Overview The Sexual Assault Testing and Evidence Collection Act (SATEC), enacted November 29, 2006, established the statewide sexual assault evidence collection program. SATEC grants responsibilities to the Department of Health (Department) and the Pennsylvania State Police (PSP) and provides for the rights of sexual assault victims. SATEC was amended by Act 164 of 2018. Act 164 requires PSP to complete and submit a biannual report to the Department of Health (SATEC Act 164 of 2018). Act 164 was signed by Governor Wolf on Oct. 24, 2018 and went into effect on Dec. 23, 2018 (SATEC Act 164 of 2018).
Act 164 made several changes to the existing version of the SATEC. First, a new statutory provision, 35 P.S. §§ 10172.6, was enacted that mandated biannual reporting requirements on PSP. The provision requires PSP to make an initial report to the Department by Dec. 31, 2018, and every six months thereafter. The PSP report must include the volume of sexual assault kits for which testing is completed, the average turnaround time to complete testing and the reasons for any delays. The report submitted from PSP to the Department in February is Appendix A.
Additional amendments to the SATEC under Act 164 include: - Establishment of a designated telephone number for health care facilities to call when law enforcement fails to take possession of a sexual assault evidence collection kit within 72 hours; - The requirement for health care facilities to notify law enforcement within 12 hours of collecting sexual assault evidence; and - The requirement for the testing of evidence to be completed within six months of it being submitted to an approved lab
Every year by April 30, the Department is required to publish a report summarizing the information submitted by local law enforcement agencies to its website. This annual report is intended to provide a comprehensive overview of the number of untested sexual assault kits in the commonwealth and to ensure that those kits are tested in a timely fashion.

Methods As mandated by the SATEC, law enforcement agencies were initially required to report the number of sexual assault kits in their inventory awaiting testing and the number of sexual assault kits in their possession with backlogged evidence awaiting testing as of Dec. 31, 2020. The SATEC defines backlogged evidence as “sexual assault evidence that is awaiting testing for 12 months or more” (35 P.S. 10172.2). Evidence is awaiting testing if it meets all the following conditions: • Has been collected and is in the possession of a local law enforcement agency; • Has not received DNA or other appropriate forensic analyses; • Is related to a criminal case or investigation where final disposition has not been reached; and • Should undergo DNA or other appropriate forensic analysis as determined by a local law enforcement agency.
Law enforcement agencies were subsequently notified by mail and email of the biannual reporting requirements of Act 164 of 2018, as well as the ongoing requirement to report backlogged sexual assault evidence. Questions in this year’s survey were the same as last year. Law enforcement agencies were asked to provide the number of sexual assault kits in the following categories: - Backlogged kits awaiting testing; - Kits for which no consent to test was obtained; - Kits from anonymous reporters; and - Kits for which the jurisdiction of the assault was unknown.

Findings
A total of 1,120 law enforcement agencies reported results this year, the highest number of reporting agencies since the inception of the mandatory reporting in accordance with the act. The agencies, including campus police and approved laboratories, reported 153 backlogged kits awaiting testing at the end of 2020. This is a 63 percent increase in the number of backlogged kits compared to the end of 2019, but is still an 87 percent decrease compared to the end of 2016. Police departments are also in possession of 810 kits for which the victim has not consented to having the kit tested, 552 kits for which the victim is anonymous and 98 kits where the assault occurred in an unknown jurisdiction.
Table 1 includes an overview of the number of sexual assault kits awaiting testing as of February 2021. It also provides an overview of the number of kits for which the victim did not consent to testing, kits with anonymous victims and kits for which the assault occurred in an unknown jurisdiction.
Table 2 includes an in-depth list of each local law enforcement agency, university or laboratory that reported a backlogged sexual assault kit, the number of kits where the victim did not consent to testing, the number of kits from an anonymous victim (Jane Doe kit) and the number of kits where the assault occurred in an unknown jurisdiction.

