282. HIPS BID — ROUSING INVESTMENT PROGRAMME AND STRATEGY (Minute 707/85)

The Secretary to the Council reported on the receipt of the documentation for the submission of the Council's HIPS Bid to the Department of the Environment. The Committee confirmed that as a matter of principle the Coinci1's Bid for HIPS funding 1987/88 should' be prepared on the b&sis of maintaining the current levels of spending and that the Health & Housing Services Committee should consider how best to achieve the early commencement of two new build schemes in that year.

RECOMMENDED That the Bid be prepared on the basis of the Council's housing strategy and that a report be made to the Health & Housing Services Committee on the early programming of the two new schemes. (881) (SEc)

283. LOCAL GOVERNMENT (ACCESS TO INFORMATION) ACT 1985 — DOE CIRCULAR 6/86: DISABLED PERSONS (Minute 198(a)/86)

The Secretary to the Council reported that in consequence of the need for authorities to wake provision for the same rights of access to eetIngs and information to be available to disabled persons, advice had been obtained from the Disabled Living Foundation and the British Deaf Association.

Members noted that certain work had already been carried out to improve access for disabled persons to all of the Council premises4 and that difficulties should not be experienced by such groups in obtaining access to information. The Committee considered it desirable for advance notification to be received of any disabled person wishing to attend a Meeting at the Civic Suite so that, within the time constraints otherwise imposed by the Act, any available additional or alternative facilities required might be provided, noting that this was in line with the advice provided by the British Deaf Association.

RECOMMENDED (1) That the advice from the associations concerned reprnting the disabled be noted.

(2) That publicity be given to the need for disabled persons wishing to attend Meetings at the Civic Suite to make known their requirements in advance in order that the necessary administrative arrangements may be made. (30580) (SEC).

284. CHARTER FOR A DEMOCRATIC HEALTH SERVICE (Minute 135/86)

The Committee noted the existing representatives who had been appointed f or tour years to run until 31st December 1989 and that replaceunt representatives could only be appointed if existing representatives agreed to stand down.

287. COUNCIL DEPOT, SOUTH STREET, ROCHFORD — DISPOSAL OF LAND AND PROVISION OF INDUSTRIAL UNITS (Minute 142/86)

The Committee noted that as a consequence of the negotiations for the sale of land at the Depot it had been necessary to relocate the MSC demountable building from the rear of 57 South Street onto the adjoining ear park, for which a temporary planning permission was required. The Chief Executive had exercised his authority under Standing Order 18 to pass the tirst resolution in the deemed consent procedure so that an application could be lodged. (831) (DD)

288. SEETEC — SITING OF PORTAKABIN EXTENSION

The Director of Development reported that the Board of SEETEC had approvd plans for the provision of a Portakabin extension to the SEETEC building in Main Road. Ilockley which needed' to be provided as a matter ot urgency. Planning permission was required for the extension and the Chief Executive had exercised his authority under Standing Order 18 to pass the first resolution in the deemed consent procedure so that an application could be lodged. 289. CIVIC SUITE. RAYLEIGH (Minute 569/85)

The Assistant Chief Executive reported that following completion of the permanent exhibition of paintings by Mr Frank Todman in the Council Chamber foyer, it was felt that the corridor area leading to the exhibition could be converted into an attractive and useful sitting and refreshment area, to be used in conjunction with the letting of Civic Suite rooms and to house the proposed permanent Thinning exhibition.

RECOMMENDED That the Assistant Chief Executive investigate further the conversion of the corridor area for a refreshment/exhibition area. (27620) (ACE)

290. ROCEFORD - THE PUBLIC IMAGE

The Committee had before them a new information pack which had been prepared in connection with the appended report of the Assistant Chief Executive on updating the official guide and Street plan publications, and were enthusiastic about the for-mat which had been selected, which would enable individual sheets to be updated as and when required without necessitating a complete reprint. Members discussed various methods by which the proposed publication might be enhanced and suggested that tourist information' centres and local railway stations be included within the distribution arrangements. Members were invited to advise the Assistant Chief Executive direct of any suggestions for improving the document which had been prepared. (922) (ACE)

292. USE OF STRUCTURAL ENGINEERING CONSULTANTS ON BUILDING REGULATION APPLICATIONS (Minute 368/85)

The Director of Development reported that it was proposed to renew on similar terms the arrangements for using the services of the existing three Consultant Structural Engineers and to add a fourth who could offer a similarly efficient and cost effective service. The Secretary to the Council reported that this application had been considered by the Planning Services Committee.

