Murray Graham is updating the retail statement following the observations from WYG and I will receive this on Friday and expect to forward to you on Tuesday 28th August.

On the subject of what maximum floor space may be dedicated to each use class, we would hope to keep this as flexible as possible to be able to respond to suitable opportunities.

Can I suggest that no more than 6,000sqm can be allocated to any single use class with the exception of leisure and hotel use. Lets speak early next week.

Paragraph 3.03 states:

‘A minimum 11,361 sq.m and a maximum 12,198.60 sq.m of mixed-use accommodation to include speciality retail, leisure, galleries, visitor attraction and other commercial floor space.’

It is not evident as to what the ‘mix’ of these uses could be and we would suggest that the applicant may wish to clarify what the maximum floorspace dedicated to each of these uses may be. At present, it would appear that any one element of the proposal may occupy circa 12,000 sq.m. Furthermore, whilst reference is made to ‘speciality’ retail, we would also suggest that it would be of assistance for the applicant to clarify what type of goods may be traded from the development and if they would be prepared to accept a restrictive condition to ensure that the scheme trades accordingly.

In terms of the two key national retail policy tests, Section 7.0 of the Updated Retail Statement seeks to provide justification for the development in terms of the ‘sequential’ test. However, we are not aware of any detailed consideration being given to the test of ‘impact’ which is now set out by paragraph 26 of the NPPF. In this regard, the NPPF sets out a ‘twin’ impact test relating to:

· the impact of the proposal on existing, committed and planned public and private investment in a centre or centres in the catchment area of the proposal; and

· the impact of the proposal on town centre vitality and viability, including local consumer choice and trade in the town centre and wider area, up to five years from the time the application is made. For major schemes where the full impact will not be realised in five years, the impact should also be assessed up to ten years from the time the application is made.

The material submitted to satisfy the above tests should be commensurate to the scale of the proposal. Given that it would appear (subject to the above requested clarification) that the scheme could result in a significant quantum of retail floorspace, it is imperative that this test is also addressed.
