JAGJIT SINGH & ORS. ……..Respondents (A) SERVICE LAW – Equal Pay for equal work – Whether temporarily engaged employees (daily wage employees, ad-hoc appointees, employees appointed on casual basis, contractual employees and the like), are entitled to minimum of the regular pay scale, alongwith dearness allowance (as revised from time to time) on account of their performing the same duties, which are discharged by those engaged on regular basis, against sanctioned posts ? The duties and responsibilities discharged by the temporary employees in the present bunch of appeals were the same as were being discharged by regular employees – It is not the case of the appellants that the respondent employees did not possess the prescribed qualifications for appointment on regular basis and they would not be entitled to pay parity – So the principle of “equal pay for equal work” would be applicable to all the concerned temporary employees, so as to vest in them the right to claim wages, at par with the minimum of the pay-scale of regularly engaged Govt. employees, holding the same post – Held, all the concerned temporary employees, in the present bunch of cases, would be entitled to draw wages at the minimum of the pay scale (at the lowest grade, in the regular pay scale), extended to regular employees, holding the same post. (Paras 57, 58) (B) SERVICE LAW – Principle of “equal pay for equal work” – Employees engaged on regular basis, claiming higher wages under such principle – “onus of Proof” – Person who claims it, has to proof parity in the duties and responsibilities of the subject post with the reference post alongwith other parameters described in paragraph 42 of the judgment which can be taken into consideration while dealing with the matter.

    CHIEF JUSTICE OF INDIA CHIEF JUSTICE OF INDIA The Chief Justice of India (CJI) is the head of the judiciary of India and the Supreme Court of India. The CJI also heads their administrative functions. In accordance with Article 145 of the Constitution of India and the Supreme Court Rules of Procedure of 1966, the Chief Justice allocates all work to the other judges who are bound to refer the matter back to him or her (for re-allocation) in any case where they require it to be looked into by a larger bench of more judges. The present CJI is Justice Dipak Misra and is the 45th CJI since January 1950, the year the Constitution came into effect and the Supreme Court came into being.