RECOMMENDED That for the purposes of Regulation 5 of the Town and Country Planning7eneral) Regulations 1976, the siting of a Miniature Railway on Rochford Reservoir be carried out subject to the conditions in paragraph 3.13 of the Supplementary Schedule of Development Applications considered by the Planning Services Committee on 22nd May 1986. 294. LAND AT HAMBRO HILL, RAYLEIGH (Minute 495/85 & 253/86)

Arising out of the decision of the Planning Services Committee on 22nd May regarding the representations to be made to the County Council on the current application for sand extraction at Hambro Hill, the Committee considered the appended report of the Chief Executive on the effect on the Council's existing policy for the long—term resolution of the various problems in that area.

The Committee agreed that the Planning Services Committee should be asked to reconsider the consultation on the application and related aspects as a matter of urgency at a Special Meeting on the 11th June, and suggested that an Extraordinary Meeting of the Council be called for 5th June 1986 to give effect to this procedure. 1 RECOMMENDED (1) That the Planning Services Committee be asked to reconsider the consultation on the Hambro Hill sand extraction planning application ROC/O65/86 (Minute 253/86) and the proposals for the whole of the Hambro Hill area.

(2) That a Special Meeting of the Planning Services Committee be held on Wednesday, 11th June 1986 at 7.30 p.m. for that purpose at which a full presentation be made by the Officers of all the factors involved in the Council's policy for the area. (Minute 495/85) (9806) (SEC,DD)

296. CLEANING OF ELDERLY PERSONS SCHEMES AND COMMON PARTS TO COUNCIL ESTATES

(Note: Prior to discussion of this item Councillor J.A. Sheaf declared a pEiihiary interest and left the Meeting).

The Committee considered the report of the Director of Health & Housing that of eleven companies invited to tender for the above contract five had submitted quotations, the lowest being that of RCS Cleaning Services Limited. The first had subsequently been invited to tender for the new extension to Britton Court to be included within the contract and for ad hoc cleaning to common parts of Council estates as required, and the prices received were in line with the original tender.

Members noted that the report was being submitted to them in accordance with Financial Standing Orders, the purpose of which was reiterated für the benefit of new Members.

RECOMMENDED That Contract No. 1128 be extended to include the cleaning of Eritton Court extension and such ad hoc cleaning to common parts of Council estates as may arise from time to time. (CON112B) (SEC.DHH)

The Panel noted with pleasure that the Chief Executive had recently presented a paper on the above subject to a Management Course for Chief and Deputy Chief Officers which placed particular emphasis on the appraisal system. Considerable interest had been stimulated therein and he had been asked to participate in a further course at a later date.

The Panel had before them the report of the Assistant Chief Executive on the review which had been carried out on a number of service areas within the Depot with a view to consolidating and concentrating on the central servicesand re—evaluating the peripheral activities. Members noted that the skip hire service had in consequence been discontinued. that arrangements had been made for an improved bottle bank scheme to be provided by Essex County Council who could also garage the Councils mechanical street sweeper at their Castle Road Depot and that discussions had taken place with the Save—a—Can Organisation regarding difficulties arising from the operation of the scheme.

RECOMMENDED (1) That appropriate notice be given to Cleahaway Limited terminating the contract for the bottle bank scheme within the Rochford District.

(2) That arrangements be entered into with the Essex County Council on terms to be agreed for the provision of a bottle bank service.

(3) That appropriate notice be given to the Save—a—Can Organisation terminating their contract with the Rochford District. (ACE)

32. PRESENTATION— HONEY'ELL COMPUTERS LIMITED

The Panel welcomed Mrs. S. Bray and Nassrs.'M. Doughty. R. Kunarek and R. Whitehead from Honeywell Computers who had been invited to join the Meeting to give a presentation on the computer facilities and services which that Company could provide.

Following on that presentation the Panel considered the implications of replacing the existing ICL main frame in terms of comparative costs involved as between different suppliers and the impact upon user departments.

Resolved that a further Meeting be arranged for 16th June 1986 to enable a further presentation to be made by the existing supplier and that the Director of Computer Services be asked to report in detail at that Meeting on the various questions which had been raised. (SEC. DCS)

RECOMMENDATION: REFUSAL, FOR THE FOLLOWING REASONS:

1. The local planning authority consider this proposal to be an overdevelopment of the site which would result an a cramped appearance, out of character with the nearby existing properties, and have a detrimental effect on the amenities thereof.

