Notice is hereby given that the has made an Order to close temporarily to all traffic:

Cross Lane (Part), Marlborough; from property known as Princes Paddock, Cross Lane for a distance of approximately 70m in a north westerly direction.

To enable: Thames Water to carry out a new water connection.

Alternative route: via Cross Lane (unaffected length) – Hyde Lane – Cardigan Road and vice versa.

The closure and diversion route will be clearly indicated by traffic signs.

This Order will come into operation on 09 November 2018 and will be required until 14 November 2018. Access to the East Side of The Green

Summary – Members are asked to re-visit an issue raised about access to for emergency vehicles

1. Background Members will recall discussing an issue at the Planning meeting of 30 July about access for emergency vehicles to 10, The Green where there are elderly and vulnerable residents living in affordable housing. This had been brought to the Council’s attention by Merrimans, solicitors and Cllr Stewart Dobson.

The specific concern raised was that emergency vehicles cannot not access the area because of cars parked along the side and could not use the edge of The Green because of Sarsen stones laid there. Elsewhere at the site, there have been posts and chains put in place by the Town Council to protect and preserve The Green. It is not clear when the Sarsen stones were added (certainly not in the last 5-8 years). Other points to note are:

 It is believed that there is electric cabling along that edge of The Green  There are double yellow lines along that stretch of road  The road itself is the responsibility of Highways and The Green (registered as a Village Green) is the responsibility of the Town Council.  Other access to the residents’ flats via the top of The Green is even narrower  When cars are parked on the pavement itself to widen the road access, pedestrians find it difficult to pass.

At the 30th July meeting Councillors agreed the following resolution:

RESOLVED: to make slight changes to the boundary arrangements set out with posts to allow emergency service vehicles to drive across The Green when necessary

2. An Update Our Grounds Team was asked to remove a small number of posts to enable access for an Ambulance or a Fire Engine. However, before doing this, the emergency services were contacted and we have been informed that emergency vehicles are unlikely to drive across The Green as the ground is not suitable for this especially in wet weather.

Town Clerk’s Recommendation The Town Clerk recommends that, in the light of this most recent information, Cllrs again look at this issue.

Enforcement Issue

Summary – Members are asked to consider a response from Wiltshire Council (WC) concerning tree works adjacent to the near Bridge Garage

1. Background At the Full Council meeting of 10 September Members discussed a response from WC about a decision to close the enforcement issues around works to trees adjacent to the River Kennet near Bridge Garage. The following is an extract from the meeting minutes:

230/18 ENFORCEMENT ISSUE As requested by the Planning Committee at its meeting of 20 August 2018, Members considered a response received from Wiltshire Council about tree works on the banks of the River Kennet adjacent to Bridge Garage. The Town Clerk had provided a report setting out the background. Cllr. Heath (Tree Warden for Marlborough Town Council) outlined his and local residents’ concerns. Discussion included:  A planning application for pollarding work had been approved and the work carried out in accordance with conditions  Subsequent to the above, more work had been undertaken resulting in the felling of the pollarded trees without a further tree works application being submitted, so in breach of Section 211 – 213 of the Town and Country Planning Act 1990  Wiltshire Council’s enquiry had concluded that the trees were immature (less than 3” in diameter), and therefore exempt from planning conditions. However, there was evidence that some of the trees were around 20 years old, mature, and larger than 3” in diameter  Whether, in line with legislation, remedial action should be sought to replace the felled trees with suitable new specimens. RESOLVED: that although the Town Council has no powers in terms of enforcing planning legislation, Marlborough Town Council requests that Wiltshire Council’s Enforcement team provide further clarification on how mature willow trees in a Conservation Area were given permission to be pollarded and then later, without permission, felled. Also that clarification of how this was not in breach of relevant sections of the Town & Country Planning Act 1990 be provided by Wiltshire Council.

2. Update As requested, the Town Clerk wrote to the Enforcement Team at Wiltshire Council and its Team Leader has responded to this. The full exchange of emails is at Appendix 1.

Finance sheet to be presented. SH presented a spreadsheet with details of CA TG's remaining budget. Confirmation was needed of the 25% contribution from Marlborough TC towards the new 20mph project. MH confirmed this had been agreed by Marlborough TC. SH also explained an estimated cost of £10,000 for work at Froxfield needed to be included, although this was likely to take place during 2019/20. This gives CATG a remaining budget of £2,106.

