Main Results of the Council

The Council agreed on the integration into the EU legal framework of the parts of the Prüm Treaty relating to police and judicial cooperation in criminal matters (Title VI of the EU Treaty, the so- called " third pillar"), with the exception of the provision relating to cross-border police intervention in the event of imminent danger (Article 18). This last particular issue will be further examined by the Council at one of its forthcoming sessions.

The Council also agreed on a general approach concerning a draft Framework Decision on the application of the principle of mutual recognition to judgments in criminal matters imposing custodial sentences or measures involving deprivation of liberty for the purpose of their enforcement in the EU. This instrument will allow the transfer of sentenced persons to another Member State for the purpose of enforcement of the sentence imposed, taking into account the possibility of social rehabilitation of the sentenced person.

Finally the Council adopted a Regulation establishing the EU Agency for Fundamental Rights. This Agency will provide the relevant institutions and Member States with assistance and expertise relating to fundamental rights in order to support them when they take measures or formulate courses of action to fully respect fundamental rights.

INTEGRATION OF THE TREATY OF PRÜM INTO THE EU LEGAL ORDER

TheCouncilagreedontheintegrationintotheEUlegalframeworkofthepartsofthePrümTreaty relatingtopoliceandjudicialcooperationincriminalmatters(thesocalledthirdpillar),withthe exceptionoftheprovisionrelatingtocrossborderpoliceinterventionintheeventofimminent danger(Article48).ThisparticularissuewillbefurtherexaminedbytheCouncil.

ThePrümTreaty

Signedon27May2005atPrüm,Germany,theTreatyisdesignedtointensifycrossborderpolice cooperation,especiallyinthefightagainstterrorism,crossbordercrimeandillegalmigration1.

TheTreatyhasmeanwhileenteredintoforceinAustria,SpainandGermanyandisexpectedtobe inforceintheotheroriginalsignatorystatesinthefirsthalfof2007atthelatest.Theratification processesinthecountriesintendingtoaccedetotheTreatyarealsowelladvanced.

Alreadyatthisearlystage,theautomaticinformationexchangehasbroughtaboutnoticeable operationalsuccess:Forinstance,theGermanauthoritiesmatchedDNAprofilesofopencases againstdataheldbyAustrianauthoritiesandfoundhitsinmorethen1500cases.Inthiscontext, over700opentracesfromGermanycouldbeattributedtopersonsknowntotheAustriancriminal prosecutionauthorities.Brokendownbytypesofcrime,14hitsinhomicideormurdercases,885 hitsintheftcases,and85hitsinrobberyorextortioncaseshavebeenfound(asat4January).Itis truethateveryhitneedstobeexaminedcarefully,anditwillnotbepossibletoclearupopencases byaDNAhitalone.NeverthelessitcanbeexpectedthathithertounsolvedcasesinGermanyand Austriacanbeclosedandtheperpetratorsbebroughttojustice.Inanycase,prosecutionauthorities areconfidentthatthenumberofhitswillincreaseconstantlyasfurtherPrümcountriestakepartin thisprocess,andthattheywillthusbeabletosolvenumerousotheropencases.

ThespecialvalueoftheTreatyliesinthesubstantiallyimprovedandefficientlyorganised proceduresfortheexchangeofinformation.Thestatesinvolvedmaynowgiveoneanother automaticaccesstospecificnationaldatabases.Thisamountstoaquantumleapinthecrossborder sharingofinformation.

Thecontractingstateshavefullanddirectonlinereadaccesstovehicleregistrationdataheldby theirpartners.TheygiveoneanotheraccesstotheirDNAanalysisanddactyloscopic(fingerprint) databasesinwhatiscalledahit/nohitsystem.Policeservicesmaylaunchaqueryinthedata systemofacontractingpartnertofindoutwhetheritcontainsdataconcerningaspecificprofile, andareautomaticallyinformedoftheresultwithinamatterofminutes.Furtherinformation,such aspersonaldata,maybecommunicatedinthecourseofmutuallegalassistance.