2. The proposed dwellings would be significantly overlooked by the existing properties — to the rear — to the detriment of the site's occupants. Furthermore, the local planning authority is not convinced the site can be suitably developed for three dwellings - with necessary parking spaces — without a reduction in the normally acceptable minimum standard sizes for private garden areas.

REPORT: A letter from the County Surveyor has been received concerning the unauthorised inclusion of a "public footpath" into site. However, it would appear that no registered footpath exists in this location - the strip merely being ighway land - and confirmation if this is awaited from the County Council. The applicant has stated that this land was incorporated into his garden in 1969 — or thereabouts - and an adequate footpath alongside this area remains. Furthermore, he has agreed to reduce the proposal to three bungalows. X 000667 Members will no doubt note that the site can be divided into three plots with a width of more than ao ft. each - which acccords with the authority's normal minimum requirement. Likewise, the rear garden of the smallest plot could have an area of approximately lOOm2, the normal minimum although there is some doubt here. Members will be aware that this minimum can be dropped to 50m2 in the case of one or two bedroomed properties. Nonetheless, the rear wall of the two proposed properties closest to No. 42, The Westerings would be only some l5m or so from that of No. 1, Claybrick Avenue. Furthermore, the appearance of three bungalows on this limited site may seem cramped when compared with adjacent properties and densities. On balance, therefore, the recommendation of refusal is made although Members may wish to indicate their opinions in respect of a proposal for two bungalows on this site. I

No formal reply from the County Surveyor has been received at the time of writing, but it is understood that he considers the proposed parking facilities acceptable subject to a revised layout. REPOPT: In 1916, planning permision was ranted for the use of this 27 acre site as a riding school. At the time the brick-built dwelling on the site existed, together with various pole barns and outbuildings. The pole barns are being used as stables for the school's horses and an indoor riding school was approved and built in 1978. Planning periniflion has also been granted in recent years, for an extension to the dwelling (subject to a Legal Agreement) for use by teaching staff. The proposed garage 9.9m x 5.62m (32'6" x 18'6"), built of rendered blockwork and plain clay-tiled pitched roof, will match the other buildings and the dwelling on the site. It is also sufficiently far from the dwelling (9.3m) not to form part of the overall bu1kof the house. Its use will be restricted to the parking of vehicles belonging to the applicant or his staff, and there are no planning objections to the proposal. The flockley Parish Council is concerned about the poor state of the access to the site, which is unmade at present but with a clinker surface. No planning condition exists which provides for an improved access, but the new owner is carrying out extensive refurbishment of the site, and will almost certainly improve the access driveway surface as part of his programme.

REPORT: This application and that following (ROC/158/86) seeks to make use of redundant, or near redundant farm buildings for other commercial uses. The building the subject of this application is a large barn WS which is redundant to needs. The second application is for a small part of a range of farm buildings which is used as a workshop connected with the farm. The large barn has previously been used for the packing of vegetables. The rear part of the building is currently used as a haulage firm's workshop following the slccessful appeal against the dismissal of planning permission on green belt grounds in 1976. It is proposed that the buildings will be used for the storage and assembly of tractors delivered to the site in component form. The traotors are manufactured abroad and the applicant has indicated that many of the tractors are likely to be re-exported. Recent Central Government advice suggests that non—agricultural commercial uses can be acceptable in redundant farm buildings,, notwithstanding their location in rural areas and areas designated as Green Belt, where they would result in no demonstrable harm to the area in which they are located. Such advice was primarily issued to help small businesses.

The County Surveyor has directed the refusal pf both applications. The Director of Development will report verbally on detail provided by the applicant and is still considering whether any additional reasons for refusal on Green Belt grounds are appropriate to both applications.

REPORT:

The following applications involving new development at the above site were considered by tile Committee on 27th February, 1986 (para. 20).

1). ROC/O11/86 - Add extension to existing aquatic display building.

