1. APPLICATION

1.1 On 8th May 2018, an application to vary the Premises Licence held by Plant Pot Ltd for the Greenman Festival, an annual event held on The Glanusk Estate near was received by the licensing authority.

1.2 The festival has won several awards including "Best Medium Sized Festival 2010","Grass Roots Festival 2012" and in 2015, Green Man won "Best Festival" at the Live Music Business Awards. It is the largest contemporary music and arts festival in and has been given major event status by due to the festival's positive impact and wealth creation.

1.3 The Greenman festival benefits from an existing premises licence that is attached at Annex A, it is time limited to ‘a maximum 8 consecutive day period which includes a weekend in June, July, August or September to be notified as stated in condition 1 of the premises licence’. Typically the event takes place in mid-August each year.

1.4 There are currently two halves to the festival, Mon/Tues/Wed prior to the main festival is known as Settlement and is when the site is being prepared for the main festival and the traders arrive and set up, a small number of licensable activities take place during this period and it is possible for customers to buy tickets for the festival that includes the settlement period giving them the chance to explore the local area, the current capacity of the Settlement period is 2000 people (inclusive of artists and crew) The main festival runs on Fri, Sat and Sun with people arriving from the Thursday prior and staying potentially until Monday. The current capacity for the main festival is a total of 19,999 (inclusive of artists and crew).

1.5 The licence for the Festival at this site was first granted in 2006, in 2010 the licence was varied to increase capacity of the main festival from 14,999 to 19,999 and also to extend the period of the licence to include licensable activities during the settlement period (Mon/Tues/Wed).

1.4 The application submitted seeks to:

 Further increase the capacity of the main festival from a maximum of 19,999 persons to 24,999, inclusive of artists and crew.  Increase the capacity of the settlement from 2000 to 5000

2. CONSULTATION

2.1 The applicant & The Licensing Authority satisfied procedural obligations by consulting the Responsible Authorities and advertising the application. It is also practice to notify the local Council member of any premises applications in their area, in this instance Cllr Jackie Charlton was notified about the application.

2.2 During the consultation process Cllr Charlton, representing the local community requested a meeting with the Senior Licensing Officer to discuss the application and raise their concerns. On 23rd May the Senior Licencing Officer met with Cllr Charlton along with a representative from Mid and West Wales Fire Authority who wished to find out more about the festival and the application. Ian Fielder, the festival manager provided the Senior Licensing Officer with further written information in respect of the application to present to the local member this is attached at Annex C. During the meeting the process for making representations was discussed and Cllr Charlton was advised that representations must be relevant and relate to the Licensing Objectives in order to be considered.

2. REPRESENTATIONS

2.1 Responsible Authorities

No representations were made by any of the Responsible Authorities.

Cllr Charlton submitted representations in respect of the variation application on 1st June 2018, these are attached at Annex D

3. OPTIONS

3.1 In determining the application for the Premises Licence, the Sub-Committee must take such steps as are considered necessary to promote the licensing objectives;

i) The Prevention of Crime and Disorder ii) Public Safety iii) The Prevention of Public Nuisance iv) The Protection of Children from Harm

The options are to;

a) grant the variation application as submitted by the applicant without modification, or b) grant the variation to the licence with modified conditions; or c) reject the whole or part of the application.

Annex 1 – Mandatory Conditions

a) at a time when there is no designated premises supervisor in respect of the premises licence, or

b) at a time when the designated premsies supervisor does not hold a personal licence or his personal licence is suspended

Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personnal licence.

Door supervisors will be correctly registered with the SIA.

The admission of children to the exhibition of any film must be restricted in accordance with the film classification.

1.—(1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children–

(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to–

(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

(ii) drink as much alcohol as possible (whether within a time limit or otherwise);

(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any

Page3 7 promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on–

(i) the outcome of a race, competition or other event or process, or

(ii) the likelihood of anything occurring or not occurring;

(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

4.—(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

5. The responsible person shall ensure that–

Page4 8 (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures–

(i) beer or cider: ½ pint; (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and (iii) still wine in a glass: 125 ml; and

(b) customers are made aware of the availability of these measures.

Mandatory Licensing Condition from 28th May 2014

1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

2. For the purposes of the condition set out in paragraph 1 (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(a); (b) “permitted price” is the price found by applying the formula — P = D + (DxV ) where — (i) P is the permitted price (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence — (i) the holder of the premises licence, (ii) the designated premises supervisor (if any) in respect of such a licence, or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence; (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a

Page5 9 capacity which enables the member or officer to prevent the supply in question; and (e) “valued added tax” means value added tax charged in accordance with the Value Added

3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

4. (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day. is present and able to prevent a supply of alcohol (in relation to premises in respect of which there is a club premises certificate). Paragraph 3 provides that the permitted price is rounded up to the nearest penny. Paragraph 4 provides that a change to the permitted price which would apply as a result of a change to the rate of duty or VAT charged in relation to alcohol would not apply until the expiry of the period of 14 days beginning on the day on which the change in the rate of duty or VAT takes effect.