3. Efforts were made to update the list of active LEA for this year’s survey. The high number of small and part time LEA within Pennsylvania lead to chronic changes in status, personnel and location. Between December and February, PSP Bureau of Forensic Services provided responses to over 500 email and phone call inquiries from LEA seeking guidance regarding the mandatory reporting. Some respondents provided information regarding LEA currently disbanded, merged with other agencies or otherwise inactive. One question in the survey requested a list of municipalities serviced by the reporting agency. Inactive LEA were removed from the list if their municipality was serviced by another law enforcement agency.
4. Questions in this year’s survey were the same as last year. Law enforcement agencies were asked to provide the number of sexual assault kits in the following categories: backlogged kits awaiting testing, kits where no consent to test was obtained, kits from anonymous reporters, and kits where the jurisdiction of the assault was unknown.
5. The results of the survey for the mandatory reporting of sexual assault evidence are found in Enclosure (6). The Excel spreadsheet contains two tabs: 1) reporting agencies listed by county and 2) non-reporting agencies. The number of kits reported by each agency are listed in columns L through O. The list of non-reporting agencies was determined using the agencies with currently active ORI numbers as per CLEAN where no other information was provided to indicate the agency was disbanded, merged with another agency or otherwise inactive.

6. In summary, a total of 1,120 law enforcement agencies, reported results. This is the highest number of reporting agencies since the inception of the mandatory reporting in accordance with the statute. The agencies, including campus police and approved laboratories, reported 153 backlogged sexual assault kits awaiting testing at the end of 2020. Though this is a 63% increase over the number of backlogged kits compared to the end of 2019, it is still an 87% decrease compared to the end of 2016. Police departments are also in possession of 810 kits where the victim has not consented to having the kit tested, 552 kits where the victim is anonymous and 98 kits where the assault occurred in an unknown jurisdiction. It should be noted that in many cases with anonymous victims, the jurisdiction is also unknown.
7. The Non-Reporting Agencies listed in Enclosure (6) include the mailing address that the PSP contacted in an unsuccessful attempt to obtain data for this reporting period. As the Pennsylvania Department of Health (DOH) is ultimately responsible for obtaining backlogged evidence data from non-reporting sources, this information is provided to DOH for its information and review.
8. Under the most recent amendment to the Sexual Assault Testing and Evidence Collection statute, the PA State Police is to annually report the volume of sexual assault kits for which testing is completed, the average turnaround time to complete testing, and the reasons for any delays. The data from the three approved forensic laboratories within Pennsylvania is listed in the table below.
The average turnaround time to complete testing is calculated from the time the evidence is first submitted to the lab until the reports are completed.

* Due to the large number of outsourced cases, as well as the complexity of the data obtained, reports and CODIS uploads were completed in 2020 for 59 of the sexual assault kits that were outsourced in 2019. This outsourcing effort was successful in reducing the backlog of sexual assault kits in the custody of the ACOME, but also negatively impacted the turnaround time due to the overall age of the kits that were outsourced. If the turnaround time for the sexual assault kits processed in house is evaluated, independent of the outsourced kits, then the average turnaround time reduces from approximately 9 months to approximately 6 months, which is within the expected turnaround time for testing. Another element that impacted the turnaround time was the dedication of senior DNA analysts

to the training of more DNA analysts. While this effort will be beneficial to the efficiency of the ACOME in the future, the immediate impact is to reduce the time the fully trained scientist can dedicate to completing DNA reports. Additionally, the COVID-19 pandemic changed many of the duties of the Forensic Biology Manager and DNA Technical Leader, drastically reducing the number of reports both fully trained individuals wrote, so that some cases would have to wait longer for the report to be written, once the data was obtained.
9. In accordance with the Sexual Assault Testing and Evidence Collection Act, 35 P.S. §§ 10172.6, a review of current practices, including interagency collaboration with LEA and rape crisis centers, in rape kit collection is to be reported every two years. To address issues impacting sexual assault evidence collection and management, district attorneys, law enforcement agencies, health care facilities, and victim advocates in some communities have developed differing solutions based on their community resources. Such protocols allow for victim confidentiality, securing of evidence, protection of victim rights, and follow-up if an investigation is requested. A solution that works in one region may not be successful in another. The following provides a review of current practices in several areas of the state.
Allegheny County
The Allegheny County Office of the Medical Examiner (ACOME) has continued to work with hospital networks in the area to improve sexual assault evidence collection. Active participation on the UPMC Council, which brings members from law enforcement, the forensic lab, UPMC hospitals, and prosecutors together to discuss issues and concerns associated with sexual assault cases has allowed the ACOME to collaborate with several groups on this topic. Additionally, the ACOME gathers data on all kit issues observed and shares the information with the hospital associated with the collection, to help in their quality control efforts.
The ACOME partnered with the Allegheny County Police to pursue a grant under the Sexual Assault Kit Initiative (SAKI) funding stream to help improvement sexual assault investigation and SAK testing in Allegheny County. While pursuing this effort has been slightly delayed due to the COVID-19 pandemic, meetings will commence in 2021 between members of the multi-disciplinary team (MDT), which is comprised of individuals from local advocacy groups, local hospital networks, the Allegheny County Police, the Pittsburgh Police, the Allegheny County District Attorney’s Office, and the Medical Examiner’s Office. Those meetings are intended to establish written policies and procedures that will then be implemented on cases in Allegheny County to ensure the timely and efficient investigation, testing, and prosecution of cases with sexual assault kits.
Berks County
The Sexual Assault Response Team (SART) in Berks County was officially formed and the first meeting was held in July of 2020. The SART is a victim-centered and trauma- informed multidisciplinary team of professionals that aims to prevent re-traumatization and provide support for victims throughout the reporting and criminal justice process. Members of the team include victim advocates from Safe Berks, law enforcement, SANE nurses from both