4. Top 5 Priority Schemes Following discussion of all projects currently being developed, the priority of remaining schemes was allocated. The letter given here reflects the new priority. SH stressed the need for the group to prioritise five projects to allow him to focus his limited time on those the group wants taking forward. a) Issue 4352 Virtual footway complete. SC said that Chilton Foliat is also looking at buying SIDs. He wondered if suppliers could be approached by several PCs for a bulk order and get a discounted price. JB said that this is what happened with Mildenhall and Ramsbury PCs. AJ said he could contact all parish clerks to get ideas about SIDs from around the area, collate this information and try to put interested parties together.

JS asked about white lining around the bus stop in Aldbourne on the B4192. MC has put this on order and it needs to be chased with the contractor.

SH points out that Manor Park has been resurfaced, but not very well and the surface is breaking up and the road markings have not gone down. MC explained that even though the surface would have been rolled by the contractors, part of the process for the surface to bed down is for it to be driven over by cars but that Manor Park is not busy enough for this to happen quickly. He confirmed the road had been swept and given time, it will bed in. The markings here and at Brew House Hill will be put down. SH asked about the holes that have already been made in the surface and if they will be filled. MC says that there is a two year guarantee on the surface, so any holes will be repaired by the contractor.

The funding of projects will contribute to the continuance and/or improvement of environmental, social and community wellbeing in the community area, the extent and specifics of which will be dependent upon the individual project.

Update on No Idling in the High Street Initiative

Summary - To update members on the Town Council’s support for the ‘No Idling’ initiative

Background – At the Planning committee meeting held on 24th September 2018 members resolved as follows:

RESOLVED: that the Town Council works with the Area Board on its ‘no idling’ initiative and that letters are written to bus companies seeking their support and co- operation for the benefit of the community.

Current Situation - Further to this meeting letters have been sent to all of the bus companies who pass through Marlborough, encouraging them to support this initiative going forward. One very positive response was received from Richard Gagg, Operations Manager at Salisbury Reds, please see an excerpt from his email below:

“Thank you for getting in touch with us at Salisbury Reds. We would be delighted to join in with this initiative. If you are able to forward any relevant promotional material, we will brief our drivers accordingly.

It will hopefully be of some encouragement to you to learn that we already take air pollution and engine idling very seriously. Our buses are fitted with auto shut down technology, which prevents excessive idling. Furthermore, we measure all idling every month and are measured against our sister companies on this. I am delighted to advise that Salisbury Reds consistently achieves the best performance in this regard”.

This response has been shared with Andrew Jack, CEM for the Marlborough Community Area and discussions are already underway on the support the Town Council can provide primarily in terms of the promotion of any Area Board initiatives which may come forward.

ITEM 14 Update on Progress with Speed Indicator Devices (SID’s)

Summary - To note a further update regarding suitable locations for the installation of SID’s. Background – At a meeting of the Planning Committee on 24th September 2018, members noted a report which gave some background to the process to date and informed members of a proposed meeting to look at suitable locations for the installation of SIDs across the town.

Current Situation - On Monday 8th October, Clare Harris, Nigel Weatherly and Martin Cook, Wiltshire Council, Area Highways Engineer visited all of the main gateways to the town and other key roads, to assess their suitability for the installation of SID’s. Each location was assessed on its merits taking into consideration the following factors:

 Is it within a 20mph and 30mph limits: at least 200m within the limit?  Can it be mounted at a minimum height of 2.1m above ground level where no pedestrian or cycle movements take place or 2.4m where pedestrian or cycle movement do take place?  Can it be mounted with edge clearance of carriageway of 450mm minimum?  Is the lighting column suitable for installation? (SIDs cannot be fixed to telegraph poles or concrete lighting columns).  Is it on a straight road approach, free of obstruction/trees/foliage?  Is it too close to residential properties/will it impact on privacy?  Is the location safe and accessible for the grounds team, who will be carrying out the installations?

The following locations were identified - please refer to maps for each at Appendix 1.

 A4/Bath Road – Three potential locations were identified; one inbound and two outbound. Whilst the inbound location is located within the 40mph speed limit and technically not suitable, it is on an approach to a well-used pedestrian crossing, vehicles are known to persistently speed in this location and as such it was felt that an installation here could be justified. The machine could be re-calibrated for this location and could be set to show a happy/sad face rather than speed, which may confuse the issue.

 St Martins/Paulton Hill– Two potential locations were identified; one inbound and one outbound, both on the same side of the road, although it was felt that this would not be an issue as visibility was clear in both directions.

 Herd Street – Three potential locations were identified; one inbound and two outbound.

