METROPOLITAN BOROUGH OF SEFTON MODIFICATION ORDER NO.1, 2021

This ORDER is made by Metropolitan Borough Council of Sefton ("the Authority") under section 53(2)(b) of the Wildlife and Countryside Act 1981 ("the Act"), because it appears to that Authority that the Definitive Map and Statement of Public Rights of

Way, Sefton Metropolitan Borough Council — Area 3, require modification in consequence of the occurrence of an event specified in section 53(3)(b) namely, the expiration of a period of use that raises a presumption that ways have been dedicated as public paths.

There are no Local Authorities whose area includes the land to which the Order relates and who is required to be consulted.

The Metropolitan Borough Council of Sefton hereby Order that:

1. For the purpose of this Order the relevant date is 14th April 2021.

2. Definitive Map and Statement of Public Rights of Way, Sefton Metropolitan

Borough Council shall be modified as described in Part I and Part II of the

Schedule and shown on the maps attached to the Order. 3. This Order shall take effect on the date it is confirmed and may be cited as the

Metropolitan Borough of Sefton Modification Order No.1, 2021.

The Byway has a minimum width of approximately 4.6m.

The byway width is as shown on the Record Plan prepared under the Finance Act (1909-1910)

There shall be added to the Definitive Map of Public Rights of Way, Sefton Metropolitan Borough

Council — Area 3 a Footpath, Formby No.59, being a length of St Luke's Church Road running

from its junction with Range Lane at O.S Grid Reference SD 328374,405550 (point A on the Order

Map DC2122) in a southeasterly direction to its junction with Altcar Footpath No.5, which runs

adjacent to the boundary fence of the NWRFCA Altcar Training Camp at O.S Grid Reference SD

328680,405163 (point B on the Order Map DC2122), as shown on the order map DC2122.

The entire route is shown between points A and B on the Order Map DC2122 by a broken black

line.

The Footpath has a minimum width of 3.5m.

It has a length of 507m.

There shall be added to the Definitive Map of Public Rights of Way, Sefton Metropolitan Borough

Council — Area 3 a Byway, Formby No.60, known as Alexandra Road running from its junction

with St Luke's Church Road at O.S Grid Reference SD 328155,406257 (point A on the Order Map

DC2123) running in a south westerly direction to a point where it formerly connected to the Promenade at 0.S Grid Reference SD 327462,405773 (point B on the Order Map DC2123) , as shown on the order map DC2123.

The entire route is shown between points A and B on the Order Map DC2123 with a continuous line with arrowheads.

The Byway has a minimum width of approximately 4.7m and a maximum width of approximately

6.4m, its boundaries being marked by stone kerbs in places.

It has a length of 860m.

Formby Footpath No.61

There shall be added to the Definitive Map of Public Rights of Way, Sefton Metropolitan Borough

Council — Area 3 a Footpath, Formby No.61, being the continuation of Albert Road commencing at its junction with Formby Byway No.62 at O.S Grid Reference SD 327575,405584 (point A on the Order Map DC2124) running in a south westerly direction to the shore at O.S Grid Reference

The Footpath has a minimum width of approximately 3m.

It has a length of 157m.

Order Map DC2125) , as shown on the order map DC2125.

The entire route is shown between points A and B on the Order Map DC2125 with a continuous line with arrowheads.

The Byway has a minimum width of approximately 5m and a maximum width of approximately

8m, its boundaries being marked by stone kerbs in places.

It has a length of 623m.

Reference SD 328157,406260 (point A on the Order Map DC2128) in a south easterly direction

then in an easterly direction to its junction with the bituminous surfaced length of Cambridge Road

at its junction with Stapleton Road at O.S Grid Reference SD 328538,406245 (point B on the

Order Map DC2128) , as shown on the order map DC2128.

The entire route is shown between points A and B on the Order Map DC2128 with a continuous line with arrowheads.

The Byway has a minimum carriageway width of approximately 5m and a footway to its southern

side as recorded on the Ordnance Survey Lancashire Sheet XC7, Edition of 1927, Scale 1:2,500.

The kerb lines are still visible in places.

It has a length of 385m.

Stapleton Road at O.S Grid Reference SD 328738,406080 (point A on the Order Map DC2129) in a south westerly direction to its junction with St Luke's Church Road at O.S Grid Reference SD

The entire route is shown between points A and B on the Order Map DC2129 with a continuous line with arrowheads.

A length of St Luke's Church Road running from its junction with Lifeboat Road at grid reference

O.S Grid Reference SD 3281123,406586 in a southerly direction to its junction with Alexandra

Road and Cambridge Road at O.S Grid Reference SD 328156,406256.

Surfaced with bituminous macadam.

The Byway has a minimum width of approximately 4.6m and 6.4m maximum.

It has a length of 335m.

Formby Byway No.58

A length of St Luke's Church Road, a cart track, running from its junction with Alexandra Road and Cambridge Road at O.S Grid Reference SD 328156,406256 in a southerly then south southeasterly direction to its junction with Range Lane at O.S Grid Reference SD 328374,405550.

Surfaced with crushed stone between Cambridge Road and Asparagus Cottage and sand from

Asparagus Cottage to Range Lane.

The byway width is as shown on the Record Plan prepared under the Finance Act (1909-1910)

Act 1910, reference IR 132/3/25.

It has a length of 740m.

Formby Footpath No.59 A length of St Luke's Church Road, a cart track, running from its junction with Range Lane at O.S

Grid Reference SD 328374,405550 in a southeasterly direction to its junction with Altcar Footpath

The Byway has a minimum width of approximately 4.7m and a maximum width of approximately

The continuation of Albert Road commencing at its junction with Formby Byway No.62 at O.S

Grid Reference SD 327575,405584 running in a south westerly direction to the shore at O.S Grid

Reference SD 327420,405456.

The Footpath has a minimum width of approximately 3m.

It has a length of 168m.

Formby Byway No.62

Known as Albert Road, a carriageway running from its junction with Alexandra Road at O.S Grid

Reference SD 327929,406061 running in a south easterly direction and then in a south westerly direction to the point where it formerly connected to the Promenade at O.S Grid Reference SD

327575,405584.

Surfaced with bituminous macadam and crushed stone and overlain with sand in places.

The Byway has a minimum width of approximately 5m and a maximum width of approximately

8m.

The Footpath has a minimum width of 2m.

Formby Byway No.67 The length of Cambridge Road that does not have a bituminous surface, running from its junction with St Luke's Church Road at O.S Grid Reference SD 328157,406260 in a south easterly direction then in an easterly direction to its junction with the bituminous surfaced length of

Surfaced with crushed stone and grassed in places.

The Byway has a minimum carriageway width of approximately 5m and a footway to its southern side as recorded on the Ordnance Survey Lancashire Sheet XC7, Edition of 1927, Scale 1:2,500.

Known as Range Lane, a cart track running from its junction with Stapleton Road at O.S Grid