090S91 2). ROC/012/86 — Erect greenhouse for growing plants. The report to that meeting explained that the first application involved a modest infill extension measuring 5.5m. x 6m. to the main warehouse/aquatic display building approved under ref. ROC/810/84. The second application sought permission for a new greenhouse abutting the northern boundary remote from existing buildings in an area restricted to a growing area only controlled by a planning condition and a legal agreement aimed at containing the extent of buildings on the site and the appearance of the Green Belt. No firm recommendatidn was made on eiher application as other unauthorised developments had been commenced on the site and also on additional adjacent land. Furthermore conditions imposed in previous consents notably concerning advertisement signs had not been complied with. The unauthorised developments comprised the erection of a large conservatory building to enclose a swimming pool display and the tipping of waste materials and soil on adjacent land owned by the applicant but not forming part of the nursery/garden centre.. The latter had been the subject of a report to Committee in December, 1985 at which authorit'- for all necessary action to remedy the situation was given. The matter had been reported to the County Planner who carries the responsibility for dealing with the use of land for the deposit of waste itiaterials he had also obtained authority for enforcement action and had written to the applicant pressing for the removal of the waste material. Having regard to the breaches of planning control reported, the terms of the previous planning permission ROC/810/84, and the planning merits of the submitted applications the Committee delegated authority to the Director of Development to refuse both applications on Green Belt policy grounds. Arising from the Committees decision the applicant submitted formal planning application for the building enclosing the swimming pool display area in March ref No. ROC/224/86. He also requested a meeting with the Director of Development to discuss the situation. A meeting took place on 8th April at which the following points were discussed:—

(a) ROC/Q11/86 — involved a small infill extension to the main warehouse building. In the original plans of the warehouse the planned accommodation was included and the applicant felt it was unreasonable to refuse the proposal.

1100692 (b) ROC/012/86 — the proposed greenhouse — the applicant explained that he needed more covered growing area and that the siting was chosen to act as a windbreak to the open growing area. However he acknowledged the Councils concern and previous restrictions on maintaining the northern half of the site as an open area and indicated that he would not pursue the proposal. An open area exists within the existing complex of greenhouses and the applicant felt this could be an alternative which he could pursue if it was agreeable to the Council.

(c) On the question of advertisement signs the applicant agreed to remove some of the existing signs and provide smaller identification and directional signs to the additional car parking area approved under ref. ROC/81O/84. This has now been done. (d) With regard to the unauthorised structure above the swimming pool area the applicant stated that it was a display building and for this reason he thought it did not require permission. However, he had now submitted a formal application for the development and hoped that the Council would find it acceptable. He felt it was vital to protect the swimming pool display in the interests of safety. It was within the existing building complex and to a large extent concealed by other buildings and features.

(e) As regards the tipping of waste materials the applicant explained that this was intended to be a temporary matter of strong hardcore for use to construct paths and bases within the nursery/garden centre and to deposit soil and waste material cleared from his growing areas. Inclement weather had delayed the operation. The hardcore had now been removed and the soil and other material had been spread across the land. All that remained was for the original top soil layer pushed into piles around the site to be levelled resulting in a very minimal increase in the finished level of the land. The applicant promised to complete the operation by the end of April. At the time or producing this report the peripheral piles of earth remain and there have been reports of rubbish dumping on the land b unknown persons who may be under the impression the land is a refuse tip. The applicant has since agreed that the levelling operation will be completed by the date of the meeting. Since the 27th February and the officer meeting with the applicants the department has received several neighbour complaints and a letter from the Parish Council regarding:- 1) the parking of cars at weekends along the Lower Road in spite of the new car park which is full.

2) the use of public address/tannoy music playing.

1 12 09UG93 is felt that notwithstanding some improvements to the SW operating It efficiency of the nursery/garden centre the level of activity now threatens to exceed the capacity of the site and pressure is evident to extend further into the Green Belt. Great care should now be taken and some of the points which now need to be resolved are:—

1) Is the Committee prepared to reconsider its decision on the small infill extension to the main warehouse building having regard to earlier plans which include the area within the main building?

2) Are the Committee prepared to grant planning permission in retrospect for the structure enclosing the swimming pool display area? I

3) Is the extent and nature of advertising material on the site frontage acceptable? 5 4) Is the Committee prepared to indicate that it would give W favourable consideration to a new greenhouse within the existing main complex of buildings following the rejection of the structure on the controlled open growing area?

5) Has the unauthorised tipping and levelling on the adjacent land been remedied to the Councils satisfaction? In response to the above the Director of Development recommends subject to the completion of item (5) :— (a) That the development under 1) application ROC/O1l/86 be approved and the decision and imposition of appropriate conditions delegated to the Director 'of Development.

(b) That the reduced level of fixed advertising is acceptable and agreed in compliance with the condition imposed in planning permission ROC/81O/84. Other advertising material currently displayed on removable signboards however is considered excessive and damaging to the street scene and should not be displayed on any part of the site frontage outside the bqundary fence and gates.