 Kingsbury Street – No suitable locations were identified, however, if Wiltshire Council Highways were encouraged to install a post as a location to erect a SID then this could be incorporated with a junction/bend ahead warning sign towards the top of the hill for The Common and Frees Avenue. A SID could then be attached to this column once in position. If members are minded to support this suggestion, an issue would need to be raised through the Area Board who would forward it on to the CATG to sanction the request. The Town Council would be required to fund the post, signage and installation (circa £500).

 Salisbury Road – One potential inbound location was identified.

 London Road – Four potential locations were identified; one inbound and three outbound.

 George Lane – Four potential locations were identified; two on each side of the road. In addition, Wiltshire Council Highways are looking to install a ‘School Ahead’ sign through the CATG process and as such a SID could be attached to this column once in place.

ITEM 14 Consideration has been given to the length of time these devices should remain in each location. Whilst guidance suggests one week is the most effective, to reduce the impact this additional work will have on our grounds team, a two-week period was felt more manageable. Officer time will also be required to set up the devices prior to installation and to download and process the data collected. It was suggested that a report could be presented to members once or twice a year detailing the statistics gathered.

Due to the large number of potential locations identified, some 17 in total, it was generally felt that two SID’s, working on a rotational basis would effectively cover the locations identified.

Quotations are now being sought on the most suitable type of SID to purchase. There are many different types on the market and they can be solar, battery or mains powered. Costs range hugely dependent on the specification. This work is being done in consultation with Martin Cook, Area Highways Engineer to ensure the units are suitable for our needs and compliant with Wiltshire Council’s requirements. Costings will be brought back to this committee for approval.

Recommendation – Members are requested to consider and approve the suggested locations within the report and agree a way forward in terms of Kingsbury Street.

Planning Committee – Budget Setting – 2019/20

Summary - In line with Financial Regulation 3, the Planning Committee (as with all budget holding committees) should submit budget proposals for the following financial year to the Finance & Policy Committee before final recommendation to Full Council. Members are now asked to consider estimates for 2019/20

1. Background Officers have compiled a set of budget proposals for Members to consider (colour coded to identify where there are changes to existing budgets or new budget lines.) This is based on the spend as at September of 2018/19 - the half-way point of the financial year.

The proposed budget for 2019/20 the Planning Committee for is at Appendix 1.

These are estimates only and it is for Members to decide the estimates to take forward.

2. Points to Note  All budgets will be affected by the possibility of more devolved services and asset transfers from Wiltshire Council over the coming 1-3 years.  Councillors will be aware that over the last 2-3 years there has been a possibility that the government would cap town and parish councils and extend referendum principles to them. (This means that there has to be a referendum if the precept rise is in excess of 2%). For 2018/2019, central government decided to defer the setting of referendum principles the town and parish councils for three years. However this was conditional upon: a) the sector taking all available steps to mitigate the need for council tax increases, including the use of reserves where they are not already earmarked for other uses or for “invest to save” projects which will lower on- going costs; and b) the Government seeing clear evidence of restraint in the increases set by the sector.

3. Town Clerk’s Comments This is the smallest of all committee budgets. It is suggested that the budget line for the Neighbourhood Plan remains as it was for 2018/19. (There is an ear marked reserve of £20,152). Councillors may like to consider raising the Street Furniture budget to take into account new signage for the town and/or more SIDs (see item 14). It’s also recommended that the CATG budget is increased. The Town Council has to make a 25% contribution to CATG projects. Once invoices come through, then the current year’s allocation is likely to be overspent.

Town Clerk’s Recommendation The Town Clerk recommends that Members consider the draft budget figures and decide whether any additional information is needed for a final recommendation to the F&P Committee meeting which takes place on 3 December 2018.

Emergency Plan Working Party

Summary – This report asks Members to agree that the Emergency Plan Working Party is re-established and continues for the remainder of 2018/19 and considers its membership.

1. Background The Emergency Plan Working Party is affiliated to the Planning Committee and as business needs to continue to enable a Plan to be completed, then this should now be re-established. Working Parties can be established at any time but, need to be formally re-established each year if they are to be continued.

2. Terms of Reference It is suggested that the ToR remains as was previously agreed in 2017/18 and is at Appendix 1.

Members of the Working Party in 2017/18 were Cllrs. Castle, Kirk Wilson, Cairns, Price and Heath. Cllr Price was the Chairman and Cllr Cairns the Vice Chair.

The officer administering this Working Party will be the Assistant Town Clerk.

Town Clerk’s Recommendation The Town Clerk suggests that Members agree that this Working Party is re-established, appoint Councillors to it and agree the Terms of Reference.
