term from May 1, 2019 through April 30, 2020; and

WHEREAS, Resolution 20-428, approved on June 24, 2020, authorized the City to exercise the second renewal option pursuant to the Agreement for a sum not to exceed $569,281.00 for a term from May 1, 2020 through April 30, 2021; and

WHEREAS, the City wishes to exercise the third and final option to renew the contract with Liberty Humane Society Inc. for a term of one year effective May 1, 2021; and

WHEREAS, the total cost of the contract renewal shall not exceed the sum of $569,281.00; and

WHEREAS, funds in the amount of $100,000.00 are available in Account No. 01-201-27-336-312, PO #141185.

NOW, THEREFORE BE IT RESOLVED by the Municipal Council of the City of Jersey City that: 1. The renewal of a contract with Liberty Humane Society Inc. for providing Animal Control Services effective May 1, 2021 through April 30, 2022 is approved;

2. The total cost of the contract renewal shall not exceed the sum of $569,281.00; and

3. Pursuant to N.J.A.C. 5:30-5.5(c), the continuation of the contract after the expenditure of funds encumbered in 2021 fiscal year temporary budget shall be subject to the appropriation of sufficient funds in the 2021 fiscal year permanent budget and in the subsequent fiscal year budget.

WHEREAS, the City of Jersey City's ("City") Department of Health and Human Services (Department) currently provides animal control services with City personnel; and

WHERRA^, Resolution 16.818 approved on December 14, 2016, authorized the City to use fhe Competitive Contracting Law, NJ.S.A. 40A:11-4.1 et seq., to award a contract for animal conrrol servkes; and

WHEREAS, on February 10, 2017, a Request for Proposals for Comprehensive Animal Control Service was advertised, and the City received two proposals on March 22, 2017; and

WHEREAS, the City proposals from Lit)erty Humane Society, Inc. ("LHS") and Associated Humane Society; and

WHEREAS, a committee appointed by the City's Business Administrator pursuant to N.J.A.C. 5:34-4.3 reviewed tfae proposals and prepared a report attached hereto recommending that the contract be awarded to LHS; and

'WHEREAS, LHS is a non-profit corporation of the State of New Jersey and is not subject to the New Jersey Local Unit Pay -To- Play Law, N.J.S.A. 19:44A-20.4 et seq.; and •

"ftTIEREAS, LHS will provide comprehensive animal control services to the City, supervised by the Department of Health and Human Services (HHS), for a term. of two (2) years; and

WHEREAS, the City agrees to pay LHS a fee of $555,397 for tiie fast year, plus $93,000 onetime startup cost for a total of$64S,397 and $569,281 fertile second year, for a total contract amount of $1,217,678; and

WHEREAS, funds m the amount of Twenty Five Thousand Dollars ($25,000) are available in Account No. 01-201-27-336-312;

1. Pursuant to N.J.S.A. 40A:11-4.1 et seq., a conta'act to provide animal control services is awarded to Liberty Humane Society, Inc.;

2. The term of the contract is two years effective May 1,2017 and the total cost of the coufract shall not exceed $1,217,678. The City shall have options to renew the contract for up to three (3) additional one (1) year terms.

Summonses for the above will be signed by one of the NJ state-certified Animal Cruelty Investigators (ACI) employed by LHS.