(c) That the Committee agree to favourably consider an application for a greenhouse within the existing built complex provided it is used:-

(i) solely for growing purposes. (ii) no retail sales are conducted within it. (iii) it does not exceed the height of the existing greenhouses. (iv) any permission is accompanied by a legal agreement covering points (i) and (ii).

REPORT: There is an established use on the application site as a scrap yard which was, until recently to be continued to be operated as such by a scrap dealer. However, the present applicants wish to use the land as a builders plant and equipment repair depot, by erecting a workshop with ancillary stores and mezzanine offices attached. The applicants are an established house building firm based in Essex and East London and wish to operate their business from a permanent site. Whilst they do not intend to use open land for the storage of materials except for a few items of plant and equipment, they require the site essentially to erect a workshop measuring about 13m. x 13m. in which they would repair and maintain their private cars, light commercial I vehicles, excavators, dumpers, compressors, mixers, pumps, generators, etc. The overall concept of the building is acceptable, being only 7.3 metres in height and the double set of windows in the front annexe to provide daylight to a store area with offices over, being contained within the single storeyed profile of the building, does not prejudice the generally accepted principle of encouraging single storeyed buildings on the site. This use of the land would be considered to be more appropriate to the estate than the scrap yard use which exists at present, and suitable conditions can be imposed to control the use. Car parking, landscaping and turning areas for vehicles conform to the generally adopted standard and the County Surveyor has no objections subject to conditions, one of which requires an Increase in the distance between the car spaces. This however, will involve only the resiting of the building 1.5 metres further back into the site. The Anglian Water does not object to the proposal subject to the usual conditions regarding oil pollution etc. The Director of Health and Housing has no objections subject to a suitable conditon being included to cover paint spraying etc., which could give rise to nuisance if adequate safeguards are not provided.

The applicants have submitted an application in support of the application in which they state:- We have one child of two years old and feel the property as existing is not of a suitable standard for his occupation, and indeed we would not be able to bring up a baby within the property during the conversion. The temporary siting of the caravan wpuld offer our only accommodation until the conversion was completed.' I feel very strongly that old people should not be banished to Instjtutions outside the community, but continue to live normally within the community. After careful consideration and market research, I have decided to extend our home to enable me to care for 4 to S people in a caring, homelj atmoshphere. The extension has been designed by an experienced Architect to blend in with the community yet meet the rules and regulations set out by the Social Services. Adequate parking has been provided and we do not envisage any disturbance from Trades people or deliveries as all shopping will be carried out by the staff.

I am an experienced Sister in the Intensive Care Unit at Southend Hospital. I have also had experience in the care of elderly patients at Rochford Hospital. I have worked for the Southend Health Authority for twenty one years. I have a supportive family most of whom are medically oriantated. Westbury is a quiet road within easy reach of shops, churches, surgery and hospital, it should make a very pleasant place for my prospective clients to live in. Following the submission of this letter revised plans have been submitted which would provide accommodation for a maximum of 4 persons in care together with the applicants immediate family. A letter of support has been received from the occupier of the adjoining property. Two letters of objection have been received • from near neighbours who believe the proposed use to be out of keeping with the area. There is also a concern with parking and overshadowing from proposed windows. Those comments were made in relation to the proposal as originally submitted. The proposal is unusual for a property within a close limit residential estate but the design of the extensions is acceptable and parking provision can be accpetably provided within the site to meet adopted standards. It could be argued that the use will result in an unacceptable level of disturbance by way of vehicle movements and other activity connected with the use, but with only four residents in care this may be an unreasonable view to take.

The property fronts onto Wadham Park Avenue and is located on the site of a previous bungalow. The dwelling is suffering from serious structural problems which the consulting engineers for the insurers suggest is the result of heave in the clay subsoil on which the dwelling is built. The applicants seek permission for the erection of a replacement farm house of similar design but in a new location fronting onto the Lower Road. The Ministry of Agriculture considers that the holding is a viable one and one on which it is essential for a person Eo be accommodated in the interests of animal welfare and security. At the time of writing the Director of Development is due to visit the existing property with the authorities own consultant engineer in order to obtain this authorities own assessment of the case for replacement and relocation and will make a further verbal report at the meeting. The Director of Development is concerned to ensure that the construction of a new dwelling on this holding some way removed from the existing farm building and which would contribute towards the 'ribbon development' along the Lower Road in this Green Belt location is fully warranted.

The proposed development would be likely to result in an increase in the number of vehicles using the existing Daws Heath Road/A127 Trunk Road which as sub—standard. The additional slowing down and turning movements involved particularly as some of these additional vehicles would be towing caravans, would be to the detriment of the free and safe flow of traffic on the trunk road.