Furthermore,theexchangeofdataconcerningpotentialterroristperpetratorsandhooligansis regulated.Policecooperationmayalsobesteppedupthroughoperationalmeasures,suchasjoint patrols,transferringsovereignpowerstopoliceforcesofothercontractingstates,orassistancein thecaseoflargescaleevents.

TheTreatycontainscooperationmechanismsthatneedtoberegulatedatEUlevelintheFirst Pillar.Thisincludesprovisionsregardingdocumentadvisers,skymarshalsandreturnmeasures.

AnimportantaspectoftheTreatyisthecomprehensiverangeofmoderndataprotection regulations.

AsthedraftersofthePrümTreatysoughttofurtherdevelopEuropeancooperation,theTreatyhas beendesignedwithitsconversionintoEUlawinmind.

Thesignatorystatesare:Germany,Belgium,Spain,France,Luxembourg,TheNetherlands,and Austria.

ThosestateshavingnotifiedtheirwishtoaccedetothePrümTreatyare:Slovenia,Italy,Finland, Portugal,Bulgaria,Romania,GreeceandSweden.

MIGRATION

TheCouncilhadanexchangeofviewsontheimplementationoftheEuropeanCouncilconclusions of14and15December2006relatingtoaComprehensiveEuropeanMigrationPolicy.

Inparticular,theCounciltookforwardthediscussiononmigrationwhichwasstartedatthe informalMinisterialmeetinginDresdeninJanuary2007:strengtheningcooperationwiththird countriesinthefightagainstillegalmigrationthroughthedevelopmentofincentivestocooperate, partnershipagreementsonmigrationanddevelopment,promotingcircularmigrationbyallowing temporarystaysforthepurposeofworkorfurthertrainingandeducation.

ThediscussionfocussedonaPresidencynotewhichputforwardthefollowingideas:

– countriesoforiginandtransitshouldbegivenpracticalsupportforcapacitybuilding withintheframeworkofregionspecificcooperationplatformsformigrationand development;

– theappropriatecooperationplatformsshouldbedesignedonthebasisofuniform principles(e.g.regularmeetings,ongoingdialogueandexchangeofinformation, monitoringandaccompanyingevaluation);

– inestablishingcountryspecificmigrationprofiles,particularaccountshouldbetakenof:

– causesofmigration,

– owncapacityofcountriesoforigintoregulatemigrationand

– obstaclesinthecountriesoforiginwhichstandinthewayofeconomicdevelopment andexploitationofthepotentialwhichexistsinthosecountries.

Thenotealsosuggestedthat,inconcludingpartnershipagreementsonmigrationanddevelopment, thefollowingelementsmightbeconsidered:

– creationoftemporaryresidencepermitsforwork,educationalorfurthertrainingpurposes accordingtoMemberStates'possibilities;

– grantingofoptionalquotasforcertainsectorsofthelabourmarketoreducationbythe MemberStates;

– obligationonpartnercountriestorecogniseprinciplesofdemocracyandtheruleoflawas wellasprotectionofhumanrights;

– reliablereadmissionofownnationalsandthirdcountrynationalsbythepartnercountries;

– EUmeasurestopromotereintegrationofmigrantswhohavereturnedtothepartner country,andtoexploittheknowledgeandknowhowacquired;

– obligationtocreateframeworkconditionsinthecountriesoforiginwhichmakeitpossible tousethedevelopmentpolicyandeconomicpotentialofmigrationinthosecountries.

ThenoteadvertedtotheneedforreliableguaranteesinrelationtonationalcompetenceofMember Statesfortheirlabourmarkets.