15 Management controls and training will be in place to prevent the sale of products to underage purchasers or the sale to others who then supply to those underage.

16 A proof of age policy (such as Validate) agreed by the Police and Local Authority will be enforced.

17 An age restricted sales policy is to be agreed with the Police and Trading Standards, which could include a refusal book, staff training and a recognised proof of age scheme.

18 Security Industry Association staff and stewards to be on duty for the period in which the festival is open to the public, at a ratio previously agreed with the Police and local authority.

19 No Steward/Attendant shall be permitted to consume intoxicating liquor or other intoxicants during any period of duty at the Premises and shall report on duty in a sober condition.

20 No Steward/Attendant shall be engaged in any duty that would otherwise prevent him carrying out his duty as a Steward/Attendant or exercising general supervision and control of persons attending the premises.

21 A condition of entrance will be that SIA door staff may search and exclude those for:

Page8 12 i) the possession of controlled substances under the Misuse of Drugs Act 1971 and ii) possession of prohibited or offensive weapons as defined in the Criminal Justice Act and Prevention of Crime Act. iii) Searches may take place on all entrances to the and during the festival. Stewards will maintain search records and any drugs or weapons that are seized will be recorded and retained and notified to the Police.

Green Man has applied for a 5,000 increase in overall capacity, 3,000 of which is for an increase in the capacity of the Settlement.

We do not plan to increase the capacity to 24,999 in one year, (we currently plan to sell 300 extra tickets in 2018). The costs involved with applying to increase the license means we don’t want to apply each year for a change in numbers, the last change in capacity was in 2010. We have a track record of producing a well-run event that takes impact on the local community very seriously. We hope that our history, will reassure people that we will manage the increase in capacity professionally and gradually, whilst taking into account the effect it will have locally.

The Settlement

60% of the proposed increase is for the Settlement which runs from the Monday to Wednesday before the festival. Green Man started running the Settlement as a tourist activation for the local area. We promote local businesses and tourist attractions on our website, in our programme and through our pre-event marketing (our online PR reach is over 1billion), and we actively encourage guests to leave the festival and explore the local area.

By increasing the capacity of the festival (and the Settlement in particular), we will increase the economic impact in the immediate surrounding areas. Since the festival has been at Glanusk in 2006, the direct economic impact to the Welsh economy has been approximately £28million. By increasing the capacity of the Settlement and encouraging hyper-local tourism we will increase the economic benefits in the communities most affected by the festival.

Traffic

• 60% of the increase in capacity is for the Settlement. This is designed to spread the arrivals over 3 days, we predict that the increase in the Settlement audience will not have a major impact on traffic during the 3 days it is running. • The majority of extra vehicles arriving for the festival, will be directed to the Park and Ride at Cwrt y Gollen. It has capacity for the increased numbers, it is flat and there is a good amount of hard-standing, meaning it should not be significantly affected by adverse weather. It was used successfully by the National Eisteddfod with higher numbers than we are proposing. • Glanusk are building a new hard standing road through Orange Car Park which will speed up ingress and egress. • 3 new passing points on the B4558, will speed up ingress and egress and make the road more suitable for 2-way traffic and larger vehicles. • There is a new route into Orange Car Park, cars will enter through the Orange Car Park Gate (EE), be directed through the first parking field, then turn left and be directed into the second car park field through the Southern gate. This will ensure there is more space for traffic to queue, and public exiting their cars do not cross traffic coming in, which slowed cars previously. • The police will cone the verges on the A40 to prevent people parking. • On Monday the after the festival: o The bridge in Llangynidr will be staffed on Monday morning to prevent any traffic turning onto it. o The turnoff from the B4558 to the B4560 will be staffed to direct traffic towards Beaufort.

Page 15 o The traffic lights in Crickhowell will be operated by a member of our traffic team to regulate the flow of traffic. o The police have advised us they will position mobile units near Llangynidr and in the vicinity of the A40, to monitor traffic and assist if necessary. Sergeant Owen Dillon will be based at the festival on Monday morning, so he can easily communicate with his team and the festival. o There will be a police presence at the junction of the A4077 / B4558 / Crickhowell Bridge to prevent any large festival vehicles driving up the road. o The Dardy turnoff on the B4558 will also be staffed to manage the flow of traffic. o All Green Man suppliers are contracted not to turn up before 4pm on Monday. However, if any do, we will use Cwrt y Gollen as a holding point for any large vehicle that may turn up. (We currently do this with National Express Coaches to regulate the amount of coaches on site at a time.) • Alternative transport: o We have more than doubled the amount of National Express coach routes coming to the festival this year. This is on top of a 40% increase in use last year. o We offer free shuttle busses from Abergavenny Station, although Arriva trains cannot increase the service to Abergavenny. o We have partnered with https://gocarshare.com/ to promote car sharing for the festival. o We offer free secure storage for bikes and free parking for motorcycles.