2. This site is within the Metropolitan Green Belt and the proposal is considered to be contrary to the policies appicable to this area and as defined in Policy 5.9. of the Approved Essex Structure Plan. Within such Green Belt areas as indicated in the Approved Review Development Plan, the policy states, inter aiia, that permission will not normally be given for the construction of new buildings, or changes of use, or for purposes other than agriculture, mineral extraction or forestry, small scale facilities for outdoor participatory sport and recreation, institutions in large grounds, cemeteries or similar uses which are open in character. None of the above exceptions would seen to apply and there appears to be no justification for departing from this policy in this case.

3. If granted permission, this development would create a precedent for other similar development elsewhere in the locality and contrary to the above policy.

REPORT: Members may recall that enforcement action was authorised to remove the caravans presently being.stored on the site. However, concern was expressed by some Members the time that finding suitable areas for such uses was a problem. Consequently this application was made to overcome the major objections to this development i.e. visually detrimental and visible from adjacent highway. The Director of Health and Housing has no adverse comments and similarly Anglian Water has no objections.

Having regard to the retention of the existing commercial storage use, the site is considered to be of insufficient size to accommodate the proposed dwelling, necessary vehicle hardatanding and garage space, and a reasonable private garden area as stipulated in the authority's adopted planning policies.

REPORT:

This proposal was deferred from a previous meeting — 10th April, 1986 — and revised plans submitted. Although the site boundary shown on these revisions indicates a rear garden area ira excess of the normal lOOm2 minimum, it is understood from the applicant that the existing established use • for storage of builders' equipment, etc. within this area will remain. In effect, therefore, the true garden area will be in the region of 56m2. In view of this, the proposal was altered from three to two bedrooms to comply with the authority's minimum standard of 50m2 rear garden area for one and two bedroom properties. Nonetheless, the overall size of the proposal has remained the same and the second bedroom is capable of being readily divided into two rooms, contrary to the authority's policy. Furthermore, there seems to be little available space for a vehicular hardstanding except on the building materials storage area. If Members are in agreement with the recommendation, it is further suggested that the applicant be invited to submit an application for the same development on the plot adjacent to 121, V 000711 Shoebury Road. This plot offers greater garden size and less overlooking of adjacent properties. In addition, the scheme could incorporate the reduction in height of a wall which impedes visibility at this junction with Seaview Drive.

Pknglian Water have no objections to the development in principle.

2. The local planning authority feel that the proposed car park would be inadequate to serve the traffic generated and lead to parking outside the boundaries of the site.

3. The local planning authority is not satisfied that the proposed plaing field facilities are adequate to justify the creation of a separate club house and would lead to unrelated uses inappropriate in this Metropolitan Green Belt location.

REPORT: The application has been the subject of widespread local opposition, particularly from the nearby residential properties concerned about local impact.

Notwithstanding the District Council's support for leisure/sporting projects, it is felt the site is inadequate to justify the proposals in this instance. The Parish Council has submitted a detailed letter of objection, many of the points of which are incorporated into the suggested reasons for refusal.

REPORT: Although this proposal would normally be dealt with under the Director's delegated powers, it is brought to this meeting in view of the history of this case.

An appeal into a similar proposal was dismissed in February this year, although the Inspector felt an acceptable scheme could be submitted separating the garage block from the swimming pool addition. This application reflects this suggestion to some degree, although some reservations were felt concerning the proximity of the garage block in relation to the front windows of adjacent residential properties. In view of this, the Agent has now further modified the garage block element of the proposal such that it is now "permitted development" and thus no longer forms part of the application. The objections received from neighbours mainly referred to these garages and are therefore no longer relevant to the application. The application involves the demolition of 116, Daws Heath Road and the erection of 21 four bedroom detached houses. Surface water drainage problems are to be overcome by the use of an on—site storage facility as agreed with Anglian Water. Daws Heath Road is narrow along the frontage of the site and is to be widened to 5.5m and provided with a footway in accordance with the County Surveyor's recommendations. The revised site layout now before Members incorporates a number of revisions to satisfy the requirements of Anglian Water and the highway authority, and achieves a more attractive and practiced layout comprising two shared access private drives off of a short estate road and frontage development to Daws Heath Road. The application was received prior to this Council's application of an embargo on new development drainage into both Rayleigh Sewerage Treatment Works in accordance with Anglian Water's request. Rayleigh Ratepayers Association asked for the Lower Wyburns Farm decision to be taken into consideration and are concerned at additional traffic flows which may occur in Daws Heath Road during construction of the Rayleigh Weir Underpass.