ItshouldbenotedthatinDecember2006,theEuropeanCouncilinvitedtheCommissionto examinebyJune2007howpossibilitiesforlegalmigrationmightbeincorporatedintotheEU’s policyinthefieldofexternalrelations,inordertoarriveatabalancedpartnershipwiththird countries.Atthesametime,theCommissionwasalsoinvitedtopresentdetailedproposalsbyJune 2007tobetterorganiselegalmigrationbetweentheEUandthirdcountriesandprovideinformation aboutthevariousformsoflegalmigration.

ThediscussionheldtodaybytheCouncilwillhelptheCommissiontodrafttheseproposals. CommissionVicePresidentFrancoFrattiniagreedtobrieftheCouncilonthestateofplayofits workontheseissuesatthenextJusticeandHomeAffairsCouncilmeetinginApril2007.

TRANSFER OF SENTENCED PERSONS TO ANOTHER MEMBER STATE

TheCouncilagreedonageneralapproachconcerningadraftFrameworkDecisiononthe applicationoftheprincipleofmutualrecognitiontojudgmentsincriminalmattersimposing custodialsentencesormeasuresinvolvingdeprivationoflibertyforthepurposeoftheir enforcementintheEU.

Theagreementreachedtodayonthisinstrumentwillallowthetransferofsentencedpersonsto anotherMemberStateforthepurposeofenforcementofthesentenceimposed,takingintoaccount thepossibilityofsocialrehabilitationofthesentencedperson.

TheCouncilrecognisedthatPolandneededmoretimethantheotherMemberStatestofacethe practicalandmaterialconsequencesoftransferofPolishcitizensconvictedinotherMemberStates, especiallyinthelightofanincreasedmobilityofPolishcitizenswithintheEuropeanUnion.For thatreason,Polandwasgrantedatemporaryderogationoflimitedscopeforamaximumperiodof fiveyears.

AllMemberStateshaveratifiedtheCouncilofEuropeConventionontheTransferofSentenced Personsof21March1983.UnderthatConvention,sentencedpersonsmaybetransferredtoserve theremainderoftheirsentenceonlytotheirStateofnationality,andonlywiththeirconsentand thatoftheStatesinvolved.TheAdditionalProtocoltotheConventionof18December1997,which allowstransferwithouttheperson'sconsent,subjecttocertainconditions,hasnotbeenratifiedby alltheMemberStates.Neitherinstrumentimposesanybasicdutytotakechargeofsentenced personsforenforcementofasentenceororder.

RelationsbetweentheMemberStates,whicharecharacterisedbyspecialmutualconfidencein otherMemberStates'legalsystems,enablerecognitionbytheexecutingStateofdecisionstakenby theissuingState'sauthorities.Therefore,thislegalinstrumentenvisagesfurtherdevelopmentofthe cooperationprovidedforintheCouncilofEuropeinstrumentsconcerningtheenforcementof criminaljudgments,inparticularwhereEUnationalsorotherpersonslegallyresidinginone MemberStatehavebeenthesubjectofacriminaljudgmentandhavebeensentencedtoacustodial sentenceorameasureinvolvingdeprivationoflibertyinanotherMemberState.

EnforcementofthesentenceintheexecutingMemberStateenhancesthepossibilityofsocial rehabilitationofthesentencedperson,givinghimorhertheopportunitytomaintainfamily, linguistic,culturalandotherlinks.

ThisdraftFrameworkDecisionrespectsfundamentalrightsandobservestheprinciplesrecognised byArticle6oftheTreatyandreflectedbytheCharterofFundamentalRightsofthe EuropeanUnion,inparticularChapterVIthereof.NothinginthisFrameworkDecisionshouldbe interpretedasprohibitingrefusaltoexecuteadecisionwhenthereareobjectivereasonstobelieve thatthesentencewasimposedforthepurposeofpunishingapersononthegroundsofhisorher sex,race,religion,ethnicorigin,nationality,language,politicalopinionsorsexualorientation,or thatthatperson'spositionmaybeprejudicedonanyoneofthosegrounds.