local hospitals, individuals from the District Attorney’s Office, and Berks County Jail personnel. The SART meets monthly to discuss current issues related to sexual assault and how to better provide services to survivors of sexual assault in this county. There is a current focus on how to connect incarcerated individuals who are victims of sexual assault to necessary services. Although the team is newly formed, the creation of a SART protocol is already underway. Some of the things this protocol addresses includes short and long-term goals of the SART, special populations of victims, and roles and responsibilities of team members.
Clinton County
January 31, 2021 marked one year since the launch at the UPMC Lock Haven Emergency Department celebrating the partnership between the newly formed Sexual Assault Nurse Examiner (SANE) Team and the Penn State Sexual Assault Forensic Exam-Telehealth (SAFE-T) Center. Prior to the training and certification of the initial seven UPMC Lock Haven SANEs, it was not possible to get a sexual assault forensic exam completed by a certified SANE in Clinton County. This partnership and launch greatly increased accessibility of sexual assault forensic examines to survivors of sexual assault in Clinton County. In addition, the SAFE-T program assists the UPMC Lock Haven SANEs through equipment that provides video connection to one of the SAFE-T program’s trained SANEs. This means that if a patient chooses, they can have two expert nurses, one in person and one through video telehealth, fully focused on ensuring that they receive the best care possible.
Clinton County has had an active Sexual Assault Response Team for years and it currently meets bimonthly. The SART has included active members from Roads to Peace, Clinton County District Attorney’s Office, Lock Haven Police Department, Lock Haven Sheriff's Department, Pennsylvania State Police- Lamar, Clinton County Communications Center, Crossroads Counseling, MH/ID, Clinton County Children’s Services, and Lock Haven University. The SART now also includes the SANE Coordinator from UPMC, who coordinates the joint SANE team that serves both Clinton and Lycoming Counties.
Philadelphia County
The Philadelphia Police Department Office of Forensic Sciences (PPD/OFS) participates in a multidisciplinary working group that focuses on the submission, analysis, processes and policies related to sexual assault evidence. The working group is comprised of the PPD/OFS, the PPD’s Special Victims Unit, the Philadelphia District Attorney’s Office, Philadelphia Sexual Assault Response Center (PSARC), Women Organized Against Rape, and the Women's Law Project. The group meets routinely to discuss these topics. PPD/OFS also meets routinely with PSARC and Sexual Assault Nurse Examiners to discuss topics of mutual interest and provide training.
In addition to the working group above, both victim advocacy groups are members of the Community Review Team that meets quarterly at the Philadelphia Police Department’s Special Victims Unit to conduct case reviews/audits of all unfounded sexual assault

