What is the “Sixties Scoop”?

It is when Aboriginal children were taken from their homes and families without consent and forced into the child welfare system, and in most cases sent to live with middle-class Euro-Canadian families.

Who does it apply to?

• Anyone who was registered or eligible to be registered as Indians (as defined in the ) or ; and • Were removed from their homes and care of their family in between January 1, 1951 and December 31, 1999; and • Who were adopted or made permanent wards and placed in non- Indigenous homes

What is a ?

A Class Action Lawsuit is when a group of people with the same or similar injuries caused by the same product or action sue the defendant as a group.

In a class action, one or more people called “Plaintiffs” sue on behalf of people who have similar claims. All of these people are called a “Class” or “Class Members.” This action then becomes a “Class Action”. The courts resolve the issues for everyone affected, except for those who exclude themselves from the lawsuits.

What does the proposed Settlement look like, how much money will I receive in compensation?

The Federal Government will pay up to 750 million to settle all claims across Canada. Individuals are expected to receive between $25,000 and $50,000.

What are the risks if I choose to “Accept” or if I choose to “Opt. Out”?

If you accept, once the proposed settlement becomes final, you will give up your right to sue the for the claims being resolved by this proposed settlement. You will be “releasing” the Government of Canada as described in the proposed Settlement Agreement, which means you cannot sue the Government of Canada for anything related to Loss of Culture, Loss of Identity or Loss of Language due to the Sixties Scoop. If you opt out, you remove yourself from the settlement agreement. Choosing this option means that: (1) you will not receive or be entitled to compensation from the settlement; and (2) you will not be held to any order or restriction made in this class action.

To opt out of the settlement, you must submit an “Opt Out Form” to Collectiva by August 9, 2018.

How can I get out of the process if I disagree with the settlement (“Opt. Out”)?

If you want to begin your own lawsuit against the Government of Canada about the Sixties Scoop, you must opt out in order to do so. You will need to hire and pay for your own lawyer if you decide to pursue this option. If you opt out, you must abide by all applicable limitation periods and you should consult a lawyer. A limitation period is a specified period during which you must start a claim or you could lose your ability to make a claim.

If I choose to accept the settlement as offered, what do I need to do to receive my payment?

You need to fill out the appropriate claim forms and follow any timelines that may be identified through the process.

First the settlement has to be approved in the court. It is anticipated that this will occur during the summer or fall of 2018.