COMBATING RACISM AND XENOPHOBIA

Overlunch,MinistersofJusticeheldageneraldiscussionofadraftCouncilFrameworkDecision oncombatingracismandxenophobia.Thisproposal,whichwaspresentedin2001,hasnotobtained theagreementoftheCouncilsofar.

ThePresidencyisoftheopinionthatMemberStatesarenowcommittedtoreachinganagreement. ThereforethePresidencywillprepareanewtextonthebasisofthediscussionheldtoday.

MIXED COMMITTEE

– SISone4all

TheMixedCommitteetooknoteofthestateofplayoftheSISone4allproject.Portugalindicated thatthisproject,whichwillallow,interalia,removalofthecontrolattheinternalborderswiththe MemberStateswhichaccededin2004,isgoingwellandisonschedule.

– Global rescheduling of the Schengen Information System II

ItalsotooknoteoftheCommission'srevisedtimetableforSISII.CommissionVicePresident FrancoFrattiniannouncedthatSISIIisexpectedtobedelayedbysixmonths,andthereforeit wouldbeoperationalinmidDecember2008.

– Network for SIS, SIRENE and Vision (SIS-NET and S-Testa)

TheMixedCommitteealsotooknoteofthereportofthePresidencyconcerningthenetworkfor SIS,SIRENEandVision,thatwasapprovedlaterinthedaybytheCouncil.

– FRONTEX

TheMixedCommitteereviewedprogressinrelationwiththeproposedRegulationestablishing RapidBorderInterventionTeams.ThePresidencyurgeddelegationstoworktowardsearly agreementontheproposalwithaviewtoreachinganagreementwiththeEuropeanParliament underthecodecisionprocedureinApril2007

UndertheproposedRegulation,MemberStatesmayrequestFrontextoestablisharapidborder interventionteam.TheteamconsistingofborderguardsoftheMemberStateswhocanprovide rapidoperationalassistance,foralimitedperiodoftime,wherearequestingMemberStateisfacing asituationofurgentandexceptionalpressure.TheRegulationwillestablishamechanismforthis purposeandwilldefinethepowersofandtaskstobeperformedbyborderguardsoftheMember Statesparticipatinginjointoperationsandpilotprojects.

TheMixedCommitteealsoreviewedprogresswiththeestablishmentbyFrontexofacentralised registeroftechnicalequipment(thesocalled"toolbox")offeredbyMemberStatesandwhichcould beputatthedisposalofanotherMemberStateandwelcomedtheprogressalreadymadeinthis regard.MemberStateswhichhadyettodosowereencouragedtoactivelycontributetothe toolbox.

– Moldova

CommissionVicePresident,FrancoFrattinidrewattentiontoanumberofdevelopmentsin MoldovaarisingfromthemostrecentenlargementoftheCommunity,includingitsimpactonthe numberofMoldaviansapplyingforRomanianpassportsandproposalsfortheestablishmentofa commonvisacentre.

TheCouncilmandateditspreparatorybodiestofurtherexaminethisquestion.

– Environmental protection through criminal law

CommissionVicePresidentFrancoFrattiniinformedtheCouncilabouttherecentCommission proposalforaDirectivewhichwouldobligeMemberStatestotreatseriousoffencesagainstthe environmentascriminalactsandwouldensurethattheyareeffectivelysanctioned.Theproposal alsosetsminimumsanctionsforenvironmentalcrimesacrosstheMemberStates. InSeptember2005,theEuropeanCourtofJusticeconfirmedthattheCommunityhadthe competencetoobligeMemberStatestoadoptcriminallawmeasuresfortheprotectionofthe environmentifnecessarytoensuretheefficientimplementationofitsenvironmentalpolicy.Forthis reasonitannulledtheFrameworkDecisiononenvironmentalcrimeadoptedin2003bytheCouncil onthebasisofaMemberStateinitiativebasedontheprovisionsforjudicialcooperationincriminal matterscontainedintheEUTreaty(TitleVI,socalled3rdpillar).Theproposalpresentedtodayby theCommissionthereforeisdesignedtoreplaceboththeCouncil'sFrameworkDecisionof2003 andaproposalforadirectivealreadypresentedbytheCommissionin2001,whichtheCouncil rejectedwhenadoptingthe2003FrameworkDecision.