complaints.
The PSARC was established in 2011 to meet the forensic and medical needs of sexual assault victims who are 16 years of age and older. PSARC is a private, not-for-profit center whose mission is to provide expertise in the assessment and evaluation of sexual assault victims in Philadelphia. All services are provided in private, medical office setting located adjacent to the Special Victims Unit of the Philadelphia Police Department. This unique setting allows for private, confidential, victim-centered care. The center is staffed 24/7, by on-call, specially trained and experienced Sexual Assault Nurse Examiners (SANE) who provide forensic rape examinations and evidence collection to both females and males. Our SANE staff are all highly trained, compassionate nurses with years of experience in the care of sexually assaulted patients. PSARC works closely with the Philadelphia Police Department's Special Victims Unit, the Philadelphia District Attorney's Office, Women Organized Against Rape, and the Philadelphia Sexual Assault Advisory Committee to provide a survivor- centered approach to sexual assault. PSARC cares for victims regardless of their cooperation with law enforcement. Accompaniment services, if desired, are provided by Women Organized Against Rape, Philadelphia's rape crisis center. Washington County
The goal of Washington County’s STOP Coordination Team is to ensure collaboration among the District Attorney’s Office, local law enforcement agencies, Domestic Violence Services of SWPA, The SPHS CARE Center STTARS Program which serves sexual violence victims, and allied professionals for the purpose of thorough investigation, effective prosecution, and comprehensive support services to victims.
This includes partners from Washington Health System, the local Child Advocacy Center, Washington County Probation, Washington County Children & Youth Services, Southwestern PA Legal Services, and other human services agencies whose efforts are essential to the recovery of sexual and domestic violence, and stalking victims. The team meets bi-monthly to confirm that all partners’ interactions with victims are respectful and focused on the health and well-being of the victim regardless of the individual’s decision to participate in the criminal justice process.
Protocol review and law enforcement/allied professionals training focusing on the Team’s priorities with victims are held annually. Topics of recent trainings have been on responding to survivors from underserved populations including victims who identify as LGBTQ+, an introduction to Forensic Experiential Trauma Interviews (FETI), human trafficking, best practices in forensic evidence collection, and the procedures surrounding anonymous reporting for victims along with victim notification processes. The team has also formed a subcommittee focused on developing protocols to address human trafficking, as well as to provide additional training and outreach on this issue.
Because of circumstances surrounding the pandemic in the past year, the team has been forced to pivot its activities to guarantee continued responsiveness to the needs of victims while maintaining consistent communication across the various disciplines represented in the group. The transition to virtual meetings has gone smoothly, as did this year’s annual

training which was held in webinar format. This evolution is a testament to the strong foundation that the team has built over the last decade and its commitment to promoting victim responsive care, in order to encourage reporting and participation in the criminal justice process to hold perpetrators accountable for their crimes.
Wyoming County
Wyoming County is a rural county in Northeast Pennsylvania. More than 20 years ago a STOP Coordinating Team was established and continues to meet quarterly. The team consists of law enforcement, prosecutors, victim services, medical, civil legal representatives and community service agencies, who work to assure the quality services are provided to victims of sexual assault. The ability to meet provides continued communication between law enforcement, victim services, prosecution, court, and probation the opportunity to discuss changes and issues as well as resolve problems. As changes occur in criminal statutes and required notifications the sexual assault protocol has been revised to reflect these changes. These changes are reviewed at meetings and annual trainings.
The collaboration has increased attendance of law enforcement at local trainings and participation in Sexual Assault Awareness and Human Trafficking Awareness Months. Members of the STOP Coordinating Team have received quality training at the national level by attending the End Violence Against Women International Conference. Attending this conference as a team has not only given the team an opportunity to build stronger working relationships but also the ability to learn more on best practices and emerging issues to effectively respond to victims of sexual assault.
PA State Police
The PSP Bureau of Forensic Services (BFS) has a long history of providing training to SANE/SAFE health care professionals and partnering with the Pennsylvania Coalition Against Rape. Lectures are provided by Forensic Scientists as part of the Sexual Assault Nurse Examiner Adult/Adolescent Training Course conducted at various sites throughout the state. The lectures cover techniques to optimize evidence collection and explain how the evidence is processed once it is received into the laboratory. The BFS is working to provide requested feedback to the SANEs regarding the quality of the sample collection. The feedback is one means of continual improvement.
The BFS has updated the Sexual Assault Testing and Evidence Collection Act (SATEC) Awareness Training PowerPoints available to law enforcement through the Pennsylvania Chiefs of Police Virtual Training Network and through the PA State Police internal network. Staff have assisted in presenting an updated SATEC Awareness Training webinar conducted by PCAR in January 2021. Additional lectures are anticipated for 2021. The BFS established a resource email account to manage the large volume of inquiries by law enforcement agencies regarding the SATEC. The BFS staff responds to several hundred inquiries annually and have experienced a significant increase due to Act 164 of 2018.
