Boys Basketball Tournament (February 26-28, 2021)

Waiver, Release, Indemnification and Hold-Harmless Agreement

The Hopkins Royals Boys Basketball Association (“HRBBA”) has agreed to organize and sponsor, and the undersigned Coach (“Coach”) has agreed to have his team participate in, the Royal Rumble Boys Basketball Tournament (hereinafter the “Rumble”). As such, the HRBBA and the undersigned Coach agree as follows:

Section 1. In consideration for each player, spectator and coach being permitted to participate in the Royal Rumble Boys Basketball Tournament (hereinafter the “Rumble”), each coach, each spectator, and each player (and their respective legal guardian) attending the Royal Rumble for the team of the undersigned Coach shall agree to:

• acknowledge that participation in the Rumble is voluntary and that a refusal to agree to any of the following terms in this Section 1 will disqualify the associated player or coach from participating in the Rumble or the spectator from attending the Rumble; • recognize and acknowledge that all athletic activities, including the Rumble, involving strenuous exertion or potential body contact are hazardous recreational activities and involve substantial risk of injury or illness (including, without limitation COVID-19), including health consequences resulting from wearing a mask while playing; • waive and relinquish any and all claims of whatever nature that any player or guardian or coach may have against the HRBBA or any of its partners, sponsors, directors, members, managers, employees, coaches, players, volunteers, independent contractors or the Hopkins Public Schools (collectively, the “Released Parties”) as a result of participating in the Rumble, even if such claims arise out of negligence of the Released Parties; • fully release and discharge the Released Parties from any and all claims for injuries, illness (including, without limitation COVID-19), including health consequences resulting from wearing a mask while playing, damage or loss which the coach, spectator, or player, or any of their respective parents, legal guardians, spouses, heirs, executors, administrators or assigns may have or which may accrue to any of the foregoing as a result of attending or participating in the Rumble; and • indemnify, hold harmless and defend the Released Parties from any and all claims resulting from the injuries, illness (including, without limitation COVID-19),including health consequences resulting from wearing a mask while playing, damages and losses sustained by themselves or by a player for which they are a guardian.

For the purposes of this agreement, the term “coach” includes any adult participant in the Rumble that is associated with the team for the undersigned Coach.

Each of coach, spectator, player and guardian further understand and agree that the terms of this waiver, release and discharge extend event to situations where there is a failure to provide proper instructions, supervision, use of or adjustment of any and all equipment, personal protective equipment or apparatus, and anything related to the use of the facilities utilized by the Rumble.

Section 2. The Coach signing below further attests and warrants that the Coach has: • provided a copy of at least Section 1 of this Waiver, Release and Hold-Harmless Agreement to each of the player’s guardians; • informed each player’s guardian that a failure to agree to the terms of Section 1 will disqualify the player from participating in the Rumble; and • received a consent from a guardian for each player indicating that they agree to the terms of Section 1.

Section 3. The Undersigned Coach agrees to prevent any player that has not had a guardian consent to the terms of Section 1 from participating in the Rumble as a member of the Coach’s team.

Section 4. The Coach signing below additionally agrees to indemnify and defend the Released Parties from any and all claims resulting from the Coach’s failure to comply with the requirements set forth in Section 2 or Section 3, or that otherwise includes an allegation that any spectator, player, guardian, or other coach of their team failed to agree to the terms of Section 1.