Noise

We have worked with the same external sound consultants since 2011. We have designed the PAs to reduce sound bleed off site, and we have robust off-site monitoring systems in place. If there is an issue we can identify the stage and rectify the problem swiftly. Any future changes to site layout and/or staging will be designed to minimise external noise. We don’t believe the increase in capacity will have an effect on off-site noise.

Crime, Public Nuisance, Protection of Children

These are covered in our Event Management Plan.

In Summary

We believe the biggest potential impact is an increase in traffic. We believe the steps we have outlined above will mitigate this increase.

Green Man has been at Glanusk Estate for 13 years, we want to be here a lot longer. We know from experience that the best way to manage an increase in numbers is to do it gradually and to ensure that the changes work. We have enough space for parking, there is extra space available at Glanusk for camping and we currently have enough room for entertainment. As in previous years, all changes to the site plan and event management plan will be submitted to the relevant authorities at least 3 months in advance.

Page 16 NEW LICENCE GREENMAN FESTIVAL Application by the Green Man Festival applying for a Licence to increase attendance numbers from 14,999 to 19,999 to include artists and other attenders as well as festival goers.

The panel hearing for the Licence is set for 11 June 2018 in Brecon. The impact statement is which was attached to the application is very positive. It suggests an increase of 300 this year but asks for consideration that the increase be managed over several years thereafter.

I do not agree with this report that the biggest impact is traffic. It is a major issue but has been well managed over time with new learning each year. There are other areas of concern which are outlined below.

There is no statutory requirement to consult with local people or the town or community council in the case of this Licence. There is a statutory notice in Glanusk Estate (agreed by the officer that it is difficult for the local community to access) and advertised in the local press.

I understand there are specific areas that can be objected too. Having met with the Licencing Officer and the Fire Officer for the Welsh Fire Brigade I do feel that representation should be made on behalf of Llangattock.

The festival organisers have been in touch with Cllr Rosemarie Harris in Llangynidr but did not think to contact me. It was the Licencing Officer who decided to contact me. Cllr John Morris has not been contacted either. I have made Llangattock Community Council aware of this application.

My view is that there is a case to ask for representation on several grounds which can be considered. These are:-

1. Nuisance 2. Health & Safety 3. Protection of Children and accessibility

On point 1, the consideration should be for those who live higher up, on the Ffywddog and above Crickhowell. The reason being that sound travels up and an increase in numbers just on the basis of an increase of enjoyment and the sounds associated with around 19,000 people will have an impact. There will be an increase of 20% in the numbers so it could be argued a 20% increase in noise levels from people. The Green Man Festival is fantastic for this area and the location is probably one of the best in Europe let alone Wales. The amphitheatre of sound is wonderful for festival goers. For those people who live here increase in the level of sound will have an impact possibly as high as 20%. The report suggests sound can be mitigated from the stage but this will not be the case beyond the stage area.

On point 2, we are already very aware of the impact of these numbers on such a small community. We have accepted, celebrated and welcomed this festival over the period it has been here. The 20% increase will have a major impact on the capacity of services to protect although I understand there is no objection from the police and health care professionals including Welsh Ambulance Service as I understand there are adequate services on site. However, there are concerns about fire cover which

Page 17 needs to be overcome. The Fire Service are looking at this issue after discussions this afternoon. The main issue is the space provided for campervans and tents and whether this has been increased to an adequate level. It will be important to assess the space available and whether the festival plan has provided adequate spacing between tents and campervans on site. It is important that the Fire Service is satisfied about this aspect of safety. The other consideration is movement from site to town for those staying on site and for others moving across and around the site. Last year we were all shocked by the death of a young man at the Royal Welsh. This site runs alongside the Usk. No accidents have occurred to date but we are looking at an extra 5000 people attending over the next couple of years. It is important to be satisfied potential risks can be mitigated. The application suggests a steady increase over time but we have no way of knowing the management of this as once approved then numbers are liable to increase without notification to the community.

On point 3, this is not a concern on the basis of children needing protection but on the basis that this is such a successful family event there are a high proportion of children attending. The concern is a follow on from the above point in respect of safety. It will of course be for family and carers to protect their children but as a community we also need to consider how the breakdown of that protection could filter out of the site into our community. I would ask that the services such as the police have considered safeguarding and are able to provide support if necessary. Additionally, have the festival organisers provided for increased disabled access and accessibility across the site.

It is not my intention to suggest there should be no increase in numbers, just that this increase from 14,999 to 19,999 is not acceptable without giving due respect to the community that surrounds the site.

I feel I have to make representation as the County Councillor for Llangattock. I am drawing your attention to this application and my initial concerns.