I 4. Nine letters of objection have been received from the occupiers of 7, 19, 21, 23, 27 and 29, woodlands Avenue, 131, Daws Heath Road, 5, Wyburns Avenue East and 155, Eastwood Road. These objections may be summarised as follows — increased traffic on a narrow part of Daws Heath Road.

— Anglian Water drainage embargo.. — loss of unallocated/Green Belt land. — furthet strain on overloaded community and social facilities. — loss of open land/rural character/wildlife.

- too high a density. — surface water and sewage problems. - out of character with surroundings. — no need for additional housing. — nuisance/devaluation of property. • 5. The possibility of an incorrect site boundary was pointed out by the occupiers of 19, 31 and 33, Woodlands Road. There is no evidence of an incorrect boundary and their fears arose because of a misrepresentation of a hedgerow line on the site layout as originally submitted.

6. The occupants of 2 and 10, Wyburns Avenue and 104 and 145, Daws Heath Road had no adverse comments to make; the occupier of B, Wyburns Avenue feels the development will look attractive. 7. The County Surveyor's recommendations regarding the width of Daws Heath Road and the estate road sight lines, footways, radii of curves and other details have all been incorporated into the revised site layout.

O1(- Ethaàcduwg CtunciL At the request of the Council (Minute 297) the Committee had before them I7.bGb for reconsideration the County consultation on the Development ApplicatIon ROC/Obs /86 for sand extraction, Hambro Hill, Rayleigh which had been submitted to the Planning Services Committee on the 22nd May 1986 (Minute 253) and the proposals for the whole of the Hambro Hill area. The report of the Chief Executive to the Policy & Resources Committee on the 3rd June 1986, (Minute 294) had been recirculated to Members and the Committee noted that they would receive a full presentation by the Officers of all the factors involved.

At the invitiation of the Chairman, the Director of Development displayed with the aid of various viewfoils the different uses involved in and around 1-lambro Hill and carefully delineated the area which was the subject of the sand extraction application. tie recalled that there had been problems on Hambro Hill for some considerable time, that it had been decided in consequence of consultation on the Draft District Plan to undertake an exercise to achieve a satisfactory resolution, and that the heads of agreement reached with the various parties concerned had been reported to the Policy & Resources Committee on the 16th July 1985. The sand extraction application was part of a process of regularisation, and reference was made to two Further planning applications to be submitted in due course to create a composite parkland area accessible from Hambro 11111.

The Chief Executive then outlined to the Committee the various courses of action needed under those heads of agreement and advised Members that the sand extraction application was in accordance with the Council policy on the whole of Hambro Hill, and that a refusal could well callt. into question the remainder of the package.

The Secretary to the CounciL reported on the Section 52 Agreement which had recently been completed jointly with Devenish and Perry, which defined the boundaries of the Perry's site precisely, contained 18 covenants, both positive and negative, and would be binding on successive owners, thus regularising the existing use. The Committee were advised that negotiations had been protracted and involved considerable Officer resources and had also demonstrated the commitment of the other parties involved.

The Director of Development then iteaised the reasons which had been put forward at the Planning Services Committee on the 22nd May 1986 to support 000'719 Planning Services Committee

refusal of the application by the County. He indicated on an aeriaL photograph the site of the sand extraction which had been taking place on the crest of Hambro Hill in recent years and explained the basis on which the larger area covered by the current application to the County Council had been defined. It had been established that there was no alternative site for sand extraction within the applicant's ownership and that the sand being extracted was of a quality and in a quantity that could not be matched elsewhere within the District.

Since its submission the application had been significantly amended in certain respects following discussions with the applicant. It was now proposed to prohibit mineral extraction within 50 metres of the existing houses and to work through the site in eight distinct phases over a period which would depend upon the rate of extraction. The options available were outlined together with the average number of lorry loads per day which would be generated in consequence. The working boundary and the eight areas involved were depicted on a viewfoil for Members' info rma t ion.

With regard to the Structure Plan criteria, the Committee were advised as follows:—

(1) The original application had envisaged the generation of between three and five lorry loads per day which the County Surveyor had found acceptable in terms of road safety and traffic movement. If the slowest rate of extraction which had been discussed with the applicants were chosen, it would generate an average of one load per day, albeit that working would continue for possibly a further 15—20 years.

(ii) MAFF did not regard the site as of sufficient agricultural importance to oppose its loss and had advised on methods and phasing of work.