MemberStateswouldberequiredtoensurethatarangeofactivities(e.g.illegalshipmentofwaste andunlawfultradeinendangeredspeciesorinozonedepletingsubstances)alreadyprohibitedby EUornationallegislationareconsideredcriminaloffences,whencommittedintentionallyorwith seriousnegligence.Memberstateswouldhavetoensurethatparticularlyseriousenvironmental crimesarepunishablebyamaximumofatleast5yearsimprisonmentandfinesforcompaniesofat least€750000.Thesecaseswouldincludecrimesthathaveresultedindeathorseriousinjuryofa personorsubstantialdamagetoair,soil,water,animalsorplants,orwhentheoffencehasbeen committedbyacriminalorganisation.Inaddition,theproposeddirectiveprovidesfor supplementaryoralternativesanctions,suchastheobligationtocleanup/reinstatetheenvironment orthepossibilityofstoppingbusinessesfromoperating.

Theproposedmeasureswillensurethatcriminalscannotexploitthesignificantdifferenceswhich currentlyexistbetweentheMemberStates.Loopholesintheactionagainstenvironmentalcrime shouldthereforenolongerexistwithintheEuropeanUnion.

EU Agency for Fundamental Rights

TheCounciladoptedaRegulationestablishingtheEUAgencyforFundamentalRights (16241/06).

TheobjectiveoftheAgencywillbetoprovidetherelevantinstitutions,bodies,officesandagencies oftheCommunityanditsMemberStatesimplementingCommunitylawwithassistanceand expertiserelatingtofundamentalrightsinordertosupportthemwhentheytakemeasuresor formulatecoursesofactionwithintheirrespectivespheresofcompetencetofullyrespect fundamentalrights.

TheAgencywillcollectobjective,reliableandcomparableinformationonthedevelopmentofthe situationoffundamentalrights,analysethisinformationintermsofthecauses,consequencesand effectsoffailuretorespecttheserights,andexamineexamplesofgoodpracticeindealingwith thesematters.

TheAgencywillhavetherighttoformulateopinionstotheUnioninstitutionsandtotheMember StateswhenimplementingCommunitylaw,eitheronitsowninitiativeorattherequestofthe EuropeanParliament,theCouncilortheCommission,withoutinterferencewiththelegislativeand judicialproceduresestablishedintheTreaty.Nevertheless,theinstitutionsshouldbeabletorequest opinionsontheirlegislativeproposalsorpositionsadoptedinthecourseoflegislativeproceduresas farastheircompatibilitywithfundamentalrightsisconcerned.

Inaddition,itwillpresentanannualreportonfundamentalrightsissuescoveredbytheareasofthe Agency'sactivity,alsohighlightingexamplesofgoodpractice.Furthermore,theAgencywill producethematicreportsontopicsofparticularimportancetotheUnion'spolicies.

TheAgencywilltakemeasurestoraisetheawarenessofthegeneralpublicabouttheirfundamental rights,andaboutpossibilitiesanddifferentmechanismsforenforcingthemingeneral,without, however,dealingwithindividualcomplaintsitself.

TheRegulationrepealsRegulation(EC)No1035/97witheffectfrom1March2007.TheAgency willbecomeoperationalby1March2007.

InDecember2003,theEuropeanCouncilagreedtoextendthemandateoftheEuropeanMonitoring CentreonRacismandXenophobia,establishedbyRegulation(EC)No1035/97,andtransformthis CentreintotheEUAgencyforFundamentalRights.TheseatoftheAgencywillremaininVienna (Austria).