(iii) The sand fulfilled a proven need, being of a quality used in the production of moulds for specialist brick manufacture.

(iv) There was no other site available in the applicant's ownership.

(v) There would be a diversion and fencing of the public [ootpath while the area was being worked.

(vi) The Structure Plan policy was there as a test of appljcations.

The presentation on the sand extraction application having been concluded, it was moved by Councillor A.J. Harvey and seconded by Councillor Miss JhG.J. Lovect that the application ROC/065186 be now supported subject to appropriate conditions.

Some Members were of the view that the history of the site, coupled with the former attitude of the applicant, was such as to jeopardise any attempt to bring the existing use under control, notwithstanding the gain in terms of public opea space, of which there had been recent significant dedications in the Rayleigh area. It was argued by the local Ward Member with the aid of viewfoils of historic mineral extraction and infill permissions that the application site was not in fact the same area, the woricings being of more recent origin. Furthermore, Minute 495/85 had / specificalLy ruled out extraction at the rear of Hambro Close and the 'y application had gone beyond that intention. Planning Services Committee

Other Members pointed out that the alternative to support for the application was not the cessation of activities, but rather that the existing activities would either continue unfettered or the applicant would appeal with a reasonable prospect of success. Regularisation would therefore represent a gain to the local residents in the short term in the operations coming under control and tp the community in the longer term by the opening up of a parkland vista with great leisure potential. Furthermore, whilst the application was for sand extraction, the end result was to maintain jobs and to provide material for house building. The Committee discussed the options for rate of extraction which had been outlined earlier and which would determine the approximate number of lorry movements and the length of time taken to extract the total quantity of some 75 — 8O,OOOm3of sand, and did not demur from the basis of the application. The concensus was that in the event of tjte app]4cation being allowed by the County, the impact upon local residents should be cushioned by conditions regulating noise, hours of work, and proximity, which could be properly enforced.

Rayleih Grag Community Association —_Future Management (Minute 276/86)

In moving the reception of Minute 276 the Chairman of the Committee secured the concurrence of the Council to the report and recommendations of the Meeting of the Rayleigh Grange Management Committee held on 10th June.

The Chairman of the Council took that opportunity to congratulate the Community Association on achieving their independence, to express the sincere wish of the Council that they would expand and prosper and to reassure them that the Council's advice and support would be available in the future should it be required.

Resolved (1) that arrangements be made for management of the Rayleigh Grnge Community Centre to be handed over to the Community Association ;h effect from 1st July 1986 on terms to include the following:—

that a licence be completed for a period of twelve months at a nominal fee to the satisfaction of the Secretary to the Council.

307. LAND AT HAMBRO HILL, RAYLEIGH (Minute 301/86)

The Meeting had been called on a requisition signed by eight Members of the Council to reconsider Minutes 115/85 and 495/85 in the light of Minute 301/86 of the Special Meeting of the Planning Services Committee held on 11th June 1986, all of which were before the Council.

The Leader of the Council in indicating his intention to move adherence to Council policy, as contained in Minutes 115/85 and 495185, mentioned that he had been aware at the Special Meeting of the Planning Services Committee of some confusion existing over the definition of the area of land at the rear of Hambro Close from which sand extraction would not be permitted in future. Us explained that from a study of his Committee papers on the subject, it was apparent that the boundary line was not defined by Minute 495/85 but in the reports that supported Minute 115/85. This had included a plan which had been considered in confidence and which he asked be now displayed again for the benefit of Members.

lie drew Members' attention to an area on the plan to the rear of Ilambro Close which was shown as possible "W'nite Land" and which had been rejected by this Council. It was that area of land where this Council had agreed that there should be no sand extraction in future. The boundary line of that land was approximately 75 metres from the rear garden fences of Hambro Close, some 25 metres further on than currently being advised by County Council on the application. This boundary line could be marked on the ground with posts and it would further reduce the level of inconvenience to residents if the sand extraction were to commence at that boundary and move away from it. He suggested that if the Council adopted his proposal to adhere to Council policy, the conditions as to the boundary and its marking and for extraction to commence at that boundary would be added to those agreed by the Planning Services Committee in Minute 301 and sent to the County Council.

It was then formally moved by Councillor A.J. Harvey and seconded by Councillor Miss B.G.J. Lovett that the Council adhere to the Council policy as contained within Minutes 115/85 and 495/85 on the basis of the explanation which had been given of the land to be excluded from sand extraction in the future. - /
